The officer talking in the video is the ranking officer, he is not the cop who opened fire. That is why I believe the ranking officer should have also been held responsible for this shooting. His tone escalated the situation, and this cowardly pussy cop opened fire on an unarmed man trying to pull up his pants.

Saddening to know all the details now. After doing further research it makes the shooting more and more unjustified. 1. The ability to give clear verbal instructions and use of deescalation tactics were very poor if not at all there within the whole interaction with shaver. 2. I understand the plus 1 rule but they were called there for a man pointing a rifle out a window. Shaver had a t shirt and shorts on. So either the communications the officers from dispatch were not clear of the weapon that served the threat that was called in was non existing or they went on the sole belief he had a firearm with him in his shorts (not a rifle) 3. Shaver was very drunk at the time scared out of his mind by the fact the officers said any mistake you make you will have a high possibility of being shot leads to shaver begging for his life with tears and fear. In conclusion the training for checking of weapons and dealing with the threat was handled very poorly probably the worst I’ve seen instructions were contradicting and unclear. Also when they made shaver crawl your arms will naturally go towards your side, but in this case it looked like shave was trying to pull his shorts up. The correct way to make sure this guy wasn’t a threat would have been to ask him to put his hands behind his head and face his back towards them, then ask him to pull his back of his shirt collar up and slowly spin in a circle to see if he had any fire arms in his waistband. Finally with his hand behind his head with his back towards the officers slowly walk to there voices. I believe with upmost certainty this way of pursuing the threat would have ended with shaver being able to go home to his kids. That officer needs to be charged with 2nd degree murder.

For the first thing, cops were way to big pussies to come to suspects and cuff them. Or maybe there is something wrong in Maricopa county policing. For second thing, there is no such thing as shooting into shoulder. Cops can shoot only when deadly force is authorized. Then they shoot to stop attack. Sometimes that can be done with one hit, sometimes you need to fire several magazines (specially with handgun). Wounded people can stile be dangerous. For deadly force to be authorized, officer must reasonable belief that he or somebody else is in jeopardy to lose life or be greatly badly injured. Reasonable means that reasonable cop with same knowledge, training and experience would came to same conclusion. I am not really big expert, so I am writing of memory.

“I had a split second” Yeah fucking sure. You had over a full second to decide to discharge. Shaver’s hand was almost on the floor again when you shot. You could’ve easily seen that there was no firearm in his hand but NOOO, you were too fucking trigger happy and you decided to execute this innocent man. He was literally at gun point. It would have taken a second or two to even aim it in your general direction. Even if he had a firearm, you would have ample time to shoot your rifle before Daniel could get his aimed. Instead you put multiple rounds into Shaver. Not even bothering to check for a gun on Shaver. It’s been years since I first heard of this murder and I still can’t get over it. You murdered Daniel, Mr. Brailsford. Shaver spent 26 years of his life dreaming of living it to its full potential not knowing that all of it would come to an end because he needed to pull his pants up. You willingly executed him Brailsford. There were so many different ways you could have handled this. Letting him lay face flat on the floor with hands behind his back and then handcuffing him. Or hands in the air walking to you. Even putting them to the side of the hallway while someone watches them and you check the room. You set him up to fail. Giving him unfair instructions. Not letting him think by constantly screaming at him. There was no mercy in your voice. No hope for his survival. Not even any reassurance that everything will be okay. Speaking of that, I can assure you that there is a special place in hell waiting for you. Eager to meet you. You sick fuck.

No something about the subject matter before making ignorant comment. First of all , the dust cover of the AR did have that saying in it. However, the ex-officer did NOT engrave it himself. Something that would be extremely difficult to do, since the dust cover is a harden plate of dense aluminum. That being said, a person can go onto pretty much any firearms supplies website and easily purchase a Dust Cover for an AR....there's many types of engravings and saying for the Dust Cover. I'm not condoning what the ex-officer did...it's quite apparent he purchase the Dust Cover and then installed it...which is very easy. Please don't spread false information. It's people like what you doing that causes the video to subsequently be Sealed Evidence or suppressed per se.

I’ve worked law enforcement with 6 officers pointing guns at these people there was no need to have them crawl they could have been cuffed laying on their stomachs.. these officers created the environment for this execution.. the only reason they’re found innocent is because Shaver was white had he been a minority (as I am a minority) . An officer should see a gun before pulling the trigger. It takes time to aim so if you are already aimes (especially with a rifle) there is no real damage. Waiting to see the gun is identifying you target, The hall was well lit which further evidence of the policeman's incompetence.

i want to hate him but when you think about it, daniel put his hand on the belt. but this situation is the policeman's fault, he would never have asked him to crawl but to stay on his stomach with his hands in front and go and put handcuffs on him, everyone knows it!!!

Leading questions are totally allowed for defense witnesses. They are not allowed under cross examination by the prosecutor. Sorry to burst your bubble but it's a common legal misconception.

Just so everyone understands something very important about why he wasn't found guilty... The cop that gave the orders and the cop who shot him are two separate people. The shooter was following a direction from his partner. Had he been the one giving the orders it's quite likely he'd be found guilty. I read the cop who gave the orders left the country. Police Sergeant Charles Langley gave the orders, Brailsford shot him.
