And even if you are innocent and say you invoke the fifth and want to talk to a lawyer the scumbag cops would keep you in a interrogation room with no food drink or restroom for 12 HOURS. Who honestly fucking knew if they were gonna keep me in for more. Fucking scumbags and that was how I served 3 years in prison because in order to use the restroom I HAD TO TALK TO THEM. It was already 12 fucking hours and I was ready to burst. Fuck cops all of them pigs

Not exactly true. Watch the interrogation of Bruce MacArthur. He admits to committing an offence, but manages to convince the police it wasn’t done on purpose and they let him walk. In certain cases you can talk your way out of an arrest/conviction if you’re a good talker/liar.

This is the exact advice my lawyer friend gave me. He says most of his clients talk themselves into trouble. Policy put pressure on you. Give us some information now and you can go home. What are your parents and friends going to think if you spend some time in prison.

Absolutely true, Ed, even in a traffic stop. You inevitably get the "where are you headed today" then followed by "where are you coming from". You are not required to answer their seemingly innocent questions. They are fishing! I just hand them my license, registration and insurance card and roll my window up. They get the message.

Wish I knew these before it happened to me. At 18, i was detained for something I didn’t do; a misunderstanding. I naively believed the police had my best interest in heart; that they would prove me innocent. I gave em everything, cooperated fully, agreed to let them search my dormitory room.. Anything to be cleared an leave the nonsense behind.. Refused to call my mom because I didn’t want to worry her for nothing while believing only guilty people with something to hide immediately lawyer up. Result? They nitpicked bunch of irrelevant stuff and used em against me. I was later cleared but this whole ordeal not only changed the way I viewed the law enforcement, but also the world in general. It affected my future because the prick of a principal suspended me until further notice, making me unable to attend my finals thus sabotaging my college applications. I believe I’ve also seen earliest examples of cancel culture heh, you know how rumors spread along with the mindset of “if it resulted in this, he has to be guilty” …. Now, even around a decade later, thinking about it makes me wanna punch a wall.. There are even people who lose complete freedom over such stuff; innocent people serving long jail time. Kudos to folks at Innocence Project and anyone fighting against these injustices.

Reading this immediately sent me into a full body burning rage, because I was 17 when I was done nearly the same way by an investigator, and almost took charges for terrible..Fucked up, and just sick with how flipped and warped the situation was at first. Long a to try short, now I am gang stalked and have been labeled as a baby/child abuser, and have the entire community I live in using sick methods to try to further hinder my sanity, cause my life to only have negative outcomes when I pursue anything to make it better, biker gangs, under covers, street gangs, radical church members and other radical locals are all involved and I am guaranteed to die with this treatment. I am sorry you went through this all to common and fucked up lazy way of doing justice.

Mob mentality really is primitively twisted where people are terrified of pointing out 2+2=4 when everyone is barking 2+2=5. Human beings as species are also fucked up in a way that they feel safety in unity against a common threat; regardless of the threat being imaginary. Gives them the opportunity to mask their own demons and project their personal frustrations. Throughout the years, all those holier than thou types have proven to be the most hypocritical of all to me. And ofc.. the “tough guys” .. yknow the ones who love to lecture “just move on” & “fergitboutit” . Well faauuk you.. Let’s see your coping mechanism, Mr. Knowitall-seenitall when your future is wrecked, reputation ruined, people turning their back to you, all that in an instant one snap of a finger and for no reason. Who’s going to give you back all that’s lost? Frankly, there’s still a part of me that wishes friends (at least i was able to learn they were fake friends all along) who abandoned me or their loved ones to go through a similar situation. You're not anywhere near important enough for a whole town to go to so much trouble as to "gang stalk" you using all varieties of people and endeavoring to sabotage every aspect of your life. Nobody cares that much to go to all that trouble. Great comment and apply it to your employment too. If you are are involved with the cops, even being completely innocent, they are most likely going to fire you at work. I've seen many examples of this on this very Website. The most you'll ever get out of your employer for this is common law severance (Kanada). This will vary according to your location and please consult a lawyer if this happens to you.

I'm in my 60s. I've never been arrested, let alone charged with a crime, and I don't have any reason to expect I ever will be. But life happens. The sort of basic legal information and self defense tactics you've laid out in this video should be a standard part of Civics Classes in all public schools, taught before people go from being minors to being adults in the eyes of the law.

This is old news. This isn't the reason why people talk. They talk to avoid legal consequences in their minds, even when they think it's going fine, the detectives can use evidence that will throw their story into the garbage Jodi arias was telling her version of a story until the detective sometime into the interview asked her to explain how she ended up in her boyfriends apartment when she claimed she was miles away from the city. She denied it and asked for evidence, attempting to call the detectives bluff. He stated he has the evidence and stepped out to retrieve it, showing her After this verification of proof, she changed her story and still did not request counsel

@@j777 --In the US, they can't use it against you if you invoke your right to remain silent or not to speak without a attorney present. Lawyer up is always the best option.

Whenever you have contact with police or any other form of enforcement ALWAYS make notes immediately afterwards or as soon as possible after the contact, writing down date and time, what occurred, and what was said by both you and the officer. It may help you in court a year or more later to refresh your memory and will certainly give more credibility to your evidence and testimony if you inform the justice that you made those notes when the incident or contact was fresh in your mind. Police rely on this tactic all the time to help discredit the accused in court, who mostly have to rely on memory alone, whereas the police will ask the court if they can refer to notes taken at the time of the contact. My 2 cents.

Yep, that is literally true. Little known fact is that what you say can be used against you, but it cannot be used in your defense. Your lawyer can use nothing that is mentioned in an interrogation, in your defense. True in US, not sure if that is the case in Canada though

Even if you don't they can put words in your mouth or base assumptions of guilt on your behaviour. If you are upset they think that indicates guilt even if you are upset because it's a wrongful arrest actually. If you are not upset enough maybe they assume you are a psychopath. Who knows what goes on in their heads? Sometimes if you report a crime they treat you like a criminal too which deters people asking them for help too. Lots of them are just control freaks looking for an easy target. They don't even return phone calls or enforce court orders half the time they also get used as muscle for criminals sometimes who send them on wild goose chases.

I don't know about Canada, and the possibility they'll twist any silence into evidence against you, but that's very possible in the USA. Best thing to do is state you want a lawyer. And only that.

He is 100% correct. Before I retired, I spent a good portion of my young adult life in the Army Military Police. I've interviewed hundreds if not thousands of suspects. From my point of view, and what I know it's always better to say nothing. If you need to tell uour story, tell your story to your lawyer first. Remember, once you let the genie out of the bottle, you will not be able to get him back in there.

It's important to understand how NOT to talk. Name,address and date of birth. Other than that,stone cold silence even if you get locked up.,ezpecially,if you get locked up. Assume you're on video and anyone you talk to will relate any conversations to either correctional staff or the police.

It probably can be done, but I suspect that it's a lot harder to do in practice than in theory. Because in doing that you are completely handing over the the stage to the officer. They will likely try to provoke you at this point. And you'll need really good impulse control to keep this up. They'll probably accuse you of outrageous stuff and tell you that they'll interpret your silence as a sign of an admission of guilt. Maybe they'll insult you (which I would imagine could be a great starting point for the good cop, bad cop routine).

Nice to see information from a Canadian lawyer. I was once told by a retired cop that it's easier to talk your way INTO a ticket than out of one. The key is to shut up. Even a cop asking your destination at a traffic stop is a dig for information. My answer is always, "I'm not going to answer that."

I absolutely agree with this except for one case that I was recently involved in. I was pulled over in a speed trap that was set up in an area where the speed limit had been changed in the previous week. I made one simple statement to the constable , “In todays social climate can you really afford to so casually spend the capital of public support that you are spending here today with someone who appreciates the difficult nature of your job and supports the police in the fulfillment of their lawful duties?” I drove away with the ticket that the constable never registered ie. tore it up later.

Had an issue with the Police tonight and yes they tried everything to pin a crime on me while I was the witness to the crime; I've now filed a former complaint to the Police Service Board as I didn't know in Canada the Police are "Brown Shirts" when they interview at your front door. And people don't let them in your house walk them off your property and close that front door unless they have a warrent.

I have been through interrogations and listened to many advices, many videos, yours is just great, straight to the point, all I ever said to them was, I want my lawyer and no comment. The reason for the success of your channel is simple. Few people know the law very well, and most sources that attempt to explain the law and your rights are sketchy. Your channel provides a detailed overview of the laws and one's rights. And it is free for the taking! I learned a lot, and you have cleared up a lot of misconceptions! I find it disappointing to reflect on circumstances where people in the know have said very little to help steer people in the right direction. Knowledge is useful.

In the U.K. if you are suspected of a crime, refusing to give your name and address will get you arrested on the spot.

@@DT-yd6ex If police have a power of arrest they don't need your ID and can simply arrest and find out your ID later, in fact if you have no previous convictions with DNA or fingerprinting on record to ID you they really don't need your ID and can happily proceed without it although you will not get bail and will be held until the case is brought to court, or perhaps dropped and John Doe is released blinking into the sunlight, they can't charge you for failing to ID. What PACE act provides is for offenses that do not have a power of arrest. If they catch you doing something as simple as littering they require your ID for the purpose of serving a summons, and if your refuse to ID they can arrest you, to discover your ID or to put you before a court.

I am referring to please attend interview at police station Not a stop in a public place and then they have to give a reason that you have or are about to commit an offence. In uk it is only mandatory to give details if in charge of a vehicle.

So I had a phone call with an officer and I didn't say much of anything. But he wrote down in his report and testified that I said things I never said. "Anything you say can and will be used against you in the court of law" Apparently means "I'm going to make up whatever I feel like to get you charged" I really don't know how to combat this, It's disgusting

Get. A. Lawyer. You need to act fast as there may be a recording the police have of the phonecall that the cop is too afraid to delete himself but knows after a certain amount of time old recordings are deleted to free up storage space. You need to get a hold of ANY recording, find out if anyone else was listening in on the conversation, the date the "notes" were actually made. Also subpoena the phone company for the actual duration of the phone call.

@@Treblaine I live in PA we're a 2 party state. He didn't say the call was recorded. I'm already past it. PA ARD program, my charges are up for expungement. I need to send in the paperwork. I should have gotten a lawyer for preliminary because the entire situation was a joke and never should have made it anywhere.

​@@goaliedude32 That doesn't mean they didn't break the law recording illegally, they broke the law with fabricated statements. One reason a lawyer might be interested is a lot of lawyers do not like corrupt cops and they'll make it their mission in life to make sure bent coppers don't get away with it. Remember, you're probably not the only person this cop had done it to and there are rules for lawyers they cannot "ambulance chase" they can't go phoning around every person this police officer tried to lock up.

No sometimes if they have no evidence and think you are going to get the cop in trouble for their unprofessional behaviour they will just stay the charges and deny you your right to a trial to keep the cop out of trouble they don't like to admit they are wrong.

The cops often charge you with charges not known in law to scare you.....to overwhelm you. The Crown works with budgets. 90% of the cases plead out......go to trial....they have to prove their case.

I once faced "preliminary charges" - meaning I was technically arrested and charged, and interrogated for about 4 hours - about an assault. I live in Denmark, btw. Apparently I was identified by a victim through social media. Now, I live a 4 hour drive from where it happened - had never been to that town, failed to resemble the one fact they had about the culprit - "... He was out for a night on the town with his military platoon." - and I had electronic evidence that I had been somewhere else at the time. I'd used my credit card, and checked in at my jobs electronic check-in - in a different town. I supplied all of this, to the police. It *still* took the police 5 months, and follow-up phonecalls to actually dismiss the charges, and when they did, the reason given on my receipt was "that they did not believe pursuing the matter was likely to result in a conviction." NOT - that I was clearly, obviously - innocent. Just don't talk, man. Ask for a lawyer, ask for a lawyer, ask for a lawyer. By the way, I will caveat this; They were neither rude nor aggressive with me. They were polite and attentive, and didn't badger me at all. It was not a traumatic experience. I'm just shocked at the waste of time and resources, and the ineffectual process. They STILL to this day have my DNA and fingerprints on file. For no reason, except probably a miscommunication from a traumatized, drunk victim of an assault, being shown pictures from facebook or something.

I remember in my teens being slapped repeatedly by Canadian police while handcuffed. It worked. I talked. It wasn't at the police station. I guess they figured they could do what they wanted while unobserved. I told my lawyer this and the case was thrown out. Apparently this officer had a habit of doing this. WTF.

@Me. Me Conservation officers have always carried sidearms. In Ontario they have been carrying handguns since their inception which I believe is the late 1800's.

Conservation officers are not like regular police. They are outdoorsmen themselves and are usually very respectful to hunters and fishermen. Yes, they have a little more authority to search, trespass and seize in accordance with the various wildlife conservations acts. A little known fact is they are pushed to issue fines whenever possible. And that crap about they can seize 'everything you own' is a little misguided and grossly exaggerated. The old timers like to spew that crap. Use a little common sense.

I was not meaning exclusively game warden stop. I was thinking more on regular rcmp traffic stops if they ask to look in vehicle or roadside sobriety checkstops and game warden stops

Me game wardens here in Ont Canada have always had a side arm.. ,, mind you i can onlt speck back into the early 70's you are right they can do anything they want, they have more power then cops, they can walk in to your camp, home and check your freezers with no warrant.. the can and will take every thing you have out hunting with you, cars, boats, RV guns, food, you name it..

@@ve3xtr seize 'everything you own' is a little misguided and grossly exaggerated. far from it, i seen it before my very own eyes, 2 usa hunters shot a moose in a no hunting area. they seized there 2 trucks, boat, guns, coolers. the 2 guys were only allowed to take any small personal items out.. they didnt have an RV as usa people must stay at a registers out fitter,, and pay the out fitter thousands of dollars for an a tag,for a cor, or bull, or calf... each out fitter is given a set number of tags depending on the size of there operation... . these 2 guys never got there stuff back, and band from hunting for life. plus a 10k fine each. this was also back in the time when party hunting for moose was not allowed. the game warden asked who shot the bull. and the guy with a cow tag said i did,,, wrong thing to say , that was another charge for that guy..

I've heard that search warrants are also a dangerous situation. I once heard a talk from a lawyer giving advice on correct behavior during a house search. That was for Germany but I suspect the situation in Canada is very similar. He described it the same way as you did: In most cases the police will be nice and friendly while you are being drawn into a seemingly casual conversation. And you likely won't notice when you cross the boundary into questions that you probably shouldn't answer.

Long story short, I was phoned by the police who wanted some info about the incident, he told me I must go to the police to discuss it……..to tell my side. I contacted a solicitor, she advised me to go or they will come to my house. Her advice was, “Say Nothing”, “Say Nothing”, “Say Nothing”, and look confident. I also printed out a blurb from the Police union that said when being interviewed by Police, “Say Nothing” I followed this advice to the letter. That was the end of the story, I said nothing, the police was frustrated and let me go. There’s nothing you can say to the police that will help you. Nothing. The police aren’t looking to find out what happened, they are looking for evidence against you.

One of the best things about court is that it has to be "proven beyond reasonable doubt", and it's not that hard to cast a shadow of doubt over things if you're not helping the people gathering evidence.

beyond a reasonable doubt means that the prosecution can have no holes in the case for you to be found guilty. Remember jurors make a verdict of not guilty not innocent. Not guilty means that there was not enough evidence to convict you, not that you did not do the crime

when I was a kid I was arrested. Asked for a lawyer. Spoke to duty counsel who told me "you're screwed." Case was later withdrawn.

The preamble they have to read to a minor is 5 or 6 pages long. Kids have a right to have a parent or lawyer present. It's hard to get youth confessions admitted at trial, they get tossed out all the time because the youth may not have "understood" their rights.

If you are a firearms owner, you can bet that the police will show up at your house looking for "Concluded With Charge." I lost my guns for 9 months because of a spurious "Public Safety Complaint." When the cops seized my firearms, they found one partially disassembled in my workshop, where the door was locked (satisfying the legal requirement to be locked inside a room that can't be easily broken into) but they still charged me with careless storage because it wasn't in the safe. They knew they had no case. They just wanted to force me to wade through the shit

It is called Using the Process as the Punishment and it is becoming more common all the time. Charges will be laid when they know very well that they have little chance of conviction. In fact, they don't care if you are convicted or not. By the time you get processed through the system, hire a lawyer $$$, take time off work $$$, and the stress of the entire procedure, with the distinct possibility of public shame, you will have been punished even though you are not guilty of anything in a court of law. There is no blow back on the arresting officers, or the crown, and you have very little to pursue a civil suit. It is one of a few a significant flaws in our legal system.

That’s the thing about owning a handgun in Canada. I hear they can come to your house anytime without a warrant and demand to see the gun. Also if you get into any trouble that is the first thing that’s going to come up when they run your name and their excuse to take your weapon whether it’s your fault or not. . Not sure if owning a handgun is even worth it in Canada.

Thanks so much for your time and effort making these very interesting videos. One thing I've always wondered when I watch these videos, is: Are there any questions that you are obligated to answer? For example, "What is your name" and "what is your address", or do you need to produce ID if you have it? Also, I know that the police are not allowed to listen to your call with your lawyer, but are they allowed to take note of the phone number that you called, so th3ey know which lawyer (or type of lawyer) you called?

I think it is so important anytime the police are conducting an investigation, and they are "looking for suspects". It can be a fine line between them asking you questions as a witness and as a suspect. You may be considered a witness at first and the some police are more interested in convicting someone, over finding the truth.

Would you recommend avoiding swear words while being "interviewed"? My first thought when you said the thing about a repeated mantra was to calmly say "I will not talk to you, fuck off" because it is so bluntly and holistically shutting off dialogue from a personal level as well as refusing to communicate since the mantra starts with "I will not talk to you".

In that situation, if you’re in an interrogation room and they state “You’re free to leave,” it’s now captured on at least one camera and two microphones. They can lie to trick you into confessing to a crime, but they can’t give you freedom to leave then revoke that with force in retaliation.

@@artemis142 if that happens your lawyer tells the jury / judge that there has been a conspiracy to keep evidence that would exonerate you from surfacing. Seeing as then it just becomes your word against them, proving your guilt beyond a reasonable doubt becomes very hard for the prosecution. Any attempt to keep a party from gaining reasonable access to evidence is a serious issue if your case goes to trial.

I'd be interested in seeing something about this too. Either A) you're on the scene and a witness or B) On the scene and could be construed as being involved but no clear evidence yet (how to avoid further incriminating yourself) ... In addition I'm curious how the presence of body cams (or other people recording the interaction) impacts all of this. Of course once you're in an interrogation room is there a fundamental difference between being interrogated as a witness vs as a suspect ... if there is any difference. Again how to avoid saying something as a witness that might make you a suspect. If you haven't actually been charged with anything yet they still won't let you go, can you still insist on speaking to a lawyer? Or is that something that's only available after you've been charged?

We sometimes don't describe things correctly the first time, and would the police use our own words if we try to correct ourselves, as a way to target us with a conviction? These days I'd be nervous just being witness.

DNA was used in a wrongful conviction I read about where the guy charged had spent time in a cell with the actual guilty party. At some point his DNA got on the guilty person who then inadvertently left it at the scene of their next crime. That’s freaking scary!

That's freaking nearly impossible, is what that is. More likely the DNA was planted or the cops lied about having his DNA.

I really appreciate what you are doing, very generous of you. I was once out with a group of people and one person started vandalizing a house at a party. The police took several of us to the station, separated us , and told each of us that our friends had said that one of us were the guilty party, hoping to elicit a confession through intimidation. It almost worked, as one kid was so scared he would of sold his mother down the river , as we were drinking underage, and the investigator threatened to inform our parents, Which they did anyway.... Fair enough. But please tell people this is a tried and true method of getting people to inform on each other

Thank you for making this informative video. I had no idea a lawyer isn't allowed to be present during interrogations in Canada. What if they ask about an alibi and you have one? Any advice on getting out of a speeding ticket!?! :-)

Alibis do have to be provided to the Crown with sufficient time to allow them to investigate, or else the court can draw an adverse inference against you. However, that can be done by your lawyer sending a carefully drafted letter.

Much of the Canadian court system, in my opinion, is the individual vs the hive. The Crown always has unlimited resources and knows full well, the law of attrition works in their favor. Once dragged in a battle, they know they have a good chance of winning. Monarchary is based on compliance. Or else.

Thank you so much! I think the tendency to feel that if you haven't done anything wrong you should just tell the police everything is incredibly strong. Media tends to portray interrogations as only dangerous for criminals.

If you've done nothing wrong, you've got nothing to hide. I've always hated that line. People who say it have either never been gaslit, or gaslight people themselves. Words can be twisted to fit evidence, and things can be manipulated to fit a narrative. The more information and data someone has on you, the more power they have.

Most criminal lawyers tell their clients to plea guilty and make a deal with the crown. Criminals don’t have a lot of money and the crown doesn’t like wasting time. Keep your mouth shut and don’t plea guilty until it’s very evident you are guilty.

Great video, but I'm confused. Why do you need a mantra etc. in an interrogation. Can't you just say "I am exercising my right to silence" and then they must stop? Can the police really force you to be bombarded with questions in an interrogation?

They absolutely can force you to keep listening to them ask you the same questions over and over for hours, all while promising they'll "let you go home" just as soon as you tell them "the real truth." They can also change up the questions to ask "Why do you want to remain silent, is it because you're hiding something?" and "Why do you want a lawyer, is it because you're guilty?"

This video is amazing even for Aussie law, in which you have to answer "no comment" to every question. There is nothing you can say to a cop who has decided to charge you that will get you out. You may just be giving them your defence to prep against in court. I know this and it saved me my life

Of course it is. They're not going to be dragged in that day, they'll be given a day or so for the adrenaline to wear off and collect their thoughts. You and I won't get that. And you can safely bet everything you own they won't be answering questions without a Union attorney or similar representation present.

I’ve had a client tell me that the police told them that I’d called in with a message that he should just answer their questions and tell them the truth. People your lawyer would not leave a message like.

The public defender assigned to one of my friends specifically told him to just confess, just plead guilty. My friend was indignant at this advice -- particularly since he didn't do it. I don't know why the lawyer told him to just plead guilty. In the long run, the case was just dismissed, which would not have happened if he had taken the lawyer's advice.

@@cam4636 Yes, I think you're right. His father suggested that he just blow off the court case for a year or so, and this was good advice. When he was re-arrested and this old cold case re-emerged, the judge just dismissed it without comment.

From a guy that had some very umm colorful teen years and early adult years I can say, this advice is golden. Worked 30 years ago. And I'm sure works today. Easy to repeat something over and over to them no matter what.. I used to say " are we done now, can I leave" to everything they would ask including, so Mr - - - - can I call. You that, and I'd reply " are we done now, can I leave ". Repeating something gives your brain something to focus on other then what there saying. Now that I'm many many years older and wiser, and haven't needed a lawyer in over 20 years, and hopefully never will again. But if I did. I would definitely use the repeat one line over and over, wonderful video with great advice and great break down of how it goes. Side note, true they can't use the hose on you but sleep depervation they can, or used to any ways, and lack of sleep really can mess you up and how you respond.

My favorite is, especially if stopped on the street, "I would like to be on my way. Am I free to go?" The implication is that you are not there voluntarily, you have something else you wabt to be doing, and they're imposing on you with their questions.

I have been interrogated as a suspect despite being innocent. One thing that is extremely important is to understand the difference between being questioned blind as an innocent person with no knowledge of what has happened and having the benefit of hindsight. There's a lot of people who sit in the comments section of KZbin saying, "Lawyer up immediately!" I assure you that's not how it works when you're innocent and have no knowledge what has even happened. I went to work one morning and got a call from a detective and was told to come home. The police then said, "No, go straight to the police station." As soon as I got there, I waited in a room for what felt like an eternity before a detective even showed up. I was texting a friend of mine, joking about being arrested because I had no idea that something truly devastating happened. At that time, it may seem like joking via text messaging was a bad idea, but I was deep down seriously anxious. I was a citizen with no previous criminal history with the only thing on my record being a traffic ticket for improper passing. When the detective got there, he didn't even really say he was going to question me. He just asked me to come back into a different room. The questions began with, "Just tell me about your day." My day was literally getting up for work, taking a shower, leaving my house to go to work and being exactly on time to work. He never told me anything that had happened, he never said there were charges for anybody, and he never said that I was a suspect. It wasn't until he got everything he needed from me that he slowly released the details of what had happened. And when I say slowly, I mean slowly. Around every corner, I was left confused. Cops oftentimes tell people they're interrogating that it's weird that the suspect hasn't asked what has happened. I promise that you, as an innocent person, will be so confused that you won't know to ask what has happened. For me, my dad shot and killed my mother and then turned the shotgun on himself, committing murder-suicide. When the cops told me of my parents' death, they didn't tell me it was my parents. After hours, they eventually told me that "two dead bodies were found." They didn't tell me how, they didn't say what they thought happened, they didn't say who the bodies were, nothing. So, I had to come to my own conclusions about who died and how. And that was on the spot. I wasn't upset, I wasn't crying, I wasn't losing my crap... I was confused... so confused... I ended up giving them everything and no charges were filed against me, but the evidence seemed very clear and detectives showed me everything at the scene. But this was after I had been interrogated. The point is that there is a huge difference between hypotheticals or having the benefit of hindsight vs. REAL LIFE situations and REAL LIFE interrogations. It's way different than what you may think. Your first thought, no matter how prepared you might think you are, is not "I need a lawyer." Now, if you're guilty, maybe you'll know to straight up ask because you know the crime scene and what happened. But I didn't as an innocent suspect.

I have had a goodly amount of time in the situations discussed in your video ! I have found that a person with a strong personality intimidates the police officer ! For instance : I tend to infuriate cops by inquiring into their home lives ! They become very defensive and flustered ! Especially if the question you ask hits the right button ! They can't get rid of you fast enough !

Ian not sure if you will see this but here in Ontario there has been a lot of concern regarding the Rodger Kotanko shooting by Toronto Police and the fact that no one is talking. Would you be able to explain why the officer will not talk to the SIU and why the TPF will not provide information. To a lot of us this smells like a police coverup

Question about the ending of the interview. If you throw up your "wall", has there been any case law about how long can they keep you in the interview room? E.g. say they keep you in there for 12-18 hrs without food, water, bathroom in an extreme case.

Another question to add: If I have to use the washroom before or during the interrogation, can I be denied permission to go? If I'm denied permission and I end up "pissing" myself, will my urine be collected for DNA? Are police legally allowed to do these things?

@@Groteskfull Urine itself does not contain DNA, but it may contain epithelial cells, which do contain DNA. Most healthy individuals, however, do not excrete epithelial cells in their urine.

I used to wonder if they had all this evidence against me, the interrogation is unnecessary. In Victoria Australia, there is no automatic entitlement to a phone call. I think you get one anyway. On the news, they say they grill suspects for up to 12 hours. But if you are not charged, you can leave.

What they are allowed to do to you, For example who can detain you who can put their hands on you etc. And also what rights you have with them-can you walk away from them, do you have to stay and listen, which ones do you have to provide your ID to?
