@@natashascott8489I’m assuming because she knows you don’t need to put a deposit down to get financing. You tell them how much you can put down and they take that in to account when requesting the loan amount.

@@natashascott8489 yes that and I believe because both were missing important parts the dealership missing documents for the bill of sale and info on the deposit and the son not having proof on calling to cancel so she split it

When you are buying a car, don’t be in a hurry! Do your research. Visit other dealers with a notepad and pen to write down things like make, model, year, mileage, warranties and price. Go home and do some figuring and rank your choices, best to worst. Know where you will get your financing and all that is included. Then start with best. Don’t put any money down or sign anything until you are sure it is the deal you want. BE PREPARED TO WALK AWAY IF YOU DON’T LIKE THE DEAL! Be smart!! 👍🏻😃

Dealers have most of their inventory online now. You can compare the cars on the lot plus cars at other lots. Cars that you are interested in you can pull up the Kelly Blue Book so you have an very good idea what you are willing to spend. Some dealers will even post the VIN so you can run a CarFax report on them.

@@AnikaBren You are correct. I found my last car on line. But I would still want to test drive it and the walk-away is more effective than just clicking off! 🤣 The first car I bought on my own was in 1992. The salesman actually asked me if there was anyone’s permission I had to get before buying the car. I literally laughed out loud at the question. I was 45 years old! 🤣 We’ve come a long way!

They were lucky to get anything at all. Silly of them to pay a deposit with zero paperwork. And the car dealer is super shady for taking their money like that.

Harvey's advice at the end is some of the best I've heard him give. If a place asks for a deposit that is 60 or 70% of the sale price, there's a reason, and it's usually not a good one. They're anticipating a fallout and want to make sure the majority of the money is on their side when it happens. A deposit should be 50% MAX, but really closer to 20 or 30%. Especially if you're being told it's just to "run credit." Anything more than that, run like the wind.

If the car was sold for $11K the deposit was 25% in this case. That is way too much for my tastes.

I believe the mom when she says the salesman told her she had to put $2500 down in order to start the paperwork on the financing. She was naive in not asking for clarification and getting that in writing but I do believe she was duped. She was naive but the used car place was sleazy and dishonest.

Dealers will pull the "oh it could be gone when you come back but if you give me x deposit can hold it for you" its their way of not letting you just look at cars without buying. They are always putting pressure on you. Wife put $100 to hold her car I didn't care because we were buying one anyway but he got her to hand over cash while I went to piss. Dealers are shady af

Your monthly payments are contingent on your credit, hence you don’t know what your payments are until AFTER they process your full credit plus taxes and financing. My advice is NOT to deal with mom and pop car dealership; a real dealership will let you know in a matter of hours what to expect to pay.

Hmm so funny when I bought a car, and my husband bought his trucks, we had a pretty good idea how much the monthly payments would be. Well on the one truck that was financed and not paid in full at the dealership. There is this thing called math. It can easily be done on your phone and give you an approximate of the monthly payments. Insurance will also let you get free quotes. No excuse for what they did.

Multiple variables can change depending upon which bank agreed to write the loan. The finance charge, any banking fees + loan amt, duration of the loan = monthly payment. Since the plantiff are a high risk borrower. It probably took a lot of calls to get a bank loan. Some people stay thru this process. Others leave & await a call back. This car dealer was sneaky. The paperwork processing fee is usu $150. That charge needs to be in writing. The plantiffs put a down payment NOT a deposit. They used the wrong terminology, which skewed the case. The car dealer didn't correct them either. He wanted to double dip in the cash on that car!

Why would the plaintiffs think the defendant should pay for their driving costs getting the son back and forth to work? The plaintiffs are the ones who chose not to buy the car in question.

Every car I've ever bought came with, in writing, a 100 percent refundable deposit! This car dealer is probably buying the cars at auction, for cheap. Usually, it's the amount they require for deposit. That way, once the deposits have been made, it's all bottom line $ Something doesmt smell right here!

Doubt the dealer bought that car for only the amount of their deposit since they were able to resell it for almost 12 grand. But yes most used dealers buy their cars from auctions, often from dealer-only auctions when new car dealers send their trade-ins to auction that they don't want to warranty and put back on their lot as certified used.

@Stressless2023 "YES I HAVE," and I do it all the time! And then "HIGHLY UNLIKELY " LOL!! Stop being a Karen clown and take a breath. As "HIGHLY unlikely " as you think it is, we do it weekly! Cars on our lots are sold based on their book value. What we pay at auction, depending on where the auction is at really depends on the car and who's bidding. It's very common to sell the vehicles for 3 or 4 times what we pay. It's those margins that enable us to make deals, take trades that people are upside down in, and make deals work. Are all cars purchased like this? Yes, they sure are. Now, wipe that egg off your face! It's smearing your clown makeup!

With no credit or bad credit this is how ny works If you don't get approved for financing you get a refund. I had a car dealer ship sell the car after I gave them a 7,000 deposit then they refused to give me my money back said they had others cars not the one I put the deposit on or one that I wanted. In the end I got my money back.

@@tchevriersome ask for the deposit so when they apply for the loan they can input the deposit so the loan payments would be lower and they can hold the car for you but they definitely give you paperwork to sign saying if the loan isn’t approved your deposit would be refunded, I know I signed one when I went to purchase my vehicle but this defendant was definitely trying to scam them out of their money

This was fd-up! JM was wrong-wrong-wrong! That slimy car salesman sells 70+cars a week! Where's the crayon & toilet paper!? Finance isn't official until they get signatures from the borrower. People drive away from dealerships all-the-time just to be told to come back b/c the loan was denied! He is slimy AF for keeping these ppl money 🤡. He made $600 by *not* selling the car to them! JM be on some BS. What happened to "If it's good enough for you, it's good enough for me?" "Pay the lady"

The defendant is lyeing when he said he got tags and made up a bunch of junk to say he was out. If I was the judge, I would have asked him to prove that he got tags , when the plaintiffs didn’t sign anything for the car loan , and he knew 12 hours that they weren’t going to buy. The defendant was not out anything, but knows what to say to keep the deposit, which is why he dodged that he got more selling the car again. For buyers , don’t put a deposit down until your sure that you want the vehicle, otherwise it will be quite difficult to get anything back. The plaintiffs realized it’s better to get a cheaper car outright than all these extra charges for a loan . My advise would be that’s the way to go .

The defendant was out money. It takes employees to work up a deal and get the paperwork done. I am having a hard time believing they got the financing approved the same day when both had bad credit. I am not sure half was fair, but that was the ruling.

This is another example of why sub-prime lending is a thing. People have terrible credit because they make terrible financial decisions (usually), then they pay more $ for worse deals (another poor financial decision) because companies/lenders are taking on high risk customers who probably won't pay because they make poor financial decisions. And the cycle continues.

This is the second case of this Auto sales place that goes to People's Court I just finished watching One case with that guy that paid 22,000 for a used, in the defendant looks so familiar and is the same guy from the other case, people are you watching People's Court because keep an eye on this guy he's not a good he's not a trustworthy

There’s always some larceny in car sales they know what they paid, for they know what they can sell it for judge. Marilyn gave him a little more than what I felt he was due but the other party should realize that you’re going to lose money if you back out of a deal, I find it hard to believe that she was trying to sue for having to take her son for work. That’s a you problem if you don’t like driving him make it his problem.

Oh boy….. Every contract for services shall provide that such contract may be cancelled within three business days after the date of receipt by the buyer of a copy of the written contract. That is in NY. So if they had a contract the plaintiff can cancel the purchase and get her money back….every dime of it. So I am confused. There is no contract so she loses money? That is NOT the way it should have been handled. There have been many times if these tv judges were really practicing that they would have been sanctioned.

I know! I just watched a clip of Harvey saying deposits ARE refundable unless otherwise stated. There are different laws regarding deposits in lots of episodes. Maybe a state to state thing?

The dealer is only entitled to keep what they are out. The sold the car for more the second time so the plaintiff just had to cover some administrative costs. Giving the dealer a windfall of $2500 for doing very little work would be wrong.

The plantiffs put a down payment NOT a deposit. The used auto dealer is being Shady. Saying the whole $2500 was a deposit. The defendant should've had all his buyers sign a non-refundable paperwork fee. Most car lots have this form. It's usu. $150 processing fee. Car salesmanship time involved fee is a joke. They pitch regardless all day to many buyers productive or not. I've helped in many car finance departments.

I've had a few people leave me deposits on vehicles and other stuff and never come back, it's kinda crazy. It's not surprising that these people are constantly broke and have bad credit.

I just went car shopping not too long ago. I did have my own financing but I would have never put down a deposit without getting any financing details. The defendant also needs to be more clear about his deposit policy. He’s tryna be sly.

If you have your own financing, then you already know the terms of the loan and the car dealer has nothing to do with it. And "tryna" isn't a word..... it's toddler-speak.

Many dealerships know who they can manipulate and often do ask for a deposit prior to financing info is presented. You should always be diligent in knowing your stuff.

I seldom side with a used car salesman in these types cases, but he should not have to return that much. Thought JM was going to just split the"extra profit" he made by selling it to someone else after the plaintiffs breached the agreement (half of the ~ $690). I see no reason to give them half of their deposit. 🤷🏾‍♂️

Ok hold up. Doesn't the judge always and I mean ALWAYS say that deposits are non refundable cause they take the car or apartment or whatever off the market and blah blah? But now in this case because he said he made a bit more money from someone else.....he gotta return half her deposit?! Which is it then? U get no deposit,u get all,or u get sum? No wonder her new show is so bad using actors and stuff. Cause alot of her cases on this show be flip floppy

I've never handed over any money until all the papers were signed and my credit had already been checked and i knew what payments, etc would be. This is a weird way to do it.

I believe this case is inconsistent with other deposit cases. It's surprising that the plaintiff received $1200. Typically, a deposit implies that the money is forfeited if the sale doesn't go through. How does this differ from other instances where deposits are non-refundable? It seems Judge Milian may have been swayed by sympathy for the plaintiffs, leading to an emotional verdict.

Please put forth the effort to fix your credit, so that you can stop paying people these exorbitant interest rates. You can do it yourself, so you don’t even need to pay anyone to do it.

Moma's boy @ 26 🙄 splitting the deposit makes sense because they both were wrong. The paperwork - receipt for the deposit should have said NON-REFUNDABLE on it.

I have never heard of a car dealership taking a deposit. I lease 2 newer vehicles and both times we had our credit ran and THEN we sign paperwork AND then give the down payments. It's literally their job to call the banks to get approval to sell the car off their lot. A deposit is a choice in this scenario.

The $2500 was a down-payment to secure financing. People with poor credit need more money down to get approved. That money wasn't just a deposit to hold the car. "I took it off the showroom" is bs. The car never moves until paperwork has been finalized due to the financing possibly falling through. Once the financing was secured I'm sure they detailed the car and maybe even topped off the fuel. The only money the dealer was out was time and money for the financing itself and paying to have it detailed. A good dealer would've kept $500 and sent them on their way

The judge felt sorry for the plaintiffs because they are poor. Otherwise a deposit is a deposit. You have to be an adult and realize that a deposit means you commit to buy whatever you're putting the deposit down for.

Most used car dealships arent aware the same day if there approved for financing or not. As it is all based on proof of income which normally isnt brought the same day!

A rule to live by is if u cant buy it twice then u cant afford it. The mom needs to allow her 26 year old son to grow up. U need to be realistic if ur gonna finance a car and should already know how much u can afford to fork over each month. I would never put a deposit on something and not know first the details of how much u can pay. Im surprised the judge gave them anything back

How you keep the deposit from one person, when you sold the car to someone else. He got paid twice on the car, or more than he asked for, at least.

try that in Canada, if they sell the car with no loss they get the deposit back. They should do the math before buying a car. Check what insurance will be as well. That's what I do.

I went to buy a car many, many years ago. I signed all of the paperwork and everything and exactly 7 days later they called me and told me I had to bring the car back. The financing fell through. So why is it that I signed all of the paperwork showing the financing, monthly payment and everything and 1 week later I have to bring the car back. It was so heart breaking. Luckily, they still had my trade in and I was able to get my old car back. I wonder what they would have done if they sold my car. LOL

demanding a 2500 deposit before u even know if u will be approved for a loan is a scam . the car dealership knows that alot of people will cancel the deal when they get approved for a HIGH PAYMENTS loan . so the dealership makes at least half of the deposit or more for doing practically nothing and not even giving over a vehicle . what a racket , it should not be legal .

Yeah, it's not the dealer's fault that people get screwed. Something just overtakes the customer and makes them stupid. We don't coerce them at all.😼

tbh when i bought my first car, i didnt have my parents to help or guide me. BUT i did do a lot of research on the cars and always went to reddit 😂 i didnt want to be stuck with a vehicle that would have me at the shop every other month or something lol. It took me about 2 years to get my 1st car after i got my license. The used car market is insane. Especially on facebook market place. the cars would have a dead battery, transmission problems, leaks, or been in a straight up accident and people are still like “$5,000 obo” LIKE WHAT 💀💀 eff that.

Defendant is greedy. He could've subtracted his costs and and given them something back. He allowed them to leave with just a receipt. The deal wasn't clear which he uses to his advantage not to return any money...

I try not to finance anything. I don't own a home, but I always pay cash for all high priced items including cars (I only shop for economical, low priced cars) and iphones.

Disagree with this. They should not get anything back, it's a deposit. In so many other court case she has had she has said this. Only way I see they should get it back is if defendant said we can get you approved and he could not.

How on earth did the defendant get to keep anything considering there’s no contract saying he can keep anything. They didn’t sign anything saying they’re buying the car. All they did was put a “proof” deposit so the dealer can guarantee funds to the lender to help them get approved with bad credit. I’ve seen it a lot at shady dealers. This is horrible.

according to a previous judgement by rhis judge the deposit is not refundable. plaintiff was very lucky to get anything at all

I don't care what its supposed to be, this is a prime example of why certain demographics are taken advantage of. I get sick and tired of the fact that cars are this supposed life decisions, if I havent driven off of the lot with the car, I should be able to change my mind. Period. Her down payment should've been refundable, and quite frankly, there should NOT have been a deposit or down payment necessary until financing was secured! The dealer is in the wrong for not even calling and explaining all of terms of the financing that was secured before having somebody do all of the paperwork to even take the car off of the lot.
