There are, but if a civilian tries to intervene in a conflict on the subway, there is a high chance they could get criminally charged by the district attorney and branded as a bigot or predator by interest groups. Not many individuals want to take that risk, so they now leave it up to authorities to sort it out. Bystanders do not get any grace or protected liability.

Alvin Bragg effectively destroyed most, if not all, motivation to follow the phrase commonly preached to the public: if you see something, say something (or do something). Your sentiment essentially tells people, "you're damned if you do, you're damned if you don't." At least if you don't do anything you are not at risk of being branded a bigot and the perpetrator of a hate crime. People are more likely going to choose being branded as anonymous assholes because at least your identity is protected and your dignity is preserved. When the DA is eager to file criminal charges against bystanders when they intervene and then put them on trial that could result in a lengthy prison sentence, that "if" is going to have an extremely decreased likelihood of becoming a "when." Being a Good Samaritan apparently comes with a high probability of being labeled as the perpetrator, and depending on the individuals involved, a bigot.

Why Daniel Penny case? What happened in 1964 to Kitty Genevese in Queens? People studied that case. This effect is nothing knew.

Absolutely, the "Bystander Effect". Multiple people witnessed her murder and NO ONE called the cops. They all said later they figured someone else had already called. So sad. Now after what happened with Penny, people are afraid of intervening. I think we should always try to help and the DA Bragg & Governor need to resign immediately.

This horrific incident IMMEDIATELY reminded me of Kitty Genevese. The story was part of an English class I was in in the 1970s. I instilled the mantra in my brain: "never again a Kitty Genovese" if I'm in a situation were I can help my fellow "man". Daniel Penny has that mindset. Hopefully his act of courage has inspired others to act in kind.

1964 people didn't wanna get involved for fear of getting in harm's way. It's 2024 and not only is that possible, but the DA is going to charge you with a crime too. So yes there is a Daniel Penny effect that is unique to this time.

@@christopher3790 Wrong! I saw an influencer interviewing people on the street about the Penny case and they pretty much could care less. I have lived in NYC and ridden the subway all hours of the day and night, the majority ignore and flee such events. You have maybe max. two people of every train who would get involved. That Penny case had no weapons, the guy threatened (I guess) but did not swing on anybody, so it was pretty easy to subdue the guy causing problems. That was an easy chokehold when the person applying it was taller than the person being choked. There is no comparison to someone burning someone verses the Penny case, where no weapon was displayed.

I was caught on fire once, In my panic, I remembered to drop and roll. It put out the fire. Couldn't someone have tried to tell her/ instruct her in what to do? My clothes were burned and melted, my hair, eyelashes, brows, burned... but l survived. She didn't. This is so sad. She was asleep, then woke up on fire, and nobody helped her.... I guess she was in shock to wake up on fire? 😢😢 I don't know what to say... There's no way that l could just stand there and not try to do something.

She stood there as the fire was burning up her body instead of rolling around on the ground which would have stopped the fire. I think the police who watched thought maybe it was a suicide. Because why would you stand there like a tree and burn up and not hit the ground and roll.

You can NOT blame bystanders for this. If you want bystanders to step in and help then you must allow them to carry a gun and use it on anyone who is a threat. But guns are illegal in New York City so don't expect anyone to put their life at risk for another when they don't have the tools to deal with such a situation.

Apparently, it's a hate crime if you help, it's a hate crime if you don't help, and if you Jussie Smollett a hate crime (report one that you staged yourself) it's no problem because you just need to make a ridiculous deal with a corrupt DA and then you will never have to face consequences even if a special investigation and jury finds you guilty and a judge sentences you to serve jail time because "double jeopardy" or some such legal technicality that protects criminals.

short answer: NO! the train was at the last/first stop (coney island) and it was completely empty with only the woman sleeping and the man who set her on fire. it was also 7:30am. if you live in NYC then you know no one could’ve stopped him from doing that except for the lady herself if she was awake.

Why are we downplaying the fact that this woman was on fire and such large fire that they didn’t even realize a person was in there at first? There was apparently no fire extinguisher on the scene, but someone had gone to find one, but how else are you going to help without a fire extinguisher without water, without setting yourself on fire or hurting this woman worse or getting yourself set on fire by the creep who did it? Like how would you help someone like this? obviously her skin and nerves have been burned where she couldn’t move by the time people realized she was there? What would be the right thing to do without making this situation 10 times more gory and traumatic?
