it's not law of Islam it only cause of geography bcz Arab world has need hijab bcz the climate and temperature distribution is against body ( i.e extreme warm with dessert warm in summer and extreme cold within winters cause of Mediterranean dipression). It can be threats for security concern ,but if we banned it then we lost our status of DIVERSITY IN ONE RING ,AND IF not banned then it's against F.R ART 14,15 IN My view ONE COUNTRY ONE DRESS FOR EDUCATIONAL INSTITUTIONS 🙏🏼

Religion is yet to become a complete private affair in our Indian society as of like western nations , Thus it also draws into various ambiguous questions of hindu students who practice discipline during mandala of Sabarimala whether will they also be barred from wearing black scarf and coming shoeless to institutions, sikhs with various symbols of religion into picture such as chains, bindi, etc of hindu traditions and Christian cross chains and so on . Uniform reflects professionalism and imbibes spirit of oneness but at the same time these exceptions must be encouraged until our society becomes matured enough to differentiate public and private affairs , In the name of secularism and uniformity we cannot stifle diversity as it might backfire and lead to improper communication of our constitutional ideals to our society. We need to define some of the unaddressed questions here such as 1.What constitutes an uniform ? , whether only dress or also accessories ? 2.Doctrine of proportionality ? - whether your individuality flouts the whole uniform or is it just an add on ? eg.hijab, bindi , flower , bangles, chain is different from burkha , whole sage attire or priestly look ? 3.courts must look into the wider implications of a progressive transformation as well because certain social lag cannot be changed overnight which requires a phased approach eg.A community of woman already suffering from marginalisation of education due to patriarchal notions should also be taken into account , as patriarchy cannot be dealt in one go or it will only backfire the woman education in return . Thus comes here a need of fundamental definition of distinction needed between a revolutionary law and an evolutionary law which judiciary or legislatures must decide which it might opt. For inhuman practices , intolerable practices such as untouchability, sati, violent jihad the law of the land must be condemning and aggressive but considering the proportionality principle again , certain aspects of religion which are less severe in nature like these behavioural aspects cannot be dealt with law alone. Thus for intolerable religious practices a law is a necessity but cannot be sufficient without social development, best example is untouchability still prevailing even after strict laws, whereas for other religious miscarriages a law must be sensitive towards present societal sentiments whereas at the same time also be visionary until a matured democracy is attained .

Mr Mustafa's last argument is highly justified. Covering of one's head with uniform's color could balance individual's right of expression and need of uniform in secular education institutions.

To me mr dahiya why we all are not looking into other important matters concerning our own survival in the present time.The education, the gender imbalance, the inequalities the jobs the hunger the law & order the justice hence the prosperity. If every section of the society is filled with respect trust and compassion ,it leads to harmony and unity which automatically handles small issues like hijab etc.

HIJAB CONTROVERSY Education plays a vital role in the development of new model india and not only it emphasises economic growth but also civilisation among the people . India being a nation of vast culture and religion has always favoured each and every member of the country equally and respect every religion irrespective of majority or minority and the reason india is known as a secular nation . Unfortunately , India has been trapped in a major controversy ie on hijab . This all started from a college in Karnataka who refused students wearing hijab to enter college which led to protest and in response the hindu students also came up with saffron sawals to protest against hijab . Hijab is actually a kind of attire that covers head . Let we not be confuse this with burkha which is face covering by muslim women as this is not a topic of debate . There is a case in iran too where muslim women were protesting against hijab as it is a kind of supression for them. Well in hindu religion too there is headcovering which women use to wear after wedding , some are agreeing and many are against it as it according to them doesn't give position in their sasural as daughter. From the above three statements its clear that the headcovering is a voluntary choice and they should choose whether to wear this or not . Overall hijab is an islamic concept of modesty and privacy notable a clothing of women that covers most of the body and this is same in hindu too as stated above . Therefore according to my view there should be no supression of not wearing this and if they feel comfortable wearing this in society than there should be no barrier on them but that too doesn't mean to impose this attire complusorily by the name of any religion as its a personal whim . As far as educational institutions clothing should only be banned if it - 1. Establish inequality 2. Disturbs law and order 3 . Contempt of court 4. Security threat etc The last point that I would like to mention here is that there should be clothing in education institute which is uniform in nature and doesn't establish differentiation and if girls( whether muslim or hindu) want to cover their head than can but in the dress colour prescribed by the institute thats it. Apart this there is limit on something that is to be frame by the court with proper deliberation.

The sentence ..in a secular country like India religion is not the topic to be discussed everyday ...itself gives the guidelines to the citizens about their social behaviour . Educational institute is not the place to show our religious beliefs . As we are free to follow our own religion at other places we should not bring such issues knowingly ...and as a responsible citizen its our own duty to do be always aware that none of our action results in creating Chaos in our own country ...its a matter to be understood by own and not to be made nationwide.

Uniformity is important but at the same time we need keep in mind that we are a secular country. The supreme law of land is giving and protecting the right to liberty as well. Any fundamental right if violated by any law/rule made by any government institution afte legislature..then fundamental right will prevail over that law/rule what so ever that may be..coz constitution is above any thing else..not ends in schools or any institution. In Corporate sector laws or rule may not be followed as same as in govt institutions..but they also don't have any relaxation to violate any law of the constitution judiciary would nullify that.. Now here the school administration made the uniform dress code in karnataka that some how create the clash with article 19 and 25.. which is already in supreme or High court they must check and if violated any one of the above two provision then..school administration must go under trial... The religion says about padha only to cover body even Head too..but what type,color or size/shape cloth should be not defined... hence covering the head then dupata by same color of uniform is also an option to cover...if hejab becomes the topic of controversy and barrier for education... Court will give very fare judgment and hope things will comedown and normalize soon...so that students start their study....its few useless politations who don't care whose career is on stake..

I agree that all have right to religion obviously, but we are such a diverse country. So many different religions, castes, sub castes etc etc. Within the classroom we must all be the same. Outside that we can be whatever we wish to be. Over and above the uniform in the classroom, we must not allow any identity of any religion to prevail. The uniform is after all , religion neutral.

@@motabhai7287 you may right at your stand but the nature of secularism is it couldn't contradict the plurality prevalent in the country so term secularism has meaning only if it assures the experssion of any form of difference, hence we can't demolish the foundation and construct the top..after all laws are made for ppl not for govt nor for politics...if ppl are not satisfied then govt can't impose, otherwise called ( andha kanoon) hence cultural diversity can't be compromised to the extent of preserving uniformity..and difference doesn't imply discrimination in a robust democracy...

😄😄... When they are following the rules of their religion i mean as they say these politicians then why you need school colleges to have their rules, dress or even responsibility.. Other point is there are many countries where these Burqa, hijab, niqab i mean everything is banned in whole country forget school colleges so are these countries are less secular... And about choice it's good for them tomorrow they will choose something else 😝 So only point is stay in uniform inside that's it..and what's wrong court has said already school colleges with uniform follow dress code there now if Bjp thinks they will even implement in places where they don't have any dress or uniform then good luck to them.... And how can court say don't spread this issue in whole country if supreme court honarable came in between then it will surely become whole country issue coz they are the top court in this country thank you

We had to fight for better standard of education, that we can compete with foreign universities. Looks like we are still stuck with pieces of cloth. In many Gov't institution their is no teachers, proper lab, basic facilities, washroom , sports.....students are being pulled into dirty politics. We are secular, we have to accept every religion that what make india beautiful and know for.
