Federal criminal defense lawyer Ryan Pacyga explains what happens when a person is arrested for a federal crime. Usually the US Marshals will arrest someone if there is a federal criminal complaint or indictment. The person is then brought to federal court in front of a magistrate judge. The prosecution or judge may require a "detention hearing." A detention hearing means they are trying to keep the arrested person in jail without bail. Federal criminal defense attorney Ryan Pacyga has experience challenging detention hearings in an effort to keep defendants out of jail while their federal criminal case proceeds.

Question my friend who already been out on bond here in Michigan for a case he caught back in 2019 (the case was felon in possession and) assault with intent to do great bodily harm) was just picked up by feds because he got caught with an ar-15 by the Detroit police. Is it no hope for him? He keeps going before judge they keep denying is release. His jury trial for the state charge he’s out on bond for starts in July is there any hope for him?

That's really hard to say without having access to all of the evidence (that's called "discovery"). I always believe there's hope, but hope can be defined in different ways...

Question: Is part of a book Im working on. So my character (Silvia) was charged with two terrorist attacks, HOWEVER, she did not commit them. She was framed. Now she's in jail or Detention Hearing if that's how you want to put it. The FBI Agent who learned about it, arrested the person who framed her for the attacks. My question is: What will be Silvia's fate, will she still have to do federal court process or will the charges be dropped (if so how long does that take?

That completely depends on whether the government (the prosecutors) believe Silvia had anything to do with it or not. If they are convinced she’s innocent then they may bring a motion to dismiss the indictment. But if they aren’t convinced that she’s innocent then Silvia would have to continue to endure the criminal court process up through and including trial or a guilty plea.

Christopher Cancel also, in terms of how long that could take, if you’re asking how long her federal case could last from arrest to trial, anywhere between about 70 days (under the speedy trial act) to a year or more.

That y he has to force his staff to not take this case to Court because he will be charged and placed under arrested god knows that.
