You haven't much experience in business or contract law. A contractual agreement like that is extremely common in businesses of all types. The real problem with that contract is that entry level employees are highly prone to violate it and have nothing to pay for restitution. Some states have existing laws that already cover much of that contract and employees current or prior can be held liable according to those laws without the contract necessary. Other states without those laws a disclosure agreement like this is very common for employers to have.

@Paul Loman7 --- I agree they couldn't show damages but clearly it was a breach of contract which the judge made reference. That is why no compensation was warranted. As for the commonality I certainly differ based on some states already have laws concerning many of those issues while others have almost nil. I've learned many things from my family and a contract attorney in my family is where my information mostly comes from. Personally I'm a landlord now that I'm mostly retired and he writes my leasing and repair contracts and contracts for other family members who have other businesses.

@Paul Loman7 --- Your lack of personal experience doesn't have any weight compared to that of an attorney who writes such contracts as a profession. You can "believe" and have an "opinion" but that doesn't have credibility. I've seen those types contracts, asked about those contracts, my son had a job which had such a contract he told me about, etc. I do not know the percentage of businesses that have such contracts but I do know as a state passes legislation that covers those issues those type contracts become less common and states with less legislation they are more common. If you really want to know the percentage and frequency businesses in that state uses such contracts I'd suggest contacting a contract attorney in that state. If you want to believe those contracts are rare and are derived from a negative practice by the businesses that utilize them you can choose to have that belief.

@Paul Loman7 --- I'm a landlord as I told you and my contract attorney is a family member which I also told you. You have some strong opinions about disclosure agreements, the frequency they are used and the intent of them. My knowledge of disclosure agreements is limited to what I've heard him mention. If you disagree with my passing along what I've learned that's your choice. Satisfy yourself by contacting an attorney in your state and/or the state this case happened and learn the frequency disclosure agreements are used and then you'll know the truth for that area and breathe a sigh of relief.

The only reason you'd make that statement is because you have zero experience with business, contract law or understanding that some states already have such laws that are enforceable while others do not and it's very common for businesses to have those contracts. Sadly, the employees most likely to breach those agreements or break existing laws are the entry level employees, often young, ignorant and immature and usually haven't anything to their name to collect from a lawsuit.

@@876me7 --- These type contracts are becoming a boom for businesses large and small. Every state has legislation pending or already passed and being lobbied heavily by all sized businesses due to online, facebook, twitter, etc defamation lawsuits. The argument of free speech or criminally liable for broadcasting personal opinion has gotten muddied in courts. All businesses understand a disgruntled employee who has done everything wrong and deserved termination can go online and cause significant damage to their company and any lawsuit gets bogged down for eons in courts. Even if they win they can't collect anything from a person that has nothing and never will have anything. These contracts completely bypass nearly all those legal hurdles and a cease/desist order happens immediately and if the person breaks that order they go to jail. The internet is the reason these types agreements are growing extremely fast and every business should have one!

@@davidswick8571 No its the management/ownership. There's not too many businesses with long term problems that are due to a string of employee's. The owner does not respect anyone, he seems to think he's above everyone else, while also attempting to micromanage and control every little thing. He's having employee's sign NDAs.... for what? And not just normal trade secret NDA's, but complete control over someone's ability to speak about their experience with the company. I'd be willing to bet that if challenged, those NDAs would be deemed illegal. He's calling his assistant "the girl". On a scale of 1 to 10, t hat's like a 6 or 7 for narcissism. He forced... "forced" the other woman to write a statement to shift blame and alter what was said in order to get out of another lawsuit. They never said a number for the year, but it sounds like they go through employee's like crazy. 11 employee's in 2 months, that's a crazy turnover. I ran a store for 6 years and in those 6 years i had a total of 14. That is a broken system with broken people in charge of it. 11 people in 2 months... yo, that's bad. If i remember correctly the worst ran store in my region had 13 in a year. This guy has to be a nightmare to deal with, look at him.... you can just tell. This man has created a work environment of degradation, egg shells, paranoia and fear. At no point are the employee's the problem in this equation.

Isn't covering shifts after firing someone the cost of doing business? It seems pretty shitty to penalize someone further after firing them because there wasn't someone to cover their shifts. When I apply for a job that's one of the questions I ask in the interview, what's your turn over like? These two employers are clearly the issue! Red flags go up when an employer has such a large turn around and drama as a regular occurrence! No one in their right mind puts in a contract that their employee can’t complain or speak on situations that occurred in their business. Everyone has the right to complain or vent so long as what they say isn’t dishonest and meant only to character assassinate! But to say you dislike your employer because they’re unreasonable about family emergencies or because the employer is unprofessional in their management skills and behavior towards employees, isn’t something that should be allowed to be sued over in court. Anyone can write up a contract but it’s the judge that has to find if it’s not only been broken by the defendant but if it’s reasonable! This couple doesn’t like to be called out and they apparently have much more to hide like employee abuse than just trade secrets! 🤦🏻♀️

Ridiculous, childish attitude of the defendant gives you an idea of the type of employee she is. I can understand why the plaintiffs had such a difficult time keeping employees as work ethics have deteriorated in society. Also, having to sign an NDA goes against the first amendment. So, horrible employer and employees in this case.

This is not a legal case. It is simply an arbitrated case. So that means that if any employer looks up any legal actions against her, this will not show up. I agree though, those employers are crap. She wasn't smack talking, she was talking the truth.
