A Colorado paramedic was sentenced to five years in prison for the death of Elijah McClain. Peter Cichuniec and a fellow paramedic were convicted in December of criminally negligent homicide for injecting McClain with ketamine, a powerful sedative ultimately blamed for his death. #elijahmcclain #usa #colorado

What the 5 year sentence tells you is that the state did not prove its case against the paramedic. This was a verdict made for political reasons. Failure to provide reasonable standard of care would have been a longer sentence than 5 years.

Surprisingly, it is part of their protocol, look further up the chain to find who implemented administration of ketamine to a patient in the field in these instances, combative, or emotionally distributed patients.

"Chronic abuse of amphetamines results in depletion of body stores of catecholamines, which may be manifested as anxiety, somnolence, or a psychotic state." "Ketamine relies on a secondary sympathomimetic effect for its cardiovascular stability, cardiovascular and hemodynamic compromise may occur in patients who are catecholamine depleted." It may also exacerbate underlying cardiac disease. McClain was behaving oddly when he encountered LE, wearing a ski mask in August and completely ignoring police when they tried to speak with him. When they touched him, he flipped out and became combative. He had been treated in a hospital in the past for "excited delirium" and had a history of using drugs. Paramedics have to make rapid decisions based on limited information. This paramedic should have never been sentenced to prison. How did he get 5 years for negligent homicide? 2nd degree assault??? Ketamine is the drug of choice for excited delirium. 3 years of probation after release...treating him like some kind of career criminal. This verdict was politically motivated and disgraceful. As for McClain's family, their court exit explains everything.

1) He was behaving oddly because he was autistic 2) the indictment written by the grand jury says: “Mr. McClain was a normal healthy 23-year-old man prior to encountering law enforcement and medical response personnel” which is completely contradictory to your lies about his medical history 3) you have no idea what these people have gone through, and so you could not possibly understand what the symbolic gesture of raising your fist in the air as you leave the courtroom could possibly mean. You will never, ever know.

...as someone previously in this field...I agree. Though I haven't followed this case and don't know the full specifics, and I don't know what the motive for verdict was, but the outcome seems excessive. I completely understand a grieving family wanting/needing to place blame, but a conviction of this sort when the convicted "appears" to have followed protocol is unwarranted. Don't get me wrong the law regarding medical negligence and malpractice is specific and definitely there for a reason (which anyone practicing must abide) but, usually requires exhaustive evidence to prove such. So, maybe something was admissible that was not shown publicly allowing for this ruling, otherwise this seems like scapegoating blame. I will say though, you are not typically allowed to administer more than the therapeutic dose without authorization, so if that was done and not authorized, I understand the anger, but on the other hand if they didn't administer enough there would also be anger and possible death. Warranted or not... soon no one will want to help anyone for fear of legal retaliation. I say that as someone who has had a death in the family likely due to negligence. There is so much to be considered when providing care and some of the most detrimental care requires immediate action, and so more needs to be considered regarding the outcome (like the intentions of the provider for instance) was it malice or neglect, and if protocol states one thing (but allows for a range) and it is given. But, if you just decide to give over that dose for no reason, I get the anger. I definitely get the frustration, now I'm going to go read as much as possible on this case to make a more informed decision.

I just want to know why does the paramedic have ketamine in the first place. If a paramedic can't administrate that and it's in their bag we have huge problem here and he's just being the fall guy for a massive failure going way above his head. This is ridiculous seriously. They can provide narcotics for pain but they can't administrate ketamine. Think about it's beyond ridiculous. If he wasn't supposed to have that in his bag or on that ambulance or on a helicopter then okay he's guilty. If that's there as a general supply then he's getting shafted because doctors don't ride on ambulances, that's the entire point of an EMT/paramedic.

There was no reason to involve the paramedics because there is no reason to sedate people who are not injured, severely so in the case of ketamine. So what if they aren't calm? That's what more flex cuffs are for. In future paramedics should not get involved in arrests.

Elijah was already dead on the ground when the paramedics showed up ...The original video show's this .. he wasn't moving at all: .. The cop's called the paramedic's ...they arrive and he's still not moving a muscle and they injected him- already dead!: .. And all taken care of !!! They all have each other in their back pocket's .. even the coroner/ crime-forensic etc. He'll have a little vacation (All their people who run the prison/ jailhouse will look out for him!) ...and he'll probably get out early !

I used to live right by that kid and spoke to him several time's ! ...That was nothing short of his being pre-meditated / pre-fabricated picked out he and his family: .. The cop's went overboard ...oooop's ... and brought in the paramedic's... ... .. who should have known better as well: The kid wasn't moving a muscle as he lay there !!! Of course they all had their little talk with each other before that happened ! You could see that (other's and probably commanding officer's) in the video of them standing in the background. - I haven't seen the video for a spell now ... I'd collected it/ saved it with a bunch of files. I have people holding a lot of file's for me per my larceny case etc. I'd even contacted a bunch of those same attorneys/ law firm's the McLain's did: Interestingly enough: They blew me off like no tomorrow !!! Isn't that something !!! Yep !

It's used for extreme pain management. I was given that in the ER a few years ago. But at my last visit they would only use morphine (which is not as effective as ketamine).

I know that what happened to Mr. McClain was so, so painful for his family and friends. My heart truly does go out to them. But their raised fists walking out of court tells me that they have no idea what they were fighting for or against. All they care about is that ELIJAH died. They don't care a single whit that what just happened here was a Pyrrhic victory that will cost many more people their lives. No... Like most Americans, it's all about THEM and THEIRS. I hope the power they felt in raising those fists was worth it.

And frightened. Elijah had neurological issues, and was assaulted because when they grabbed him his muscles tensed. Body cam showed it all, but that sweet young man lost his life for being nervous and dark skinned.

Sounds like a lot of you don't get what taking accountability is. Get the facts about the case. Elijah was telling them about the issues he had and they gave him ketamine, please. You don't get it. A young man died, get off the political BS. The cops should have gotten theirs too. He was a young black man walking and of course cops thought he looked suspicious and didn't listen to him. The paramedics were negligent. People always making excuses when a young black man dies. Accountability is required and doesn't happen enough esp. when young black men die at the hands of cops.
