Rented a house in an HOA once that didn’t allow parking on the street from 2-6 AM. Tow truck drivers would pull up to the neighborhood early and start cruising looking for targets. Cars would be immediately towed if in violation. Had a car towed from the driveway because the corner of the bumper was an inch over the sidewalk (we had company overnight, and crammed three cars into a 2-car driveway). Had another car already gone when we went out at 1:58 to move it. Luckily we didn't have to pay for that one since we were on the phone with security before 2AM complaining that our car was either stolen, or towed before two. Completely screwed up our next day though, and we were never compensated, nor did anyone suffer any consequences, for what was technically Grand Theft Auto. That alone was enough to make me never want to live in an HOA again.

My water has been cut Off by these monsters yesterday. I am 63 years old and my sister that live with me is 65. For not painting my house fast enough they want $6,100. I did paint 3 weeks pass my warning date. I am so stressed out I can't sleep I cried all last night. I am going to sell my townhome asap. I am looking for an apartment and they are so expensive I am waking up to having to go to a friends house and bathe and brush my teeth. I have just lived here 3 years and I loved my house now I got to leave. I just can't deal with this. Thank you for this information.

I lived in an HOA once! That was enough for me to last a lifetime. It was impossible to contact the HOA board members for problems. The monthly fees went to high for what we had as amenities. They played favorites with certain residents and punished others for things they made up. It was crazy! I left within a year and made sure my new house was NOT in a HOA area.

If I ever had to buy in an HOA I would 1st have a lawyer read all the paper work and fine print ....2nd would talk with where I have my home loan and show them I know my rights & have a lawyer , then tell them to let me know if HOA ever sends them anything & find out what the banks rights vs mine are when HOA communicates with them....3rd keep up with my states laws on HOA ....4th make sure HOA keeps community informed and 5th ignore the above and NEVER EVER buy in an HOA community.

We got a HOA that purchased a golf cart around 1 to 1.5 years ago and the board member husband just rides on it and stops at their unit multiple times a day and comes back out and does practically nothing just riding around. This place was built in 1970 and never and I do mean never needed a golf cart. And now they spent $14,000 on a joy ride vehicle. And we pay for it!

I paid my fine and then took the hoa to small claims court, which turned out to be the wrong venue but the hoa had to spend their annual 5k Legal budget to contend with me. So, the Small Claims judge "strongly" advised me to take it to Circuit Court. I didn't, because I would have to find and negotiate with a mediator first and I figured if the hoa wanted to continue the conflict, they could find the mediator. Eventually, I let the case close. The positive is that I learned the hoa has a limited legal budget and when they are likely to lose, they will quit. They haven't bothered me since.

I live in an HOA. It’s been eight years. I’ve had one complaint and that was about a tree aggressively growing over the fence. I enjoy living here I don’t cut no lawn I don’t have the paint my house. My Internet is included I have 24 hour security. There are so many benefits I’m 75 and I’m not picky. I moved out of a big house with a pool and all the work. There is a pool here that I don’t have to clean I am. A widow It’s perfect for me😮

You have only been there for eight years, wait till your there for ten and up. They will fee you and assess you to force you to move to put people with more money in your unit. You may have had a pool in your house but you could use it anytime you wanted. HOAs not so much, opens at 11:00 a.m closes at 8:p.m.

Yup. I have a Sprinter Passenger Van they constantly give us trouble about, even though they have no legal way to stop us. Our lawyer had fun with them making sure the billable hours were multiplied many times with stupid small changes to agreements we never signed anyway, and endless requests for minutes of meetings, discussions...anything to make them waste their time. This new HB1203 puts an end to it for good and plan to stick the knife in and twist July 1 when it goes live. If they do a single thing against us, my attorney is going to go after the board and management company for some compensation because they started legal action without a formal vote of the board....and when repeatedly asked for the minutes of the meeting where they did authorize it, sent us minutes from 3 months AFTER their attorneys threatened us. Yeah....did I mention my attorney used to work for the State of Florida as an arbitrator for associations....and wrote the controlling legal opinions on most of this HOA-Condo Association the Attorney General and Judges use for cases? Yeah.....they are F'ed.

Just last week, I backed out of the purchase of my forever, retirement home at a decent price in a very-well kept, amenity-laden FL HOA. During the inspection period, I was able to get my hands on the very-lengthy governing documents. I learned that, while reserves appeared well-funded, there is actually two HOAs in the development (one for the single-family homes and one for the condo buildings), plus one HOA over the several developments in the area, plus one Community Development District. That's a little more oversight than I think I want. Total Fees aren't too bad right now ($6000/yr), I can see HOA and CDD fees escalating out of control over time to maintain the facilities and infrastructure, now getting on 20 years old. And the HOA master insurance policy increased 20% for 2024. Ideally, I think I'd like to rent in this place, and be able to walk away at any time.

My last house was in an HOA and I was there for 16 years. Over all, I hated it. I do believe that it is a good idea to keep some form of uniformity and not having trash and junk cars all over yards. Also, keeping grass under control in people yards. However, if I pay my hard earned money for my house, no one should have a say so in what I do with my property. Yes, there are still county laws to abide by but HOA's are extreme.

@Yak Motley. Board member contact information is required by Florida Statute to be filed with the Florida Dept of Business and Professional Regulation DBPR. It is all online on the state website. The HOA board is required to file an annual report by May 1st of each year or gace dissolution in September. All the board members and officers are designated there, contact addresses are there. So, u may have to stick a stamp on an envelope. You shouldnt be calling board members, mail or email. Plan ahead, because it is a volunteer job with no pay

My best friend is in the throes of a blinding shitstorm because the Condo Association collected money for hurricane repairs from Idalia. The engineering firm said the front retaining wall along the water was to be repaired. The Association did not repair the wall and Helene took out 4 of the 5 buildings which comprised 12 of the 15 total condos. He is looking for a Condo Association expert to see if a lawsuit is in order.

A young friend of mine lived in a condo as an owner near my home in SE Looziana. It was a three story wood structure. The neighbor above him, who was a sublet renter, had kids that would, on occasion, stop up the toilet, which would, in turn, drip down on his ceiling. The condo manager would have the ceiling half ass repaired. The ceiling looked like hell. Eventually, it was discovered that the outside and under building sewer lines needed almost complete replacement throughout the multi building complex due to subsidence sagging. It was a costly NIGHTMARE for this young man.

First of all, I love my house, the setting and its location. But…….if I had known then what I know now, there is no way that I ever would have built here. I live in a development of 20 individual homes that are called a condominium complex. You are totally at the whim of whoever is in office. My wife and I have both served on our board and trust me, since these are volunteer offices most people want to complain but as I was told a long time ago, you can either be part of the problem or you can be part of the solution. The choice is yours. Oh the stories I could tell you about my experiences over the last 18 years.

I will admit that HOAs are a necessary evil in condo apartments because the unit owners must maintain the building and common areas. They can only do that through a HOA. Also state legislatures need to restructure everything and turn the "HOAs" on condos etc. into renamed and refocused Maintenance Boards with strict oversight and random audits by independent agency to make sure maintenance is actually being done.

As for detached homes that have HOAs…don’t count of the local municipality to help in keeping these HOAs in line. The local governments LOVE HOAs because it’s revenue for them while not having to maintain the roads and collect garbage in these massive HOA developments. The HOAs take care of all maintenance. These developers come in and promise extra tax dollars by agreeing to build the roads and sidewalks and have the HOA maintain it. It looks great for the local municipality in the short term but within a couple of years, schools are jam packed, main arteries are clogged with traffic, and police and fire are stretched thin. We won’t even get into how the cheaply built new HOA houses keep surrounding property values from rising as much as they are worth because who wants to buy a used home when you can buy a cheap cookie cutter for less? It’s a major long term lose-lose for short term gain.

Wanted an HOA when we moved across the country to an area that has no county zoning. Now that we know where to be in the county we will see about moving BUT we have a decent HOA that manages miles of private winding and hilly dirt/gravel roads so it is a necessary evil. Contrary to popular belief, being in a well managed HOA in this county adds value to property because the roads are kept up.

While there have been many rogue HOA boards carrying out outrageous actions, most in Florida have not and already comply. If you do want to sue your HOA, consistent with the presenter's advice here, I also strongly urge you get the advice of an experienced HOA lawyer. In some of the new laws the Florida legislature failed to adequately protect the resident by vague wording and inconsistent with longstanding case law. If you do-it-yourself litigation and lose, the HOA documents normally award opposing lawyer's attorneys fees to the prevailing party. Example: A resident reads the House Bill about pickup trucks now being allowed in driveways at all times. In reliance on this bill resident buys a very expensive pickup truck and parks it in his driveway and is promptly sanctioned by the HOA. Resident sues without representation and discovers to his regret that the law only applies to cases that arise AFTER July 23, 2024 by legal precedent. This non retroactivity is not stated in the statute. Now he can't fit it in the garage.

See what's included in HOA. My lawn maintenance and irrigation are included. I like having that taken care of. They can't complain about my grass because they are the ones responsible for it. Since I don't own camper vans or any exotic vehicles, HOA community is perfect for me. I see it as a perk, but understand how some people may find it restrictive. The most popular HOA communities are on golf corses and include a golf club membership that may be worth it to avid golfers.

You would think. But you don’t really own the outside of your property if you live in a HOA. If you want to get a new door or put up a fence in your backyard or landscape your property or paint your house or put on a new roof, you have to get it approved by the HOA. It is ridiculous because it is YOUR property. I have heard of HOAs who don’t allow you to keep a car in your driveway overnight…it must be in your garage.

People see videos like this that generally take an anti-HOA position and they automatically make the wrong assumption, they’re all a bunch of crooks and bums. In my condo, I’ve been forced into the position of HAVING to serve on the board, because no one else will do it. I don’t even want to do it! Like you said in the middle of the video, “why would anyone want to?” Someone has to or you will be ripped off left and right, guaranteed. Until I served on the board I had no idea how much work has to be done, as a board member. It sucks! I hate it! But if I don’t do it, no one else will. It pays absolutely nothing and is completely volunteer so unless you see your association grossly interfering into peoples business, you might want to reserve your criticism until you know what you’re talking about. Or better yet, volunteer to serve on your board if you think you can do a better job. Unless an association is trying to cover up some kind of wrong doing, the other board members will be glad to make room for you to serve on the board and lighten their load a little bit.

After being tenants in an HOA, we bought just outside the city in farm country. You'll never see an Amishman buy property in an HOA.

Hello helppppp I live in psl Fl in a hoa community new law went into affect July 1 in regards to personal pick up trucks being parked in your own personal drive way and there still preventing me from parking a pick up truck and are claiming a law that protects hoa called Houfman law and telling me that it couse the language in there declaration pages can still prevent me from haveing a pick up truck in my drive way can hoa superseads the law Fl passed FL senate bill 7044hb 1203 FL SFA HB 1203

It's the Florida Kaufman case and binding precedent in Florida that does not allow retroactive application. The HOA document you signed at closing is a Contract between you and the HOA. The US Constitution and the Florida Constitution both prohibit the impairment of contracts. See my comment here. There you have it.

@@carlosquijano8327 It is a certainty that litigation or stature amendment will uphold the original covenant. You can test this in the meantime by parking but run the risk that a court will uphold the HOA and you will be paying your attorney and the HOA attorney fees.

I used to live with an HOA. was super annoying, but property values increased much faster. We even had a special rear entrance for construction workers.The worst rule was that men couldn't be shirtless outside in Louisiana!

You labeled a bunch of reasons that I have owned only 1 property covered by an hoa. Never had any issues during my ownership of that property but Have heard many horror stories though. Decided at that time I wanted nothing to do with them, so all other properties that I have owned are single family homes, with NO HOAs. For those in an HOA. Do yourself a favor and escape asap.

Never lived in a Hoa, but very glad my town has nearly non of those things cuz it's really just a gimmick to excluding certain people.. and I don't believe in discrimination Love thy neighbors or just ignore them.. but don't try to force them out with petty complicated housing laws? It's bad enough with how expensive homes are.. why add more stress other than property taxes..

No one wants HOAs until there's the neighbor that messes it up for everyone. The bylaws are there; be participant, the board members should no exceed two periods, and frivolous stuff should be voted off the bylaws of the community.

99% of the time, county or city codes would cover whatever a bad neighbor might do to 'mess it up for everyone.' You DO NOT need an HOA for that. The reason almost all new developments in Florida for the last 30 years have HOAs is because the cities and counties refuse to take financial responsibility for common grounds like rain water retention areas and such....they want the homeowners to fun that maintenance and rebuilds if they are damaged. This requires an association...so the builders just create the HOA and add a bunch of C&Rs from boilerplate crap from lawyers. That is how we end up with all the crazy overreaching rules.

This is completely and totally wrong.. and you need to start with traditional HOA environments, like high rise multiple family, condo apartment style buildings. Places that have a common roof, plumbing, exterior walls, windows, structure, parking garage,gym, pool.. you can act all cowboy but wait until you want to fly solo on a parking garage or you want to maintain the fire alarm in your unit but the building and everyone else is on their own!! See how far that gets you. People living throughout the United States, Miami, Nashville, Austin,LA, NY, Dallas, you name it, you have to have cooperative rapport and mutual goals to maintain the property, the lobby and mailbox area, garage and hallways need to be cleaned and maintained, can't do it as a solo thing

What a difference your message would make if you were encouraging people to SERVE on their HOA board instead of "othering" people. Accountability is good, for everyone, but attacking HOA boards, who are unpaid and people generally do NOT want to be on them, only encourages more hate, not improvement.
