In my case, I am the third, but in lineage I should be the fourth. My great grandfather was the first but he did not name his son (my grandfather) after him. But my grandfather named his son (my father) after my great grandfather, so he was the second. My father then named me after himself, so I am the third. Confused yet?

Yes! At 7:51. Usually a document like that is written by the seller not the buyer. Also there should have been evidence that they discussed the warranty by text or something. Why discuss it in person only? If it had a warranty, it likely would have been discussed elsewhere (e.g., text or the advertisement of the car)

It's very suspicious that the warranty SHE typed up for him to "sign" (supposedly at the time of the sale) specifically states that the car has "no transmission or engine issues". That specific wording makes you suspect it was typed up after the fact. However... and you could make a case that the defendant intentionally misspelled his name in order to deny that it's his signature, but the handwriting extending the warranty to 60 days... that tells you he didn't sign it. No way anyone would agree to that on a 15 year-old used car. lol

@@marleonetti7 The problem with your argument is under no circumstances do you get a warranty when buying any vehicle from a private party, which is why if I was going to get a vehicle I would not get one from a private party, and from a dealership the only way you're getting a warranty is if you're getting a vehicle that's no more than 4 years old with well under 100,000 miles registered on the odometer. on a Hooptie like what the plaintiff got, no dealership is giving a warranty on that, full stop, that is something you buy at your own risk. And even a newer vehicle with low odometer reading, a dealership is only giving you at most a 6 month warranty, and a very limited warranty at that.

Here in Belgium, there was a guy who ran the same scam as this guy, he sold things online, and intentionally made errors in the contract (misspelled address, wrong postcode, etc ) then he claimed that it was not my signature, and I never saw the contract. He got all the merchandise back too and he had the money too, until one judge got him twice in a row, and he found it fishy. He then sent the contract to check for fingerprints and to analyze the handwriting and the signature.

The letter wasn't just signed wrong. His name wasn't spelled correctly in the body of the letter either. The planttiff said she typed it up, but I don't think he would have signed a warranty like that. It was basically an agreement to give her back all the money she paid for the car if anything happened to it. That's a ridiculous agreement, and no used car salesman would ever sign it and expect to stay in business. The planttiffs crazy.

It is possible he mis-signed on purpose as he knew that car had problems but wanted to sell it. I think he knew he could make the argument that he did not sign it if he were sued. Unfortunately for her, she couldn’t prove it w/ a video showing he signed it.

See I'm not inclined to agree with that because though because what would be the point of that, he could just simply REFUSE to sign that warranty contract. There is no law mandating a dealership provide a warranty on a used vehicle, which is why you almost never get a warranty on a used vehicle ESPECIALLY a hooptie like the one she had. Dealership will give a warranty on a vehicle that maybe 6 years old with a low reading on the odometer, and that will be at most a 6 month warranty, and a very limited warranty, but don't EVER expect a warranty on a hooptie, EVER..... That is something you buy at your own risk.

@@Hardin9 The point would be to assert the car had no issues b/c that was the buyer’s contingency. He was desperate to sell and she was desperate to buy so it’s not hard to believe he’d mis-sign the doc to avoid losing the sell. It was evident she was naive as she didn’t take any logical steps when buying a used car: buyers inspection, CARFAX check, etc. before spending a lot of money. He took advantage of that but she can’t prove it. She should have never purchased that vehicle w/o an inspection at minimum. Considering she skipped that part, she should have at least recorded the signing or had the transaction completed w/ a notary.
