True. I also get a bit miffed when people like Phil don't know the difference between fortunately and unfortunately. It's true she should have recused herself from the case involving Penguin (any involvement with a plaintiff or defendant presents a conflict of interest, though hers was a legitimate business transaction), but let's not pretend that what Sotomayor did was in any way the same or as egregious as the "extracurriculars" we now know Thomas and Alito have participated in.

Citizens United needs to be overruled before anything can be done about this - and the right-wingers that dominate this Court won't be doing that any time soon, especially when they are enriching themselves with that very ruling. The bribes (let's be clear here, they ARE bribes) accepted by Thomas and Alito are clear ethical violations, but because of their positions as Justices and the murky laws surrounding political donations, they are pretty much untouchable by anyone but Congress - and the Republican-controlled House isn't about to impeach their own appointees, regardless of how destructive and harmful to the integrity and trust in our institutions they are.

I'm worried about it, but also, wtf do you do? Impeachment might get through the house, but the senate requires a 2/3 majority to convict. With a Republican majority in the house, it just seems incredibly unlikely that they could swing 16 votes to convict. It seems like it would just be a token gesture. It seems like to actually get something like that done you'd have to somehow stomp out gerrymandering, go through a couple election cycles to vote out incumbent blockers, THEN file the impeachment. I just don't know we can pull all that off before the heat death of the universe, much less before the current SCOTUS members all die of old age anyway.

@seraph8
@seraph8 Жыл бұрын
@@sharazar It *should* be started, but any impeachment recommendation begins in the House. Because Republicans hold control over the House, impeachment proceedings would never even get off the ground. Let's just be clear: Republicans have no problem with stacking the Court with bought demagogues and partisan hacks so long as THEY are the ones doing it. The hand-wringing and half-measures we see from that side of the aisle is nothing but political theatre - the *appearance* that they care about integrity, civic and democratic values, and the impartiality of the Court - though we KNOW that they do not. If they cared, they are in the unique position of being able to do something to remedy the situation; that they do nothing but try to rationalize and explain it away lays bare their true intentions and fascistic ideals.

If the system functioned the way it was intended, with decisions made based upon laws guided by actual ethics and democratic values, that *would* happen. We already know that Alito has engaged in the same manner of impropriety (shocker), and that House Republicans categorically DO NOT care about what amounts to undermining the foundation of our justice system from within because they are the ones who are beneficiaries of that impropriety; basically, these are "their guys" and this was the plan all along. It's transparent what they're doing, and all the hand-wringing and rationalization is a distraction to the gullible, the misinformed, and, of course, their proudly fascist base. The simple fact is that no Republican is opposed to stacking the Court with bought-and-paid-for ideologues so long as it is them doing the buying. The impeachment process would never even get off the ground, and people like Thomas and Alito have no shame because they believe their actions to be righteous - to them, their goal of turning back the clock on human rights and protections for the marginalized and disadvantaged is worth compromising our nation's integrity and values on fundamental level.

@remedy653 Of course this is ideal, and Justices in general should be more rigorously screened and audited regularly for this type of flagrant ethical transgression, but I would be remiss if I didn't mention that the only Court members that appear to have engaged in it are Thomas and Alito - two Republican appointees who have been on the court for decades. Yes, it is possible that any number of further Justices have participated in the same abhorrent behavior, and I believe such scrutiny is warranted in light of these revelations, but this isn't the time for the "both sides" refrain; only one party is responsible for this specific variety of corruption as far as we are aware, and that same party has the onus AND unique ability to do something about it - but choose not to. Funny how that works out.

@@wesleyson21Weird Al doesn't rely on Fair Use as he gets permission from the artists to make his music. A lot of his songs wouldn't count as parody in the legal sense. His songs' new lyrics have to be about the original song to justify using the music. For example, 'Smells Like Nirvana' is about how you can't understand what Kurt Cobain is saying in 'Smells Like Teen Spirit' and has a strong Fair Use case because of it. In contrast, 'Eat It' is just 'Beat It' with different lyrics and has a weak Fair Use case for using the music.

Humans have always been stumbling around in the dark since before what we recognize as a modern human came to be, and now a bunch of over-complicated primates are having all their issues are blasted towards them 24-7. I can't say that the internet is the direct cause of these overtly radical attitudes, but with the instant and vast communication it provides, I'm confident that it exacerbated them quite significantly.

Sure, copyright strikes can be issued by malicious third parties. Sure, somebody could technically impersonate her and upload Toxic Gossip Train to platforms like CDBaby and Spotify. However, to argue that someone NOT ONLY uploaded the song onto multiple platforms BUT ALSO started monetizing videos reacting to it maliciously is ridiculous. It's far more likely that Colleen's lawyers have finally started trying to damage control her insane behavior from the past few weeks. Their statement leaves a lot of wiggle room for the song to have been uploaded/claimed by a member of her team or someone else close to Colleen, which is a far more likely explanation.

Stay inside during the day, drink lots of water, go out in the morning or nighttime. Over 110 doesn't surprise me. BUT what does worry me is all the people who have moved here over the last few years not understanding how serious the heat is. It's not your usual summer heat. I also feel thankful that we often have air conditioning in most of our houses and apartments. I have a friend in New Mexico who can't say the same. A lot of places there don't have updated central air or any at all and are seeing similar temperatures. My advice to anyone new to these temps is above and also look out for your neighbors and donate cases of water where you can. Places here often have water drives. Keep a water bottle on you for yourself and if you're able, ones to hand out to houseless people on the street. It's rough but it's something that's very understood here we have to deal with every summer unfortunately. I'm honestly worried for how worse things will get as global warming rages on. Thank you Phill for covering this!

I've had people see what are apparently my "clones" out there before, someone even asking if I was working a second job because they'd seen me working someplace else...took some convincing to assure them that no, the store I was in at that moment was my only job and that they likely met one of my doppelgangers.

The interesting thing about the Tate situation is like sooooo what if…everything is true. Like why possible hitch a wagon to such a possible monster? I know they think “ahh the media cycle is so fast you’ll forget” forget what you saying multiple times you agree with him and gassing him up. Where is the win here?
@crose00
@crose00 Жыл бұрын
The win is they get to intimidate women. Men like tucker carlson know tate is guilty. They know he’s a human trafficking abusive piece of sh*t. They do it to put women back in their place because they see the me too movement and other feminist movements in recent years as a direct assault against them

presumably they'll just continue to bang on about how he's been "framed by the matrix" and is actually innocent. To his true fans it's just going to confirm what he's said all along making them even more zealous in their belief of him and the ideas he spouts.
@stanleymontgomery2132
@stanleymontgomery2132 Жыл бұрын
I really can’t tell if the allegations are true or not. Only thing I’m so far able to cling to is that the case is suspicious. It’s more than obvious that the case is corrupt and violated his human rights by treating him as guilty until proven innocent and imprisoning him for months. But it’s also obvious that even though this was years ago when he did it, he was a sort of snake from his cam girl scandal. And I see why these die hard Tate fans get so pumped up and feel the need to follow the ideal that the “ matrix “ is setting him up. You got the fact he’s been unlawfully imprisoned, the fact that the government used a normal conversation and framed it to where it would sound like Tate planned to flee the country and that one of the girls in the case, Sophia I believe the name was has no known identify, no last name, no social media presence and pretty much 0 evidence she was a real person
