Hi Syed, In new labor reform initiative it was informed that internally worker can transfer the sponsorship, whereas certain conditions are kept as well. Mostly companies are acting same as you wrote. In such situation employee has only one option to report this to Labor court. Yesterday i wrote an email to Qiwa and MHRSD, requested them for a face to face meeting or virtual meeting which every they preferred. Listed 9 questions whose answer is not clear to me and most of the people, one of the question same as yours. Lets see if they revert so that we can have a clear answers: Questions: 1. If a person does not have Iqama, It is not issued by Company then how he can apply for Sponsorship transfer?. 2. If Employment contract is expired, then during sponsorship transfer does it require approval of the current company?. In the FAQ it is mentioned that if the contract expires then transfer will be completed directly. How we will make sure about it because in Qiwa we do not have contract start and end date. 3. If a worker's status is "absent from work" and he is inside Saudi, will he be able to transfer the sponsorship and if yes, how his absence from work status will be cancelled. 4. If a contract is terminated digitally via Qiwa portal and after completing the notice period does it still require the approval from the current company for the transfer of sponsorship? 5. Does the company have any time frame to accept or reject the digital contract termination request?, if yes may we know how many days they need to accept or reject the request? 6. If a worker terminates the contract will fully comply with contract terms and conditions and even though the company rejects the contract termination request , then what shall a worker do?. 7. Many people are complaining that company is not allowing worker for sponsorship transfer, can you please suggest what worker will do if any company does not allow worker for sponsorships transfer? 8. Some companies apply 'absent from work' to workers which is not correct, in this case what a worker can do to remove this absence from work status. Sometimes sponsors apply absent from work and demand money from workers. 9. If a worker is absent from work status, Iqama is valid, then can he apply for Sponsor transfer?
