Good analysis of duress. The handcuffing of the husband is definitely duress, you should have started the video prior to that - I've seen the original. The family should have accepted the offer of an ambulance if he police would pay, and they would need to make . I disagree with your editing out the video showing the wrists, viewers need to see how "reasonable" their treatment of the husband was. You may have wanted to mention the fact she could have canceled her permission at any time, for example when he went into her bedroom, just to hammer home how unvoluntary it was. Yes I know she really didn't grant permission, but her trying to revoke it might have forced the issue though the courts already seem to have agreed with them. Community caretaking, including wellness checks, are one of the most most abused areas of law enforcement. My children know not to use them for me. Due to my family history of heart disease, I am already well past the age (39) where we start having myocardial infractions - heart stoppage. A wellness check won't do me any good at that point, I'll have died in minutes if that happens, and my getting in an argument with an officer at my door might cause me bigger problems, especially if I'm short aleep, have no coffee, and don't have my back brace on (pain). I sympathize with the husband in the original video.

KZbin just needs to have a disclosure saying the ads that play before a video have nothing to do with the video you are about to see. That way advertisers would be able to get a bigger range of people to see the comercials. Its that easy

There was no medical emergency, of course. They claimed the girl was in a possible medical emergwncy, but they were looking for the boy, not the girl. There was so much bullshit there, and audit's grade was WAY off. Full on F-. No way it deserved a C or even a D.

megan hunter Good question. Though EMS will sometimes stage away from the scene until it is secured. But that’s usually when the people involved are known to be pretty shady.

About sums up the story. I understand doing your job but from what sounded like the tip came from the girls family that may or may not have been abusing her. Reason why I say that is because runaways normally run away due to family abuse and they are fed up with it. Now the medical excuse could have been because of the heavy long term abuse she has suffered or maybe an illness from birth or growing up. But despite how serious the family thinks it is, I do not think it would kill her unless she has asthma or D type 2.

ANY cop that gets a complaint against them should be heard in court in front of a jury of people they took an oath to protect and serve. NOT just investigated by other BAD cops.

There are nuisance complaints, just like there are bad cops. Having all complaints go to trial would create just as much of a problem as we have now. The core issue is that neither the police nor the public trust the system to render a fair judgment about the actions of the other.

Much as it would be nice to be able to have such a system, it would very obviously be ripe for abuse. Definitely something needs to change, this, maybe isn't the answer.

We pay the settlements because we are taxed and an account is funded to cover their illegal actions. I seen too many instances of people allowing their Civil Rights to be violated because it is easier than resisting. I'm going for the money/settlement/punishment when it happens to me. No warrant, no probable cause, no entry.

As the AtA guy said in the video, the legality of this situation isn't clear. It was a situation where everyone was acting in good faith: the courts will end up deciding it. I would like to know why the one guy was placed in cuffs, though.

Typically that is how that should go with at least one exception. If the police have it on good authority that there is someone in immediate danger or in need of medical attention, then that would be an exception. In the case they were definitely in the wrong and should have had a warrant.

Or, place an officer just outside the boundaries of that property to make sure no one comes in or out without being seen and send the rest to get a warrant , an ambulance and do things properly.

The older ones with a F compared to the exact same thing in newer ones but C- because the "current climate" and "understanding it from the cops eyes". Sorry, thought this was supposed to be viewed an audit from the point of law not because the officer was polite and had a smile as he broke the law and trampled rights. They shouldn't get excused because they did the bare minimum that should be expected to begin with.

Officers who bring harm to someone for no reason other than “I told him to stand here and he moved 5 feet” and violate the rights of the citizens should be required to cover restitution and pay out of their salary, rather than the pockets of the taxpayers.

The best way is to have each police officer to obtain their own insurance and when sued and lose the cost is paid by their insurance after a few payouts by an insurance co their cost to keep said insurance policy will become to expensive and they will never be able to be a police office again.

There are reasons they should be allowed in without a warrant. If they saw the suspect dragging a screaming woman in to the house do you really think they should have to wait for court approval before going in? Yes an anonymous tip with nothing else backing it up is definitely not justified but to say a warrantlss search is always wrong is ridiculous.

The Nuremberg trials long established the fact that 'I was just following orders' is not a valid excuse. If you know your orders are illegal or immoral it's on the officer to refuse to carry those orders out.

The whole point of the video is that he is supposed to be operating on exigent circumstance. That is a warrantless search exception. It means he does not require a warrant. The question is wether that exigent circumstance actually exist. It very obvious they are not in a hury. So I would suggest it doesnt. The excuse of just doing what they are told is never a good excuse because Police are never under a legal obligation to act unless the see a crime occurring in their presence or if they are serving a warrant.

They're trained to coax you into giving them "permission". If they don't just bust in, then they don't have probable cause or reasonable suspicion of immediate risk to health or safety of someone inside, or a warrant.

If you watch the video it explains the Deputy was acting on Exigent Circumstance witch is a valid Warantless Search exception. There are 13 of them. If you want me to detail what they are I will gladly tell you. The issue here is simply wether exigent circumstance actually exists. On the one hand if this is a possible medical emergency( the exigent circumstance) like someone else said where is EMS. On the other hand shes awful nervous for someone not hiding anything.

The guy had every right to file a lawsuit.He wasn't doing anything wrong. Just not allowing cops into his home. He didn't need to be thrown to the ground for walking on his own property either. He never should of stepped outside. There was no reason for it. Man I'd be so mad if it was me in this situation.

The difference in this particular state is instance. The Audit here on the channel is based on the legality based on situation. The grade is based on the officers information on hand. In essense, they are truly looking for someone having a medical issue, that could lead to loss of life. C- would be what i give them too. The way they handled the situation in entirety was poor, but legal, and passable. However, the man did not need to be in cuffs, neither of them needed to go through all of this. I blame the call they recieved for shitty information more than i blame the officers reasons for entry and search, but the rest of it cant be overlooked either. This is an accurate rating.

I got woken up at 4 am years ago by the cops looking for some runaway girl I didn't know. They even lied and said they had the right to search my home because it had to do with a minor. My boyfriend told them no and they had to get past him to get in 😂

This is why the homeowners should have gotten a lower grade. "I do not consent to any search" is the one and only phrase you should ever utter in response to any LEO who is seeking to search your property.

If someone is mute or incapable of articulating themselves correctly does that mean it’s open season on them? We have to expect our police to know when they are breaking the law even if the person who’s rights they are violating are ignorant of the violation or unable to articulate it. Sometimes I think the people who follow this type of channel are split between those interested in ethics and autistic kids.

When a settlement is reached with public funds or an Insurance company paying that settlement on behalf of the public, should be by LAW, 100% public information, UNABLE TO SEAL THAT INFORMATION. Settlements such as this can not be " SEALED " under the LAW that I'm proposing. The sealing of the amount is so the winning party is not harressed by people because they know they won the case. However the amount should be made public and not attached to any case or individual to be transparent while protecting the people who won in court.

@Ian Battles I think they could legally enter, but I agree with you that they should not have wasted time with the home owner. That only escalates the situation and wastes valuable time. They should have said that they were coming in. And if she got in the way, they should have slapped some cuffs on her like her husband. I have actually seen cops do that. The person said that they couldn't come in, and they said yes we can and went in. There was no negotiating involved. And nor should there be. If there was someone who needed medical attention, she would be dead before the cops got to her. If there was suspect in the building, they would be long gone by then. The homeowner was also an idiot. What was her idiot husband trying to prove by attacking a police officer? I'm probably a lot tougher than that guy, and I wouldn't have been stupid enough to try that. The best thing to do is to say that they don't have your permission to enter. And if they do it anyway, they will have to face the legal consequences. And then you step aside and say nothing else. If they believe the law is on their side, they'll enter the home. If not, they'll leave. And if you don't like what they did, you can file a complaint or sue the police department. Although getting a video like they did wasn't such a terrible idea. That helps to make certain that everything is documented. I would also take a video of the condition of the home after they left to show any damage they caused.

When the cop came in, he wasn't looking for the girl. He was only looking for their son. When he was finished with his search, instead of leaving to continue the search for this girl with the medical emergency, they had to stick around to argue and justify their actions. Their actions contradict the story they're telling.

@teslagod2003 There's really not much worrying on the part of the cops. They very rarely are held personally accountable. Even if a lawsuit is won, it still has no impact on the police. They don't pay the settlement. The taxpayers do. We pay for them to do what they're doing, and then we pay for their mistakes. And they don't even have to admit fault for anything. It sucks.

@@brussell639 Maybe. But I'm not sure I see the point of doing that. If I am following the story correctly, they also said that they were pursuing a suspect. The son or whoever it was. If that's the case, they had a legitimate reason to go into the home anyway. And, again, it makes no sense to ask for permission or to have a lengthy discussion with the home owners. I have seen police going into a place like that. They knocked on the door and said they were were coming in. When the person in the house said they couldn't come in, the police said yes we can, and entered. There was no lengthy discussion involved. And they certainly didn't ask for permission.

They don't give a rip about that woman, that was just an excuse to enter the home and a flimsy one at that. Plain and simple they were after the son. They had no warrant so they colluded and came up with a BS story. They lied, coerced and injured a man in handcuffs. They executed a warrant less search and held a man hostage as leverage. When executing a search normally yes you need a Search Warrant. There are however 13 Warantless Search exceptions. Most of these 13 revolve around whether or not one has a reasonable expectation of privacy in a given situation( SCOTUS has defined what is and is not a reasonable expectation of privacy and what is not)The key word in 4th Amendment and most of the 13 exceptions is REASONABLE. I said most because there are a few exceptions where things like exigent circumstance and hot pursuit trump ( according to SCOTUS case law) an otherwise reasonable expectation of privacy. Now the people in this video have that reasonable expectation requiring a warrant under most normal circumstances. The question is do these deputies actually have the exigent circumstance they are claiming? I think had they showed up with EMS or had EMS in rout or at all been answering a real medical emergency the answer would be yes. That however is not whats happening. If it had been a real exigent circumstance they would have yanked up both these people put them in cuffs and gone into the house and then cut them loose when the search was over. What they are doing is trying to talk their way into the house talking about exigent circumstance then they will turn around and call it a consent search. Key difference in a real exigent case police are forcing entry they are not going to sit around discussing it with you this is a ploy nothing more.

If they get a search warrant approved based in actuall evidence then so be it. There was no such warrant, only suspicion based in an accusation. How would you like it if I was your neighbour and I accused you of harboring a criminal because you just didn't maintain your yard as well as I thought you should. Would you allow the police into your house warrantless for some random accusation because of an angry neighbours tip. The law feeds on people like this. Our founding fathers placed a set of constitutional rights that the government cannot break to protect the proud citizens of the USA against a tyrannical government. If you are a United States citizen then you will uphold and protect those constitutional rights until death. If not, then get the fuck out.

Does her "medical emergency" constitute 'exigent circumstances'? If she's a grown-up travelling with the guy on her own freewill, that should not be grounds for them to just claim to absolutely need to go into whoever's house they fancy. The fact that no EMS came along or was supposed to reach any time soon proves that the police did not genuinely believe that entry was necessary to prevent physical harm to the lady on the grounds of some alleged medical emergency.

Exigent circumstances don't give them the right in that circumstance to enter the home. If it had, a second officer would be obtaining an emergency warrant from a judge who'd heard the evidence. It goes like this: By phone: Deputies: Your honor, we need a warrant for these reasons. Judge: Agrees or disagrees. If agrees: I'll have it ready for pickup in 5 minutes. Deputies: Officer so and so will pick it up in 5 minutes. In 5 minutes officer would be en route to the home while the other officer speaks to the homeowners/renters. How the conversation with the judge went: 1. They never called because they knew there was no evidence and it was a flimsly tip, without even a name of the girl. 2. They called because they could, like at the house, because they could, and the judge said NO. The woman is right. They used bully tactics and not the law to gain entry into their home.

The biggest clue that exigent circumstances did NOT exist is the fact the cops asked to enter the home. They were trying to get consent to search because they lacked the right to search. If exigent circumstances did exist they would have just pushed their way in. Whenever a cop ASKS for your permission it's because he NEEDS your permission.

Always begin to record when cops approach. Talk to the cops through the door or not at all. They are not your friends or protectors and only a fool trusts cops these days. The most dangerous moments of your life are when involved in a traffic stop or other encounter with cops, all with an armed cop there to "serve and protect" the system.

I had a couple cops claim a warrantless search on my parents house when I was in high school. They were looking for a friend of mine. My friend wasn't at my house. The two cops were fired . City had to pay a lot of money to my folks. One cop couldn't find a job after that. He committed suicide. The other has bounced around as a security guard the rest of his life.

They forced their way in when I answered the door. Absolutely no sign of my friend or drugs. I suspect the cop who committed suicide may actually felt guilty over what they did.

According to what I read about this case was based on an anonymous caller. If the Police can raid our homes based on an anonymous, evidence less, calls, we have no rights at all. These Cops should be fired and arrested for assault, kidnapping and breaking and entering. I find it incredible that you give these Cops any credibility. They could have gone to the home and requested cooperation. When the people refused, one Cop could have watched the house and the other cop got a warrant.

SolarReturn If the anonymous caller said the son was armed and dangerous would they have entered shooting? I saw a video where this happened. An anonymous call said the home owner was killing people and instead of checking out what was going on the homeowner opened his door to see what was going on outside and the Cops killed him. Totally unarmed. The door was well lit. The Cop said he felt he was in danger and shooting this innocent unarmed citizen, who didn’t have any idea what was going on, was the proper action to take. The Cops were all safe under cover and with bullet proof barricades. The Cop who killed the home owner was behind a shield on the side of the porch. He was never in any danger.

Yup. I had a bench warrant issued for my arrest at one point. They showed up at my house one day. Knocked for like 10 minutes, then just left. They knew I was there, but didn't actually see me, so they couldn't do jack without a warrant. Funniest part, after they left, I called the courthouse and got the whole thing dismissed without any fines or detainment

I'm still watching the video but that's not true.... even if you are illegally detained you can't break (other) laws. Best case when being illegally detained is to document the situation as best as you can, keep calm and don't do anything stupid. It's really easy to be infuriated by cops who are high on power, but starting a fight is he best way to get yourself legally in trouble.

you can see the fear in the eyes of the officer after the search. he knows he done goofed, and he knows that if these people make a case out of it both him and his partner is more than likely done in the force, so he tries to convince them that what he did was a minor thing in the grand scheme of things

I think a good retort to "it's just a minor intrusion" would be: "Fine. Give me YOUR address. I'll be there in 10 minutes with my best friend so we can search YOUR house and put YOUR spouse in handcuffs for 30 minutes. It's just a "minor" intrusion, right?"

If you ask someone a rude or personal question nicely it doesn’t change that it is rude to ask in the first place. “Officer would you mind if I placed my penis in your mouth please” See it’s still a rude question. So is asking an American to give up their right to privacy.
