As a Los Angeles California licensed PI who works divorce / custody cases regularly rule number should be: Never, ever, never send text messages, e-mail or leave phone message that even approach anything close to "untoward", as they NEVER go away. I had a "celebrity" client who simply could not stop sending vile, angry and threatening text messages to his ex despite my efforts to make him stop. Some of these messages were appauling to say the least. When she did not reply, he got even madder and sent nastier text messages, usually late at night and when he was drunk. Needless to say her attorney and the court saw them....... his case did not have a happy ending and was 100% avoidable.

Thank you. Me and my exes 10 year old daughter is being groomed and kept from me now for 2 weeks. I have soooo much saved, including admitting telling her I'm on drugs, blocking me constantly from her phone, even got her school to not let me get her because neither of us have custody. CPS placed her with him (he's a registered sex offender here in Florida, since she was 2).... so scared and I get angry and sad and text A LOT. How long should I wait before filing anything because this is just one more thing that could make me look bad

Yep!! Also, purposely push communications to text, email or an app as much as possible WHILE making sure that you remain calm & rational. Personal example, my husband was recently appointed sole conservator of his two girls. His ex has a drinking problem. This past summer she got drunk, went online, met a total loser and invited him over to her house for a little “adult time” while the girls were asleep in their beds. She then passed out and basically left herself and two young girls vulnerable and alone in a house with a complete stranger she’d met online literally only a couple hours prior. The oldest (9) was introduced to him the next morning when she found him in her mom’s bed. After that, he never left. Just moved right in and my husband’s ex immediately began leaving the girls alone with him. Any concerns my husband expressed were ignored or laughed off as “you’re just jealous.” We now know the bf is NOT a good person and that the whole time they were together he’s been using opiates and has messed his mind up so much that he hears voices in his head and is super paranoid. Like, he thinks the voices in his head are FBI agents and that they’re mad that they’ve never been able to put him in prison. He even thinks these FBI agents can use his eyes to see what he’s seeing. The female agents apparently flirt with him and participate in a little “personal” time while they watch adult entertainment videos online together. Yeah, It’s bizarre to say the least. Anyway, the bf was a problem, rather… her complete disregard for the girl’s safety and her refusal to put them first was, and still is, a huge problem. Once my husband realized things were clearly heading in a direction that he may have to step in to protect the girls, I advised him to push convos to text so he had time to think before responding and so he could choose his words carefully and hopefully get her to admit to things. So he did. One of the very first texts he expressed his concern and listed out her drinking, how she met the bf, how she brought him over the first night with the girls at home, how she allowed him to start texting the oldest after knowing him only 5 days, how she let him move In immediately and how she was leaving the girls alone with him. Her response? “You’re so right. I know I’ve screwed up and I shouldn’t have done those things. I poured all my vodka down the sink. I’m done with it. I realize how much damage it has caused. Besides… my bf said he wouldn’t stay with me if I keep drinking.” Of course, this was still early on and he was still playing good guy and hiding the fact that he was also an addict. That was the first of many admissions and I also kept a running timeline of literally everything’s that happened including the dates & times. I’m sure you can imagine how helpful those were in the long run and how much easier we made things for our attorney!! Already long story short, 6 months later she OD’d after she drank half a handle of vodka in a couple hours and took a couple pills he bought off the street. Paramedics needed two doses of narcan to bring her back. We got a call from a cop we know at 1:30am. We rushed to pick them up then refused to return them and called our attorney to start the process of filing for emergency custody. She eventually had her bf and friend lie for in court but because we were so diligent about pushing convos to text and recording any calls, we were able to easily prove they were all lying! It can be a pain and difficult to remember to record things but it pays off in the long run!

I was co- parenting fine, well we had issues of him not having a place to live, a vehicle and he would just be hours, sometimes days late getting him and than refuse to bring him home. BUT my son told me his dad makes him watch videos with men & little boys naked and touching each other (way worse but you get my drift). I went to CPS and they sent it to sheriff’s SVU. Well the sheriff couldn’t get him to come in, talked to him over the phone, he denied it, got rid of evidence (his phone) and closed the case. So he threatened court AGAIN and I said “ok fine, take me to court!!” Now I got served papers, so here we go. 😢 I just want my son safe!!

Interrupting- interrupting makes judges pissed. And constant interrupting will help you lose your case. Be respectful, polite, give clear concise answers to what is asked. Listen to your lawyer, never go against your own lawyer unless behind closed doors.

I can’t afford a lawyer and have been trying to co-parent for the past five years. Their father has not kept them up to date with any doctors needed. And they both now have ptsd from the abusive behavior of the father and multiple girlfriends. I have ptsd after years of abuse myself. I have taken the children to all doctors needed, or have the visits set up. They are both now in with psychiatrist to help them with their issues. What can or should I do considering I can’t afford a lawyer?

I've been using AI GBT to help me with everything. Google parenting guidelines in your jurisdiction or even ask the AI because it'll probably know. Then, based on those guidelines, start making a list of instances or situations where he was completely disregarding those guidelines. Make sure you have evidence to back up all of those claims. I've been making the mistake of being afraid and waiting too long to take action. But neglecting the children's medical needs is a big make against his ability to parent. You can use doctor records to show that you have been the parent to handle it all. You can use messages asking him if he's taken the child to the doctor or if he can take the child to the doctor when nesserary, and if he doesn't respond or refuses, there's your proof.

You can even ask AI to write you a legally professional motion. I use it to write my facts and arguments, but I always carefully re-read through it to make sure nothing was altered to give false information or claims.

What could happen if the other side is constantly filing motions, re-litigating issues that have already been brought up, filing multiple motions while some other motions are currently pending, even after the GAL said there’s no emergency going on? YES. That’s what the ex is doing. I filed for a parent coordinator, he missed 5 court dates and only shows up upon being served with a contempt order. Then he filed for full custody while we were still in mediation. Then he told the parent coordinator that he would give me full custody. Then he told the kids they had to choose which parent they want to live with. So there are motions at work that overlap and it’s just nonsensical but I can’t get off the merry-go-round. There is no emergency, we are both good parents, love our children, but now I feel like the ex is hurting them by making them choose one parent or the other. It’s really heartbreaking but I’m just trying to keep a clear head and take good care of my children. ❤

@@javesday8814 I didn’t actually file for contempt. He was served by the court after missing 5 summons. Then he had to go before the judge and explain why he hadn’t complied with the 5 summons and why he refused to meet with the Parent Coordinator after being ordered to do so. He sat there in a suit & tie and told some BS story about how I wouldn’t pay my half of medical bills, after he had violated the order by signing up our kid for braces and giving me a bill for $3000. I told the judge that our custody agreement states that 1) I am responsible for medical decisions and 2) I simply do not have $3000 for a non-emergency medical procedure that I didn’t consent to. He was so charming and “frustrated” with my behavior in his description, that the judge decided NOT to hold him in contempt or arrest him. It was a classic narcissistic flip. The judge did order him to comply with mediation, during which time he filed the motion for full custody. After 4 mediation sessions we still didn’t resolve anything so pre-trial hearing is in March. It’s absolutely ridiculous but the narcissist’s power is not to be underestimated. Sadly enough.

Hello. Can you give some advise. I have every other weekend visits/Judge browns visitation schedule. However the temporary order has not been signed. My is not responding to text or phone calls has blocked me. I have sent non threatening amicable messages to speak to my kids which is in the order. But as stated it has not been signed by the judge despite the fact we are acting on the visitation part of the agreement. Should I continue to send messages asking to speak to to the kids despite she's Ignoring the messages? Clearly if I'm making and effort and using all the time I can this can only make me look better??? Right???

Opposing counsel was allowed to write an order to SEAL a file in guardian court . Instead she wrote an order to impound the case and transcript. I re-approached the bench when I read what she wrote. The judge told her NO only SEAL the file. I left the courtroom and she wrote impound and seal the entire case file and TRANSCRIPT. The only way I can show the court is to pull the transcript and let the judge see the video . They are refusing me the transcript. Now I am asking a lawyer to help .

I'm currently fighting for custody of my 2 year old cousin who I've raised since 8 months old. The biological parents placed her into my care due to drug and financial issues... The maternal grandmother had only met the baby 1 time at a year old, then showed up with a temporary custody order at 16 months old.. we have been fighting her in court since. Have the mother sign temporarily custody or guardianship over to u & get it notorized & file it with the court family Division .Might b away around having to deal with establishing custody of the child right now u have no legal custody so it will b easier for bio grandparent to get custody .The child needs to b in someone's custody legally if not in parents custody . u really need to get mom & dad if possible to sign rights of the child o er to u GOOD LUCK !!!!

My son and I escaped severe domestic abuse. My ex abused my son and harmed him. She was convicted on breaches of domestic violence orders and ended up with multiple criminal charges. She took her case to family court after 13 months of separation. I self represented with my lawyer working on the side. My ex's lawyer got me into a consent order for supervised access. I now regret the decision as my son is only 4.5 years old and he is worried about seeing his mum again. Once I submit my response to her application, can the supervised access be rescinded?

Interesting and informative. Opposing counsel keeps filing motions trying to get my case denied and showed up without Discovery. The magistrate gave them another 10 days (she said 7 but listed 10) to provide it resetting the trial date. I responded with a motion asking that he would be barred from trying further to get the case denied before trial, was that an acceptable move? The attorney seems to be trying everything to get the case thrown out before trial and I'm worried he will use case law to get his way.

I have a highly litigious crazy making attorney representing mother, and she is lying and refusing to answer discovery. Her attorney cut and paste a statement about "not being comfortable" with answering the discovery after answering 20 questions by question 60 it was a breakdown... so lazy.

Any advice for going through court battles in Montréal Canada in the case of parenting alienating the other party I'm the targeted parent trying to do what's best trying to rise above things it's really tough the other isn't doing what's best there's been a lot over the past 4 yrs. Her tips were very helpful I haven't done any of those things lie on the stand I've been brutally honest I find it tough the other party and lawyer have straight out lied and cheated and tried to manipulate the system to get what they want and I didn't respond at all it's been extremely tough when it's our children that your hurting in the process

Fired my lawyer and teaching myself. I don’t want to bombard them with evidence or overload. I didn’t share my information in the beginning or pre trial with my original lawyer because I grew up in a boys home. I was afraid If she was deemed unfit or myself I didn’t want my child ending up in CPS. So I let her slander me about drinking. No dui, no dwi. I recently filed An answer and motioned for Trial on our already temporary orders open case. Would this evidence get thrown out if I fired my lawyer and now representing myself pro se.

I need help. I had no idea what my ex was going to bring up in trial. I had to defend myself in court with no evidence to prove I was telling the truth and that he was lying. I didn't see what he was filing until the day of trial. I also tried to provide evidence prior to trial but the other party objected and so it was never allowed into evidence so I lost custody. We went to appelate court and I lost again because I didn't know you're not allowed to submit additional evidence. My ex has two aggravated misdemeanors on his record including aggravated assault and wreckless behabior with a weapon, the latter he pled guilty to DURING his trial home placement period after DHS temporarily took away custody. I'm stuck in a nightmare and am verbally abused almost daily while he has my baby. He sends me degrading messages constantly and blames me for his life failures. When he's in a good mood he begs me for sex, pictures, videos of myself and even asks me to meet him at a hotel, knowing that I'm re-married. He sends me naked pictures and videos of himself. This guy is a psychopath but intelligent and manipulative. I've never stood a chance against him in court. We're going back to trial as I continue to fight for custody. I have a lawyer but I have nothing but doubt and fear going into this a second time. Most of the time it feels like my lawyer is on his side!

How do we use Facebook evidence? Example. Other side posts something, we screenshot it. It only shows “ 2 hours ago”. The other side deletes it after screenshot and we can never put a date to the post.

Will the family judge frownupon me for not allowing the coparent to visit the child if I have a restraining order against the coparent for my safety, and one of the times that I was abused by the coparent, he shoved me while I was holding my newborn, and he also was letting the newborn suck on his body, which is very weird. My newborn is breast-fed. He talks about taking my baby for me as well. I understand my mother can probably do supervised visits with him, but he’s rude to my mom as well. He threatens to take me to family court. He says he wants a third-party to figure things out, so do I still have to continue to work with him? Or should I call him on his bluff and tell him to take me to family court? I’m prepared for family court, but will the family judge look down on me for not doing any kind of visits with my coparent till then

I worry because I am violating the judges orders. There are 3 very good reasons for this that the judge is not aware of. I did file a motion to change circumstances so that I wouldn’t be violating orders, but my attorney was absent and the judge blew me off without seeing or hearing any evidence.

This is exactly what happened to me but I didn’t have representation. So I didn’t know how to do so and at court I was basically told to sit down and shut up. 😞🤦🏼♀️ I was on bed rest and 6 months pregnant totally screwed everything up

My ex filed for divorce when we were still living together. I have always been worried about law. I let my daughters with him. It's been 11 years since I let the house. I see them when I can. They live in California and I live in nj. I didn't know about my rights as a mother. I don't know what to do. I asked him to send my younger daughter to come to visit me and he said maybe. "The maybe means no" when I go to visit my daughters he always wants to be with us. I never felt comfortable. I'm the mother and I have rights to be with my daughters. I don't have the strength to tell him. I'm still scared of him. He didn't treat me well when I was with him.

I had this .I just had my trial .the judge gave other parts so much time anddis not accepted my usb exhibits.those were vedios of my kids.The judge has granted sole legal decesion making to my husband and says until January I have to complete some things then she will modify that order.I am thinking to file motion for reconsideration and née trial.please give me advice.

Does this same advice apply in the State of Texas?? My children were kidnapped and murdered from 1993, FBI, police could never find the children and the mother who is a citizen of Haiti filed before she left the country. No address provided and no court ordered medical records. I have never seen a judge for trial and no attorney has every been allowed in court to speak for me or my children. Now I am 75 years old, homeless and dying and still owe Texas $11,000; New York $53,250-where she filed for same case same children; IRS $3,500 money taxed on my Social Security never received sent to Texas; VA hospital $2,800.

The social worker said I was giving her inaccurate information to get in touch with my therapist and psychiatrist this is not true I even had my therapist call my worker personally to get in contact with her and she has call her and left her a few messages with her contact information as well but the judge won’t see any of this evidence unless go to trial because she leaves out this part about the information disclosure in her affidavit and just said that I am giving her false contact information I’m so frustrated

Hoping the best for you and your child. This sounds exactly like what happened to my father with his son. Unfortunately, he always paid child support and never got the visitation he deserved. Fortunately, my father and I were both able to form a relationship with him once he reached adulthood and could reach out to us on his own. Even though I didn't get to grow up with my big brother, I love him dearly.

Don’t listen to these people saying no chance. You have just as many rights as the mother. Keep records of anytime you reached out to see your son. You did the right thing filing for parental rights and responsibilities. Alot of men dont and here you are 19 years old taking the initiative. A judge will see that! I guarantee you will get visits. Smoking weed is not an issue as long as its not when your child is present. Ask for every other weekend. Or if that is too much start with day visits every other week and ask the judge to start with that and if you stay consistent for maybe 4 months then ask for overnights every other weekend. A judge wants both parents involved whenever possible. Go for it! That is your son there is nothing to lose. Also anytime u file anything in court ask for a waiver of fees . Ive done almost all my court stuff for free with no attorneys. Only costs money when i have to have a sheriff serve him. My situation different father was in prison 5 out of 7 years of our sons life and very abusive to me.

Hello, I have a question. so I had solo legal custody and sole legal custody because mom abandoned my son in a period of 4 years she moved to different states supposed she has one day per week of visitation but she left. few months ago judge revoke me the sole legal custody because I leaved my son in the car for a 15 mins police arest me and cps takes my son custody temporary just for 2 days. court for cps ordered to realese my son to my custody immediately and denied mom emergency motion. mom now has visitation only facetime twice a week but I have a pre trial about it the other part defender's mom want to show to court that lm not the right parent. its possible to loose my son custody?

Remember, lawyers make money on litigation. Talk to people that have gone through this. The only way a man wins custody is if he can prove she leaves the kids alone for days at a time without food and water - or if he has pictures of this ex having sex in front of the kids. Otherwise you won't win - look up the statistics.

I lived in California with my ex husband and two daughters. When i asked him for divorce he told me he would stay with my children because he was the one who was making money. I was depressed all the times. He ignored me most of the times. He never wanted to listen me .. i went on a diet because he said i should lose weight... so i decided to leave the house without my kids... i didn't know anything about my rights as a mother. I always thought he had the rights to have custody of my children. Now my youger daughter is sick she needs to see a doctor but her father thinks thai it is not serious what she has. 😢

No “litigation” is going on in Family “law” courts. If you have not been CRIMINALLY convicted of child abuse a Family “law” judge (or court for that matter) lacks the subject matter jurisdiction to even hear your matter

It seems to me that family court is highly dependent on making the judge like you...... Which is a pretty terrible way to run a legal system
