The plaintiff brought her car into the defendant’s shop for repairs after a car accident. However, the plaintiff says her car sat in the defendant’s shop in limbo. She got frustrated and wanted to bring her car elsewhere, but the defendant still won’t release the vehicle. The plaintiff is suing for car damages and pain and suffering. The defendant says the plaintiff retracted the insurance claim, so he doesn’t owe the plaintiff anything.

As someone who has worked for a major insurance company, which I will not name, and who has been in an accident the judge hit the nail on the head. I have had a repair shop inflate an estimate so that I would not have to pay the deductible and being 20 I didn't know what that was but when I was in my second accident I made the other insurance pay as their insured hit me from behind being on the phone. When I worked for an insurance company glass companies, repair companies etc would say "hey you throw us business we'll throw you business", and for that guy to start working on that car without getting an approval from the adjuster and the amount and then say he's going to use aftermarket parts make it cheaper. That is something that they do. He was completely in the wrong.

Totally agree with the judge. I was an auto claim adjuster for 31 years, now retired. My particular area handled 14 states. We ran into 2 shops like this one. One in Portland OR and one in PA. Never chose shop recommended by tow drivers, especially they have shop’s business cards. Don’t choose shop where they waive your deductible. I know it’s good you don’t have to pay but shop has to make up the difference somehow. These shops don’t have your best interest at heart.

Geico is the worst insurance company to deal with, my truck was hit by someone that had Geico and they were trying to say my truck was totaled. A broken leaf spring, wheel cap and a dent in the bottom corner of the cab is not a total truck. They actually already submitted claim to total the truck before even speaking to me, first mistake. Then adjuster said frame was bent with out even inspecting it, second mistake, it wasn’t ! I came down to the repair shop and told them give me my truck and drove away.They told me I could buy the truck back and I said why would I do that , I already own it. Went to a friends shop made and estimate of damage and made them pay it , and it was more than what they wanted to give me for the totaled price they offered originally but because I had adjuster over a barrel because she jumped the gun thinking they were going to bully me into accepting their pay out. If you get hit by someone with Geico never let them take it to a Geico repair shop !

My auto shop has a sign that warns customers about "burying the deductible." It says insurance companies use the same estimation software so they will probably know and if your repair shop does this they most likely are giving you aftermarket or used parts to make up the difference. They posted this warning because they are an honest shop and were losing business to other shops that would "help" the customer burying the deductible.

Years ago when i was a new driver someone hit my car and i took it to the shop their insurance advised me to go to. I needed something that i had left in my car days after I dropped it off and it was wayyyyy more damage to the car than when i’d left it My side mirror was ripped off my windshield cracked. and some other stuff…. it freaked me out so bad i told them i didn’t want me car there any longer and they ended up having to pay for the damages they did

As a GEICO customer who's had an accident that they paid for, I can say that they won't pay for after market parts. I have an older Jeep Wrangler that was rear-ended, then broadsided by another vehicle. That day, over 200 accidents happened in a few hours after a freak daytime snow storm. My Jeep was in the repair shop for 6 weeks because they had to wait for the Jeep parts to ship during the holiday season. Ugh! Those after market parts are the problem, which is now *his* problem. And GEICO won't pay if they're faulty. I wish her good luck.

If he won't release the lien, she can probably take this judgment to whatever the place is and be like "I literally have a court order for him to release that lien and he refuses to abide by it."

I feel a little worried on denying the insurance part of her lawsuit, If she were on a month to month plan I understand suspending it. However, most companies allow you to also pay 6 months at a time or a year at a time. You can't just suspend that 6 month to a year payment. Would she then be able to collect that insurance if she was out for one whole month unable to suspend because she was smart and paid ahead of time?

100% agree. Another reason as to why she couldn't suspend her insurance is that some states will actually suspend your car's registration and prevent you from re-registering the car if you have a registered car that doesn't carry insurance.

I’ve been in two accidents while I’ve had progressive and never experienced any of the sort.. and they handled everything I never had any side conversations with the collision shop..this is ghetto lol I also only use a shop the insurance recommends because there’s a warranty on the work for as long as I own the vehicle
