The comment by cptsideslider is good but the only case that I know of with drinking and a horse is: the man wasn't drinking while on the horse, he was drunk and got on the horse. The police tried to charge him with DUI but the rider stated that he wasn't steering the horse and that the horse knew the way home. When brought to court, they put a citizen on the same horse and they weren't allowed to touch the reigns. The rider then said "go home" and the horse did in fact walk all the way home without any guidance. So it was found that the man was not driving the horse so the case was thrown out.
