Brian owned the conversation;; and, in the end, Brian owned Mr. Bertolini! 🤭 That real estate attorney tried to slip in some slick garbage. A person's right to remain silent only applies to a case of criminal nature. In a civil case, remaining silent has no significance. The burden of proof only needs to be circumstantial. And in this case, I don't believe any judge in their right mind would dismiss. There are too many circumstances that add up to intentional infliction of pain etc. on the part of the Laundries. The time line will tell the truth. Timing is everything!!

@@Memow-pk1ng Non-action is not the definition of intentional pain and suffering. The Laundries have no duty to answer the Petito's questions, whatever "pain" that resulted does not elicit a cause of action. They didn't go out of their way to hurt anyone, they simply hired an attorney and remained silent. That is perfectly legal and a fundamental right. The case has no merit.

@@Ericah81 it may look that way to many, but I am 100% confident in saying that is not what they want. Put yourself in their position, you have lost your daughter at the hands of their son at the suspected stage with him coming home in HER van and refusing to give any information about where your daughter is. You are then trying to contact his family and have completely blocked you even after the close relationship you shared with his family. As a result this entire ordeal has disrupted your lives, you can't work, sleep, eat from all the worry of not knowing what has happened to your daughter. Meanwhile, his family are sitting behind hidden walls with their secret planning how to make sure their son gets away with his crime. His family have no regard for what you and your family are going through while you sit waiting for answers and a need to know where your daughter that you love is and if she is safe. Then the truth is finally revealed when her body is found, and this answers the question of why his family alienated you, because their son is responsible for the death of your beautiful daughter. Months go on and their son has taken the easy way out, instead of facing up to his crime. Further to this, evidence is found PROVING that his parents not only knew what he did, which contradicts what they were communicating through their lawyer at the time that your daughter was missing, but also that they wanted him to get away with it. Meanwhile you and your family are still going through hell because there has been no justice, his family even after everything we know now has not been made to pay for their part in housing a murderer and staying quiet about what they knew and deceiving you and your family into thinking they wanted her to be OK when they knew she had been killed. So, how do they pay for what they have done?! You sue them for EVERYTHING. You lost everything because you lost your daughter to their son....not their fault, but covering for him when you know he killed someone, that is terrible and for that they should lose everything too!

They say the exercised their fifth amendment right to remain silent; but, that is not entirely true. They made a statement through their attorney (putting their voices in) ,after their son had returned home, after they knew Gabby was dead, they had their attorney put out a statement along the lines of: "We understand that there is a search for Ms. Petito in Grand Teton National Park (never mind their son murdered her) and they hope she is found safe and sound." That is overly cruel; ridiculously cruel. It speaks to their shady, shady character. His parents also knew when Brian, then listed as a "fugitive", went "missing"; they lied about the dates. His parents certainly didn't tell the F.B.I. when he left their house, with a loaded gun. He could have been homicidal, suicidal, etc., but they opted to be less than honest about what day and what time he left the house (as a fugitive). I cannot believe the disregard to Gabby; someone who lived with them; who was their daughter-in-law. Clearly, the Laundrie's only care about themselves and Brian. Way to teach your children well....don't tell anyone that he confessed to murder, and just try to get him safely out of the country. Hiding shady actions behind "right to remain silent." You weren't silent. You chose when to speak up about events and when not to. You blocked Gabby's parents from being able to contact their daughter (Brian had her phone), Brian, and either one of you as parents. Her parents were looking for proof of life for both her and BRIAN. She was denied any information about their missing daughter that the Laundrie's knew about. It is an infliction of emotional distress. Intentional. What great parents; he's dead on national news and the world knows he was a murderer. And a thief; adding insult to injury, at that. Brian stole over $1000 from Gabby's debit card on the way home. It's sick, the emphasis of this lawyer, is how they lost their son. Their son was a murderer, period. He took Gabby's life is a selfish, violent way. I don't find it appropriate to be focusing on poor Brian's death. He's the bad guy in this story.

And the Petitos claimed Gabby and Brian lived with them FALSE they had an apartment they lived in. I think the suicide letter was composed while Brian was at this parents' home, and worded by the parents, the attorney and Brian himself, who wrote it so that the handwriting would not be questioned and included some of his real sentiments. It's a script. A declaration calculated to cover his parents' ass and protect them from a civil suit and public disdain, while making him sound like a hero (helping and carrying Gabby, then doing a mercy killing when she said she wanted the pain to end.) Then comes the weird statement about how he thought about asking his friends to kill him, but he didn't want them to go to prison, "even though they would have wanted to." WTF?!? But the most egregious part to me is the one-two punch when he claims to be offing himself NOT to "punish" himself, but because he "just can't live without Gabby". Then the passive-aggressive line about wanting to be eaten by animals because "that would make her parents happy". Brian Laundrie was a manipulative, deranged malignant narcissist. He was a textbook sociopath. And his parents not only aided and abetted him, they inflicted untold pain on Gabby's family by refusing to tell them what had happened. They deserve to be sued within an inch of their lives. But I'm sure they've already moved their money and other assets around so I doubt Gabby's parents will get a penny.

Bertolino is of course representing the Laundries so you would expect him to defend them. However, he never shows any compassion whatsoever for what happened to Gabby, it's always about the Laundries losing their son. Brian Laundrie made a choice, he was the one who was abusing his girlfriend and murdered her and he was the one who chose to end his own life. Gabby never asked to be murdered, her parents never asked for any of this. The Laundries made the choice to be horrible human beings, they also chose not to look for their son, we all know they knew where he was and yet they made no attempt to find him. The parents could have called upon a psychiatrist to come to their home and take Brian into care in a mental hospital - they had to know he was at least thinking of suicide? The father could have removed the gun/s from the house - taken them to another member of the family - so Brian could not access them? A LOT of parents would have done that, given the obvious risk of suicide. When Brian left the house, the father could have insisted in accompanying the son into the reserve. YES there ARE things the parents could easily have done. For Bertolino to even talk about how the Petitos should offer an "olive branch" is just another example of cruel "outrageousness" this family inflicted on former family members? The Laundries committed so many ACTIONS as outlined by the Petito lawyer... and more examples to come during a trial.

In fact, if I remember right, they reported he stated his fiancé was at their camp site and he was returning there. But, he did not have the van available to him at this time. What happened to that testimony? And it was believed he was trying to establish an alibi, a timeline, that he was away from Gabby when she died. Did the van belong to Gabby? Why was probable cause not implemented the moment he returned without Gabby. The Laundries actions show guilt not because they stayed silent but because of buying burner phones, cleaning the van, picking up the vehicle B took to the reserve before he was found and not turning him into police immediately to answer for his actions. No surprise the Laundries think they are victims and blame everyone else but themselves in these days of no accountability, gaslighting & blame shifting. Brians sister should be a part of the claims because she was involved too. I wonder what her parents would do if roles were reversed we would probably see outrage.
