Japan is interesting in the sense that it had the brief Taisho democracy in the early 20th century which was oddly liberal, but then slid into a more authoritarian state as the military took more and more power in the government.

Japan had the Zaibatsu(mafia) in power and they actually protected the country in secret, just after the US occupation dissolved the fascist government. The problem with translation and culture differences allowed them to do that. They have governed Japan behind the curtains until Japan was targeted by the WEF/IMF in the 90's, because their industry success was threatening US hegemony on the global market. So they interfered with a Japanese Central Bank that ravaged the country's economy. It is all in a book, Princes of the Yen. There is also a documentary. "The French Revolution seems admirable to those who know it poorly, terrible to those who know it better, grotesque to those who know it well." - Nicolas G. Davila The French Revolution is the first great lie of the modern world; is the mother of all lies... then the Russian revolution would come, now the sexual/feminist revolution, and all with the same common element: under the supposed defense of human rights, the greatest persecution of natural reason, the most elementary logic, common sense, and the only possible freedom, freedom based on truth and natural law. LIBERALISM IS A SIN Dr. Don Felix Sarda Y Salvany Liberalism is the root of heresy, the tree of evil in whose branches all the harpies of infidelity find ample shelter; it is today the evil of all evils. (Ch. 4). "The theater, literature, public and private morals are all saturated with obscenity and impurity. The result is inevitable; a corrupt generation necessarily begets a revolutionary generation. Liberalism is the program of naturalism. Free-thought begets free morals, or immorality. Restraint is thrown off and a free rein given to the passions. Whoever thinks what he pleases will do what he pleases. Liberalism in the intellectual order is license in the moral order. Disorder in the intellect begets disorder in the heart, and vice-versa. Thus does Liberalism propagate immorality, and immorality Liberalism." (Ch. 26). Liberalism "is, therefore, the radical and universal denial of all divine truth and Christian dogma, the primal type of all heresy, and the supreme rebellion against the authority of God and His Church. As with Lucifer, its maxim is, 'I will not serve.'" (Ch. 3). "Liberalism, whether in the doctrinal or practical order, is a sin. In the doctrinal order, it is heresy, and consequently a mortal sin against faith. In the practical order, it is a sin against the commandments of God and of the Church, for it virtually transgresses all commandments. To be more precise: in the doctrinal order, Liberalism strikes at the very foundations of faith; it is heresy radical and universal, because within it are comprehended all heresies. In the practical order it is a radical and universal infraction of the divine law, since it sanctions and authorizes all infractions of that law." (Ch. 3). "It is clear that the main tenet of socialism, community of goods, must be utterly rejected, since it only injures those whom it would seem meant to benefit, is directly contrary to the natural rights of mankind, and would introduce confusion and disorder into the commonweal. The first and most fundamental principle, therefore, if one would undertake to alleviate the condition of the masses, must be the inviolability of private property." Pope Leo XIII “Remember, democracy never lasts long. It soon wastes, exhausts, and murders itself. There never was a democracy yet that did not commit suicide.” - John Adams

I think you are mistaken in regards to fascism in Italy, but it was difficult not to. There is indeed a 12th provision to the Constitution (dodicesima disposizione transitoria e finale), approved in 1948, which prohibits the reforming of the fascist party, but that is notoriously a very formalistic prohibition. It is also widely known that the old fascist party was actually reformed (though with some adjustments) less than a decade after the end of WW2, it was called the Movimento Sociale Italiano (MSI). It remained a real parliamentary force up until the end of the first Republic in 1992. I find your argument for Italy is very weak, though you should have been an italian, or an expert, to avoid the error. Nonetheless, once one deepens its knowledge of comparative public law, it is not difficult to find that Italy is probably one of the most democratic systems in the world, to its own demise in my opinion, but generally political pluralism in Italy is outstanding compared to other western countries. For Japan your conclusions are right but the premises are wrong: the lack of democracy is not related to the "imposed" Constitution, but because of the oligopolistic economics at the core of their society.

Apart from the point, that you're criticizing the G7 calling themselves "liberal democracies" based solely on the historical origins of the political system in these three countries, ignoring changes since then (other people have already pointed out how Japan has expanded its military again in the face of Chinese ascendancy), you're also ignoring quite a bunch of historical facts to paint your picture. Denazification wasn't a brainwashing and it was, in fact, carried out quite lax in some areas, with multiple cases of people involved with the NSDAP being cleared and carrying on with a nationalist ideology. And the Prime Minister of Italy is Giorgia Meloni from the Fratelli d'Italia, a party which is widely classified as "postfascist" and pushes many rightwing viewpoints, so it's not like these positions are outlawed that strictly. Granted, she got elected after you posted the video, but Italy had right-leaning parties and governments before. While it is true that approval of the Fascist regimes in Germany and Italy was high at times of the Great Depression, both of them didn't just have their political system forced upon them. In both countries Italian/German nationals were involved in the process of rebuilding the country. While not outrightly saying so, you also make it sound like Germany and Italy were attacked by the Allies, ignoring the fact that Nazi Germany started the war and brought it to their neighbors first. And you conveniently left out any mention of the Holocaust - there you have one of the reasons why National Socialsm was evil. Lastly, you're ignoring the fact that the Fascist governments outlawed any opposition themselves, persecuting democratic politicians. Thereby I - and most other people - find it totally valid to outlaw the Fascist parties and groups, to prevent such a dictatorship taking over again. No tolerance for those who are intolerant themselve. Governments aren't afraid that fascist movements will catch on because they have all the right answers - they are afraid that fascist movements will abuse freedoms granted by democracy and promise the people some easy solutions or scapegoats to get to power, to then abolish any possibility of getting them out of power.

" Thereby I - and most other people - find it totally valid to outlaw the Fascist parties and groups, to prevent such a dictatorship taking over again." The problem is a fascist government, can rise to power by calling their opponents fascists and the outlawing them, that is what the Soviets did, that is also what Putin did, he called the Ukrainians Nazis and he used that pretext to invade Ukraine, because as he said he was just fighting Nazis, so he was making a preemptive strike on Ukraine before they decided to do another "Operation Barbarossa" and invade Russia to make the Fourth Reich, or so Putin claimed! Putin is a fascist, he demonstrated that with his behavior. The only way to really tell if someone is a fascist it to allow him to rise to a position of power and then see what he does with it. To arbitrarily decide that someone else is a fascist and not allow him to run for political office because of that is very subjective. It's not helpful in fighting real fascism when people call someone like Trump a fascist, that just divides the alliance. Trump has been president of the United States, and he didn't do fascist things, he didn't try to stay in power illegally, he did step down and he let Biden become president, so he passed the test, and he is not a fascist, but Joe Biden is acting like a soft fascist by doing a bunch of things to prevent Trump from becoming president again, such as lawfare and calling him a fascist and maybe encouraging someone to try and assassinate him!

1 INTRO. The purpose of this Video is to outline How to FIX Fake and Broken so-called Democracies.. There you go. Not a big ask really ! ! ………..As the saying goes, necessity is the mother of invention. Well, If that were REALLY true, then the ancient Egyptians would have invented the bulldozer….. Not quite, but You get the idea. In reality, DISSATISFACTION is the mother of invention, but you need to be SUFFICIENTLY dissatisfied before you actually get up off your backside, pull your finger out and actually DO SOMETHING…………….. Well, I AM INDEED SUFFICIENTLY DISSATISFIED- and so are many others -, with the blindingly obvious failures of so-called Liberal Democracies right across the world. It’s simply not working out quite as well as we thought it would - and were TAUGHT it would !!!! BUT DONT LOSE HEART , …I HAVE AN UNEXPECTED SOLUTION FOR YOU…….. I HOPE THIS VIDEO GIVES YOU FOOD FOR THOUGHT……and positive action later on too… 2 BACKGROUND . Ahhhhh. Democracy…. Don’t you just love it ? Actually I have only PROPERLY studied it, or had time to REALLY think about it, since I retired - and not before. Before i retired, my mind and focus was having to earn a buck for the family, the mortgage and to keep my job and career going, preferably upwards. …………………As an adult, I have LIVED in so-called Democratic countries like the UK for about 8 years, Australia about 8 years, and NZ about 30+ years Do the maths, I’m getting on ! ………Now Despite these countries being very different in many ways, One of the things they have in common is LABELLING their political systems with the captivating title of “liberal democracy”……. Well, We all love “liberal”, for it means that we are a reasonable people, fair minded, progressive and not oppressed. Brilliant, what’s not to like, I’ll have of 2 them thank you very much !……… The word Democracy however is a Chameleon word that’s a little like Humpty Dumpty…. Remember ? He is famous for saying “when I use a word, it means just what I choose it to mean - neither more nor less”…… this brilliant principle of fluid meaning is so easily employed by all Liberal Democracies around the planet. We are subjected to and bombarded by ideology brainwashing almost daily, that Up is Down, Wrong is Right and He is She………….You can work it out, without any examples from me…… 3 MY OBSERVATIONS. . I have seen constant conflict in the political realm of all the countries. Not just a clash of opinions but loathsome disrespect, disparagement, personal attacks and conflict. And most damning of all, a failure to deliver what the people actually want and need, ABLY SUPPORTED BY A COMPLETE DISINTEREST IN WHAT THEY WANT OR NEED IN THE FIRST PLACE ………………Now Compare this behaviour AND RESULTS with the average successful Company……How many companies actually ALLOW conflict within their own ranks…. Disagreement and discussions to find the best path, sure , but conflict ? NO WAY, you’d be out the door pretty darn quick if you took that line. . SUCCESSFUL companies require and instill COOPERATION amongst their workforce to yield the best results. Observable reality. A House Divided against itself cannot not stand. Blah blah. Ring any bells ? 4 CONCLUSIONS. My conclusions from observing RESULTS over the last 50 years in many countries is that we ALL have the WRONG FORM of Governance THAT OFTEN attract the wrong sort of person and CONSISTENTLY FAIL THEIR PEOPLE, with some occasional “wins” usually by luck rather than by deliberate navigation. 5 PROBLEM STATEMENT Time now for MY definition of that Chameleon word… DEMOCRACY….. and this is it….”A land where the government DOES, what the people WANT and NEED”. Simple. ……………..Bottom line is, we do NOT live in such a land , we do NOT really have democracies, nothing Like it. We have Fake democracies. VOTING is merely a DIVERSION but nonetheless a THEORETICAL way of selecting the best people to IMPLEMENT the WILL of the people. However if you think that VOTING IS Democracy, then these countries have some of the best democracies money can buy….. cos they VOTE a lot…… and you have been well and truly conned No question……….. HOWEVER , I judge from RESULTS, not ideologies, and I see in these countries RESULTS VERY DIFFERENT FROM WHAT THE PEOPLE WANT AND NEED……………….. IPSO FACTO, none of us have democracies……………………. The political systems we have (No matter their titles of “Liberal Democracies”). are 1) Ineffective. We DONT get what we want and need. 2) Socially Divisive, Politicians spend all their time rubbishing the other lot creating antagonism and distaste for both politics and for the other lot, whoever they are. Often the people are inculcated to attack the “others” who do NOT share their views…… . 3) Inefficient. We pay for all the MPs, and most of the time, most of them are NOT employed making things better for us. They are Employed for bringing down the government. Almost treasonous one could say. ……….. 6 ROOT CAUSES. First , The principles that govern my thinking are Logic and a complete rejection of ANY dogma or ideology. I am NOT the slightest bit “tribal. I have never blindly supported a party, or a celebrity , or a football club, or a nation, or a SYSTEM. The core STRUCTURAL failure of these so called democracies, is that they ALL believe in a specific fallacy with an almost religious fervour. And irrespective of the RESULTS of that political system ( that SCREAM at them in their faces ) their BELIEF still holds fast……………. Now this is their belief , and it’s probably yours too, since we have all been indoctrinated since birth - BTW I USED to believe this fallacy before I retired and REALLY had time to think…….. their Belief is this……that COMPETITION always yields the best results, whatever the undertaking, whether its Government, commerce, public services, or politics, healthcare , everything. Competition is God, competition is the name of the game, and the only game in town.……………..And whilst this INITIALLY appears to be true, certainly in the short term, it’s LONG term SUSTAINABILITY has already proved to be zero. THAT’s why nearly ALL Liberal Democracies are in turmoil. Very few exceptions COMPETITIVE systems clearly have a SHELF LIFE. And we are now at the end of that shelf life. Just Ponder the reality of the RESULTS in ALL of these and many more liberal-democracy countries. 7 SOLUTION. THE SOLUTION IS FIRST TO RECOGNISE THAT BLIND ALLEGIANCE TO IDEOLOGY HAS NOT DELIVERED YEAR ON YEAR IMPROVEMENTS TO THE LIVES OF ORDINARY PEOPLE. ………SO….1st We adopt the spirit of cooperation , not competition . 2nd We establish a list of everyone’s visions for the country, yes millions of them…... a description of how they want life to be in the future. Areas where we ALL have visions for a better life would include Safety, Employment, Taxation, Defence, Housing, Education, Corruption, etc ect. With technology and AI these days , THIS IS AN EASY JOB ………. This will paint a picture of the promised land as it were, The place where the people want to be………….. Personally, I’d like the streets to be safe for everyone, eg no knife crime, and for my daughters to be able to walk down the street at 2 am, FEEL SAFE and BE safe. You know , like they can in Singapore Tokyo and Beijing…….. 3rd This “Register” of visions will be used BY Parliament (note , every MP from each party) to craft appropriate policies and methods for ACHIEVING those visions. . ALL PARTIES WORK TOGETHER to enable the delivery of the peoples’ visions. All Simple………, except for the attitudinal shift right up front. 8 THREATS. Anyone and everyone who currently GAINS from the existing political establishment. Gain may be financial or influential, or BOTH !. They may be in government in its many arms - eg parliamentary, judiciary, civil service etc OR in private enterprise corporates.

About Italy: comparing italian 1925 economy with italy 2014 economy, witch was a general period of recession, isn't fair. @@davidegiaretta2843 BS. 1) Italy (and every western country) is a liberal-democracy, not just a democracy. That's a very important difference because you have the liberalism factor. For example in a pure democracy you don't have the division of power, while in a liberal democracy yes, because it is required by liberalism. Same goes for the defence against authoritarianism, in a liberal democracy you have Popper's tolerance paradox, so you must, by definition, stand up and stop intollerants (aka fascists). 2) If a 100% fascist party where to rise you could never vote it off, lmao, that's the whole point of fascism ideology: government by control of the masses through tradition and violent persecution of the opposition. 3) Fascism isn't actually banned. You can be fascist and declare yourself as such. You can also create parties with some pretty clear references to it. You have just some minor bans, like not putting "fascist" in the name of your party and not using "fascist means", aka violence and repression. In fact, today's governing party in Italy is a direct successor (like a grandson basically) of the original fascist party. Before writing (and before watching stupid videos like this one you should study history and political philosophy.

A true democracy should technically have the right to vote itself out of existence. Due to this dilemma I can understand why it is important that the system ban certain ideologies in order to protect itself and others. Hate speech and racism are exceptions to freedom of speech and rightfully so. To me it is reasonable to make exceptions to rules. The law is not absolute and must be handled with common sense.

Actually the German denazification in western Germany was nothing more than a superficial beauty treatment. in fact there were still some nazis in high positions after world war 2. In the East, on the other hand, the whole evil Nazi theme was approached somewhat differently. On the one hand it was a lot more thorough and on the other hand the poor people in the east were simply relieved of all the blame by saying "the rich capitalists were the nazis and forced the ordinary citizens to do these bad things". The basis for the ban on NSDAP-like parties is that these parties are anti-democratic. They openly pursue the goal of decomposing democracy and, above all, of oppressing or even "abolishing" other groups of people (in whatever form). The whole basic structure of such parties is based on the radical views of the party that once killed millions of people in Germany in an industrial system. In addition, right-wing ideas are generally not forbidden in Germany. The AFD, for example, is a major force in the Bundestag (on a vote/seats basis), unfortunately the German right-wing is just populists and unable to do proper parliamentary work. 12:00 The reason for the popularity of right-wing/populist parties is always the same, namely falling living standards or the current crisis. There is a problem and with the help of populimus some suddenly have very simple solutions to it, be it the foreigner, the Jew or the communist. This principle can be applied everywhere and always in crises. Just like in 1920-33, the Nazis were only able to win so many voters through the economic crisis and their populism (more precisely, the answer to the current problems was either "Hitler", "THE JEWS!" or "away with the SPD"). In 2015, the AFD made a good leap in the polls and their election results with their "Foreigners out" campaign. apparently, then as now, not many have considered the actual goals of these parties. Because then you would know, for example, that the AFD and with their "we are the people" mentality don't really care about the common man, but rather want to protect the assets of the rich and large landowners. To be more precise, Germany was a democracy even before the Nazis. However, this was not very mature and in the end got in its own way, after all this state collapsed under the legacy of World War I. This democracy or the "Weimar Republic" was the form of government chosen by the people after the end of the German Empire and World War I. In addition, the NSDAP and its ideology was not the form of government chosen by the people because they only achieved 43.9% in their last election. Due to the incompetence of another guy, Adolf Hitler took over sole power and set up an anti-democratic state that was brought into line. In this state everyone was oppressed who threatened the "order" and or was "different".
@paolobarontini799 Жыл бұрын
Pardon me, but the part about Italy is completely off. First of all, by 1942, following defeats after defeats in War Wolrd Two, the Fascicsts had got very unpopular, so much so that the King dismissed Mussolini from the position of Prime Minister, in favour of General Pietro Badoglio. Badoglio, seeing the difficult situation in Italy (Sicily had just been invaded), decided to sign an armistice with the Allied powers. However, Germany invaded the country, creating a puppet government in the north. Thus, the Italian partisans took arms against the nazi-fascists, and they ALONE were able to liberate Genoa and many northern parts of the country. It was in this context that the provisional administration of Northern Italy decided to kill Mussolini and his closest advisors. After this, tho, the Communist provisional Minister of Internal Affairs declared a general amnesty, so that no "Italian Norimberga" was ever held. Thus, many prominent fascist personalities were allowed to continue political activities: they established the Italian Social Movement, an explicitely neofascist party, which was represented in the Italian Parliament continously from 1948 to 1994 and even entered in the First Berlusconi Government. You could even argue that Fratelli d'Italia, the current ruling party, still has several ties with Fascism, and many important personalities inside it are still widely considered Fascists, such as Ignazio La Russa, the Italian President of the Senate.

This is an interesting, yet very one dimensional perspective, that prompts viewers to think about the state of democracy after giving them information only fitting Pax's POV. A Point he brought multiple times now is that democracy "defending" itself, through banning parties that want to abolish democracy, is non-democratic. And while it is true, that it goes against the fundamental Idea of democracy (giving the power to decide to the people), on the other hand that is because a democratic state is still a state. Democracy is a form of distributing authority in a state, wich means it is an Idea layered on top of the Idea of forming states. In a state people trade some amount of freedom for some amount of security, in the democratic way that security is also a security against losing the power to vote even if it restricts that power, by eliminating certain parties. In my way of looking at it, it is just another tradeof between freedom and security, where both are actually of a higher degree, than in an autocracy, where your security and freedom depend on the whim of a small group of people, even though you already traded some freedom for security, that security is more of a pretense to take more and more freedom, wich clearly makes countries like china/russia less democratic and less free. That being said there is differences in democracies and they have their own problems, namely global conglomerates and lobbyism (in my opinion), wich makes certain democracies more democratic. I think there is no such thing as a perfect democracy and striving for one while calling everything else a hoax is foolish. So calling them "fake democracies" is not accurate and puts them on one level with authocraties. p.s. communism and democracy can (at least theoretically) work together perfectly fine, in fact they are complimentary, so forbidding communist parties doesn't really make sense.
@leonardorighele3415 Жыл бұрын
I live in Italy so i will talk about that. First we entered in a civil war for our own, yes we have been helped but we weren't occupied. And after the end of the war we have done a national referendum where the people expressed the desire to abolish the monarchy. Second the italian costitution was written by all the party of the time, even the communist one (obvusly not the fascist one), so it's one of the most "inclusive" costitutione. Third fascism has been banned because the people have seen and suffered and hated it, and aslo fascist is an ideology that wants to abolish democracy and makes that one of his principle, communist on the other hand in theory doesn't do that, so it isn't like fascist, the dualism of fascism and communism was a theory created in the 80's by some historians but now we know it's a wrong theory, communist is not the same thing as fascist, and doesn't aim to abolish democracy as fascism do, and that's why we banned it. At the end i want to say that democracy in many country is not perfect (not even close to that) but you can't compare an autocracy like the russian one where you don't effectivly have freedom of speech and many other rights are precluded with Italy, where simply you can't create a fascist party (by the way this doesn't stop anyone from speaking about it or saying that was good, it doesn't stop freedom of specch, also there are political parties openly insipired by fascism that are legal).

Does free speech include me being able to say „I think 9/11 was good“ in an American airport without being put on a no-fly list? You‘d probably say no, so how is it different when i do nazi related things like a hitler salute in Germany, where it is also banned because it‘s such a problematic historic event. Wasn’t it also that being a communist could get you arrested in America once? How is that different from Germany? Things differ from country to country, but mocking/supporting dead people and tragic events directly tied to the history of the country you‘re in shouldn‘t be allowed in any case! Also „free speech“ isn‘t tied to democracy. Democracy means that the government is elected by the people, nothing more. Calling something a „fake democracy“ because they can‘t say specific stuff is just plain wrong. Also If you were the Allies, wouldn‘t you also denazify the state that directly caused the deaths of more than 40 million people? What was the alternative? Do a treaty of Versailles 2.0, have the people become angry, they elect an extremist government and then 80 million people die die to another war? Also when talking about Germaniens populous being brainwashed into thinking nazis were bad, going back to the 9/11 example, you could say „oh, America was brainwashed to think that 9/11 was bad, even though they could be of another opinion“, like what is your point? A jumpstart so that an objectively evil ideologie wouldn‘t return and cause more deaths is a bad thing now? Also, if like you say Germany was „brainwashed so hard that they can‘t elect what they want and America and Britain and France are so evil etc…“ it was a pretty bad brainwash, since the newer generations are leaning towards the right again, which is a trend all over Europe tbh., but atleast we‘re working INDEPENDENTLY (since that’s so important for you) on banning that party

We could say the same thing with anarchist and communist groups though
@MaxStirner123 Жыл бұрын
This is simply false, there are numerous socialist and communist parties at the head or in any case part of governments: Chile, France, Japan, Italy, etc. As an Italian, I can assure you that the historic (post-Togliatti) Italian communist party was absolutely democratic as far as it tried to build a socialist society (something on which one can agree or not), then anarchists by their nature can only be democratic although the means of some of them are not (anarchist terrorism). The only 3 cases of anarchist states in history had a very short life and were always in conflict : Paris Commune, Ukrainian Free State and FAI CTN during the Spanish Civil War
@joelmedina9606 Жыл бұрын
@@MaxStirner123 In the comment I was trying to defend the illegalisation of fascist movements such as national-socialism. Notwithstanding, I also think anarchism is very dangerous to a democratic system since it wants to desmantle any form of state (even though some want to organise into little communities like anarcho-socialists) usually by means of violence. I think in the moment of its apparition in the second half of XIX century we can be very comprehensive and understand it because there were very unequal societies and the effects of the industrialisation on the proletarian class were very negative but at the present I don't think it makes sense to continue defending the anarchist ideas which would lead to the dissapearance of the welfare state from for example Spain, where I'm from. On the other hand, regarding communist I agree that communist parties should have the possibility to be represented on a democratic system only if they refuse the idea of establishing a dictatorship of the proletariat or defending stalinist ideology (a criminal and repressive regime). Nevertheless, it's true that there are many examples of communist parties iintegrated in democratic systems and engaged in achieving social and worker reforms in order to improve the life quality of many. The French Communist Party or the Communist Party of Spain are living examples of democratic communist parties which I respect a lot (even though I'm more in favour of social-democrat mesures like the ones PSOE is launching in Spain). However, in the final part of my comment where I defend the prohibition of communist parties I wanted to refer the ones who don't adapt to a free parlamentary system. These are usually the communist parties outside Europe, which are way more radical, revolutionary and with autoritarian ideology like many in Asia, Africa or even America. In my opionion if they want to establish a hard-line communist rule, they should be banned.

written by another German above Hi, I've actually studied law in Germany (I'm currently working on my PhD thesis) and I wanted to provide a bit of background information and legal context to the aspect you mentioned after 10:42. You see, the laws regarding the legality or illegality of spreading national socialist propaganda (namely § 86 IV Nr. 4 StGB and § 130 StGB) are a hotly debated topic among legal scholars in Germany. My then professor for constitutional law, Michael Sachs, belonged (he sadly died recently) to those that deem those laws strictly unconstitutional, precisely with the argument you present in this video, and I agree with him. Let's start in the beginning. (In English: "(1) Everyone has the right to express and disseminate his or her opinion in word, writing, and image freely and to educate oneself unhindered from generally accessible sources. Press freedom and the freedom of reporting through broadcasting and film are guaranteed. Censorship does not take place.") This, of course, guarantees freedom of speech and freedom of expression. If Art. 5 GG only had this content, there could be no debate about whether the aforementioned laws are unconstitutional - they would obviously be. However, Art. 5 also contains a section 2: "(2) Diese Rechte finden ihre Schranken in den Vorschriften der allgemeinen Gesetze, den gesetzlichen Bestimmungen zum Schutze der Jugend und in dem Recht der persönlichen Ehre." (In English: "(2) These rights are subject to the provisions of general laws, statutory provisions for the protection of youth, and the right of personal honor.") And for the last 70 years, German legal scholars have been debating what exactly constitutes an "allgemeines Gesetz" (general law). For many, many years, the leading opinion on that has been that only a law can be an "allgemeines Gesetz" that isn't targeted at one specific political (or non-political, for that matter) group, but applies to all opinions equally. A good example of this would be that insulting other people is illegal - it doesn't matter who insults whom with what insult, it's equally illegal in any case; so making it illegal is justified under Art. 5 II GG. By that logic, § 86 I Nr. 4 StGB would be unconstitutional, and many scholars actually hold that opinion. Others have always argued that Art. 5 II GG only means law that is not meant to attack freedom of speech itself (whatever that is supposed to mean), with some further mental gymnastics to argue that those laws are not unconstitutional. However, the Bundesverfassungsgericht (federal constitutional court), the highest authority in terms of constitutional law, takes a very weird and very different approach towards this problem. There has been a ruling in 2009, the "Wunsiedel-Beschluss" ("Wunsiedel-Ruling", Wunsiedel is a small town in Germany) that serves as a landmark case for this whole issue. This case actually doesn't deal with § 86 I Nr. 4 StGB, but with § 130 IV StGB, which states: "(4) Mit Freiheitsstrafe bis zu drei Jahren oder mit Geldstrafe wird bestraft, wer öffentlich oder in einer Versammlung den öffentlichen Frieden in einer die Würde der Opfer verletzenden Weise dadurch stört, dass er die nationalsozialistische Gewalt- und Willkürherrschaft billigt, verherrlicht oder rechtfertigt." ("A person who disturbs public peace in a way that violates the dignity of victims, either publicly or in a gathering, by approving, glorifying, or justifying the National Socialist violent and arbitrary rule, will be punished with imprisonment up to three years or with a fine.") The debate is of course the same for both norms. What had happened in this specific case was as follows: Some Neo-Nazis had called for a "Rudolf Hess Memorial March" in the town of Wunsiedel. They wanted to commemorate Rudolf Hess, Hitler's long-term number 2, who had spent decades in Spandau prison after the war and had refused to abandon his previous convictions. The city prohibited this, as it would violate § 130 IV StGB (German Penal Code). Consequently, the Neo-Nazis filed a lawsuit against this, arguing that it violated their freedom of speech. The Federal Constitutional Court took a completely new line on this issue in the Wunsiedel ruling. I've taken the liberty of translating a few interesting sections into English: *[Note: At the beginning, the court summarizes the case itself.] The complainant repeatedly registered an open-air event in the city of Wunsiedel with the theme "Commemorating Rudolf Hess" in advance until the year 2010, including for August 20, 2005. Rudolf Hess's grave is located there. That year, the planned event was additionally to bear the motto "His honor meant more to him than freedom." With a notice dated June 29, 2005, the district office prohibited the event and any form of substitute events both in open air and in enclosed spaces within the city limits of Wunsiedel. Applications for interim legal protection were unsuccessful at all levels. The complainant filed a lawsuit against the notice of June 29, 2005 before the Administrative Court, which was dismissed on May 9, 2006 (B 1 K 05.768). The appeal against this was also dismissed by the Bavarian Administrative Court on March 26, 2007. [Note: The Federal Constitutional Court's own legal view follows] § 130 para. 4 StGB interferes with the protection of Art. 5 para. 1 sentence 1 GG. Art. 5 para. 1 sentence 1 GG guarantees everyone the right to freely express and disseminate his or her opinion. Opinions are characterized by the individual's subjective relationship to the content of his or her statement. They are characterized by the element of taking a position and regarding something as true. As such, they cannot be proven true or false. They enjoy the protection of the basic right, regardless of whether the statement is founded or unfounded, emotional or rational, valuable or worthless, dangerous or harmless. The citizens are not legally obliged to personally share the values underlying the constitution. Although the Basic Law relies on the expectation that the citizens accept and realize the general values of the constitution, it does not enforce value loyalty. Protected by Art. 5 para. 1 GG are also opinions aiming at a fundamental change of the political order, regardless of whether and to what extent they can be implemented within the constitutional order. The Basic Law trusts in the power of free discussion as the most effective weapon also against the spread of totalitarian and inhumane ideologies. Accordingly, even the spread of National Socialist thought as a radical questioning of the existing order does not initially fall outside the scope of protection of Art. 5 para. 1 GG. The free democratic order of the Basic Law primarily assigns the task of confronting the dangers arising from this to civic engagement in free political discourse and state education and upbringing in schools in accordance with Art. 7 GG. [Note: This is exactly your argument!] [Note: The decisive section of the judgment follows] The infringement of freedom of speech is justified. § 130 para. 4 StGB is a legal basis that can justify an infringement on freedom of speech in a constitutionally permissible way. Although the criminal norm is not a general law in the sense of Art. 5 para. 2 alternative 1 GG. As a special law, it also cannot be based on the right to personal honor in accordance with Art. 5 para. 2 alternative 3 GG. With regard to the National Socialist regime between 1933 and 1945, Art. 5 para. 1 and 2 GG also allows interventions by regulations that do not meet the requirements of a general law. In view of the unique injustice and horror that this regime, under German responsibility, brought over Europe and large parts of the world, and the significance of this past for the identity of the Federal Republic of Germany, statements that approve this can have effects that cannot be accounted for solely in generalizable categories.* What the Federal Constitutional Court is doing here is to say that while the law contradicts the wording of the constitution (because § 130 IV StGB is NOT a general law), there is an absolute exception to it because there are constitutional values that are not explicitly stated in the Basic Law. This is an absurd argumentation that completely violates every legal principle. Furthermore, this was not intended by those who drafted the Basic Law. This argument shows that the German Constitutional Court is ready to throw any law overboard to protect the status quo. Among legal scholars, this ruling has caused outrage in many places because it is so obviously nonsense. What I want to say TL;DR: Your view and argumentation has been widely shared among professionals for some time. It is an open secret that this is illegal law, but everyone is too scared to change anything about it.

I'd like to point that nothing in the US Constitution or legal code really outright bans non-Republican or Democratic parties. It's the people themselves that have chosen to ignore alternatives. This is radically different than any of the former Axis powers, which have direct provisions in their Constitutions and/or legal codes that outright ban certain political viewpoints. As for the other three you mentioned, I'd also point out that we've had violent riots by extremists on both side of the scale and yet still, no laws or amendments to the Constitution have been passed to prevent them from organizing peacefully and/or speaking their mind. The system may not be perfect but considering it's held a country together from the time when it was 2.7 - 4 million people inhabiting 430,000 square miles to now when it's 331 million inhabiting nearly 3.8 million square miles (or about the size of the entire continent of Europe) and we have yet to experience a truly authoritarian period or a truly violent transfer of power, I'd say the system works pretty damn well.

In regards to Japan specifically, none of the things you said count against it being a democracy. A democracy is not required to have a military. It is not required to have reached its political system of its own will. First they imposed onto Japan a system designed for the US mentality which is completely different, then when Japan was doing economically too good despite that, Reagan proceeded to economically destroy it with the Plaza Accords and stuff. Though I don't believe his intention was that, I think he was banking on the collapse of China and North Korea in 1991 alongside European socialism, and calculated that Japan would recover its economy by exploiting those markets, but it didn't happen and instead, they're not only both still there, but North Korea has closed itself completely and China has risen to become an economic powerhouse that produces basically everything.

It's false that national socialism is banned in Germany. The only things which are banned are certain symbols and saying that the holocaust didn't happen. I disagree with those limitations, even though I'm pretty sure that the holocaust happened, but I don't think these limitations of free speech turn Germany into a "fake democracy". I mean when nazis (or communists) protest they get police protection! That looks more like protecting freedom of speech to me. Of course violence, both from Antifa and from Nazis, is illegal. None of those two groups get somehow protected. When it comes to politics it is forbidden to form parties with the goal to abolish the system. This means in practice national socialist parties, but also communist parties, can be banned when they pose a danger for the democracy. So far the SRP (Social Reich Party) and KPD (Communist Party of Germany) were banned. It is a problem that corporations have more influence than they should, but even that doesn't turn the democracy into a "fake". And I can also say, no, we don't hate ourselves. I am also not ashamed of myself because my ancestors did rather evil things. I didn't commit said atrocities and won't do so. In school it was only taught that our responsibility is to not repeat said things. Is the system perfect? Far from it. But I wouldn't call it "fake democracy". I agree than the US are barely democratic though. at least when it comes to those with less money, but it's still not an oligarchy. It "only" favours heavily the rich and especially the GOP tries to cut out voters which vote on average rather for the democrats. Both parties are highly flawed, but recently the GOP seems to be more problematic when it comes to limiting freedoms and eroding the rights of citizens. The democrats seem to mainly try to control the guns. I can't say how severe the situation is when it comes to Antifa. But something which is noticable is that in western style democracies the overall standard of living is usually higher.

I know this is an old video, but I want to make a comment. Most of these are flaws, but you seem to be greatly stretching what is a "failure" for democracy. Also, I would argue you are mistaking Liberal for Democratic. Most issue you raised are non-liberal, rather than non-democratic. Assuming my terminology is correct, Democracy is simply a system of governance in which the general populace are given strong, if not the strongest, say in government proceedings and/or appointments. Liberalism is the ideology in which maximum individual autonomy is allowed towards its members. In theory, one could have a liberal aristocracy or an authoritarian democracy, so the terms are not interchangeable. Your argument would make more sense if you had said fake *liberals* rather than democracy in this case. To add onto this, I would say that going so far as to call these places fake and by extensions insincere liars only trying to put a self-righteous mask on themselves, even with these flaws taken into account, seems condescending and shows a certain perfectionism that won't accept even the smallest of issues. One does not need to be perfect to champion a value or idea. Just because one is not always liberal, doesn't mean one cannot believe that liberalism is an ideal that people should strive for. I fully agree with the idea that these are flaws in these countries, in fact in my home country of Canada I am strongly against all of the free speech restrictions, however I do believe these nations should be dismissed are fakes and not be allowed to advocate for their ideals on a world stage even if they, like all humans, are occasionally hypocritical.

You're forgetting a lot about Japan. I mean, at this point, your arguments on Japan are lacking several major facts that sink your rather sophomoric argument. First, them being forced to renounce war was due to the fact that their military committed war crimes all over the Asian Pacific territories before and during WW2, to the point where tales of atrocities by Japanese soldiers were common in Vietnam, China, the Philippines, Korea, and many other territories. Their army and navy would compete with each other and would pick fights and start wars against other nations just to gain more money and power from their central government, and members of the army even tried to overthrow the Emperor to keep the war going. So not only was the military led by violent punks who were competing with each other, and who'd pick fights and start wars at the drop of a hat, but leaders within that army even tried to commit treason against the throne just to keep fighting. Who would want to work with such a military? Second, the Japanese government reserves the right to alter the constitution at will. In fact, in the aftermath of the fall of Nationalist China to the Communists, the AMERICANS tried to get the Japanese to rebuild their military as a counter-balance to Red China in the East. The Japanese refused, and continued to devote themselves to pacifism and corporate/artistic pursuits. In fact, now that their current government is ripping apart their restrictions in the military to counter Red China's newfound belligerence, guess who's protesting against the new Japanese militarism? Certain Japanese citizens, who do not want their nation to have a military again, and who agree with the pacifism that MacArthur imposed upon their country in 1945. Third, the Japanese government is still democratically elected. The elected Prime Minister holds power, not the Emperor or some other arbitrary figure. So by the classical definition of a democracy, Japan is a democracy. Fourth, in terms of declining birth rates, Japan is hardly alone. America, China, most of Europe, South Korea, most of the developed world is facing a massive demographics decline as the urbanized population refuse to have kids due to the cost of it.

I want to stance to the Germany part, because it's my native country and I know it way better than the other ones mentioned: 1. At about 10:13 he states that there's a trend that liberal democracies are breing created by "brute force and mass killings". Well what other options was left? you can't say to Nazi Germany, that they should stop being a dictatorship and slaughtering many minorities. They started the war, they started to kill millions of innocent people who didn't fit in their view of the world. HOW THE FUCK SHOULDN'T THERE BE ANY KILLING?! IT'S WAR GODDAMN. Of course killing is bad, but imagine the allies didn't went to war with Germany, I think we all know that the results would have been way, WAY worse with in mind what the Nazis had planned for the future. 2. Since about 10:30 he starts talking about the denazification and how a democracy couldn't be called democratic when they prohibit the use of national-socialist thought. Besides mentioning the "Paradox of tolerance" ("The paradox of tolerance states that if a society's practice of tolerance is inclusive of the intolerant, intolerance will ultimately dominate, eliminating the tolerant and the practice of tolerance with them." ~Wikipedia), why isn't that democratic? I get his idea of a democracy that includes everyone, yet the German Constitution allows the ban of groups or organisations which "want to restrict or abolish the liberal democratic or fundemental order". Also those groups are only allowed to get banned, if they are being a serious threat. Those group often have the goal of intolerance (e.g. against minorities, people with different sexual orientation etc.). So why wouldn't you go against potential people with nearly zero tolerance. You still can elect other parties, have different ideologies in parlament, just not those who are a threat towards the greater and liberal good. Same with freedom of speech. You can say our chancellor is crap, you can say that Germany is weak or has a weak parliamanet, but hate speech is just not allowed, and for a good reason. We learned from the Weimar Republic, that even a small very radical group can become a disaster for humanity. All in all, for me this sound like a HUUUGE relativization of Nazi Germany and its past. Why don't we want another fascist government? Because it killed a lot of people, restricted the freedom of speech and a lot more. For me, this video is not more than someone who doesn't really know what a democracy can be. The power comes from the people, they elect their parlament and their parties. Its goal is that nobody should be excluded, and of course this doesn't count for nazi szmpathisers, but that's the goal of it. It wants, that nobody can take those rights away. We don't claim to be the best democracy in the world, but like my mother always said: "Besser vorbeugen, als auf die Füße zu kotzen" (better anticipate than to throw up)

Yeah. That part of the video made me raise an eyebrow. Completely skipped over the many atrocities of Germany at the time and it was pure evil. As a Catholic I’m surprised he was defending them. There is no alternative but to shut them down, unfortunately that comes with consequences but so what? What does he seriously expect good will come out of letting a horrible wicked government like that exist? No power in their right mind would want that devil to exist again… Such ridiculous naive arguments bring shame to the right wing

Speaking as an italian. You are making a lot of confusion and are probably kind of blinded by your self-imposed mission of "showing the West's true face". Japan was one of the major escalators of WW2. It attacked and invaded sovereign nations with a brutality matched only by that of the nazis. On top of that, unconditional surrender, which is the only acceptable defeat for Axis powers, had to be forced through nuclear bombings. That's how much the japanese were willing to drag the conflict. I am currently living in Japan and I can see why: many elders truly believe that Japan shares no responsability for what happened and that it was 100% in the right doind what it did. It only makes sense that a country this stubborn had to be put under check with a pre-made Constitution. And your point about the defenselessness of Japan isn't really valid because article 92 grants Japan the right to constitutional revision, although it does require two thirds of both chambers and a national referendum. As for Italy, are you really contesting the banning of the fascist party? You seem unable to distinguish between not allowing a party to reform and adhering to the ideology of said party. You can be fascist in Italy. Some people are in fact and as long as they don't make any threats or acts of violence they don't really have any troubles with the law. Hell, the current Speaker of the Senate has proudly talked and shown in the past his collection of fascist memorabilia and it's a well known fact that he was part of the neo fascist party Movimento Sociale Italiano. We draw the line at reforming a Party that poses a threat to democracy, freedom and that has been guilty of an immense amount of suffering in the past. If that is what you deem a paradox in a democracy, you are either very naive or you have some worrying political stances.

This video is very wrong. I'm from Russia, and I know what authoritarian and undemocratic country really is, it's when students listen and watch propaganda every monday. It's when one corrupted as fuck party and person rules country for 23 years. It's when any kind of priotest and political activity is banned and you can't do anything about it and can't win the case in court, because every single court is under the ruling party's control. It's when in parlament you have only one real party which holds power and majority in EVERY election in EVERY region or country as whole even though nobody voted for this party, if somehow candidate from another party wins, this candidate gets arrested and accused of every possible crime. It's when every opposition leader is either killed, imprisoned or ran out of the country. Countries you have mentioned aren't perfect democracies, especially USA, but nobody is perfect and countries either, so saying that Japan isn't a democracy because its Constitution was made after defeat in a war, Germany and Italy aren't democracies because in their Constitutions, there is an article that says that awful and anti humane ideology is banned, this is just stupid.

@dadodadokowski9108 Жыл бұрын
@@captainchaserman7148 i agree with you there. However basically all of the examples named are not liberalist, or at least not neo-liberalist. Most examples here are social democracies, implying that they will have higher degrees of state controll. This mostly applies to economic matters but can also extends to some personal rights. This however isn't necesarily bad as these are mostly rights which would infringe with the life of others. There is a german saying about this, which roughly translates to: "One's freedom to swing the fist ends where the other's nose beginns." When applied to the first amendment of the german constitution (The dignity of every human is not to be harmed) it makes it impossible to combine with unlimited free speach because there are viewpoints that actively want to undignify (is that a word?) others. Especially right-wing and therefore nazi ideology. That is the reason why it's unbeneficial to have unrestricted free speach On an unrelated note I wanted to also adress some other points made in the video which I still recalll. 1. You have to be dillusional or both blind and deaf to think that the US isn't democratic solely because of antifa and the left. For centuries the US has been heavily plagued by heavily armed right-wing extremist groups and no one cared but now when one small leftist group emerges it's the threat to democracy in america. While I do agree that the US has not been a democracy for quite some time, it's because of their terrible voting system (I can ellaborate on that if you want). But saying that it's undemcratic solely because of the left has to have some sort of schizophrenia. 2. "To see who's in charge ask who you're not allowed to criticise" it always looks good to add some citation to seem like you know what you're talking about, however this citation is absolutely false in this case. In most countries brought up here you are at no point not allowed to criticise the government, the system, democracy and so on. The reason why most right wing parties are being banned is in most part, as stated above, because they actively want to exclude, get rid of and indignify groups of people. Which is basically the only limitation of free speach in countries like germany. So all in all my case still stands that the creator is a right-wing prob. Nazi who's mad that some countries don't allow him to express his hate-speech.

You can clearly tell that this guy at least 2 years ago has some sort of sympathetic views towards fascist led governments and probably self describes himself as a 'libertarian', what I don't understand is how some people can't comprehend that suppressing certain views and ideologies actually strengthens democracy. I agree that both sides of the authoritarian variants of capitalism and socialism should be banned, it's far more obvious why fascistic parties are more of a concern, mayyyyybeeee because they advocate mass death and war against neighbours /s. This guy clearly is unhappy with the worsening trend of liberal ineptitude; unfortunately, most uneducated or narrow-minded people gravitate towards the right, since it relies on fear, paranoia and innate shock instincts which can captivate someone more whereas democratic socialist ideologies are ignored by these individuals because it's a bit harder to grasp a different economic model, progressive social values, etc, for people who don't bother or don't have enough exposure to commentary from the other side. Antifa is antifa, anti-fascists, it's decentralised, so that's why there may be a higher prevelance of rioters, which is inevitable in any large gathering especially disorganised ones mainly via the fractured internet groups with one broad goal in mind. Overall, I like that the video points out that things need to change and find a different way of governing, however this guy is coming from a strange anti-left background, even making claims that communism kills more people than capitalism, which is an overused talking point, we can all agree that authoritarian socialists and capitalists are evil; if you want a more equitable, fair and humanitarian society, the answer is not to go right, back to medieval-brained ideologies, or so far left that you end up on the 5th face of a hypercube in the attempt of global revolution, it's to go more left than social democracy but not introduce authoritarian systems, democracy is compatible with socialist or mixed economics. IF YOU READ THIS, THANK YOU, IT'S TIRING HEARING THESE WRONG VIEWS. btw, I absolutely despise the PRC, USSR, DPRK. I just want to clarify that I don't like the 'communism kills more than capitalism' because it was fabricated and is a broad anti-left argument including the democratic variants, which is infuriating, like okay???? Yeah socialists have caused pain and suffering, so do capitalists when ,e.g, a mother with 3 kids has to work 2 jobs isn't granted proper help, is demonised by people not in her position for being on welfare, and lives in an unsuitable house, no one cares, you get my point.

I just wouldn't call fascism "hyper capitalism" or any kind of extreme form of capitalism. Extreme capitalism is simply laissez Faire. Fascism has numerous elements of state control, of fixed prices, of state controlled labor unions,and more. They have more in line with Marxists economically than either would like to admit, than either do with capitalist countries and systems.
