@AthenianOwl2372 жыл бұрын
Right? Why bother having a component that encourages justice in the justice system?
@JMSginoclave2 жыл бұрын
@@AthenianOwl237 That's not justice. A person can be partially guilty, or be under attenuating circumstances. In the vast majority, it takes a lawyer invested in their client's well-being for the attenuating factors to be recognized. Nearly nothing is automatic, any excess or abuse needs to be dealt with by some petition or appeal. Don't give in to the "only guilty people need lawyers" mentality: one is innocent until otherwise proven. So no, turning lawyers into prosecution number #02 does not encourage justice.
@AthenianOwl2372 жыл бұрын
@@JMSginoclave I'm not saying don't give them a decent defense if they're partially guilty- I'm saying if they are flat out guilty, there should probably be a duty to admit this so that in the event that the prosecution happens to be led by less-than-capable individuals (we all know that happens) the injured parties actually get justice. Might just be the way I wrote my original comment, but I don't actually disagree with you- I just think there should be a duty to admit guilt in the event of a crime where there aren't extenuating circumstances. Like if a car thief admits he stole a car because they were bored, the lawyer should have to admit that and basically knock things down to attempting to mitigate the sentencing rather than wasting time and resources.
@chebi972 жыл бұрын
@@AthenianOwl237 That 100% wouldn't work. What if your lawyer is lying? Every client would argue this, you'd need to swap lawyers and a retrial, since there's no way a jury remains impartial after that. What if you think there are attenuating circumstances and your lawyer doesn't? You'd now need to convince your lawyer about this to get proper legal representation, that sucks, that's your lawyer's job to determine, it's part of what the trial is for. Also, a client just saying "I did it cause I was bored", even to their lawyer, isn't the norm. This wouldn't really come in all that much. What would do is to affect how clients communicate with their lawyers, since there's now a very real danger if they think you are guilty. You might harm your case by lying to them. Besides, a lawyer should still defend a client even if they think they are guilty, because the main thing is whethere there's enough evidence to convict. If you convict a guilty man without evidence, nothing stops you from convicting an innocent man without evidence.
@EebstertheGreat2 жыл бұрын
@@AthenianOwl237 A lawyer is not allowed to lie in court. So if they know for a fact their client is guilty, it makes it very difficult to defend them. That's why lawyers don't want to know their client is guilty, and if they find out, they might ask them to get a new attorney. Technically, the ethical obligation for the lawyer is to try to dissuade the client from committing perjury, and if they can't, to move to withdraw from representation. Obviously I can't say for sure how many lawyers follow this obligation, but presumably many do. They still generally can't report the confession because of attorney-client privilege.

As a defense attorney, if you thought the presiding judge was actually guilty of the crime your client was accused of, I think you’d have to refer the matter to an ethics board of some sort. You can’t very well ask the judge to recuse themself by asserting their guilt. A prosecutor would have an easier time, depending how high up in DA’s office they were. They’d likely have to start by dismissing the charges against the current defendant; then they would have to file separate charges against the sitting judge in another case. Most prosecutors do have the discretion to dismiss charges “in the interest of Justice” if the jury has not yet rendered a verdict.
