He should have brought his bicycle to another shop, to have them check if the axle was adjusted properly to begin with - his story is quite likely, but he needs someone else to confirm it, even though he has to pay for that type of assessment. The quick release axles where I work require that a second nut (not the lever - that tightens against the second nut, but the lever must be shut to lock in place) to be properly tightened and adjusted to the width of the fork, otherwise the lever will be loose, and they will not tighten on properly. It looks like it was too tight the first time, and too loose the second, and the plaintiff would in that case simply never have a chance, the lever will open by itself without touch, if it's not adjusted properly in the start from vibrations and the rotation of the wheel -- imagine a lever that is supposed to tighten and sort of clamp a bit together, but instead it can't quite reach, like vice grips that are open too far, and won't grab hold and lock into place.

@@kac4klhc977 well, you can, but it might not stay. That's WAY out of alignment.....the bone will have trouble remodelling itself over THAT far a distance. If it's not through the skin , you CAN push it back into place but WOW! does it hurt. You cross fingers and pray that with the bone back in position and the arm in a sling, the bone will STAY back in position, and then it will heal and remodel itself quite well....sometomes to the point where you can't see where it was broken. Btw, i'm a Dr. All the best to you!! (Drs these days probably DON'T re-align the bone as much.....kids scream and adults sue.) I had to pop my own shoulder back in when i was 12....it was either that or wait for ages to go to the hospital and then see a Drr and WOW it HURTS as well! Besides, if my mom had foiund out, she would have killed me (we were playing on the swing set)

I broke my collarbone in 1988. My doctor said they didn’t “realigne” the collarbone. That was 34 yrs ago. How long has it been since it was the norm to do so?? I think you’re full of bs.

I flipped over the handlebars as a child on my bike, and it was because I somehow got my sandal stuck somewhere on the front tire. I've never worn sandals on a bike again, and the neighborhood kids laughed at me. Fun times.

so true . alot of bike accidents happen because a person's foot may miss the pedal causing the pedal to spin around and hit them in the back of the ankle causing a loss of control from being startled and then falling off the bike. i think something similar most likely happened to the plaintiff but he wanted to blame someone else to get them to pay his medical bills .

I recall getting road rash on both of my elbows and my knees. The chain came off while I was riding and boy did i get jacked up.. I was about 8 years old and luckily I didn't break anything.

@@journeysalkebulan they are raw fed and get different amounts due to sizing Titan gets 19.5 ounces twice a day Zeta and Shorty both get 15.5ounces twice a day. Which is made up of bone lean meats and organ. It’s been a long time since we’ve fed kibble but if I had to guess it would be 4-6 cups twice a day but that’s a guess. Titan is 132 lbs Zeta is 120 lbs and Shorty is 103 lbs and they get the same amount because Zeta can easily put on the weight and Shorty needs a little extra to keep on weight as she is HIGH energy lol 🥰.

The quick release is attached to a threaded rod you have to tighten it up by holding one side and spinning the other as you engage the quick release it puts pressure on the rod pinching it between the forks holding the tire in place. If the bike shop didn't tighten the rod enough the quick release would not have much pressure on it so it could be easier for the quick release to open and cause the tire to come loose from the bike. You want to make sure the release is tight but not too tight where it is vary difficult to close all the way, if it is over tight the lock on the release won’t close all the way and could then pop free causing the same issue. There is no way to prove if it was the bike shop or if he caught it on something and pulled the quick release so the judge made the right call.

i think he simply just lost control of the bike. most bicyclists get injured due to falling off the bike due to loss of control from missing the pedal when riding at a fast speed or going over a big bump or a hole they did not see in time to avoid or swerving in order not to hit something at the last second .

Properly adjusted quick release cams don't come loose as easily as the bikeshop owner suggests. I've had them on a bike for years and never had one come undone from a knock or otherwise.

I have never seen a wheel lock up unless the chain derailed again that might lock the wheel so derailer might of been unaligned by rider or shop. Wheel could tilt left to right by adjusting wheel wrong. Sound like when he left he wasn't using that gear and when he did it derailed due to misaligned derailer

I'm heavier than a typical bicyclists and therefore capable of applying more force than usual when standing. I always did my own work on bicycles and found that regardless of brand or quality if I installed the rear wheel perfectly lined up, I applied enough torque to bend the axle causing the tire to rub on the left side. With the axle tight it would only bend so far however and I found if I installed the rear wheel lined up so it was almost rubbing the right side I would end up bending the axle only to the point the wheel was then centered. After changing a tire or tube I would have to be sure to reinstall the wheel with the bend in the right place and I usually replaced the axle at every other tire change just to be safe. With that in mind I can see how if the quick release was loose either from not being fully locked or from not being adjusted properly it could possibly shift enough to stop the wheel from turning. I think the most likely scenario would be if the lever wasn't fully locked in place and when the added torque was applied it completely released. That would cause an instantaneous shifting of the tire into the frame, likely with enough force to lock up. The rubber marks also suggested a very hard contact. Personally because of my weight I never used a quick release on the rear. They require a hollow axle for the skewer to pass through. Since I was bending the axle I felt a solid axle with nuts I could tighten to the exact torque I wanted was a better choice for me.

Brand new bike, and we didn't check the quick-release wheel my son applied the brake flipped over the handlebars, the front wheel fell off, and cracked some of the plastic pieces because of the way the bike fell. We had the bike for one day. They exchanged it out, but like the man said, we check that often.

Not knowing how old the bike is but if the skewer was replaced than the quick release should have been replaced as well. The tire locking up wouldn't make sense with the quick release failing. Sounds like a bearing misplacement or the end cap is flush with the lock ring meaning something is not sitting right. This could have been from being an old bike or the defendant did something on accident to the tire without realizing but without a second bike mechanic opinion can't really say for sure. However the plaintiff would have no reason to touch the quick release if the defendant said he put a lot of pressure to keep the quick release closed. Saying it doesn't take much to release the quick release is just wrong. The bike industry wouldn't release something to the public that can potentially cause accidents. I worked on quick releases & after replacing them & using my hand to close it & the pressure is more than enough to have a tight lock on those quick release's. But I still agree with the Judge here, the plaintiff didn't get a second opinion to see how the accident happened.

Going up a hill, and thrown over the handle bars? He hit a rock..... The issue was not in the rear drive train. A rear lockup cannot throw the rider over the front fork.

It can if the bicycle comes to a full stop from the wheel locking, while you have forward momentum. It happens far more often with the front, but if the entire bicycle comes to a sudden halt from the rear wheel locking, you can still wind up thrown very easily. In that case, the bicycle doesn't tumble over with you, but you sort of wind up ejected from it in a different manner, flying over the top, while it stays put behind a bit. When the front wheel locks, the back just flips up over you, tossing you with it. This is why you need a seatbelt when driving a car as well -- it doesn't matter if the front or rear stops, you keep going through the windshield or into the dashboard without one.

Just after hearing what was said at the very beginning I have a huge question.... If it was the rear wheel that locked up, how did he flip forward? Wouldn't the only way he would be flipped forward would be because the front wheel locked up? It kind of doesn't make sense to me.

A quick-release can get out of adjustment very easily by turning the external nut. every rider should know how to adjust the quick release so that when the cam lever is closed that it is not easily opened by itself or by vibrations.I did not like how easy the nut turned on the demo assembly..

It’s the responsibility of the bike owner to ensure te bike/quick release is okay when using their bike. Same with KNOWING how the bike and these parts WORK. Too many people simply use the gear and things like quick release without understanding how they function!

Had it been any other part of the bike I might have been on the plaintiff's side, but the rod that is held shut with a 'quick release' lever, is the bike owner's responsibility. I have friends that take their front wheel off EVERY time they lock their bike up, by putting the front wheel and back wheel together and then the bike lock goes through both wheels and then around the post AND then they take their seat away with them, all of which have simple 'quick release' lever bolts...

antibodies only last for 3-4 mos. After that immunity is from T and B cells....there are no more antibodies. If your daughter had it in Jan 2020, there wouldn't have been tests in time to detect antibodies....they would have passed LONG before.

Dude , if they're that easy to open, then imagine if someone wants to ride their bike for 10-20 miles and it just gets jostled open?? That seems way too faulty to me... especially if the "expert" is talking about people going UPHILL ... I live in Canada , everywhere you go there are hills... makes no sense. The plaintiff should be reimbursed. Especially if the guy took the bike into the back to "fix the issues" on two other occasions for half a second each time 🙄

Not commenting on whether the plaintiff or the defendant is right or wrong but why does the judge keep allowing the defendant to repeat himself? he has said the same thing so many times! it is ridiculous, talking about the quick release and how he tells his customers to always check that and the Tire pressure, like okay we get it the quick release being open even the tiniest amount could cause the wheel to wobble and you should check your tire pressure before you go on a bike ride! 🤦♀️🤦♀️🤦♀️🤦♀️

i think quick release axels were invented for professional racing bikes they really are not suited to the weekender the shop owner was right, it could easily be knocked out of lock position i had them on my bike when i was younger and can understand exactly what may have happened

I bet she did have it in January 2020. I did and ended up in the hospital. The thing that makes me so sure is I had all the symptoms including the loss of taste that I now know is a sure sign of it. I also tested negative for the antibodies but by the time there was a test for antibodies it had been so long that we now know people don't test positive forever.

The defendant is showing a front wheel, not a back wheel. A quick release is usually only on the front because the rear is connected to the frame by cables and the chain. No 'quick release' for a rear wheel.

Defendant lied about the wheel clamp; it has nothing to do with Pressure. It is to keep the wheel in place and is there to lift up to remove the tire. And sad when one professes to be a prefessional and is not.

I don't know if it's the details or specifics of the actual cases or just flat out bias, but Milian seems much more pleasant and relaxed when dealing with caucasians and non blacks. Not to mention listens to the litigants without interrupting as much. In any event I side with the plantiff here and believe Milian got this wrong as she oftentimes does.

I've been watching judge milian for years and I totally disagree about the race baiting thing you're doing. And she's from Cuba so she's not white she talks about that a lot. Theresa nobody's race baiting here. I'm being honest and truthful with respect to what I've seen from here as a avid viewer of this show. Because she's from Cuba is even more of a reason as to why she's indifferent to blacks. Hispanics and blacks have a longstanding relationship of disfunction if you will that's been around since forever. So the mere fact that she's Cuban doesn't change a thing. I've been able to make my own personal opinion about her based off of how she treats blacks in her courtroom as oppose to everyone else. This isn't race baiting, making up stuff or anything else. You just don't pay attention to the details as I do with respect to how she is when dealing with certain litigants.
