The plaintiff claims the defendant sold her a different bike than the one she wanted and so she is suing for a refund. The defendant claims the plaintiff had the bike she purchased for six months and will not give her a refund.

I know someone like her. I’ve never seen someone spend so much time researching something..she’ll even write paragraph after paragraph.. and be just plain wrong. And it’s not me thinking her opinion is wrong (like politics) it’s factual things. She usually gets obsessed with something she has no experience in, research it, and become an “expert” on things she’s never experienced.

The issue here is that there are two different 2014 models; one has 26 inch tires and forks that fit it and the other has 29 inch tires and forks that fit it. The girl buying the bike did not do her research as buying a 2014 model is not the singular requirement.

First the manufacturer didn’t tell her that - she decided that based on the date of manufacture on the bike. But manufacturers start building and shipping next years model at the end of the previous year. Also she based it on the brand of fork on the bike. But some manufacturers change components on a years model for various reasons - eg supply issues

If you have you will know you get told many different things by many different people. You can get one rep that will tell you it's a 2013, another might say 2014 and hell the last might say it's a 2012!! They say ANYTHING to get you off the phone. The reason why Judge M got the answer is because of who she is and being a judge. She probably talked to some high ranking executive vs plaintiff talking to a customer service rep!! Plaintiff couldn't be more wrong if she tried. To anyone that knows about bikes if you look at the seat stay where it meets the rear tire, it's absolutely clear as day that there is no way a 29" wheel/tire would ever fit this thing. There's just no room for it to fit! Like the defendant stated, you could have bought that bike brand new either as a 26 or a 29 and she got the 26" version. Failing all that, the plaintiff's eyeballs would have told her the bike had 26" wheels on it. 29" are substantially bigger. It's like looking at a stock Jeep and one modded with a lift kit and 37" wheels on it. They. Are. Not. The. Same. Stevie Wonder himself could see the difference. My guess is since the plaintiff had the bike for 6 months starting in June of that year, she cracked the frame (it's carbon fiber) and now wants to weasel a refund because the frame is now junk.

While I was visiting my daughter in the Chicago suburbs, the jerks on the bikes will just flip people off even though the signs say not to ride two and three abreast. Why do people spend $80k on a car? Or $1 mil on a house? Or $6000 on a musical instrument? If it’s your hobby, you want the best. If she’s competing, then the frame material does make a difference. That’s not even that expensive…my BIL spent $8000 on one.

Actually it's very normal for bikes. Seats and pedals are very rider specific and usually get swapped out immediately. Defendant most likely kept them for her new bike. And when you buy a 'real' bike from a shop (not talking about WalMart or other department store bikes) if they do come with pedals from the manufacturer they almost always come with the cheapest set of low end pedals you can imagine. They only exist so the bike could be test ridden or pedaled home and then they get chucked in the garbage or forgotten about on a shelf in the garage. Same with the seats. If you're a serious rider you're spending a LOT of time on that bike, everyone has their individual preference and once you find something that works for you, you keep it.

I could see her issue, but 6 months just is too long to wait. Then she really needed to do her research on bikes. It's common for manufacturers and retailers to sell bikes built a year ago as current model years. Even if the manufacturer listed it as a 2013, the seller might have been told it was a 14 when they bought it new, and was acting in good faith. Also, if you care about the wheel size, then check it as you buy it.

well, when the manufacturer states it is what it what it was sold as then there's nothing that can be done but do your due diligence and be more meticulous in your research. perhaps use these smart phones we all have that have data to the internet and check the vin numbers on stuff and look at several sites, manufacturers definitely! and make sure you are getting what you want. the lesson here is always do your research.
