In my point of view they can be sued for: violation of privacy, abuse of power, illegally withholding identity documents, kidnapping and perhaps much more than this!

I hate when something is presented from only 1 side. "Usually" governments hold to the letter of the law in regards to immigration. They don't arbitrarily make up rules.
