The plaintiffs rented an apartment from the defendant, but then the boiler broke. They didn’t have heat or hot water, leaving their apartment below freezing. They say the repairman couldn’t fix the problem. They’re suing for the cost of one month of rent and hardships. The defendant argues she immediately called a repairman who said he would order the parts. She claims she told the plaintiffs to buy space heaters and she would reimburse them.

That woman is heartless! Our furnace broke down just in December. Our landlord was there an hour later trying to fix it. He couldn’t, he had one space heater. So we were okay for the night. 7am the next morning the HVAC tech was there. It couldn’t be fixed and needed replaced but they couldn’t do it until 4 days later. The landlord was there was 5 space heaters just a few hours later. We got a brand new furnace. Gas instead of oil. Our bill is $100 less now a month, and a whole brand new a/c unit.

Ridiculous verdict... Punitive damages are awarded by a court to punish defendants whose conduct is considered grossly negligent or intentional. Plantiff should have received the maximum judgment allowed...

@johnpeter9793 In this case I don't see that the defendant was "grossly negligent" she acknowledged the problem and at minimum half-baked attempted to get it fixed. Had she completely ignored the plaintiffs and made no attempt to resolve things then grossly negligent would apply.

VERY expensive. I have electric baseboard heating in my apartment and thought that getting space heaters in my bedroom and living room because my apartment is so small and thought it’s less expensive to heat that way. I was sorely mistaken lol

If Sears couldn't fix it within a week, she should have called a 2nd repair shop IMMEDIATELY. A month is far too long to wait for the boiler to be fixed, plain and simple. I think the landlord wasn't on top of things because she wasn't the one without the heat or hot water.

In Australia a landlord has 24hrs for urgent repairs ,water heating and cooking, anything else they have 14 days, if that doesn't happen the tenant can get it fixed and the landlord has to pay the bill.

this is another example of incompetence or disinterest on Milian’s part. If ever there was a case for imposition of punitive damages this was it. The actions of the plaintiff were knowing/intentional.

It a downside of the setup of the program. Despite all the pretending this isn't a real court - it a private mediation service on contract disputes in reality. Private mediators don't have power to load punitive damages onto settlements unless the contract in dispute has very specific clauses about them. The laws about habitability and pentilities for breeching them are only avail via the formal court process for whatever jurisdiction they fall under, not a private contract mediation service. The plaintiff should have kept the case in NYC housing court as this would resulted in the outcomes you and I believe would have occurred. Problem of course this is often lengthy and frustrating process, no doubt made worse by the landlord refusal to attend the first hearing.

I would of went to a hotel after a few days and passed the bill off to the landlord. The judge should of have them the whole month back. 19 degree and no hot water could of gotten the parents in trouble if the kids went to school and complained about it. CPS could of gotten involved. I would never consider using a space heater in apartment that's 19 degrees. If it was 50 something sure. But 19 is ridiculous.

I stayed in a room with no heat vents. The room was large, I did use a tower heater which helped but minimal. I purchased those Hot Hands warmers and also the ones for feet ( obviously they are larger). I had them in pockets and footies. They keep warm for about 10 hours. Worked well for 2 nights.
