The argument is correct. The ICJ is simply a panel of judges elected by member states. These include Arab (edit: and Islamic) states like Iran, Iraq and Lebanon which all have a personal and religiously motivated animus against the State of Israel. Thus, there is no International law that prohibits (dictates that one can't) the sale or furnishing of arms to any nation (With the exception of Nuclear arms). Article 7 requires a risk assessment for all weapons transfers, and prohibits exports where there is an overriding risk that the weapons could be used to commit serious violations of international humanitarian law (the law of armed conflict). As we all know, there is no International "Police force" that enforces International law - it doesn't work that way. When the ICJ or ICC is more like "civil court" and not criminal court. Once the court finds in favor of an "overriding risk", they make a ruling. But even then, its up to the Nations that are signators of such agreements to "police themselves. Example: The Hague court of appeal ordered the Dutch government to suspend arms exports to Israel. The court relied on reports from Amnesty International and the U.N. when it listed multiple examples of apparent violations of the law of armed conflict in Gaza. The Dutch decided not to sell arms to Israel. But they could have continued, and no body could stop them. That said, "Hamas" is not a Nation, nor do they represent a Nation. One of the aspects of a Nation is that the Nation _Taxes_ its citizens, to use the proceeds to run the government...including for "defense" cost. Both Gazan's and WB Palestinians do not pay taxes to "Hamas", or the Palestinian Authority. Israel collects tax on behalf of the Palestinians. All of this is to say that the concept of "International Law" is nothing like 99% of people imagine.

The UN didn't determine the legitimacy of Israel's statehood in 1948. The Jews won the war of 1947-49 and their state was recognised by other countries that made determined Israel's legitimacy like all others states on earth. If the Jews didn't win the war as it was expected by all parties, the UN partition plan would have been a dead resolution.

And at the end of the debate when Piers tells him that the UN says the settlements are illegal he goes on to say that the UN "is no authority to define international law". Now Israel is saving the Palestinians from the evil UN that votes for a ceasefire. Looks like Israel has done a better job of saving Palestinians in the last few months than the Arabs did in the last 75 years.
