carlos oliveira I would accept it, then find a job that wouldn’t do that. But since he has an obligation to pay the debt they must take it regardless of form since it is legal, and if they refuse, then the debt would be cleared.

I can see paying fines & tickets with pennies as payback, especially for victimless "crimes". Make them waste time counting tons of coins for wasting our time. It is much easier for people to get up to a few hundred dollars of pennies from a bank compared to a company needing millions/billions of pennies for payroll. It isn't in an employer's best interest to use coins.

So yes, the DMV, court house, city, etc, CAN refuse. Most do not, but there are some who do limit the format / delivery of coins. But ye ole adage "You must accept any and all legal tender" is flat out false. " This statute means that all United States money as identified above are a valid and legal offer of payment for debts when tendered to a creditor. There is, however, no Federal statute mandating that a private business, a person or an organization must accept currency or coins as for payment for goods and/or services . Private businesses are free to develop their own policies on whether or not to accept cash unless there is a State law which says otherwise. For example, a bus line may prohibit payment of fares in pennies or dollar bills. Other times when we’re busy no. State and federal buildings yiu can pay with a million dollars worth of Pennie’s. . You don’t know what you’re reading A courthouse isn’t a private building. Private business are every business but state and federal building which takes all forms of currency for debt.

Also, you could tell those pennies came from the bank by the way they were rolled. They should have taken them. Plus the top of the bag was clipped closed because it was 50 dollars in pennies. He should have told them more information.

I agree! You guys caved in way toooooo easy!!! Yes of course it is a HUGE inconvenience for the DMV to have to count all them pennies. And YES they would have to open all the rolls and count them to make sure they are all in fact pennies even though they looked like they were rolled by the bank. For those wanting to pull this stunt, IT IS LEGAL TENDER! They said "policy" says we can only take two or three rolls, they should have asked to SEE THE POLICY to verify. If its a public debt (money owed to Uncle Sam) they have to accept any type of legal tender, hence you won't find any real policy that states you can only pay with one or two rolls of coins.

Well, nice alternative to instead count it yourself I suppose, but he said policy states he can only accept "a couple" rolls due to customer volume. That's bullshit, no policy anywhere would ever use "a couple" to describe a quantity it has to be exact otherwise they can't enforce it by law because it's too vague. Next time if there is a next time, ask them exactly what the quantity is on the policy otherwise they can't enforce it, and if they still refuse just call the police, the DMV is connected to the government so calling the police would especially work in this situation, and if not talk to a lawyer.

rick daniels actually that is why it says on currency that it is legal tender for all debts, they do have to take it. unfortunately, there isn't actually any enforcement agency for currency. the secret service fights counterfeiting but that's about it. I called the US department of treasury, the US mint, and the secret service and they had no idea who enforced currency laws. you basically need a court order

This USC applies to policy of a creditor whether to collect any payment in form of cash only. You apparently don't understand your own quoting of U.S.C. If this organization had a payment policy to not accept cash for whatever reason, there is no mandate to do that. There are places that have a no cash policy, public and private, for security purposes if I had to take a guess. Federal law says they have to accept pennies as legal tender: Title 31 (Money and Finance), Subtitle IV (Money), Chapter 51 (Coins and Currency), Subchapter I (Monetary System), Section 5103 (Legal Tender) of the United States Code states: United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues. Foreign gold or silver coins are not legal tender for debts.

dude, nxt time..please let them know that a policy does not override a law. Where you were was at a government entity..by law they have to accept it since it legal tender. If they don't have the man power to count it, that's their problem, they're the one that have to verify it,,YOU DON'T have to be present for them to count it since you've already verified for yourself that it's the correct amount...amm, yeah, and just keep quiet, they can botch how much they want...and if they refuse to the payment, it can mean that your debt was paid in full, but I'm not too sure on that.
