UPDATE: I forgot to add that you are also required to produce your logs to an officer upon request, too. However, once you hand it to them, you are still protected under the 5th amendment from answering any questions the officer asks pertaining to those logs

In my 4 month experience I’ve only been through a weigh station 2 times and I’ve never been pulled over as a CDL holder. I’ve wondered how I’d respond if pulled over for an inspection. I was also told to comply with the inspection. I’m going to go over the different levels of inspection again to familiarize myself with them. Great points you made.

Two things you didn't mention one every state has a law that goes as follows a civilian is not allowed to help law enforcement with an investigation two a dot officer must have his dot certification with them at all times and they must show you that if you ask to see it if not they can't legally do an inspection!

Im just going to say. Ive had my cdl for 31 years. They have a lot of laws on the books that aren't enforced. You find that right gut that pulls a law from 50 years ago. Like making your bed in your truck. Yep dumb s ht will get you some times.

When you operate under a professional license you are subject to a different set of rules that don't apply to people who have a basic driver's license. Also things work differently with federal law enforcement. The law requires you to submit to an inspection. A case could be made for what your responsibility is with regard to "submitting to an inspection," but if you decide to sit in your vehicle and refuse to follow commands, then they can take you to jail.

With all do respect that's untrue. As a cmv operator, you're required to hand over your cdl if driving, you must submit to chemical testing if you are suspected of dui/dwi. You still have the right to refuse searches of your truck, and you still have the right to remain silent under the 5th amendment. NOWHERE in fmcsa regulations and statutes does it require a truck driver to help a officer with inspection. The officer CAN absolutely inspect you for any reason. But there is no statute in fmcsa regulations that REQUIRE drivers to participate in an Inspection outside of presenting your cdl, logs, and shipment paperwork. Other than that, you have the ABSOLUTE right to remain silent and not participate in helping the officer.

Just finished CDL school and we were told that when a DOT Officer wants to check that your lights are working, don't you have to turn the left blinker on, right blinker on, 4 way flashers on.... That kind of stuff? Or am I getting that confused with a station inspection?

No, your cdl school lied to you. Yes, a dot officer can check your lights. But you as the driver do not have to assist him in doing so. Because if you have a blinker out, then you just assisted the officer by self incriminating yourself. There is NO fmcsa regulation that requires a driver to help an officer with any type of inspection. You're required to handover documents like your cdl and logs, but other than that, you're not required by law to do it. Any officer who threatens a driver with arrest or a out of service order just because a driver refuses to help with a inspection, then that officer is violating your 5th amendment constitutional right. Which is your right to remain silent and not self incriminate yourself.

What if you comply and consent to them searching your truck or car, and they plant something illegal in it to frame you. You may not think that it happens, but it does. In fact, a few years ago in Florida, a deputy was sent to prison for 12 years for dozens of false arrests in which he planted meth and other drugs in citizens vehicles during traffic stops after they gave him consent to search.

You and many others are overthinking this. You expecting the officer to threaten you with arrest and all this unnecessary escalation . The DOT officer has probably already dealt with hundreds of people that refuse to assist with an inspection trust me my guy you are not the first . Expect refusal to give you more of issue being that you are in your company truck . Your company may like you but they won’t stand by you in court I guarantee my life savings on that. You are the captain of your ship now you got TVC trynna help you dismiss a ticket whether it was lawful or unlawful when the chances were you probably would have a gotten a clean inspection. I never said don’t exercise your rights but remember the supreme court has already ruled invoking 5th amendment can aslo be used as an admission of guilt . Remember courts want to know why you chose to stay silent and u can no longer just say “ it’s my fifth admendment right “.

So I'm searching, and there are zero Supreme Court opinions that state that a person choosing to exercise their 5th amendment right are considered guilty or assumed guilty. If that's the case, then Miranda v. Arizona would not exist. Which states that you are presumed innocent until proven guilty in a court of law. And it does not matter if my company likes me or not. What does that have to do with standing up for my rights? Companies will also not stand by you if you get tickets, violations, and out of service orders, too. Look, everyone can do what they feel is best. I'm stating in this video what the LAW requires a driver to do. Helping DOT conduct an inspection is not a requirement according to the LAW. So again, you have a CHOICE. You can give up your rights and comply. Or stand on your rights and let the chips fall where they may, my brother!
