Well, no, that is actually against the rules of deadly force that are used to justify a lawful killing. You need opportunity, capability, and intent. Him just having the sword would grant them capability, but unless he charges at them, they couldn't justify to the other two, which means if they shot him just for brandishing a weapon that can only be used at close range, they would be at fault, and it would be obvious.

Wow this is wild. I never thought I'd hear about this story again. I lived in the neighborhood where this happened in Seattle when it occurred and have a little more info. Tony was well known and pretty harmless considering his katana. He never drew it unless he felt his life or the life of others was being threatened. He was a huge dude too, so seemed pretty imposing. I didn't know him well or even at all, but I passed him on the street multiple times. I heard people saying that he had a "mental illness" at the time and thinking back about his actions and demeanor, maybe he was on the autism spectrum. I never knew what happened to him after the standoff, but if he is in fact still alive, I'd consider that a miracle considering the way that the police treat homeless people, let alone defensively armed homeless people. I mean yeah, a beanbag gun doesn't feel good to be popped by, but they have been using those for many years before elevating to lethal force. Lethal force was not authorized on this man until he did an act of violence, with the sword, which he never had done, it was just a standoff. Not saying the beanbag doesn't harm you, but it feels a lot better to get hit by a beanbag than by a bullet, and in this case, they couldn't shoot him, so what would you suggest they do?

There was a dude hit in the balls during one of the infamous george floyd "curfews" where the police in a lot of cities marched around areas that were completely peaceful and werent rioting or even protesting and were demamding that citizens return home and stay inside. It basically exploded his testicle. And of course the cops got off scott free. (In case anyone mentions it, im not referring to the actual riots. There are long montages of cops using absurd force on innocent bystanders in areas that had no rioting whatsoever. The reason i specify is because the news didnt give much coverage to that part of the news at all and if you weren't paying close attention at the time you would have missed it. They were doing crazy shit like shooting rubber bullets at people in their windows and on their balconies, pushing down (and subsequently murdering) old people, and apparently even shooting men in the testicles.
