In 1978 I went with a friend on a 4 day holiday weekend, and was gone 6 days. Returned to Fort Benning and received an article 15. In the article 15 I was giving 14 days restriction 14 days extra duty, a $250.00 dollar fine, and reduced fron E-3 to E-2 with suspended reduction to E-1 for 90 days. Well a buddy said my commander could not take two ranks with a company grade article 15. So I talk to a jag officer and he agreed , but I had to go through my chain of command to get it changed before he could do anything. So I went all the way up to the battalion commander. No go. So the jag officer took my case. Well a couple of weeks later I go by the officers club and see my jag officer hanging with my company commander. Well I just dropped the case and put a request in for duty change and was sent to Schofield Barracks. And things were forgotten, still made E4 and received a good conduct medal before my 3 year hitch was up.

The thing one must know is that these JAG officers are and do socialize with members with their Commandery’s even the prosecutors and UCMJ laws differ from civilian laws and courts. That been said you as a military person can use the law libraries and do your own research ( most JAG attorneys hate this cause it will make them work under the threat of them not representing or misrepresenting you). Basically a base house paralegal. Mind you racism is a part of the military so be careful of what you do and whom you associate with.

One soldier I served with got an article 15 because his wife wrote a hot check to the commissary. He didn’t write the check but he and his wife had a joint account.

What the 1SG or CO should have explained when you showed up to the company, was you the Soldier are responsible for the actions of your dependents. Wives, husbands and kids have all screwed over the bread winner from time to time. Two conversations to have, unless the spouse or child wants to live far away from the Soldier, their behavior needs to comply with the Good order and discipline of the Armed Forces and/or the second conversation, Darling if the Army wanted me to have a spouse and kids, they would have issued them to me, and say goodbye!

That's one thing that sucks about the military. You are responsible for your dependants and if they do something stupid you are the one that gets in trouble.

The shittiest article 15 i ever got was when my company was deployed to Iraq. They got me for cursing out my platoon sergeant and squad leader. It was company grade article 15. We would do road mission then when we were done, I'd get to go fill sand bags for an additional 6 hours. Yeah... don't do that.

We had a guy in our unit that assaulted his CO (at a previous duty station). He was sent to the "Retraining Brigade" at Fort Riley, Kansas. After serving time there, he finished up the rest of his enlistment and was eventually honorably discharged. It is very interesting how employers will do research into your military record. When I got hired as a cop, I signed a release form so my department could pull my 201 file from the Army record archives in St. Louis. After I got hired, I asked the human resources department about it. They told me that just because someone has an honorable discharge, it doesn't mean that they weren't a screw up while serving in the military. As you know, your 201 file contains a lot of information about your entire military service, including punishments if any. Needless to say, my record was spotless and I went on to a great career in Law Enforcement after my time in the Army.

I'm a veteran & served 4-four years active duty, MP, early 1990s. I think that place in KS was called; The Rabbit Farm, 🐇. I recall other active duty MP/JAG unit soldiers saying it started as a drug detox place for SE Asia veterans. Many returned with serious heroin, drug habits, 😟.

Cameroon Cajun: I guess that would all depend on the agency. I was with the Broward County Sheriff's Office (Florida). Second largest law enforcement agency in the state of Florida (more than 2000 deputies). They always push the phrase, "Must be of good moral character", when you apply. You can always explain your story, what ever it may be.

mac burger: I agree with you 100%. As sad as it is, it seems this world has evolved into a total sewer. There is not much incentive to do right, and even worse, not much penalty or punishment for doing wrong. I live by a different standard. My freedom is the most important thing to me as a living human being. I would not throw it away, so I could be incarcerated with other men. Sick as it is, we have a segment of society that seems to think that doing jail/prison time is an "achievement." I served honorably, and earned an Honorable Discharge. I enjoyed my time in the Army and it was a great life experience for me.

When I was in Germany I had gotten to intoxicated out in town, the MP had to bring me back, resulting in a summarized article 15, 7 days restrictions, 7 days extra duty

My kaserne (3rd. AD) in Germany had an unwritten rule that a town courtesy patrol that turned in soldiers to command would reap the "reward" of that of snitches. If you were just drunk and not belligerent, they'd just drop you off at your unit. Other kasernes (3rd. ID!) were not so fortunate. I had a friend in the 3rd. ID that was given a courtesy "lift" from the train station back to his kaserne by the patrol. He was not drunk. How nice, he thought. That Monday he was called on the carpet for drunkenness in town and given a 14/14 Article-15. Not so nice.

I was assigned to HHC Combined Arms Command at Ft. Leavenworth, Kansas. While I was there, two inmates of the Disciplinary Barracks (DB) had their cases overturned. Both were released from the DB to HHC while they were processed out of the Army. One was convicted on false testimony and received a settlement, back pay, and E7 retirement based on what JAG thought he would have attained if his career hadn't been interrupted by a stay at the prison.

A buddy had 17 article 15's, both company and field grade in his career.He retired as a e3 in the guard.

@@dougtheeliminator1077 He was stationed in Germany for 12 years and active didn't want to re-up him.He joined the guard and was a amazing infantryman.Booze and Garrison was not his thing.

When I served as a E-4 in my 2nd unit, Fort Lee VA, we had a wierd E-4/SPC in the brigade who reportedly was a former E-6 who was busted down but stayed on active duty. 😏... from what I was told the soldier had 20-22 years but %&*÷ up bad!

During my time in the military start date 76 in basic training we had a pit to settle disputes well I requested to enter that pit with a DI whom kept harassing me he refused but during our final days we received a 12hr pass and went into town. Me still angry saw this DI and I was out of uniform giving to us by the local USO so I approached him and said what you got to say now ? He didn’t say anything but proceeded to strike me fortunately a police officer saw the whole thing . In my defense I beat the daylights out of him and the cop told me to head back to base and say nothing. But other soldiers saw it. That morning this DI was out sick and upon our graduation my dad was in his Marine blues and I showed him this abusive DI and pops locked his heels . Thus he learned where my fighting abilities came from. Gotta love it . He learned never judge a book by its cover.

Message to new soldiers!!!!! If you get to your first duty station and you have not received your first 4856 ie counseling statement also called initial counseling. Say for example you miss first formation you do not have to sign that counseling because you never got an initial stating was is expected of you.

That is total BS, See how far that flies. An initial counseling is not required by Army regulation. The only thing that could be true is if you get to a new duty station and they have some local requirements is that you have to be informed of those local regulations or requirements before they can punish you for not following them. 1st example that comes to mind is going to an off limits location. When you get to a new duty station you are told what the off limits locations and establishments are. If they do not tell you what they are you cannot be punished for going to them. However every place I was stationed had it posted on the bulletin board what the off limits places were and that was considered proper notice. Being late for first formation is a big no go. Everyone will tell you where to be and when to be there.

This was very informative. From my experience, punishment can vary from the leadership and is a very deep subject matter. Just keep your nose clean and you’ll never have to worry about any of this. 🙌

I got art 15 company grade , and yep two weeks duty 2 months half pay and a bump down. My extra duty was taking little rocks from one bed of rocks to another about 100 meters apart. 1 freaking rock at a time. 2359 was time to break camp and I got it worse because I didn't have much time to to get my uniform cleaned and squared away as it should have been so every day I would be doing up downs till I wanted to die. Yep only one time with that junk and I learned a lesson. ( No back-talk to your NCOIC)

I have seen married soldiers get barracks restrictions. Meaning they have to move back to the barracks during that time, and are not allowed to leave the base...in those instances, you have to REALLY screw up for the military to deny you from going home

Yeah if they did not tell you formation was being held early then they are being a problem. Yes I know in the Army 15 minutes early is on time, and on time is late. But in this case your NCO should have been right there with you getting smoked, because it is his job to make sure you are informed of any changes to formation times.

Wow, when you scred up in HQ & Hq Co., the First Sergeant moved you out of the company and you had to live in a pup tent in the parade ground and lay out a full field inspection every morning. Now, that was on ly the beginning.

While on active duty I had gotten two Article 15s, one in Germany ad one at Fort Riley, KS both times I was able to keep my rank. Both were for being AWOL.

I remember a time in the national guard where I showed up an hour late for formation and I did not get a haircut , I got off easy after a trip to the barber the put me in KP duty for the day

I can tell you all about article 15s .. In my 16 years, I acquired 57 of them! Most of my time in the military (about 12 of my 16 years) I was a major (0-4) (NOTE: I did eventually make it to 0-5). At the 0-4 pay grade, there was a period of 2 months where I got so many Article 15s my MONTHLY pay was only $75. Please note: about 80% of these Article 15s were a matter of taking responsibility for the actions of those under my command. As a result of my willingness to protect my people, while I was only getting paid $75/mo... every person under my direct chain of command donated a portion of their pay to a collection and gave it to me. I ended up making nearly $1,000 more, than my entire paycheck would have paid me! What did I do with most of the money my subordinates gave me? At first I refused to take it ... military etiquette and all .. then I came up with a better idea... I set it aside as an emergency fund for the men and women under my command. "Your son is sick and you don't have enough for the medicine until you get paid? Here you go."

I remember my dad telling me that while they were in Iraq they use to punish people by making them burn human waste because there wasn’t really anywhere to get rid of it.

That's called shit detail, shit duty, you take a 55 gallon drum and stir in some diesel and light it and stir it. Number one rule noobies make is brag about never doing it. Keep your goddamn mouth shut if you dont want to do it. If they ask just nonchalantly say yes you've done it before, dont empathize youve done it before and you hate it, and dont ever say youve done it otherwise they will make you do it.

I had to burn shit in Iraq. the good ol days when we had nothing... one satellite phone for two companies of people. no Internet and when someone would actually go to a big base with stores. dude probably had like 1,000.00 dollars on him getting shit for everyone in their section

I think that was an excellent description in a short period of time of article 15, maybe go further with an article 32 at some point, although 15 is pretty common. I had an additional MOS 71D, legal clerk, I don’t know the MOS number today. Very good Vid.

The Miramar Brig is actually a Navy facility with a Navy CO but the operations and security is conducted my Marines. If I remember correctly the highest ranking Marine there is a legal officer that is a Lieutenant or Captain.

That would be great. What are you 2 doing to grow so fast? I know of some channels who insist that the only way to get KZbin to process their videos is too use titles so vague that it could be for anything. I think that y'all prove them wrong.

A good example of a soldier being punished by civilians is the HiFi murders in Ogden Utah. In the 1970s, two military troops committed a horrible crime where customers at a local music store were tortured and murdered. The few survivors had severe wounds. I would say more about this frightfull crime, but I do not want to give the military a bad name. The criminals were the bad guys who happened to be, well...you get the idea. Anyways, they both were executed for their awful crimes. The military kicked them out and let the civilians punish them. Luckily, the horrible nature of those crimes overshadow the fact that the murderers were military today so now many people blame the monsters who committed that crime and no one else.

I had a company commander that was hell bent on making an example of anyone, especially someone he didn’t like. He was the captain sobel type from band of brothers except this guy didn’t train troops. Only reason I didn’t have an article 15 during that deployment was because I was in another location 90% of the time. I was interviewed in private and asked a LOT of questions about command after I got state side.

Most Commanders hate doing court martials, too much paperwork. Usually they opt to just do dishonorable or bad conduct discharge. Unless of course its very serious crime.

Don't you mean General or Other-Than-Honorable Discharge? Those the commander can initiate on the administrative side. Bad Conduct and Dishonorable Discharges requires Court-Martial to hand out.

I spent 1 year as cadre at ITU (Intensive Training Unit) formerly called CCF (Correctional Custody Facility) at Fort Carson back in the 80's. Most of the "Correctees" were there for anywhere from 15 to 30 days confinement. Their offenses didn't warrant "Jail" time but their commanders thought they were salvageable as soldiers. To be honest I hated the duty, but I dealt with it. We cadre were supposed to be harsh on the correctees and train, train, train. At least there was no field duty involved with it. I did see a few that were there for 30 days leave and come back for 30 more days after maybe being out for only 6 months or so. I don't know if the Army still has CCF or ITU type units anymore, but we used to smoke those guys every day!

I have a friend of my mind that was dicharge two years ago she was punished for losing military equipment and of course didn't understand about these grade of punishment I was paying for her to have food and loading cards to military department for not to her to leave the country and ended up flying her from us to Nigeria can you help me about what kind of punishment is this?

. In Germany I had a soldier who couldn't make it 10 minutes prior for PT...literally 20 meters in front of Barracks. He was LATE to formation and it was ON. I told him he had to call me 1 hour early and give me the weather report for a week (5 days). He came out 10 minutes prior but no phone call on Tuesday (Day 2). He said he lost his phone. I said No Problem ...You will sign in at Staff Duty and hour prior and call me from SD and give me the weather report. He hated that week and a half...I kinda felt bad doing it but...He tightened up!

my wife was at her appointment but the hospital couldn't sign her in cause her pha wasn't updated but she had just updated earlier that day and right after her time was up to be signed in, it updated in their system but she was still put down for missed appointment her first ever missed appointment. the person at the front desk added a note saying she was there on time, so her nco gave her a counseling saying she has to hand write an essay of 5000 words in one day topic was the importance of not abusing the military health care system. he had also wrote that if failure to finish will be recommended for ucmj, when other people who have missed more then one appointment have been counseled for 500 word essay and have had a week to complete it. is this actually ucmj worthy?

I wanted to add that in the early/mid 1990s, someone wrote a legal guide to US Army soldiers, commissioned officers about rights, UCMJ, legal issues. It might be still in publication. 👍🏻🇺🇸

Field artillery at ft bragg. I joined a unit that just returned from desert storm and were great in the field but monsters in garrison. Anyhow the day after the field a soldier showed up after having way too many the night before. He begged me to let him sleep it off and he would work the weekend. I said nope. You and I are going to the motor pool to recover and the rest of the section I sent upstairs to clean the weapons. It was a long, hot day for him on that asphalt in 95 degree heat. After 20 yrs when i talked to him, the first thing he asked was "do you remember when..." I cut him off and said "like it was yesterday "

Can you still get court martialed if you admit to an offense that happened on AD but admitted it years later after getting out? Can they change your discharge status based on that?

I was attached to the JAG in Germany in 2011 after I got back from Afghanistan. I was a driver who picked up witnesses, suspects, drove them to courts- martial. Then if the soldier was guilty, took them to the brig. The soldiers I took to the brig convicted of crimes they committed were nasty AF and will not post them here.

In my era: 1989-1993, MPs, we were told NCOs of any MOS could do "package" escorts or assist JAG-PMOs. Gene Hackman & Tommy Lee Jones had a great action movie called The Package, IMDb.com . Hackman played a SF Master Sgt(E-8) in Europe who escorts a convicted E-2 Private(busted in a UCMJ action). It's somewhat dated but still worth watching. 👍

Most Art.15s are extra duty, reduction in rank, etc. I have heard of COs that LOVED giving 30 days in CCF. It was way more effective!

When I was in the Marine Corps in the 70s we had a dirtbag bad attitude you know didn't take care of himself the first sergeant took him out behind the barracks and had a counseling session and all the sudden you know he'd slipped in the shower but all of a sudden he turned right around sometimes quicker is better

So, where would "time in the guard-room" fit in this system? Like... an offense warranting incarceration, but not bad enough to deserve that you get sent to Fort Leavenworth (or one of the other sites around the country). You just spend a couple of days in the guardroom on your own base (like spending the night in your town jail) before being released to face whatever other punishment is deemed necessary.

The process works more or less the same across the services as well. The big exception is article 15’s (captains mast) cannot be converted to a court martial if you’re aboard a ship in the navy.

I don’t know how true it is but I heard there was a special prison built for those of high ranking officials and people with above average training like Green Berets and Navy SEALs or CIA agents because they are trained in ways to escape or building things very dangerous things out of common everyday objects and they need to be stored in a much more secure place or do they also go to fort Leavenworth’s

Hey Chris, What do you know about the requirements for going up in rank again if you have just lost your rank. For example, if I was an E4 and was demoted to an E3 would I be able to be promoted more quickly since I was already an E4? Or would i need the required time again in order to take that rank again?

To my limited understanding, a AWOL soldier after 30 days gets converted from the MPs, CIDC to the USMS, USmarshals.gov . In the 1990s, most AWOL or deserter soldiers were processed & given dishonorable discharges but after 9/11/2001 the crimes & UCMJ actions may become more severe.

So what brig did the A-Team break out of??? :) But on a serious side; The civilian ammo ship I was 3rd Officer on during OIF had a USMC security team on board. One E-3 was a problem child. Even lipped off to me when I found him not attentive to his post! He got a few interesting punishments: -XD's - he worked extra duties for the Chief Mate (basically XO). In addition to his 8hrs of duty, he had to do 8hrs of ship's work. This included cleaning the interior of the accommodation (never seen a merchant ship so clean!), needle gunning and painting on deck with the deck gang, and such. 8hrs off per day. -When he told someone he thought his NCOIC's name was funny (Sgt Pile - not Pyle BTW) he was made to sit on a #10 can and anytime anyone walked by raise his weapon over his head and yell "THERES NOTHING FUNNY HERE!" for a couple of hours. -My favorite: He left his M16 un-attended on duty (in a IDP zone). His Corporal dipped the rifle in the salt water pool on the ship then locked it away for 12 hours before giving back to him!

Got three stories from my time in Alaska and Germany in the early 90's. First, when I got to Alaska, was a guy who left his wife at Bragg when he got PCS orders for Alaska, didn't tell her where he was going, and brought along a girlfriend to pose as his wife when he got to Alaska. The wife back at Bragg asked around about the BAQ and it turned out the guy had switched his BAQ to Alaska. They busted him down, he did time at a local disciplinary barracks in Anchorage, Alaska and was kicked out of the army with a dishonorable discharge two years later. Second was a Rape, in the G-2, Intelligence Section of the divisional headquarters. Dude got 10 years in Leavenworth, dishonorable discharge and was dumped down to PV1. No one in the HHC company could believe some bright intelligence guy could do such a thing, but he did. He also committed it against a co-worker. Third was the orderly room NCOIC, an E-6, was making her PFC clerk do personal chores for her like pick up her laundry, shine her boots and pick up groceries for the E-6. The PFC was new to the army, being it was her first duty station, and didn't know any better. The XO of the company overheard the sergeant ordering her to pick up her dry cleaning that afternoon and busted her, bringing the whole thing to the CO and the first sergeant. Word was the top made the sergeant stand at Parade Rest in his office for four hours, then put a letter of reprimand in her file. The PFC was transferred out to another unit with apologies. I could go into my own story about being late for formation because I let my wife drive the car while she was arguing with me after I returned back to the company after being dismissed to shower after PT, and the the court martial I requested because I didn't agree with the first sergeant's punishment...but that is a longer story for another time.

I went in the army in 74 and after basic I went to AIT and got married in the process but then me and my new wife started having problems and I started going AWOL a lot but just received article 15s but after th6th time they locked me up and I went thru a general court martial and sent to Ft Riley, Ks for retraining but that never happened. I was discharged under honorable conditions as the Army said I was unsuitable for service and to think I'm a military brat. oh well things happen!!

Many solders I served with during the Viet Nam war were convicted criminals who were given a choice between the United States Army,or the Marines as their punishment. I'm not bullshittin either. If you got out of line the senior N.C.O.s, delt with it swiftly. Article 15s were rare.

a reduction to e4 would also strip you of NCO status, therefore you would be reduced to E4.

Not always. In some cases they might just go back to doing their job as a soldier, some cases where they could receive a bad conduct discharge or other types of discharges.

All the companies in my battalion overseas supplied 5 to 10 soldiers a day to battalion for misc duty. When the platoon Sargent said "need a man for detail", those on the shit list went to battalion.

I was Infantry. Attached to an Armor unit. When you're a grunt.. in a tank battalion.. the shit rolls downhill. We got stuck on EVERY shitty detail. I got volunteered to go on a clean up once.. it was in the fucking bowels of the base. It was filthy. I was hauling garbage up and out of the building.. throwing it into a dumpster located a few yards outside the CP. I took my battle blouse off and was wearing just a T-shirt. I was covered in sweat and grime. It was hotter than hell. After several trips.. the dumpster started to overflow. I crawled up inside of it and started stomping the trash.. compacting it.. to make more room. There was a greens inspection taking place.. over on the opposite side of the quad. I wasn't paying to much attention.. just stomping the trash.. all pissed off.. when I looked up.. the CSM of the brigade was standing there.. in greens. He actually broke ranks from the inspection.. a hundred yards away.. to march over and confront me. He locked me up. I was berated for being outside without a cover and for having my dog tags hanging out. He told me later.. on a run.. that he just couldn't resist the opportunity. I went down in history as the guy that got locked up while standing in a dumpster.. when the CSM broke from a Dress Greens Inspection.. there.. in front of half the battalion to rip me a new ass hole. He'd cemented himself in history as being the biggest prick in the Army at my expense; but, it motivated the hell out of everybody. We both wore it like it was the fucking Medal of Honor. I would've followed him through the "Gates of Hell."

One of the most messed up punishments I saw in 1996 was when we had a room inspection and he failed the inspection. They took all his civilian clothes, and anything not military-related and put them in boxes then stowed it in the supply room for 3 months until he learned to keep his room in the barracks spotless. that was an "old school army" though and the BOSS Program (better opportunities for single Soldiers) stopped all that kind of punishment. The biggest punishment I received officially was a "General Letter of Reprimand" from when my scout platoon was drinking with the Serbians trying to gather intel. LOL! I kept it and jokingly turned it into our human resources along with my awards for points to qualify for promotion to the SGT board. They looked at me and said "hey, you can't turn this in for points" and I said "Why not, I thought everything signed by an LTC and higher is equal to 5 points" LOL! General Letter of Repremand only effected me while I was in Kosovo and didn't follow me throughout my military career.

So I have a funny story as I was reintegrating to my new unit. We were separated by days as in our paperwork and what not. Dude was an E5 with no combat patch and made me drop just because he thought he could. Luckily my old NCO was on day 3 and also a SSGT. He said dont you ever make him push again, hes my soldier. Made him push until i told him to get up. We just got back from our extended deployment from Iraq. After formation my nco came up to me and said if that dude ever fucks with you ever again tell me and ill set him straight...Probably my most favorite nco

No. Three gourmet meals a day, commissary, board games, kp, cleaning, sleeping when you want, some have tvs, showers, real toilets, nice bed with a mattress, phones, not many fights... Compared to a deployment, military lockup is a vacation with no worries. If you go there, you'll get fat. CDCs are like a vacation.

One thing Chris forgot to mention is that the Summarized Article 15's do not get entered into your permanent record (No entry into the 201 file) So when you leave that unit, be it across the base or on the other side of the world. that Summarized Article 15 disappears from all records. This also means that the record is purged from the local unit records. So say you get a summarized Art 15. The PCS to Germany, finish you time in Germany and don't you know it, they send you back to the same unit you were in where you got the summarized Art 15. Even if there are people there who remember you, that summarized Article 15 for all intents and purposes never took place and they can not ever bring it up again. The reason they began using Summarized Article 15's (Back in the 80's) was to allow someone to get punished for something and not have it follow them around forever. There were too many people not getting Article 15's for minor stuff because the commanders felt that yes the person needed a punishment, but did not feel the offence was something that should permanently affect the soldiers career. So they created the Summarized Article 15

I was busted from pfcs twice for making a remark to a platoon sgt.. no article 15 was used or a court marshal. One remark was concerning not having spit shined boots b4 we were deployed to a riot in Pamama City. The other bist was when a different squad leader ordered me to carry out a trash can when I was in civies and on pass. Noc,s in the 60 were very pretty and the top shots were even more petty

A few things have changed before you made this video and even before officially. Both Joint Regional Correctional Facility's now take sentences up to 10 years and since 2007 unofficially RCF's in the US have in some cases taken sentences up to 7 years. This is because the newer USDB holds half the number of inmates as the older one and the army has reduced the number of people it confines for certain minor offenses. I don't know this is a policy since the UCMJ hasn't changed the maximums but more tone that has taken place in JAG. During peace with a small military in the 1990s they kept about 2000 inmates and now the number is around 1600 inmates. Even in the 1999, for example, the military DOD-wide only had 30 inmates for military offenses like AWOL. PCF is basically a place that chapters out AWOL's. I worked in an RCF for 3 years and the most common offenses are sex offenses and most of them involve children but you still have some rapists. The most serious offenses were manslaughter and some of them could have been murder if they were allowed to use all the evidence. From the people from the USDB, I have talked to sex offenses are pretty common there and some people who commit the same kind offenses sometimes get very different sentences. There are several murderers at Leavenworth and they even have a death row but haven't executed anyone in a very long time with some people dying before execution in the past. Now you said you weren't covering everything but another not uncommon punishment is chapter 10 where it might be unorthodox to court-martial but the army's hands are forced so they let you submit a request for discharge in lieu of court-martial. This is an Other Than Honorable discharge and can be upgraded but unless the upgrade is done by the board of corrections the VA won't recognize it. I have seen a couple people awaiting an article 32 hearing get this including a trainee who threw a classroom chair at a SMG (not normally enough for charges) and a guy who went AWOL for a while and while he was gone was arrested in hotel selling meth. He had 5 pounds of meth but the civilian prosecutor didn't want to lock up an Iraq veteran and from what I understand JAG was nervous about how the local police handled the evidence not to mention he was trying to convince JAG he was insane by insisting that he be called Jesus.

When i was in the last unit i was in DIDN'T believe in corrective action punishment or counseling statements. They would ALWAYS use UCMJ for every punishment. The unit was kinking out soldiers constantly. That was at Ft Hood

A guy from my unit was caught with cocaine in his system during a urinalysis and our CO wanted to make an example out of him. The Soldier faced court-martial and plead guilty, was sent briefly (about a month or so if I remember) to Fort Leavenworth. But before that, E4's and above, including myself, had to take shifts and watch him while he was awaiting for transport in the MP's holding cells. He was a good guy, he just majorly screwed up. I believe he was eventually kicked out with a dishonorable discharge. We had another Soldier, an E-5, who newly transferred in. Shortly after murdered his wife (a Soldier in another unit) using another Soldier to make it look like a robbery gone wrong. Both were caught but since it took place off base and after duty hours they were tried by North Carolina courts and sentenced to life. I believe the U.S. government could have gone after him with other charges if he had somehow gotten off, but luckily he didn't.

When was in the service, I was a retirement clerk. Bad time is not credited to retirement. The most interesting case was an E-8 who was the manager of the forts NCO club. Turns out he stole food, eqipment and money and applied this to a private concern off base that he owned . He had got away with this for several years and then the Army found out. He went to Leavenworth and was discharged. When he got out he sued the government for denying him a retirement.They let him in with a rank of E-1 with an agreement that he would immediately retire, He showed up at my desk and I did start to complete his retirement. Then he took a physical and this is were it gets bizarre. They find something medically wrong about his heart and so he has to retire with disability. And whats more, he retires at the HIGHEST RANK HELD. Not E-8, but he was a Captain during the Korean War. So he retires as a Captain with 100% disability. Most unbelievable case ever.

Wow. I believe it. I had an E4 with 20 years retire and the guy was a Vietnam vet who was once a CW4. He had a lot of Field grade generals as friends who he served under in Nam. I saw the paperwork changed to full retirement as a CW4.

Not usually. It’s not really against a rule but they will try to discourage it. I’ve seen soldiers have relationships with members of their platoon and seen times when they would discourage it.
