Being part of the community and living as independently as possible are among the most important values and goals shared by people with disabilities, their families, and advocates. A home of one’s own - either rented or owned - is the cornerstone of independence for people with disabilities. However, across the U.S. people with disabilities, including people with intellectual and developmental disabilities , face a severe housing crisis.
Many people with live with aging caregivers (age 60 and older). As this generation of caregivers continues to age, many of their adult children with may be at risk of institutionalization or homelessness.
The availability of affordable, accessible housing remains far less than the need, leaving far too many people with institutionalized, homeless, or in “worst case” housing (paying too much in rent to afford other basics or living in severely inadequate conditions).
Who Is a Person with a Disability?
Federal nondiscrimination laws define a person with a disability to include any (1) individual with a physical or mental impairment that substantially limits one or more major life activities; (2) individual with a record of such impairment; or (3) individual who is regarded as having such an impairment.
In general, a physical or mental impairment includes, but is not limited to, examples of conditions such as orthopedic, visual, speech and hearing impairments, cerebral palsy, autism, epilepsy, muscular dystrophy, multiple sclerosis, cancer, heart disease, diabetes, Human Immunodeficiency Virus (HIV), developmental disabilities, mental illness, drug addiction, and alcoholism.
Some impairments are readily observable, while others may be invisible. Observable impairments may include, but are not limited to, blindness or low vision, deafness or being hard of hearing, mobility limitations, and other types of impairments with observable symptoms or effects, such as intellectual impairments (including some types of autism), neurological impairments (e.g., stroke, Parkinson’s disease, cerebral palsy, epilepsy, or brain injury), mental illness, or other diseases or conditions that affect major life activities or bodily functions.
The term “major life activities” includes those activities that are important to daily life. Major life activities include, for example, walking, speaking, hearing, seeing, breathing, working, learning, performing manual tasks, and caring for oneself. There are other major life activities that are not on this list. Major life activities also include the operation of major bodily activities, such as the functions of the immune system, special sense organs and skin, normal cell growth, and digestive, genitourinary, bowel, bladder, neurological, brain, respiratory, circulatory, cardiovascular, endocrine, hemic, lymphatic, musculoskeletal, and reproductive systems.
Under regulations implementing the ADA Amendments Act of 2008 some types of impairments will, in virtually all cases, be found to impose a substantial limitation on a major life activity resulting in a determination of a disability. Such impairments are “predictably assessed” as disabilities by the very nature of the impairment as substantially limiting a major life activity or major bodily function. Examples include deafness, blindness, intellectual disabilities, partially or completely missing limbs or mobility impairments requiring the use of a wheelchair, autism, cancer, cerebral palsy, diabetes, epilepsy, muscular dystrophy, multiple sclerosis, Human Immunodeficiency Virus (HIV) infection, major depressive disorder, bipolar disorder, post-traumatic stress disorder, traumatic brain injury, obsessive compulsive disorder, and schizophrenia. This does not mean that other conditions are not disabilities. It simply means that in virtually all cases these conditions will be covered as disabilities.
In general, the definition of “person with a disability” does not include current users of illegal controlled substances, but does provide protections for individuals with drug or alcohol addiction. Individuals would also be protected under Section 504 and the ADA if a purpose of the specific program or activity is to provide health or rehabilitation services to such individuals.

I am a senior. I have lived at the same apt. for 17 years. My rent has been raised so much that I. can't afford it. I get ERUC benefits from the pandemic. I have been getting them for three months and would be homeless without it. I am told lihtc, subsidized housing is almost impossible to get Long waiting list.

GM I think I need more time then I can afford,there is no voucher for me and now I'm placed back on the waiting list because I have a sh#ty mental health case worker,have all the paperwork from my doctor's,as they were doing just what you said with the horrible location,if you could tell me how much time and is the price one time? I get 1200 and pay 810 plus utilities, been on the list more than 10yrs but have no children. Is there a way to enforce my papers saying hcv but getting PHP, I have tried but this mental health breaks my moral cause I am to be represented by my agency,so I do as much as I can before I withdraw, even the woman won't send back my SD for the box they offered me. Do you think I could get the voucher? Can't look for a place cause when we had the appt with reasonable accommodation and eligibility worker my case worker F*&*d it up and instead of my interview,it became a paper work drop off!!! I am so at my end, like fighting every day and never landing a lick, I've started smoking cigarettes again so stressed out,alone and v vulnerable.

I am widowed for 11 yes and have been on the wait list fir that same amt of time. I was homeless fir 9 months after he died with our 9 yr old son. No help. I've taken the spdat 10 plus yes ago, scoring a 22. I also am diagnsed with BPD.. As of late, the home i rent 2 roos in burnt down this last Xmas eve 2020 and I am homeless since, once again. OMG, I despise people who abandon baby animals. The cats I have now are all from a litter from one rescue cat.. Bella lost part of her intestine and passed away during surgery that was paid for by an organization. The babies are going to be 2 in April. I just cannot leave them behind, they are our family. They are confident and happy. I have 2 others that are rescued, I really am working toward finding a home that will allow us to have the cats. I feel like I have a friend in this box now! haha!! I never leave my apartment without stimulation. They have TV on, they are on a feeding schedule and I clean boxes at least 3 times daily. I REALLY need to move because the place I am living in a place now that should be condemned and is owned by a couple in California, I am in North Carolina. I am so happy to hear about your kitties! My youngest sin was put on Seroquel and Tenex at 7 years old. They dropped a $22,000.00 child suppirt they said I owed. My son had not been in CPS custody to incurr a $22,000.00. They took my son without checking my friends impeccable credentials. When they did they found out his best friend was a Luitenant they dropped the$22,000. In child support bill. And dudnt return my son to me nor did My friend ever recover a dime even after a agent and the Lte. (Eric Pearson) have any of mt friend's money. He didn't deserve to die penniless. He was a goid son. I helped take cars of his mother until the end. And his brother in law took his daughter away and raised he the rest of the way. The architech who is also a Jehovahs Witness.
