I think maybe they should let the mob have their way with that cop. I would like to see the look in his eyes when he realized the inevitable. No one should be above justice and if there’s a God I’m sure he took note.

@@pirizzo No they shouldn’t. He deserves it, but we shouldn’t induce a further betrayal of the law, for what he did. What we should do is find out why and how he got away with it and hold the folks responsible accountable. I don’t know which snakes are responsible, but they should be held accountable for their incompetence.

The fact that those two cops did not get prison time is appalling. The shooter is now living off the taxpayers dime, and the MONSTER who was shouting commands like a madman just was allowed to retire, probably with full pension. Everyone involved is corrupt.

Traffic "citations" are intended to get money for cities AND to give people an incentive to stop bad driving. Legislatures realize about the need to discourage bad driving, but they haven't responded to the need to discourage bad policing. I was in a store and a cop was in there, he started watching me, hoping apparently I would shoplift and he could make a misdemeanor arrest. They do see everyone outside their tight circle as needing to be jumped on.

Yes, they could have cuffed him when he was prone. Making him crawl towards them like a dog and knowing he was scared out of his mind the police should have handled this way better. If I were his family I would definitely sue the hell out of the police department.

I just said that when I first saw the bodycam of this a few mins ago. Aggressive d bag, like he had short man syndrome or was bullied at school. Like the guy was one of those types who join the army just to kill someone. Got the impression he'd been waiting for an opportunity to rub someone out first chance he got. Kinda sick guy really

I just knew right away the cop was going to murder the guy by the way he expressed his words being incredibly illogical and power tripping. He wanted to find the slightest excuse to execute an unarmed man crawling on the floor and obviously not a threat. The cop's finger was itching to pull the trigger. I don't understand why the cop bothered to give ridiculous commands to Daniel. The police should just have killed Daniel right away since that was the intention of that cop in the very beginning. This is a clear case of how to murder legally. The police was acquitted and there was no outrage from the public. I wonder if Obama, Jessie Jackson, Al Sharpton & the American people would have remained silent if Daniel was black. I would imagine massive demonstrations nationwide and major cities in the US would be on fire if Daniel was black. What was so disturbing was the fact that Daniel was crying & pleading not to be shot. The fear in his voice when he was pleading for his life was so haunting and what's more disturbing is the fact that the cop didn't face any jail time not even for an hour and his superior had supported his executioner style of policing and stated that they would have done the same thing...they would have also executed a defenseless unarmed man pleading for his life & crawling on the floor. They needed to humiliate and degrade the man before murdering him and this happened in America. The justice system of America had failed miserably in this case. This is so shameful that a murderer is awarded $2,500/month for life.

both of my parents are retired law enforcement, I always remember my father telling me that most people have no business having power or authority over someone else, he went on to explain that when he was in college for criminal justice, that the vast majority of the class (he said 75%) just wanted authority over some one else and thats the only reason they wanted to become a cop. it scares me how right he is

Our standards for hiring officers should be stringent, standards that show the people with abilities and a brain, from power hungry rednecks, or dorks with a domination fascination. College and mental health evaluations. It should be harder to be a cop than it is to be in the Air Force or special ops. But its quite the opposite. On the job these people should quickly be shown to be what they are. First power trip , out the door you go! We need to do better. The individuals hiring need to be better. The good ole boys club needs thrown out, and qualified and capable people be found. It is quite the opposite at this point. The good old boys do everything possible to get qualified and competent individuals out, lest they be exposed. Make the guys life so miserable he quits the force. When will this stop?>

Both of my parents were also police officers, my father only lasted 10 years before quitting on account of how morally corrupt the higher ranking officers seemed to be. He worked undercover for several years, and many of the investigations lead back to corrupt local politicians, or corrupt officers whithin the department brass. He was going to dump everything he had on a federal agents desk, but my grandfather talked him out of it. Seemed like a good way to end up getting himself Hillary clinton'ed to death.

Someone who goes around and kills people like the officer that killed Daniel (for legal reasons, this is not me encouraging you or anyone else to engage in acts of vigilante justice, and this is not me saying that I plan on engaging in an act of vigilante justice).

i hate to say it, but its because the victim isnt black. its sadly peoples initiative to make cops seem racist, and not that they are untrained or that they need more extensive mental health checks and the police academy needs more difficult criteria to become one.

@@Seth9809 i have no idea why he wasnt, this is my first time hearing of this because as long as it doesnt fit the medias narrative of constantly wanting to divide everyone, they wont go over it. i agree cops can be both, but a major psychological evaluation and extensive training should be implemented instead of harming the actual GOOD cops reputations :(

I knew one myself and his murder barely made a dent in the news because there wasn't a "spin" to sell ads and paper. Black death sells ads because white people feel detached from it . and when a white person is murdered the same way , it gets "personal" and dignity is preserved . Black men's death brings revenue the exact same way a white woman like gaby petido brings an immense amount of revenue but from a place of empathy.

Police depts literally hire almost anyone...all it takes is a high school diploma. They don't even extensively mentally evaluate their prospects. Protecting and serving has never been top priority...it's all about control and inserting violence and authority.

Have you not watched the mainstream media in the last 10 years? Every single one of these MSM stories is "innocent black man gunned down by a rogue cop". When is the last time you saw the MSM cover a cop shooting a white person? Michael Brown and Treyvon Martin were both covered non-stop by the MSM. The MSM broadcasters raised their hands in congruence with what Brown's lying buddy said he was doing when he was shot. A black eyewitness said that he couldn't believe Brown kept going after Wilson. The media showed a Treyvon Martin photo from when he was a small looking 12 or 13 year old and not a photo of him when he was 17, when he was 4 or 5 inches taller and heavier than Zimmerman. The leftist media also showed a photo of Zimmerman when he was at his heaviest, as to make people believe "how on earth could this small little guy be the one on top of and pounding this big, bulky guy?".

I remember reading somewhere that the jury wasn’t allowed to see some of the evidence, like the fact that the cop had “you’re f*c*ed” written on his gun (clearly a violent type looking for an opportunity to shoot somebody), or that he was involved in another incident where he used excessive force on some teens but got cleared by his department after internal “investigation”.

This case scares me. Scares me to the bone. I am neurodivergent and I don't always process information quickly as I have priority arrangement issues. If 6 people are pointing firearms at me, yelling incongruous commands, I may not react as they wish.

Cops live for this stuff. Most of what they do is pretty boring---driving around, talking to people about unexciting crimes that will never get solved (my bike got stolen, someone jumped my fence). Shift after shift nothing happens, yet they are constantly told that it's a war zone out there. When they finally get a call about someone pointing a gun, they go into war zone mode, and all reason seems to go out the window.

It gets worse. The city of Mesa paid for the Brailsfords to file bankruptcy as a legal tactic to delay the wrongful death lawsuits of Danial Shaver's widow by two years, in an attempt to force her into poverty so that she would accept a lesser settlement and avoid going to trial. Daniel's widow wanted a trial to expose Mesa PD corruption, but circumstances eventually forced her to settle out of court. During the legal process, the City of Mesa and the Brailsfords challenged the legality of Daniel's common law marriage and the paternity of one of his children, in an attempt to mitigate the potential damages that could be sought in the lawsuit.

Honestly, this case terrifies me more than any serial killer situation. The fact that these kind of violent idiots are given the job where you carry guns and act on legal authority is absolutely awful. When there’s a regular killer, at least the authorities are trying to protect you. But when the authority is a homicidal maniac, you’re on your own. Even when they get caught breaking the rules, they face only a fraction of the penalties that regular criminals do.

I once lived in a house that had an upper and lower suite and I lived in the lower. They raided the house based on accusations that the upper tenants were selling drugs. They smashed through my door downstairs with guns drawn and repeatedly yelled me "get down, get down". When I got down another screamed at me "get up, get up". They did this 3 or 4 times over, it was the scariest thing in my life.

Seriously. I remember seeing the video footage when this first happened and I was absolutely horrified. To think this person could get off without charges is the problem with policing today. This guy was a power hungry person who was most likely attracted to the police force because he could use that power in nefarious ways. He's just a sad little boy larping as one of his favorite action heroes or something else stupid. He entered this situation knowing full well he would take the life of someone that night. You can't convince me otherwise.

This is one of my favorite presentations yet, Doc. That last little blurb about trigger-happy policemen roaming around being just as dangerous as the criminals they're supposed to be protecting us from was incredibly well said. Our nation's law enforcement agencies are in desperate need of a serious overhaul. The lack of training and/or competence that runs rampant among these agencies has reached a level that is downright unacceptable because their blatant ineptitude often ends up defeating the entire purpose of their existence.

@@Seth9809 Money isn't the issue. The majority of LEAs already have inflated budgets. The money just isn't being allocated properly. I think better and (far) more effective training, along with actually holding officers accountable for wrongdoings would be a good place to start.

Oh my gosh thank you SO much for covering this. I was friends with Daniel in middle and high school. He was a good person, very kind. When I heard about this I was devastated, especially for his wife and his little girls. Truly tragic. I will always remember his sweet disposition and smile. Thank you again. 🙏🏻

You are 100% correct, Bach. Even if it was a hardened member of say... the Mexican Mafia or Al Qaida or a US Navy SEAL armed with a handgun on the side of his hip. You go head and reach, draw, and before you have clear aim on me (back when I was in the Marines and an excellent shot with the M16A2) I will have shot you, I will win the gun fight with my rifle already trained on you. Thus, with this terrified and unarmed young man this cop in cold blood murdered him. Pure and simple. He knows it, I know it, you know it, and God knows it.

I was a police officer for inside a decade prior to turning medic. I am familiar with this incident, and totally agree with you in your analysis. It would have been more appropriate to approach Daniel for a detainment. During my police tenure, from a psychological perspective, an us-against-them mentality is fostered through continuous contacts with variations of the criminal element. Those officers developed..no, gardened, a narcissistic foundation in exploiting a sense of being grandiose in their engagements. Daniel's death could have been prevented, but what came out of this incident as a positive is, those former cops will no longer continue to do a job they were unfit for to begin with.

Major coward is a polite way of say this person just wanted to kill someone. Officers screaming conflicting command is a major problem. I think many do it on purpose just to either beat, shoot, or rack up bogus charges. All should have been fired for such bad work.

I think the problem is divided responsibility. I personally blame Langley for shouting insane commands and upping the tension needlessly. In my eyes, he should be in jail...yet all he did was yell angrily and confuse a drunk man and stress out a nervous young cop...there is no law against any of that. He retired, so he;s not a danger as a terrible cop, so... The man who actually shot and killed him didn't create the problem situation, he just reacted to it. He was brought to a state of hyper alertness and fear with surging adrenaline by Langley. I understand why the jury thought the situation was Langley's fault and he should be held accountable, so let the young, aggressive, nervous officer go. It's infuriating. For the young officer to get PAID for having PTSD (which he may well have...just watching that video is nearly enough to cause PTSD, let alone being there) is even more infuriating. He's suffering because he took an innocent man's life, so taxpayers have to pay him $31,000 a year? It's so WRONG.

The sergeant that screamed those sinister threats wasn’t even charged with a crime at all. They let it all fall to Brailsford the junior officer who fired the shots. They threw him under the bus and although he should’ve gone to prison he was the only one charged with anything.

I had the same thoughts as well when this went to trial. They didn't HAVE to kill him, the GOT to kill him. Get the man all freaked out and nervous so that you can kill him when he fails your test. It was just as brutal as those taliban execution videos you can find all over the net. If they felt threatened, they would have rushed him, secured him and searched him like we did when deployed and other cop videos showed. Instead, they played games with that mans life, a game he couldn't win because there was a psycho behind the trigger.

@@DurkDiggler also "defund" doesn't mean no funds 🙄 just to put some funds from police into other systems that can also respond to certain calls. Funding people and organizations that are better equipped at handling certain situations without coming in guns a'blazin, which oftentimes escalates a bad situation, turning it into a lethal one, rather than de-escalating. Also de-militarize our police force. There's no reason police officers need military level weapons to meet a petty theft call, or a drunken dispute - for example.

After going over the video countless times and imagining myself in the exact same situation (drunk, and in a total panic from the police saying over and over agin they are going to shoot you if you make a single wrong move) I honestly believe that the only thing that would have saved Daniel is completely freezing, and not moving whatsoever until the police were eventually forced to come to him and put him in cuffs. And with the police that showed up to this scene, I'm not sure that even would have saved him, because they obviously showed up with the decision already made that they were going to end up shooting someone. Every single time I see anything about this situation, it makes me physically sick to my stomach. Every single one of us would have been shot if we were in his place, no matter what we did to try to calm the police down or mitigate the "threat" we posed to them. Its just absolutely fucking disgusting, and the fact that the officer who shot him got to retire with a monthly salary for the rest of his life makes me so fucking angry that I'm about to have to go downstairs and pound whisky until I'm drunk enough to forget that I live in a country where police acting like this is not only tolerated, but rewarded. Fuck each and every single one of these cops. Whats an appropriate punishment for killing an innocent crying man in cold blood? Apparently a monthly salary that is probably more money than a significant portion of this country make in multiple months/to a year. I seriously hope people remember this and never give the two cops responsible for the commands, and the actual shooting a moment of peace. Fucking god damn murdering bastards

Jessie, the media reported. But y'all were on tik tok swiveling those hips ( musically at the time) . the coverage is on youtube and most of y'all didn't see the video because it was to "preserve" Daniel;'s dignity. all of you are as guilty as those police officers

I’m not sure I can even listen to a recap of this. This traumatized me watching a few years ago and had left such a rotten imprint in my mind. That Officer yelling was SO aggressive and fond of overt escalation of the Situation. And to shoot a man who was so clearly scared and unarmed is nothing short of SICK! A passionate hate in my heart for these types of individuals has formed and the fact that they get to go consequence-less is sickening and infuriating. I cannot IMAGINE losing my loved one this way and having to see their last UNNECESSARILY frightening moments before be blasted away for NO GOOD REASON!!! Sick psychopathic murdering bastards. They are civil servants meant to serve and protect paid for by the People and they have no right to go around terrorizing citizens and literally tricking them into a mistake that will allow the to take a life without batting an eyelid. :(

That video has haunted me ever since and every cop involved in it should have been in prison. It's outrageous. The directions were deliberately confusing and the man barking them sounded like a Nazi henchman.

It haunted me too, but I disagree with every cop being involved. There were two responsible for his death. Langsford and Brailsford. Langsford was on a power trip barking confusing orders, escalating the situation, riling up Brailsford. And Brailsford for killing Shaver. He knew Shaver was not a threat, he was just itching for a reason to kill him. The other officers were just there. None of them shot Shaver. None of them felt threatened by him.

I remember when this event happened and I felt so terrible for the victim. That/those police officers were out of control. They could see the guy was distressed and they continued to yell at the man. The way to handle the situation was to talk calmly to him (only one officer) and have him lay down with his hands and feet splayed so they could approach him to pat him down. Shame on those assholses! This death was totally avoidable.

It's reasonable for them to want him to come to them because of a report of someone with a rifle in the room so they don't want to be near the door to the room handcuffing someone, but the way they went about it was ridiculously awful and they should have been able to tell that his distressing cries for his life were real and not an act.

Wow... very needless suffering these cops imposed on Daniel, his family and all that knew him. The cop that claimed PTSD should be charged not only for killing Daniel but fraudulent claim of PTSD. Sick people out there! Also, any D.A.s watching?... can someone go after him for false claim of PTSD, and revoke the pension?

The jury wasn't allowed to watch the bodycam video during the trial as it was considered "prejudicial" to the shooter. If the bodycam footage was shown in the trial, I imagine that the verdict would have gone differently.

I agree with your assessment of this incident 100%. It almost seemed like the cop barking orders at Daniel was being sadistic with him. They put the woman in handcuffs fairly quickly. Why didn't they do the same with Daniel? That would be proper police protocol. The way they handled this was puzzling. There was no need to shoot Daniel. I don't know how the jury reached a not guilty verdict, after seeing the video. Thanks, Dr.Grande. 👍❤

Of all the police shootings I’ve seen videos of or read accounts of this one still sticks in my mind like very few others do. The overwhelming sense of terror coming from the police and the sobbing from the victim before hand all on top of the fact that they got away with it is something I doubt I’ll ever forget

Thank you SO much for doing this one! I was so angry when I saw the body cam footage. The sargent was toying with Daniel, he wasn't afraid of Daniel he was having fun humiliating and scaring that poor man. The officer that shot should should be in jail right now. Imagine, killing an innocent person and basically getting paid for it. Definitely a good example of police not being held accountable.

I remember this case, and watched the body cam footage. I heard contradictory commands; for example, when someone shouted questions to the man on the floor, the guy answered, only to be screamed at to shut up! The words and tone of the screaming gave me the impression that the team was trying to confuse the suspect and then shoot him dead at point blank range. Many suspects in that situation may make a small error in following the conflicting and difficult orders, and being slightly intoxicated will spell an immediate execution on the spot.

Dr. Grande, THANK YOU for covering this tragic case. Daniel's wife and daughters absolutely deserve more justice for the loss of their husband and father. Brailsford should be spending life in prison- the "Get Fucked" inscribed on his rifle is clear premeditation in the context of this case.

Step 1: Constantly train the police to expect that they will have to kill or die. Step 2: Arm them heavily. Step 3: Put them into incredibly stressful situations. Step 4: Count how many people are unnecessarily killed. Step 5: Wonder how this happened.

I completely agree with your steps, though I have to point something out; Americans have more guns than people, everyone here is armed and nuts; however, I don't think that applied to this situation, not at all. Phillip wanted to kill someone, and Daniel was the victim.

I tried putting my hands behind my head while on my knees with my feet crossed. I'm 5'7" and slim & fit 150lbs. I found it impossible to make that move without uncrossing your legs. That cop was insane and set the entire situation up for the end result.

As always, top notch content, Dr. Grande. Such a sad case. What amazes me is that they were a group of six armed men, against one drunk out of shape man on his knees. They could've EASILY, slowly, step at a time made their way toward him while he was face down and cuffed him. The demeanor of these officers was for some reason overly fearful and insecure.

An absolutely BLOODBOLING case from start to finish. At least his widow ended up getting an $8m settlement from the city of Mesa, and his parents got $1.5m, so I guess that's something... But the cop that killed him got off completely scot-free with it.

I remember the first thing I though when I saw this, and it was that the cops acted like literal Nazis. Personally, with the way the instructions were given and how tense and stressful it was, I’m 100% sure I would have been shot too. This poor guy was just scared and trying to pull up his pants when they shot and killed him in a degrading position. Just listen to how the officers are talking to this man, it’s like this whole interaction took place in North Korea or Nazi germany or some shit. Very scary. Rest In Peace to this man and prayers for his family. 🙏

The bodycam video of Daniel's execution is one of the most fucked up things I've ever seen from 20 years on the internet. These cops were beyond not competent, it was a civilian's worst nightmare. Try taking out your less lethal weapons and approach the unarmed sobbing suspect who is prone with their arms up, with your zipcuffs, animals...

I remember this case happened right after the Vegas Mandalay Bay shooting and everyone was on edge worrying about shootings from buildings. Initially, I thought the police responce was warrented, but after watching the whole video, this case has always scared me. They issued extremely confusing commands to an innocent person who was desperatly trying to comply while crying on the ground for his life, then they ultimately murdered him anyway for no reason. That was extremely hard to watch. I can't imagine being in that situation.

I, too, was wondering why they didn't just go up to him and handcuff him, considering he was unarmed and anxious. Daniel didn't seem to be that intoxicated either because he was very self-aware of what was going on.
