Yung example po sa 13:29 dapat serious illegal detention na sya. More than 3 days na po yung duration to qualify it as SID, according to RPC 2018 version. Although I am looking for the amending law but I cannot find it :o

Gen. Rule po is under the constitution - warrant of arrest. Exception po is under Rule 113 sec 5 of the Rules of Court - warrantless arrest. President was once a prosecutor po kaya master niya po mga laws and rules.

Hindi po ba slight illegal detention lang ang charge for the City Treasurer instead of serious illegal detention because he only detained Maria for one hour. For it to be SID, the deprivation of liberty must be more than 3 days. Please correct me if I am wrong po. Thank you. I love watching this videos. Helps me a lot po as a student!

When a public officer who has the duty to detain or order the detebtion of a person brings that person to the prosecutor and the prosecutor does not find prpbable cause to charge rhat person, that is NOT arbitrary detention. Arbitrary detention is when such public officer arrests another person pursuant to a VALID warrantless arrests (or any legal grounds) and the arrested person was not delivered to the proper judicial authorities within the allowed period (12, 18 or 36 hours depending on the gravity of the offense).
