Ppl are saying it’s the plaintiffs fault, but she literally chose a sample and ordered, checked her order info on delivery and it was correct, name, inventory information exactly. she assumed it was her fault and allowed the installation meaning she was taking responsibility UNTIL she checked again, THAT wasn’t the Sample she was given. Pay the woman.

Neither the Plaintiff nor the defendant should be responsible for the screw up of the manufacturer. I disagree with The Judge about the correct party to sue. I think it should be the manufacturer not the seller.

Sometimes contractors are wrongly blamed and sometimes the client is just an utter LUNATIC!!! My dad is a contractor who has a former client that took some mistake that he supposedly made (her first complaint was made while drunk so we didn't take her seriously at first) and turned it into a whole ordeal. He agreed to fix it, sent her the paperwork about his return and everything. The Friday before he was supposed to return she suddenly files all sorts of complaints against him and doesn't want it fixed.

Absolutely not the plaintiff’s or the contractor’s fault. The contractor may have seen 20 different tiles in 2 weeks, he cannot remember everything. Also, the plaintiff would never had known that they switched the color on her until it was in place. Good win. 👏🏾👏🏾

The difference between the tiles were just too subtle, especially since the numbers matched the invoice, the contractor wasn't at fault and neither was the plaintiff. I'm surprised the defendant didn't just pay the install fee, because she would have eventually gotten it back from the manufacturer, crediting her 7% for every order.

This is crazy - happened to me too with shades of grey... paperwork matched, tiles didn't - lucky for me i took one tile home when i selected my tiles (i always take one from a box, or a box with me) and then i use that to match colours... Saved the day! Grandpa was a builder and he told me to do that always...

I'm a tile contractor and I see different combinations of tile colors that it's mind boggling. It's not my job to lay out the tiles to see if it looks good. There are so many shades of tile colors how is an installer supposed to know if it's the right shade? If the numbers jive with the invoices then I'm satisfied. Maybe the retailer should've picked up the tile and made sure it was the right color instead of blaming the installer. The defendant was going to be compensated for the labor with a 7% discount on future sales so they weren't going to be out any money. Pay the plaintiff.

Pure curiosity: if you picked up the sample for the customer and brought it back to their home.. would you think it’s reasonable for one of you to compare the delivered product with the sample before install? The tile store took the same route as you said “check the numbers and it’s good enough for me.” But the store doesn’t have the physical sample they sent home with the customer.. especially when this is manufacture mislabeling idk how the store would tell the difference.. One quick check by the woman or the contractor and this could have been avoided.. or if the manufacturer didn’t make mistakes.

The defendant is claiming you’re supposed to lay all the tile out and then have the homeowner approve you to begin installation. I’m not sure what planet the defendant lives on. That’s not practical for either the contractor or the homeowner unless everyone has nothing but free time.

Happened to us with carpets from a "Posh" UK shop. They fitted the wrong carpet, asking my wife to "keep out of the way". I get home and immediately I say that is NOT our carpet. Next day phoned up, given B.S. by the shop, then I remind them I have the samples that we paid for, reference numbers and a written copy of the order. They then say sorry, WE ordered the wrong carpet BUT we will give you 10% off if you accept it. I said NO! I said YOUR mistake and you have thrown away all this carpet, they say, we will sell the wrong carpet (now used) as remnants. I pointed out that was a criminal offence. They then ordered the correct carpet, which was fitted 8 weeks later, NO APOLOGY was given. The fitters the second time around, independent, told us that they were ordered NOT to leave a single piece of wasted carpet, so we were punished TWICE! Thank You John Lewis, High Wycombe, Bucks, UK.

I had a mislabling issue with haircolor. The sealed box read dark blonde, the tube inside was Ash ( green)extra dark brown. It was a good thing I wasn't super busy that day and looked at the tube before mixing! The whole case was mislabeled. Lots of blondes would've been really angry!

I just went through this with what was supposed to be an electric/cobalt blue highlight for *dark brown hair.* The picture showed a model with black hair; but, the box said "not for black hair" and showed before & after pictures of the highlights in brown/dark brown hair. So, I thought I was good. OY, was I wrong and I looked like a real wicked witch 😂 The "highlight" was actually black hair dye with blue highlights. Thankfully, I had a really good color remover in my basket of hair goodies and was able to get the majority of the color out. Time to replace my rescue stuff and try to find the right product 🙂 Take care! ❤️

Im a tile installer for 25 years....15 to 20 times in my trade that situation happend to me...wrong tile or shade....but always...always I manage to catch the mistake ether from the tile vendor or manufacturers....chech your materials and always double check with home owners....10 to 20 minutes well spend...

Definitely would have checked the tile against the trim before starting. That failure is on the installer. However, I've seen tile that had substantially different trim. If I were the installer, after having checked the trim and the tile, I would have called the client immediately to raise the issue and not started installation before getting approval from the client. If that procedure had been followed, it would have all been on the plaintiff and swapping the tile a courtesy from the seller. What was described as happening is very common.

It’s not that simple. The plaintiff wasn’t home to verify anything. The contractor is paid by the job, not the hour. Stopping to wait for the plaintiff to come home from work would’ve cost the contractor. The tile colors weren’t so blatantly different that the mistake was immediately noticeable. Like the plaintiff said, something looked off but she needed to see more of the job complete before she could pinpoint the issue.

Laying out the tiles and the trim beforehand, which is good practice (but not doing so does not necessarily make a contractor bad) would have immediately identified the issue. However, if I was the tile contractor and could not get in contact with the customer after several minutes, I would likely have started. Some people like that look and I have seen MUCH worse.

Tile die-lots are never that far off. Ridiculous thing to say. When the number on the box does not match the tile, manufacturer should pay. Also, when the contractor is not the one buying the tile, contractors do not take any responsibility (typically). If the contractor buys, they mark it up, then will take responsibility.

I work in this industry and it is 100% the defendants fault, despite it being the manufacturers error, you have to accept the blame, explain the reasoning/situation and fix it. It is now her responsibility to fix it and make it right. Plus if she orders as much time as she says she does, 4gs is not going to break her bank. Once her client is taken care of she fights her battle with the manufacturer. It's tedious but it's the right way. Edit. Not a single company will lay out an entire job TWICE. just to check colour. That is double the labour and double the time. 🤦♀️

Turns out husband was right. I am kind of torn with this one. Yes Manufacturer was in the wrong for color being in wrong box.. Store owner is not going to know color is in wrong box. When it is taken. What the plaintiff should have done when husband noticed it was wrong. Right there she should have gone back to store before installing the rest. That is how I feel about it. Really was not store owners fault. It was the manufacturers fault.

Tile can be so tricky. I totally understand what the plaintiff is saying. I bought bathroom tile recently and I thought I was losing my mind when the installation started and it did not seem to match the existing parts of the room like I had envisioned. The wrong grout was used. I had to have the existing part of the room with the other grout redone and from an error I am fortunate to have an ever better looking room than planned.

What makes this case so unique is the judge agreed it isn't obvious that the colors were off. It was in that perfect middle ground of being close enough to what she ordered that she didn't stop the installation...but still being far off enough to notice that her bathroom doesn't match once its all installed.

The owner of a historic home related a funny story about a kitchen renovation. She had chosen a beautiful creamy off-white for the cabinets from a sample board in the cabinet makers office. Once done,she complained that the color was wrong . She went back & forth with the contractor,who was trying to appease her . The reno was in the high six figures & this was potentially an expensive screw up , but they had to make it right. They went back to the sample board & the order number was correct but the homeowner was adamant the color in her home was not the same. The sample board made it’s way to the house for comparison.Sure enough,the cabinet color was a much brighter white,in comparison to the sample. Then the 💡went off in the contractor’s head. The shop owner was a heavy smoker 🚬& the sample boards hung on a wall in his office. Nicotine had stained the off-white the perfect color for this historic home!! 🚬🚬🚬

The defendant should have paid right away for the mistake ! The manufacture was at fault, they were going to compensate the defendant. The defendant took the cheap way out by just paying for the tiles and not the work to put them in. I would never go back to that store again. She kept trying to blame the plaintiff and contractor!

The defendant needs to sue the tile manufacturer in this same court otherwise chances are high she may lose her case. To her disadvantage : 1. She had signed and accepted the tile whithout opening the box. 2. She has a written contact that states "installed tiles are not refundable".

The two colours are very close. The chances of her being able to tell the difference just by looking in the box two weeks later is very low.

How does she always tell the plaintiff to match the delivery to the sample BEFORE they use or work with material, but here she’s mocking the idea that they should lay out the tile before installation? They should! Lighting is different and one tiny sample won’t do to know if it’ll match or work with room.

The defendant should definitely sue the manufacturer and bring them to the People's Court to recoup their loss. However, I am not sure what that would do with their business relationship.

Can’t believe the tile lady is collecting money from the manufacturer to cover the cost of the installers fee but didn’t give the plaintiff a penny. She tried to make money off the plaintiffs expense. Glad the plaintiff won

If I picked out a sample, ordered it, matched it to the info and all of that, if it ended up looking different I would also fully blame myself at first!! This all boils down to the manufacturer needing to reimburse the customer

Lol never seen a contractor lay out the tile so you can see it before install. That’s the point of taking samples home but okkkk lady 🥴😂

I did not agree with that judgment on the tile.the customer had a chance to observe the tile and let it go.

I can't believe no one on the plaintiff's side thought to put a new tile up against the existing tile to see if they matched BEFORE installation.

Why would you? The contractor has a box and checks the name on the box.

This just happened to me recently with a bathroom vanity. I picked a shade of dark gray that was in the showroom (the sample). Luckily they opened the box in front of me and when we saw it, it was light gray. It had the right numbering, but the color didn't match with the one I saw in the showroom. Well anyway at the end I had to take the sample, but no discount was given.

Plaintiff had the sample at home.. the contractor had the sample.. why didn’t either of them compare the sample with the delivered product?

I assumed the sample was the store sample returned to the store.

@@r-w-r Stores don’t usually just lend out samples to be returned by customers. You may be right about them returning the sample.. but they still had to purchase it first. It’s not like the free paint swatches you get at Home Depot.

Yes in a way. But the defendant is in a better position to claim the amount from the manufacturer rather than the plaintiff
