Sadly- he wasn't a legal step- parent.......had he been he likely would've had more rights (depending on the state!) That's y years ago- when my kids were VERY young and my hubby and ai 1st got married- I changed my will and gave my share of custody to my husband (they were 5 and 8 and said "if something " happened and Mama wasn't here- they stated "we wanna b w Daddy!" So we r in Iowa and my husband and my X husband would have been sharing custody (my X would've had to petition the court to remove them from my husband's custody and that NEVER would have been granted by a judge since we divorced bcuz he molested them!)

@@shannonobrien9922 And your case would fall under certain circumstances like Judge Vonda stated where your husband would have had some standing and because their bio father had done something to them to make him unfit to be around them. In general, step parents do not have any legal rights to kids as long as the other parent is alive unless there are certain reasons why they can not have them. My kids lost their dad at the end of 2021--keep in mind they are adults now but if they had been minors all custody would have come to me. We had joint custody. Their step mom would not have any "standing" to be able to keep them. When my kids were under 18, their step mom tried to run how their dad and I handled things that concerned only our two kids. She had no say in visitation, education choices, who the doctors were and she even had no right to know their medical history with their doctors but their dad gave her permission to do so in his place if he was not able to be there and it was on his time. There are so many things that are considered where the custody is concerned.

@@evelynwitt2529 correct except when I filled out my will to update it after we got married- my attorney did it and I was assured in MY state- my husband couldn't would b inheriting MY share of custody! (I always assumed it was BECAUSE of the extenuating circumstances i.e. the reason we were divorced! Bcuz my X could NOT retain physical custody!)

They do, but the stepfather is of no actual relation to her. If the father really wanted his daughter, especially after the mother’s death, he could certainly have her and the father shouldn’t even have to go to court!

@@LotsofLisa pure law wise you would be right. however I do think that if the child has a deep emotional investment in both (and they clearly have a investment in said child). removing one of them might be way more harm to the child in the long term. It might be that as the two adults they might need to find a way to work with that fact.

The stepdad is going to get bit by this. Either it's going to be the daughter saying he's not her dad or the bio dad screwing him over. If I were him I'd cut my losses. She's not his kid and he shouldn't be held accountable for any expenses for her. If bio dad wants sole custody I say let him have it. Stepdad needs a clean break. That poor man and child. He's practically raised her and the bio dad still has more authority than he does. Honestly I think that when it comes to stepparents it should be a co-parenting situation. But only if they agree to it. Maybe even think of it as a babysitting thing. If bio dad is wanting stepdad to take care of the child any number of days, charge him for it. Tell him you want a signed agreement whereby he pays him for it and he provides food and such. The pay is for the use of the utilities and the food is to take care of her. Bio dad doesn't just get to keep taking advantage of the stepdad.

I think it's more a question of authority. You can't be a parent while constantly being hobbled by "You're not the dad". It weakens your authority with the child. The stepdad built the trust and love of this child and now he's being told that he has no say in her life. It's not fair. You can't take the advantages of having someone else look after your child while not giving them the authority. It always leads to an imbalance of power. If the bio dad were willing to do a co-parenting kind of thing then it would be fair. But he's not. The stepdad is only asking for a recognition of what he does for that child. The child support is meant to acknowledge that. Even if he was just declared a co-parent where they share expenses for the kid that would still be reasonable. I feel for this guy. I'm sort of a stepparent myself and I can't tell you how many times I was told they're not my kids. That I had no say. I had to watch as my boyfriend's kids got screwed over by their own mother and both me and him had no say in it. And me even less. It was so sad and it was the children that suffered because of it. If the bio dad truly loved his child, he would've worked out a co-parenting situation for the two of them. Or some kind of visitation. Instead, he's going for sole custody. I suspect there's a reason for it, most likely financial. If I were the stepdad I'd say all support stops right now. If bio dad wants him to watch the daughter, stepdad gets paid for it and bio dad provides food for the child. All expenses are paid by the bio dad. If he wants to treat the stepdad like a babysitter than they have a babysitter arrangement. Otherwise, he can take up his parental duties and be the sole full-time parent. His call. You don't get to have your cake and eat it too.

. Seems to me (however good intentioned) stepdad being reasonable. As the judge said, mom had custody not step-dad and he should not be able to usurp the biological father (without a legal reason to do so). In fact, he wasn't even fighting to adopt her.... her was in court looking for the money his wife was entitled to when she was alive. Good call Judge.... Step dad has no standing and if he really loved "Little Bit" he would encourage the relationship with her biological father. No child wants to see the people she loves fight. Step dad is wrong here. He is very emotionally attracted, and it's clouding rational thought.

I wholeheartedly believe that there is a difference between being a father and being a Daddy to a child. A father is someone who shares DNA with a child. A DADDY is someone who loves the child....who knows her favorite color and favorite toys and who her friends are and what her favorite Disney movie is and what she likes to eat. He's INVESTED in her. Fatherhood is not just a noun.....its also a verb. And God bless this good man for stepping up for Malaysia and being a Daddy for her after her Mom died. I have lost 2 Moms myself and I NEED my Daddy now more than ever. But this little girl is very lucky, because it sounds like she has TWO good Daddies in her life who love her and are parenting her and are invested in her. These two men need to decide....are they going to FIGHT over their daughter....or are they going to share the role of being her Daddy and all that this entails.

Can't be a full-time dad with part-time custody 👉💯 And you just can't take a man's child just because you call yourself falling in love with it it's still his child and he's doing everything that he can while making sure he maintain a job to be able to do it. The first hit you should have looked at was the fact that The stepfather had the greatest piece of evidence possible was to prove him wrong but yet he couldn't about anything that he was saying he does for his child. So with the child not staying with him literally and him having a job it's kind of crazy to think that he's supposed to do way more than what he's doing in the position that he's in but he deserve a chance that his own child. 👉👉💯💯💯💯💯

The judge needed to really clarify this case. She did not explain why the fiancé - not step-dad - still had possession of this child. It sounds like the child is living with him and not the father. If the mother died why wouldn’t the child be placed immediately with the biological father - unless there was some issues of abuse or abandonment - which does not appear to be the case.

@@BoyGenius-1 that’s not how the law works at all. If the child died when they were together, and they were engaged he’s considered a domestic partner and can have legal custody over the child if he’s been present long enough.

No. No. No. You do not bring a child on a first date. Children do not need to meet dates until a commitment has been finalized after months of adults getting to know each other and then introduce your children to the new person.

I can see that the step dad has a great relationship with the child and doesn’t want her to leave his life because he isn’t healed from the lost of the her mother and he sees his fiancé in her😩 that’s so sad! ( also i hope people get what I’m expressing)

Step dad needs to let it go. He's holding on to the last thing that reminds him of the mum. It's up to the biological father if wants him to continue being in her life. Harsh but true

This guy is NOT the stepfather, he’s the mother’s former boyfriend/fiancé. I applaud him for stepping up after his intended’s death but not sure I trust his motivates. Pray her biological dead gets custody sooner rather than later.

People get it twisted. Child support is supposed to support the CHILD not the mother. Alimony supports the former spouse.

What if she doesn’t want to go with her dad though? Sounds like bio dad isn’t really doing anything but paying and do some occasional days together but dropping the girl off with her grandmother a lot. Stepdad should get full custody

Gentleman be very careful when taking on stepchildren as you can see legal grounds especially if you're not married and that woman dies that child's father will still have legal grounds so your relation or emotional attachment will just lead to heartbreak😢

Step dad should’ve gone for adoption from the jump. This is why it’s not good to get with someone with another person’s kids. Too much attachment with no rightful claim to anything.
