"Here’s the deal." “I’m only doing my job.” "In the current climate." "You fit the description …" “I'm not going to argue with you." "I'm going to pat you down for COP safety." “If you have nothing to hide you have nothing to fear.” Enough is enough! Paranoia will destroy yah. If It’s no big deal then, why do you need ID? The 4th Amendment makes no mention of Detention, RAS, Dogs, Officer Safety, or Arrest. These are all FRAUD instituted by the SCOTUS Privet Corporation (Fascism) and the BAR Mafia. The BRITISH Accredited Regency (BAR) is OWNED by BRITISH Bankers. A Monopoly of Law, Justice, and Banking (Fascism). Interpreting the Constitution does not include REDEFINING it. (A "NEW LAW" would mean an amendment to the Constitution, all else is Color of Law.)

There is no such thing as "Case Law", there is "Case Precedent ", nothing more. The Supreme Court offers opinions, they do not create Law. You will not find anything in Article III that grants the Judiciary the power to make law. The courts only job is to weigh actions against the Constitution, as written, and not to interpret anything. Continuing the concept the the Courts Rule, only Dictators and Kings Rule, or "Make Law" is a great mis-service to the People and helps to foster the idea that the Government has more power than the People, when in fact ALL Political Power is inherent in the People, not the government. This is exactly how we came to the place where the government no longer fears the People but rather abhors them as nothing more than a nuisance or even worse, the Enemy.

No one is disputing you have the Right to protest and bear arms, but when you do, the police will come and STOP YOU. No one is suggesting you are a slave, but when you act like you are free, police will come, put you in shackles, and throw you in jail. The only reason for police to have Qualified Immunity, dress for the Invasion of Poland, and violate the Bill of Right is Domestic Terrorism.

For those that are going to complain about "iTs TaX pAyErS mOnEy", it's not. It's Tax payers cost of freedom. I would rather pay a small fee than my life like others have, than freeload off of those that gave it all. A lawsuit against the city will set precedent that our rights shal not be infringed by corrupt tyrants. Population of Linn is 1300ish people, if she wins 2 million dollars, the tax payers will be out $1,538.00 each, which will probably be paid for by a sales tax slipped into a spending bill somewhere between schools and water treatment...

It confuses me to no end when an officer thinks by saying, "I just got here" absolves them of their responsibility to uphold the law and actually hold other officers accountable. Whenever a citizen is describing the unlawful behavior of an officer to another officer they will say that to suggest that there's nothing that they can do about it.

@@ianbattles7290 You can't. There's a large misconception that you can though, due to an Indiana Supreme Court Justice's opinion on the 1893 case of Plummer vs. State. The court's decision did not afford citizens the right to injure police officers due to an unlawful arrest. However, people get the court's ruling confused with Justice Wade's written opinion, in where he did support the right to forcibly resist unlawful arrests. His opinion was not the ruling though. People have been confusing the two for decades.

@@Cerus98 Ordinances may or may not be laws under a strict interpretation (Kentucky doesn't have "laws," it has "statutes," for example, and local jurisdictions have ordinances in Kentucky), but they still have to comply with the US Constitution and the rights guaranteed in that document. And, to @sslerlin's point, such a suit could potentially come out of this situation, if the right lawyers get the right amount of money to go there. But I'm not a lawyer, and don't even pretend to be one in KZbin comments, so I can't say for certain.

For example, in Texas there is a state law that forbids any local government subdivision from passing any law or ordinance concerning firearms or weapons. This got Leon Valley and another town into lawsuits when they passed laws concerning when and where a gun could be loaded and whether a gun could be open carried. They were forced to rescind those laws. The term "ordinance" is used mainly to differentiate between a state law and a local law. Violating a local ordinance will still buy you a ticket or an arrest, depending on whether it is a civil or criminal ordinance.

The real problem is who defines what constitutes "disorderly conduct". There was a time when cops would take drunks home when they were out walking in public and today they just arrest them for being drunk in public. A friend of mine got a public intox charge for drinking a beer on his porch.

However an officer can approach that person to ask if they need assistance since they did directly communicate to the officer that they acknowledge their presence. IMO the officer should acknowledge the person in case that person is in some kind of distress of some sort. Physical or mental. A really WELL TRAINED despicable officer can get a person to slippery slope themselves into an arrest depending on that persons actions. Just be aware of the games that can be played.

This means for example. That technically Free speech protection by the constitution has nothing to do with you and your neighbors interactions. Technically, that ordinance could enforce if you give your neighbor the finger. But not between a citizen and a government actor. Such as this case. Which shows what a slippery slope that ordinance is. But because of the slippery slope of such an ordinance. Most courts would probably just deem it unconstitutional in general.

Something similar to this happened to me not too long ago. I explained to the officer that if he assaulted my significant other, it would be the last thing he ever did without a walker and a colostomy bag and that maybe he should call a supervisor. Things slowed way down after that and he began to realize the error of his ways. When his back up arrived, they eventually reinforced to him that he should probably just have walked away, at which point we all did just that.

I firmly believe that we need to make a national law that states that police officers cannot be the sole complaintant for a disorderly conduct charge. Way to many times have I watched these videos where an illegal arrest is made with no evidence of a crime being committed, yet the cops just blurt out "disorderly conduct" and then try to stack "resisting arrest" and "failure to identify".

@@Some_Guy6 I know where you're coming from with this, but also try to understand that the way incredible stress, like being in a gunfight, affects you physically and mentally is something few people understand. Laughing, smiling, and joking in very serious/dangerous situations can very well be a coping mechanism that allows someone to continue toward danger like they are obligated to do instead of fleeing for their own safety like we are all instinctually programmed to do (self-preservation). Now I don't exactly know the specific video examples of cops laughing on body cams during the Uvalde shooting that you are referring to, so I'm not disputing those; that whole situation was a colossal failure on the police department and those cops very well could've been part of the problem. But I would also inform you that there are numerous videos of soldiers behaving the same during wartime in hostile areas. These two circumstances are not much different than one another: there's an immediate threat to their own safety, and yet they find a way to make it light hearted where anyone else would be scared for their life. I'm all for holding cops responsible for the shit they do like we see in these videos, but we should be careful to not let that call for justice target the ones properly doing their jobs, even if it might seem like they are not taking it seriously from face value, especially during extreme cases. TLDR: Just because someone laughs/smiles/jokes at an inopportune moment during extreme stressful situations, doesn't mean they are evil/corrupt/inadequate. That behavior should be looked at alongside their full performance and with full context of the situation.
