The plaintiffs were hired to cater an extravagant masquerade birthday party. The plaintiffs say the defendants still owe them money because the waitstaff didn’t get paid what they were owed. They’re suing for unpaid bills and time and energy. The defendants argued they agreed to pay one hourly rate, but it’s not on them to cover the extra cost if the plaintiffs promised a higher rate. They’re countersuing for a taste testing charge.

Honestly,, even if it was a $200.00 event,, there SHOULD be something in writing.. I sold a trailer recently, the buyer gave me a $500.00 deposit and was to bring the other $1500.00 when he picked it up. I brought out a tablet to write a simple receipt and he said NO,, it's a gentleman agreement. So I took $500 CASH and he drove away.. The next day He sent a text saying that he changed his mind with a story about truck problems.. He said "just give me back my deposit money, no harm no foul". I told him he was out of his ever lovin' mind and charged him an additional $100.00 for storage until he sent someone else to pick it up..

And before anyone comes at me.. I know this comment section well 😂 besides bartending in bars, over the 12 years + the events I still do.. Most customers do not want to pay what the event is worth and the contract will protect you. Also, $500 for two taste panels seems excessive. The difference of the servers being paid $15.00/hr or $20.00/hr should be very clear. It's no different than if you go out to a restaurant and receive great service or horrible service. The $5.00 difference would be considered a tip. If you had to be told to get off your phone and serve the guest, you were providing horrible service and did not deserve to be given any extra money. Remember that 2 out of the 9 servers did receive the extra $5.00/hr, that in itself proves that the defendants were not intentionally keeping money that was owed, it wasn't earned by the other 7 servers. Tips are given to servers and staff that actually do their job, do it well without having to be told, and they don't have their cell phone out at any time while on duty. Plain and simple. You didn't earn a tip, you don't get a tip. It's the same way in any restaurant you dine in, and a party is no different, I wouldn't have tipped them either if I had to babysit them all night.

if i were the party planners i would advise to agree on a rate and if their performance was what they considered “great” then give them extra money at the end as tip/bonus.

I'm confused at how they had hired this company to do the same thing previously and not had it fall apart the way it is now. I have no idea at how they didn't have a contract and not end up quibbling like they did here. I would like to know what was different before (maybe it was a much smaller event?). What kind of a tasting cost $250 for two people? (this sounds like more than what their per person was at the actual event!!!). it certainly wasn't just paying for the cost of the food/drinks. For the people who think $10k is alot... the actual cost was more - they didn't talk about the venue rental!! or if there was hired entertainment etc.

I would never never never hire an event planner without getting a contract to protect me as much as them. Very irresponsible of both litigants, and the Defendant was definitely a jerk.

Does the judge realize she GETS PAID FOR HER TIME? She’s dumb for making that comment over & over.

We needed a lot of people because there was a lot of decorating to do. How much decorating was there? Well they actually did the decorating.
