Great to hear from a hanafi trying to follow the true spirit of the Imam. Imam Abu Yusuf more or less was a hadithi hanafi, and was so spared the criticism the other hanafis faced from the die hard habalis. I personally think the mutazilis were right on many issues, but we only hear their views from their enemies who "won the war and wrote history".

Extreme mutazolite also justified being married to their sister..they used logic to the extreme. People missread and misquote and misunderstanding. Both Ibn Sena and Imam Ibn Taiyuan had a lot in common but this is either overlooked or overshadowed by the liberalism tendencies with ibn seenas idolised. Both are byproduct of their time and addressi g their scholars of time. So let's be balanced. projective relativity understanding does great deservice.

All independant islamic scholars are doing a great job by speaking honestly and daringly about problematic hadiths, hadrat Ali and on many other historical and political games played by that time kings, governors and how they influenced the islamic literature .

Is it ok to reject a hadith book that is unauthentic like the books before bukhari like mussanaf ibne abi shaiba, mussanaf abdur razzak, baihaqi these type of book that has more daif and mozu hadith is it ok to reject these hadith books and another question is it ok to reject hasan hadith can we reject hasan hadith please answer these questions.

At least the moroccan scholars are no hypocrites and I'm not even a moroccan, but I think it's so disrespectful to talk about the scientists like that, Who are those guys to judge others like that as if shaving beard is the worst thing a human can do. I mean shirk and immoral behavior is everywhere in Muslim countries and we are being attacked from all sides and the only thing we worry about is the scholars shaving their beards.

@@m-i_ yes i don't believe in it. But i would say the vast majority of muslims do and they have some hadith that support them. Deobandis like ashraf ali thanvi also have books supporting that. While these are points that can be argued over, i'm glad mufti concentrated on the issues of hanafi fiqh, aturudi aqidah and the primacy of hadith status... I'd rather hear the shaykhs views on those points than all the other stuff which agrees with most deobandis/muslims anyway.

I can attest to what he says. The hanafi of Bosnia and turkey are very Syrian style hanafi, which are not as "hardcore" as the Indian hanafi. But again, in India you have deobandi and brelvi which are kind of different to each other.

Assalamu alaikum. Personally I respect both of you, as you are trying to do something unprecedented. May Allaah show you the right path. I have a question on the concept "Mortgage = taukil + murabaha". In Murabaha model, isn't it like the seller has to own the property before being able to sell? We know that banks don't deal with the product or house itself, they transfer the money to your account and you are the one who buys the property, then bank treats your property as security against non-payment. Bank is, in my understanding, only dealing with money, unless it is a house in foreclosure. Am I getting it wrong? it would be great if this was explained a little bit more. Jazak Allaahu khair! By the way, the 'taukil' rationale was mind blowing indeed.

In Murabaha transaction, it’s a Shari’a condition that the Islamic bank needs to own the asset prior to selling. The Islamic bank purchases the asset in its name and then sells it to the customer under Murabaha agreement. In case the customer acts as an agent, he then purchases the asset on behalf of the Islamic bank and then purchases the asset from the bank under Murabaha agreement. The non-Islamic bank usually transfers the funds to the customer’s account to enable him to purchase the asset. It doesn’t need to own the asset. However, in both Murabaha & non-Islamic banking transactions, the asset is mortgaged as collateral.

Sheikh is grossly mistaken on the issue of Beard that the length of the beard is only raised by Indo-Pak subcontinent scholars. The first one to talk about the length was Imam Sughnaki known as sahib un nihaya. Sheikh should clear it as it was an academic mistake by him.

The following verses refers to riba / usury. Those who devour usury (interest) will not stand except as stand one whom the Evil one by his touch Hath driven to madness. That is because they say: “Trade is like usury,” but Allah hath permitted trade and forbidden usury. Those who after receiving direction from their Lord, desist, shall be pardoned for the past; their case is for Allah (to judge); but those who repeat (The offence) are companions of the Fire: They will abide therein (for ever). ( Al-Baqara, Chapter #2, Verse 275) Allah will deprive usury of all blessing, but will give increase for deeds of charity: For He loveth not creatures ungrateful and wicked. (Al-Baqara, Chapter #2, Verse #276) O ye who believe! Fear Allah, and give up what remains of your demand for usury, if ye are indeed believers. (Al-Baqara, Chapter #2, Verse #278) O ye who believe! Devour not usury, doubled and multiplied; but fear Allah; that ye may (really) prosper. (Aal-e-Imran, Chapter #3, Verse #130) That they took usury, though they were forbidden; and that they devoured men´s substance wrongfully;- we have prepared for those among them who reject faith a grievous punishment. (An-Nisa, Chapter #4, Verse #161) That which ye lay out for increase through the property of (other) people, will have no increase with Allah: but that which ye lay out for charity, seeking the Countenance of Allah, (will increase): it is these who will get a recompense multiplied. (Ar-Room, Chapter #30, Verse #39) Clear conclusions from there verses: Trade although has some parallels with usury are not the same things. The blame is only on the takers of usury not on the giver. When someone is in a financial need, help him in whatever ways you deem fit without exploiting his condition. This will be counted as charity by Allah. Since it is impossible to avoid "usury" completely (due to inflation, lack of wealth generation mechanisms, war like situation, use of different currencies in different parts of the world) a limited permissibly is granted. It is only the exorbitant (double and multiplied) usury that is prohibited and devoid of any blessings. The ultimate guidance (regarding the exact meaning of usury, exorbitant, difference between trade and usury) will come from Allah alone and everyone will be judged based on his intentions and level of understandings Unfortunately the so called "ulema" read everything but Quran. They make all things such as photo, silk, gold haram against the Quran. These ulema are making money out of the religion aso they can not be honest in accepting truth.

Now look where all the confusion comes from. Sahih al-Bukhari, Volume 3, Book 41, Number 579: Narrated Jabir bin Abdullah: I went to the Prophet while he was in the Mosque. (Mis'ar thinks that Jabir went in the forenoon.) After the Prophet told me to pray two Rakat, he repaid me the debt he owed me and gave me an extra amount. From Anas ibn Malik: The Prophet, peace be on him, said: "If a man extends a loan to someone he should not accept a gift." (Mishkat, op. cit., on the authority of Bukhari's Tarikh and Ibn Taymiyyah's al-Muntaqa). Narrated AbuUmamah: The Prophet said: “If anyone intercedes for his brother and he presents a gift to him for it and he accepts it, he approaches a great door of the doors of riba.” [Sunan Abu Dawood, Book 23, # 3534] Narrated Abu Hurayrah that the Prophet borrowed a two-year-old camel and returned a similar camel, and in addition he gave another camel, and said: 'Best of you are the best in returning your debts.' [Suhail, p. 106, quoting Jami AlTirmidhi, Kitab al-Buyu, v.6, #56] Sahih al-Bukhari, Volume 3, Book 34, Number 344: Narrated 'Umar bin Al-Khattab: Allah's Apostle said, "The bartering of gold for silver is Riba (usury), except if it is from hand to hand and equal in amount, and wheat grain for wheat grain is usury except if it is form hand to hand and equal in amount, and dates for dates is usury except if it is from hand to hand and equal in amount, and barley for barley is usury except if it is from hand to hand and equal in amount." Sahih al-Bukhari, Volume 3, Book 34, Number 388: Narrated Abdur-Rahman bin Abu Bakra: that his father said, "The Prophet forbade the selling of gold for gold and silver for silver except if they are equivalent in weight, and allowed us to sell gold for silver and vice versa as we wished."
