Awesome, right earned my first patents when I was 25 years old, a long time ago. My idea was so cool that the best patent attorney in Seattle did it on contingency. I license the patent rights to Major company and quickly discover the patent is only worth what you can afford to spend defending it. The system is useless and I absolutely agree if youve got a great idea just go do it

A friend of mine patented the idea of digital cameras automatically takimg multiple shots and choosing or constructing one in which everyone's eyes are open (possibly some other related features too, like smiles) He did it early, thought about it himself with detailed tech description (he's a smart engineer, not a patent troll).spent lots of time and attorney fees for patents in half the world. Other half plus pushy patent lawyers from camera companies forced him to sell patent with very little return for all the effort.🙁

I’m glad Austin got something positive out of this with his documentary.I’m sure at the time he would have wanted to do other things with his life than chasing around with this problem but his motivation turned it into something useful for himself and hopefully others down the line. What an incredible human being he is. This sort of stuff would crush most people and that’s why they pay up. The sense of injustice is the worst thing when these lowlife’s get away with this sort of thing and my own personal experiences of injustice make me feel crushed, depressed and lose faith in the law. Is this a feature of the crazy US legal system? Seems like you only do well with the law if you are loaded. From over the pond it looks like most of America is nuts but our legal system doesn’t seem to be much better. Thank goodness there are people like you guys. You have my admiration.

I've been using his software (X-Plane) for about 20 years, when it was barely even heard of. It was a disruptor when it came out because of the way it handles flight models. I used X-Plane for several undergrad and graduate level papers and was essential to my Masters Thesis. He's always provided an exceptional product at a fair price. I believe that Austin's outrage is quite just. Before he mentioned his 'travel to Mars analogy', I was thinking "I should file a patent for a time travel machine, a teleportation machine, a Faster-Than-Light (FTL) propulsion system, and a fusion-power machine. Then I can wait for someone to invent it and sue them when they do."

They go over that point in the video, this doesn't work. These trolls use paper companies, you can sue them out of business but can't gain anything from them. They'll just open another paper company and do it again. The difference is: you've got something to lose, they don't

I am customer of Meyer's. His product was itself is very innovative. It uses a unique flight sim computation model. It is sad to see Austin going through this mess. Hardworking people like him should not be penalized! And the answer to this problem is incentivisation of greed in our societies. Todays financial models incentivises greed and oligarchies. Dont expect anything better once the society goes down this path....

I learned about patent trolls years ago from family, but again from Planet Money on public radio. I've also heard of very large companies collaborating on patent pools to protect themselves from trolls.

Having written many patents I can relate to this issue intimately. 20 years ago there was actually some details and substance in the patents in our field. Now it's minimal viable details and no publications in conferences etc. to limit details from getting to the competition

Brutal stuff. I laughed when. you talked about musicians and copyrights. My band actually put out a CD with 13 songs on it. I was online one day and wanted to listen to one of our songs. When I went to listen to it, the system that had the song listed told me I was not allowed to listen to the song due to Copyright infringement, and I owned the Copyright! LOL It is insanity. So I could not listen to a song that I wrote and performed!

If you were logged in to the website listening to your own song, the website should know you own it. There is a problem I think with bot moderators, like on youtube and other sites, that have been deleting legitimate non insulting comments. Is this a similar thing? I have some comments of mine blocked before. They were non insulting and no bad language. Are these bots just judging by keywords or are they tuned to only allow the viewpoints of their designers?

But to now know that anyone can come up with anything in their ‘imagination’ and legally patent it, without proving that it actually works,, is a scary truth. It is written in law that the idea embodied in a patent is supposed to have to work and have utility. The USPTO just likes to forget about this requirement because it benefits them and trial lawyers. Call Congress. ☎️

Hi Zac & Jesse. Long time viewer, first time commentator. As recommended by you, I've just watched the beginning of 'The Patent Scam' documentary where Kevin O'Connor is describing the energy, cost and time (so far) he's expended on his ongoing experience, and (feeling for his family) I literally began to cry as I witnessed the evident discomfort in Kevin's body language (left eye twitching) as he spoke on this matter. How can strangers (patent trolls), who contribute nothing meaningful to this world, deliberately f&*k with a hard-working, service-providing person (and his family's) lives and livelihood, causing so much emotional distress and financial hardship, without remorse, solely for monetary gain? Surely this is illegal? This insidious behavior is obviously extortion or blackmail or something along those lines? If this type of frivolous claim cannot be eradicated then perhaps a caveat ought to be enforced by the legal system that says... "This infringement claim can only be upheld, if the 'suing' party already owns a physical or digital 'entity' that the 'sued' party is copying." (Similar to music industry). Obviously the appropriate legalese would be used. Why doesn't Google sue the patent-trolling bastards for taking money from other people, in their name? Imagine if they did this to Spotify users. Those Harvard MFers probably realized they'd never make it as conventional lawyers so together (possibly over lunch at someone else's expense) they concocted this litigation 'model' while high-fiving each other. What do other followers of this channel think? I really need to know.

I think the patent system in the USA was changed quite a few years ago where anyone could claim an infringement on say a computer program if the program did the similar thing to the accused programmers program . This was even allowed if the programs were a different design. Things seemed to have evolved to even worse where just an idea behind something can be an infringement. There were some protests about the patent change. Mainly in places like the EU and some other countries. I am not certain if the EU has its own better patent system now or if it has evolved similar to USA. If the EU patent system is better surely a lot of USA startups would want to take their business their. In China I don't think they have any patent system.

Where I live someone panted a very old and traditional type of clothing, invented centuries ago and used before by poor sheep herders (now something no poor sheep herder can buy) this was a peace of clothing that he never invented or even add the idea, this person that add a factory making it, then sued all other factories, fortunately many of them, didn't cave in to the threats and instead exposed it and caused a major nacional uproar, forcing the government to intervene and the patented being overturned but just the fact that someone, could just go to a patent office and file a patent for something so old and cultural, so easily, is just crazy.

It took me 14 years to defeat a completely vexatious easement case where the plaintiff claimed an easement over my new ranch to reach his property. Problem is the so called easement passed over the Jicaralla Reservation. The asshole who sued me was not Jicarllian and had no easement over their reservation. Anyone who knows anything about easement law knows how stupid this is. But the lawyers we hired told us to trust them and recused the original judge assigned to case who turned out to be an expert in easement law. They got us a judge who couldn't find his ass with both hands. We only won when that moron finally recused himself. I don't know how anyone can come in contact with our so called justice system and retain their sanity.

This is also the case with the legal system in Sweden ... We are in a case where the authorities have approved a forged signature and refuse to take back the decision which is based on forgery .... but we are working on finding other approaches to lift the decision and the process is now in its 5 years ...

The cost of the patent is determined by what lawyer you choose. Anywhere form $5K on up. By the time you finish it $10-20K will do it if you get a modest lawyer. Go to the largest firm in DC and the sky is the limit. The quality of the patent can very widely. The wrong words can be ruled invalid. You should revisit this topic with a true patent expert to correct a lot of this misinformation.

I wish we had an ROI party, (Return On Investment Party). Go through our government on all levels and review how things work. See what kind of return on investment we are getting. Use that first principals thinking to overhaul things based on data, not religion, not tradition,etc. Just boil it down to something work well, if not, change it. Hope more like Austin keep showing these rarely spoken of issues that actually have a large impact on our world.

There are some well known companies that own large stockpiles of patents, but hardly ever file patent lawsuits. Any time they are sued, they countersue for violation of their own patent. Patent Trolls protect themselves from this by not doing anything but file lawsuits. If America adopts the "Looser pays" principle from the British Commonwealth, this would all go away, because when you defend against a patent and win, the troll will have to pay your lawyer.

I am trying to watch the Patent Scam video on youtube and is clear to me that KZbin has earmarked this video "the Patent Scam" for slow stuttered viewing, the sound plays normal but one is presented with an unpleasant to watch blocky video, that is on any device I have (I am a network engineer) yet any other video works fine. This from the Netherlands as from a VPN in New Zealand. Does this suggest that these bad lawyers have gotten their tentacles in Google too, yet again?

Patents are bad and shouldn't exist at all since they hold human progress back. Copyright should be be shortened a lot, creators definitely don't need money after their death. Trademark law is great because it protects both the consumer from being scammed and a company's reputation.

So Patents in US should work like in Poland. You can patent only new inventions in global scale. New invention MUST NOT be public presented before you ask for patent. You must add a working sample to patent office. You can't patent algorithms and ideas. and you have monopoly up to 20 years. There is also "desin" patent. So you can patent exactly look of your product. So nobody can ideal copy your products, but if instead 3 layers of something, someone do 2 or 4 layers of something, it's OK he can do that. That secure thinks like LOGO, name, shape of cars, etc. And you have monopoly without time limit (but you must pay every year fee)

Those judges are elected - in a place that only ever votes for one political party overwhelmingly (east Texas = republicans), it’s a ripe place for criminal behavior because all they need is to be “conservative” and they have guaranteed jobs… this type of outrageous behavior is notorious in deep red America, they are drunk with power and greed

IMO: The purpose of a patent is to help innovators cover their costs of development. If anyone could just walk into a trade show and copy a finished product, there would be zero incentive to do any R&D. Perhaps the law should be changed such that unless a corporation or individual is able to show significant sunk costs into developing their idea or a working prototype within a reasonable amount of time, their patent should be revoked. The questions of what is "significant" or "Reasonable" should be settled through a dialog between law makers and research labs. And Lawyers and judges lining their pockets through corrupt practices is nothing new. But the individuals involved must be dealt with in the harshest manner legally possible.

@@Nphen I agree with you there. As Elon has stated, production is much harder than prototyping. Tesla and SpaceX must have multiple billions worth of IP in their manufacturing processes. All I'm saying is that simply writing a vague idea down on paper should not be enough to keep a patent. A working prototype that clearly demenstrates the concept in the patent within a reasonable amount of time as a requirement would stop these patent trolls in their tracks.

This reminds me of when I first started hearing about copy rights and patents, back in high school. At that time I was wondering why someone didn't just put a patent on each letter of each alphabet, and each number. That way any time someone uses a letter or number they open themselves up for a lawsuit.

I always thought you can’t patent a raw idea. However you can patent a design or concept even if the thing was never actually produced. The story about the lawyers and judges collision is not about patent law. It’s about criminal fraud! This whole problem appears to be in the realm of intellectual property, not physical designs. The Apple shopping bag is a physical object that could be protected by a design patent even if it does not qualify for a utility patent. Apple didn’t patent the idea of a shopping bag. It patented an actual design. Others can still make shopping bags as long as they don’t copy the design.

Didn’t Tesla counter sue Nikola for patent violations citing they violating the good faith clause of it’s patent share pledge by suing them? A good offense is the best defense.

Tesla has the money to counter sue and even not get anything back but shut them up, essentially throwing money to the trash "and lawyers pockets", small businesses, don't have such money, so many cannot counter-sue and prefer to settle that is why, patent trolls exist, is a profitable venture, imo no different from extortion but legal.
