The plaintiff hired the defendant to paint his house and gave him a deposit. Unfortunately, the defendant never showed up, so the plaintiff is suing for a refund. The defendant argues his truck was stolen, so he missed the day he was set to begin the job. The defendant had every intention of doing the job and explained the situation to the plaintiff.

im a professional painter and i never ask for a deposit , instead i tell people to go buy their own paint first at home depot or a paint store , and when im finished with the job then thats when i am paid . my advice to all of u is NEVER pay a deposit for labor or materials and buy the materials yourself or go with the person u hired and both of u go together to buy the materials .

If there was any doubt that the defendant was lying, I believe he cleared that at 5:14 when he said that he had the guy's file on his truck when it was stolen, which happened 3 days before taking his money.

Other than the defendant lying (and not very well at that) every step of the way, I'm trying to wrap my head around him having his truck stolen BEFORE he got into a contract with the plaintiff/taking the deposit then saying he couldn't contact the plaintiff because his contact info was in the stolen truck. Huh??? Plaintiff was smart - this totally would have turned into a nightmare job where he'd be chasing the defendant down to finish the job, to say nothing about what the quality of that job possibly would have been.

So to explain simply, the defendant said because his truck got stolen, he lost his files and couldn't contact the plaintiff because of that event. Now let's also take into account that his truck was stolen a week prior meeting the plaintiff. So how exactly could he lose a file he didn't get till a week later after his truck got stolen ? A miracle I guess, or simpler yet, the defendant is a con artist that got caught.

This is going to sound awful but I wouldn't hire anyone to work for me that is overweight. They move much slower than the average bear and could have health issues while on the job. It's not to say that a heavier person won't do a good job but I think it might take longer. I myself in later years (70), have put on a few extra pounds so I know that even I move much slower now. It's nothing against us heavier people, it's just a fact of life. This guy knew his truck was stolen the day it got stolen because his worker was injured and HE would have to make a police report. I don't believe the guy anymore than Marilyn did. But maybe if she would have let him explai FULLY the first time, she may have gotten her initial answer. She does interrupt people A LOT so their train of thought gets messed up.

The judge really needs to stop saying the word "right" when people are explaining their story. She says it in such a way as if she was there or without knowing the actual facts yet. For example, if someone says the guy walked up to me and punch me in the face and then push me on the ground, she'll respond with the word, right. Without even knowing if that's true or not.
