Once was in a trauma medicine class with a SWAT guy, who was reminding us about KISS (keep it simple, stupid) and de-escalation etc etc etc. He told us about a training scenario he went through when getting into the big leagues and it was a barricaded subject w/family etc scenario. Lethal force was not authorized on this man until he did an act of violence, with the sword, which he never had done, it was just a standoff. Well, no, that is actually against the rules of deadly force that are used to justify a lawful killing. You need opportunity, capability, and intent. Him just having the sword would grant them capability, but unless he charges at them, they couldn't justify to the other two, which means if they shot him just for brandishing a weapon that can only be used at close range, they would be at fault, and it would be obvious.

Wow this is wild. I never thought I'd hear about this story again. I lived in the neighborhood where this happened in Seattle when it occurred and have a little more info. Tony was well known and pretty harmless considering his katana. He never drew it unless he felt his life or the life of others was being threatened. He was a huge dude too, so seemed pretty imposing. I didn't know him well or even at all, but I passed him on the street multiple times. I heard people saying that he had a "mental illness" at the time and thinking back about his actions and demeanor, maybe he was on the autism spectrum. I never knew what happened to him after the standoff, but if he is in fact still alive, I'd consider that a miracle considering the way that the police treat homeless people, let alone defensively armed homeless people. seattle has a big problem with mental health problems, drug problems, and homelessness. i just went to vietnamesetown yesterday and there were probably at least 4 people dancing around like samurai’s on each street. it can be entertaining for some people, but when you go to a city like that and see how much they’re struggling, its just… heartbreaking.
