They didn't even discuss the fact that the cab driver had signed a medical document stating he would be responsible for her. I think that should hold a good deal of weight

Something was amiss on this one. This cab wasn't a regular fun cab fare. This cab is part of her medical care treatment plan. This service is designated to provide a certain level of service in care of the patients they sign off and take responsibility for. And they failed to provide said service. In fact they were the opposite of that. Not sure if the judge didn't really understand that part of it. Or if she had a personal bias with things like this. Just don't know, but isn't this negligence. It's not call a cab cuz we're drunk after the club. This was a specialty medical service they offer and get paid by the state for. She should have whoever provides their federal government payments and grants take a look at her case. Cuz they're collecting federal dollars to provide medical service. And aren't providing it. Not sure if her demeanor made the judge ignore the negligence, or since she had a friend with her she couldn't have been that afraid or her friend was watching out for her.

She definitely missed the mark with this one. And he could’ve offered her $50.00 cash or a Walmart gift card anyway. Horrible customer service.

I agree. JM said "so you had to wait 1.5 hours for a cab". She was missing the point that the plaintiff had just had a medical procedure and was still under effects of anesthetic while going through all of this. The whole reason the medical centre operates this way (patient's requiring rides) is because it is not a "normal" scenario. I think she should have received some payment for pain & suffering.

I know her personally, and EVERY word that came out of her mouth was the absolute TRUTH. She is a kind and loving person who is always helping others and would give a person anything to help them. She is also well liked and it's wonder that a social uproar didn't ignite over this.

This case was disgusting. She wasn't just waiting for a cab too long she was stranded in Buffalo(which is a dangerous area) still sedated...the Judge and the defendant took it way too lightly.

I agree! They signed to get her home safely after a medical procedure and kicked her out in the cold, what would have happened if she feel and injured herself ?! A 50$ gift card was a slap in the face and I wouldn’t want his gift card either he should have at least offered her 50$ cash if she didn’t want that it’s the LEAST he could do SMH

@@payableondeath9091 yes and suspended isn't fired, so I suspect he is still working for them. Suspended means temporarily not employed so maybe a week or 3 can't work but not fired, that set off alarm bells for me.

I don’t like the look the defendant gave his witness when the plaintiff said anything could have happened to her like getting attacked or rapped. That comment didn’t really need a eye roll.

Treating a patient like that is horrible. She deserves $2500. If the judge had her butt in 17 degree weather she would have ruled differently. The judge showed her ignorance and lack of compassion for the patient.

It's not a court of emotion; it's a court of law. And there is no law that allows someone to get $2500 for being mildly inconvenienced in a customer service dispute. She was out for a payday (which is why she sued the company rather than the driver).

​@TheQueenrevolution she likely couldn't get a lawyer to take it on consignment because there was no injury to her as a result of having to wait in a second location for the correct driver to pick her up. In the end, she was taken home by the correct driver.

I see her filing complaints with not only the insurance company but with the BBB and the government licensing agencies. She is not going to let this go and I can't really blame her. This was outrageous but what was really worse was they purposely ignored her hoping she would just go away

I'm kinda upset that the plantiff didn't get more money. He/his company put her out of the car twice at below zero temps while she was in his care. I bet it was stressful as hell. The driver is/was a jerk.

If the contract was to take her from a medical facility to her home then they breached the contract. They took her to a gas station, abandoned their duty of care for 90minutes; then transported her from a gas station to her home (for which they did not have a contract) by a driver who did not sign the undertaking at departure from the medical facility. I cannot understand how she does not have recourse for damages, and the judge did not demonstrate how she does not have a case. If the company considered it sackable mis-conduct then surely it is an admission of fault.

She isn't their customer. The insurance company was the customer (hence why they said they had been in communication with the insurance company rather than the plaintiff). Ergo, if the insurance company wanted to raise an issue with the cab company re: breach of contract, they could do so (likely by ending the contract in the future due to this breach). But the plaintiff doesn't have legal standing on THAT issue, because she was not technically a part of that contract. All she could sue for would be physical pain and suffering, and all she presented to the court in that area (being "raped, robbed, or murdered," the temperature--which would have been an issue had she been outside all that time rather than inside a Rite-Aid, etc) were all HYPOTHETICAL pain and suffering. Remove the hypotheticals, and what's left? A mild (90 minute) inconvenience. You don't get $2500 for that.

THAT'S UNFAIR WHAT HAPPENED TO THAT WOMAN. IN THIS CASE JUSTICE HAS NOT BEEN SERVED. A SEDACED WOMAN LEFT OUT ON THE ROAD TWICE, AND SHE'S NOT COMPENSATED FOR ATLEAST $100, RIDICULOUS! MORE PEOPLE WOULD EXPERIENCE THIS BAD CUSTOMER SERVICE AGAIN. THE CAB DRIVERS NEED TO BE TRAINED TO HAVE GOOD CUSTOMER CONDUCT.

Judge was wrong about this case. I hope plaintiff goes to an attorney. Judge didn’t consider the medical or health standpoint. She only considered it a reg cab ride. Wrong.

The judgement was not wrong. Morally culpable and legally culpable are not the same thing. The plaintiff was entertaining, but she took a customer service complaint and tried to turn it into $2500 in damages by invoking 9/11 and clearly exaggerating every element of the story. There's a reason her witness wasn't there, and I guarantee you it. has nothing to do with him "not being able to talk to people."

I've had a LOT of problems with these medical transport cabs. They go to the wrong location. They show up 2 hours early, and when I called the dispatch, they told me I didn't need a shower to go to the doctor. Really? Who does that? Then they cancelled my ride because I wouldn't leave within 10 minutes of the ride arriving at my home. And wouldn't schedule another ride. Leaving me with no way to get to my doctor's appointment. And other times, they didn't show up at all. I've complained, but it does no good. It makes me hesitant to use the service. Nothing like being stuck somewhere and not being able to get home.

I hate it but she has to look at it from a legal standpoint. The lady wasn't out anything and wasn't harmed. I think it showed a lot of integrity for her to tell them to donate the gift card to charity.

@@tracyadams2731 You are correct but the company had not right to neglect her either. Had it been a doctor or nurse who had dumped someone who is still recovering from sedation, I am sure the doctor or nurse would have to answer to the medical licence board. The taxi company's conduct is unacceptable considering that they didnt even bother to reach out to her after she made them aware of what had happened. I wonder if the judge would have responded in the same manner had it been her mom or dad who had been callously treated by someone entrusted to provide safe transport to patients. That was negligence.

The defendant's accounts manager said the driver had been 'suspended' but she wouldn't say the word 'fired', why not? Does that mean he will eventually get to drive for them again? The defendant says he has only just found out about this complaint when he was sued, but his accounts manager seemed to know about it well beforehand. If I was the medical insurance company, I would not do business with them every again. This is a total neglect of her wellbeing, breach of contract and putting a person who is medically impaired at risk, she should have been awarded some money, not an insulting cab voucher...

Taxi drivers are not well paid and it's very tiring work; so companies are often lower in drivers than they would like to be. That means that attitude drivers tend to be released, picked up by another company and then will come back to the first when the second lets them go.

I’m from Buffalo and I have been put in absolutely scary, dangerous situations by liberty cab time and time again. When Uber and Lyft came to Buffalo it was a BLESSING. The defendant’s daughter also used to be my childhood babysitter 😂 this case hits home, I think the plaintiff deserved moreeeeee.

Something was amiss on this one. This cab wasn't a regular fun cab fare. This cab is part of her medical care treatment plan. This service is designated to provide a certain level of service in care of the patients they sign off and take responsibility for. And they failed to provide said service. In fact they were the opposite of that. Not sure if the judge didn't really understand that part of it. Or if she had a personal bias with things like this. Just don't know, but isn't this negligence. It's not call a cab cuz we're drunk after the club. This was a specialty medical service they offer and get paid by the state for. She should have whoever provides their federal government payments and grants take a look at her case. Cuz they're collecting federal dollars to provide medical service. And aren't providing it. Not sure if her demeanor made the judge ignore the negligence, or since she had a friend with her she couldn't have been that afraid or her friend was watching out for her.

I would love for another judge to review this case. I have always highly respected JM but damn this was so NOT justice or fair. This wasn't just a regular cab fare or ride. I'd love to hear her further comments on it to understand how she could have ruled that way.

Basically there were no damages suffered by plaintiff. You generally only get damages for actual injures suffered and she had none. Even if a party IS negligent, you only get to recover damages suffered. Plus there was no extreme or outrageous behavior for JM to award pain & suffering (which is the hardest tort to recover on; almost never granted).

The judge basically allowed the defendant to tell her how to rule. If he was offering $50, at the very least the ruling could have been for that.

If you can't read the writing on the wall, you get 0. She was putting it at 0 regardless of the gift card. So, she gave the defendant an opportunity to offer a goodwill card. He did and she declined. You should watch the episode again.

No, if she got the $50 gift card, that would’ve been solely because of defendant’s kindness. He is not obligated to give her anything - that’s why she couldn’t award plaintiff $50.

And frankly, just as the first time I watched this case, I suspect she KNEW that wasn’t her car but it was nicer than the one that Medicaid covered. She thought once they got a certain distance away and she “discovered” the “mistake” they’d be obligated to finish the ride. They were not.

After taking Medicaid cabs a few years, most of those companies are shady, and will leave you high and dry in a second. I can't believe those guys aren't held accountable after leaving her somewhere under sedation, just because they were worried they wouldn't be paid right, instead of going to their boss after. That's sickening. Why would she want a gift card to ride with them again? Her Medicaid pays for the cab! That doesn't even affect her if she gets a gift card! That's NOTHING

Don't agree with this verdict at all. The plaintiff deserved some compensation ... what is the point of having a contract if people can just break it and "solve" the issue by offering a giftcard for their company? The one that BROKE YOUR CONTRACT?! I don't even care if it was an emergency, weather advisory, etc. Purely based off of PRINCIPLE, they BROKE A CONTRACT with the medical insurance company! The whole point of suing out of principle is that HAD that been a life/death emergency, that SHOULD NOT be acceptable ... so why is it acceptable in other situations that a judge thinks isn't life threatening? Why does that even matter? Maybe she needs to sue the insurance company? I don't know ... this just isn't right ... let them continue their taxi operation like this; they should get burned by people like the plaintiff. The fact that JM ruled in the defendants favour is really disheartening.

Someone t boned my car and it was totaled. My son is very sick and gets free taxis if he needs it. We HAD to use it on the way home from the doctors office and had to wait 3 hours. The cab driver was horrible and treated us like trash, I felt embarrassed for no reason. Because my son is ill and I take care of him while my husband works? People always are quick to judge.

Unfair. She didn't know her wait would be an hour. That's pretty stressful. Even then, she might worry about the drivers attitude towards her. Unwell, you just want to get home and be done with the day but nope..had to be put out in the cold. Then with all the 6 calls ignored, they make lite of it in court. Unbelievable. Shame on them all.

Surprised to see so many comments about how "unfair" the judgement was. The plaintiff was entertaining and like-able, but she was also quite clearly a bit dramatic. For starters, unless her foot fell off, I HIGHLY doubt that she is on disability from a broken ankle nearly 20 years earlier. Any time someone starts their tale of woe from last week by jumping back to 9/11, that just screams lack of credibility. Second, she framed it as if he left her on the side of the highway. He left her at a gas station/Rite Aid. She framed it as if she were alone and wandering the streets in a semi-sedated state, but she in fact had a traveling companion (who was NOT sedated and clearly either didn't want to be there or she didn't think his testimony would look good for her). That's not to say that she wasn't inconvenienced, but she had two main complaints. 1- The driver was rude to her. He was. Who knows why. Maybe he didn't have the extra licensing and thought he could get in trouble for having a Medicare case in his cab. Maybe he's just a jerk. Either way, he was fired. If she wants more punishment for that, she can sue HIM (put a pin in this for a moment). 2- She was upset that the cab company wasn't speaking to HER. But she wasn't their customer. The insurance company was their customer, and they WERE communicating with them. Could they have called her back? Sure. Is that an actionable offense under the law? No. This was ultimately a customer service complaint, and that's not an actionable offense under the law. She took a customer service complaint on a fare that SHE DIDN'T PAY IN THE FIRST PLACE, and sued not the driver who was involved, but the parent company for 50x the amount of the original fare. She likely did so hoping that nobody would rule against her story of the 9/11 disabled woman who was left for dead on the side of the road in Buffalo. Of course she didn't want the gift card. Her fares are already paid for. She wanted a payday. And you don't get $2500 because you had to wait for a cab. That said, if the insurance company wanted to pursue the issue (over the signed form that was violated), they could easily punish the company by contesting their license to GET Medicare fares. But that still wouldn't legally entitle the plaintiff to a windfall.

I think the judge has spent too much time in Florida, she doesn't understand that when it's -17°F below (-27°C) a person can very easily and quickly freeze to death. That taxi company owes her far more than a voucher with their taxi cabs. Sometimes the judge is quite heartless and refuses to understand the severity of a situation, just because this plaintiff didn't die doesn't mean she wasn't at risk and this taxi company most definitely put her health at risk. They had a duty to either return her to where they picked her up from or else take her home, you don't just abandon a person at a gas station, when her ride (with the same company) was still at the hospital waiting for her...

I understand your point, but from the perspective of the actual law, you can't sue for what "may have happened" or "could have happened" only what DID happen. The plaintiff was not injured physically or monetarily, she was inconvenienced and that's not a lawsuit. I do feel bad for the plaintiff and I think that taxi service is a terrible business, I certainly would not use them.

When a paid/hired adult caregiver either in a nursing home or in a private setting shouts at an elder whom they are taking care of; or dumps them on the kerb; isnt that grounds for adult abuse?

Her husband is FROM Buffalo. She knows the city quite well. Another way of saying "she was at risk" is that the damages were hypothetical. Legally, you can't get paid for what MIGHT have happened.

"Yehahhhhh..." What a deeply cutting way of saying "bull s***" to the defendant when he said he would have done more had he known. That "yeahhhh" was voicing what we all thought, that he knew all about it all along but was blowing the loud (and slightly scary) customer off, although it is just as likely that he has a system in place that his staff are not to bother him with mere customer complaints. However, the actions of his driver warranted his personal attention. I have a feeling that a simple apology from the boss would have been enough to diffuse the anger, because she strikes me as being a sweetheart behind that intimidating voice.

anxiety is uncomfortable but it is an everyday part of life that you really can't sue over. If every time you sued someone that caused you anxiety they could sue you back for giving them anxiety for being sued.

I've never been angry with Judge Milian!! Very bad ruling. I've never disagreed with her before, but this was outrageous! The cab company was under contact and they breached that. You don't put a medicated patient out in -17 degree weather, it was negligent, and harmful!!

You cannot sue for damages when you receive a free service with no documented negative repercussions short of mild inconvenience. Mental anguish rewards are rarely awarded in small claims court because in general, the incidents are minor.

I disagree with the judge! The cab driver was completely negligent, and the company did nothing to right the wrong. Anything could have happened to her. Plus, the cab driver had to sign something saying he was responsible for her before the hospital released her. She should keep pursuing this. Maybe, file a class-action lawsuit.

First of all, the plaintiff (and the defendant if there is a counter-suit) sign iron-clad contracts to say they will not be able to seek justice elsewhere and this is binding arbitration. They all agree to the judges verdict is what they will follow, so technically she is unable to sue the company again over this ordeal. Likewise, for a class-action lawsuit to be filed there has to be many more cases, and while the plaintiff did say "they are being sued by 7 other people right now", I don't know if that is necessarily true - and I doubt that because how would she have that information? She is just trying to make them look worse than they are by making stuff up. As for the cab driver signing responsibility, that is wrong. If you have somebody that is picking you up, you do sign care over to them but if you plan on taking a taxi or uber then you sign yourself out from your own recognizance. I know because I had to do that twice last year after being put under for a procedure. The hospital would never force the taxi driver to be responsible for a patient. It is up to the patient to be lucid enough to get into the right cab if she had a voucher.

This really made me look at the judge a little weird because maybe the woman didn’t deserve $2500 but she for sure deserved more than a $50 gift card. And, the plaintiff was willing to give the gift card for somewhere else and she cut him off. This seemed a bit biased to me.

Working in healthcare, unfortunately most ride share companies that are contracted with insurance companies do NOT respect or treat patients with an ounce of care. There are good ones, but from my experience of dealing with them for patients- they ignore requests and requirements that patients put in. I worked for a medical ophthalmologist office and we had a patient who was legally blind. He required door to door service, meaning the driver is required to walk the patient from their pick up door to their drop off door. The amount of times this patient was left wondering at the entrance of the building (it’s a large building with 8 floors), made me so angry. Every time that patient came in, I had to call the driver and remind them that they had door to door service and he was supposed assist the patient. Drivers didn’t care because it required more work then. And what she said about having to wait 40 minutes, complete accurate. I’ve had patients wait HOURS to be picked up. And the best part? The driver can be at pickup, wait a few minutes then leave saying they didn’t see the patient (the funniest ones are the door to door service that leave) and the patient has to wait even longer for a new driver to be sent out.

She could have stayed at the gas station and not walked in the weather. But this entire situation was messed up. The first cabby should be fired at the very least. She was under sedation yes, but she had an adult with her. Not every bad unfair thing that happens to someone requires a law suit. That's what's wrong with people.

The plaintiffs had a medical procedure. The cab driver signed a medical document to take her home safely. He dropped her off in the middle of nowhere in below temp weather, with no fault of her own. To have her wait 90 minutes for another cab, probably in an uncomfortable spot at rite aid. If this had happened to judge daughters she wouldn’t be laughing and she certainly wouldn’t want a 50 dollar cab coupon. She Would use her authority to see for millions. She ruled wrong on this one. This case was no funny. The cab driver put her in danger. She should sue the cab driver directly in another court

I was locked outside my house in -20 degree weather... i felt my hands and legs were getting frost bite. I had to jog a mile to the nearest store... Possibly, but that wouldn't be her case to bring. She can sue for damages if she had actually experienced any damages. As the judge said, waiting 90 minutes for a cab isn't a "damage" from a legal standpoint. The insurance company (ie: the actual client here) could definitely revoke the company's license to transport Medicare cases. And that's why the company was communicating with THEM rather than with the plaintiff.

You don't get punitive damages unless you were physically hurt by someone and if you watch the People's Court twice a day every day, you'd think one would know that. I feel bad that she was inconvenienced, but it sounds like she might need to find something else to do with her time. I'm 'handicapped' and have a full time desk job plus a side hustle. It really bothers me when people come with all the dramatic speak. She kept talking about how cold it was or she could've been raped, murdered, etc... you were at the gas station, go INSIDE... you were at the Rite Aid... go INSIDE! She wasn't paying for the ride to begin with but wants to be paid $2,500 for inconvenience. Good grief. There are so many things people can do, even part time, to help themselves make a little money these days. Maybe she can pay for her own cab next time. #rantover
