The plaintiff rented an apartment from the defendant, but every time he flushed the toilet upstairs, it leaked into her closet. The dirty water ruined her clothes and shoes, so the plaintiff is suing for damages. The defendant admits there was a leak, but the plaintiff stopped paying rent and is just trying to rip him off.

Agree. Even if it wasnt all trash she knew it was leaking. You can’t just cover your eyes and keep damaging your items. I’ve seen a video of a plumber messing up BAAAAAAD and water pouring out of under the sink because the super/apt owner didn’t want to deal with shutting off the water and it was flooding the whole place. The people were freaking out but trying to move their stuff and stop the water with towels and using a shop vac to suck up what they could. This was over time and she knew and still didn’t do anything to mitigate the damage of the water to her stuff. Ridiculous scammer because she totally tossed all her junk in there to blame it on the leak

She would’ve been smarter to just ask for a rent abatement . She would’ve gotten $2000 for that . Because over a year having a leak that is ruining your things she could’ve gotten about $150 off of rent for each month and then about $300 in damages for clothes . I’ve won a case against my landlords like this . I abated my own rent into a separate account . It was so cool that I was a law student and I won against their seasoned lawyer 😂 by the end of the case I had $1000 to go shopping with and 6 months free rent because I was ordered not to pay rent until the leak was fixed . Even after the judgement they still didn’t fix it , eventually we just left . But they also because hostile and started breaking into our apt . They also broke in before court trying to steal my evidence . They didn’t know that I had back up copies in my trunk 😂

I think the plaintiff deserved a small amount of $, but she still got way more than she deserved. All those items in the pics were definitely well used. She was greedy. Also, whatever happened to "mitigate your damages" she could have moved her items to a different location if she was aware there was an ongoing leak. The defendant, who admitted to taking too long to fix the leak, seemed like he was trying to do the right thing.

With respect to the security deposit, I don’t know if all States are the same, but where I live the security is supposed to be placed in a separate interest-bearing account. Not to be used to pay the defendant’s mortgage. Edited to add: And if there was a leak in the closet, WHY would the plaintiff put ANYTHING in there. She had a duty to keep her things away from the leak. Yes, it’s an inconvenience and can crowd the room, but she absolutely could have done MUCH more to protect her belongings.

She tried it, if her clothes and shoes were designer then yes the amount she ask for in court would have been accurate, but..... I actually think that the plaintiff was overpaid for the damages, there was absolutely no proof of damage to the air mattress, the couple of shoes that she did show like what three pairs were super old not name-brand and then she got caught lying about the suitcase and the defendant paid her $200 for an old Nautica suitcase that you could probably get at Ross for about 40 bucks, I really don't think she should have gotten anything more! And that's not because I don't think that any of her stuff was damaged or that there wasn't a leak it's just because I think she was already paid and lied about the amount of damage just to profit on the situation.
