This is essentially legal when an investigation is opened, but never closed. They never have to admit there is an investigation or a file at all. Any open investigation is a secret file kept on you by the government. Gov: We suspect you're paying attention to our activities, so we're labelling you as 'suspicious' in a never-ending secret investigation file.

I'm going to say there's still something wrong with pulling them over. Being stopped on a highway is inherently dangerous. Continuing the stop without a reason worthy of endangering life, is wrong.

@@jeremysteinacker4889 it's still wrong. I agree with you that it is completely legal. Laws do not define right and wrong. They are written by men; often corrupt men and women called politicians. Putting somebody's life in danger for a punitive fine is absolutely legal and it is still wrong. The way speeding should be ticketed if it's ticketed at all is the officer tails the vehicle (without lights or sirens) and writes down the plates. Then passes the vehicle to grab video of the driver. (The same video or perhaps their body cam, would serve as evidence of the speed indicated on radar) And then the policeman waves goodbye and goes and finds another speeder. Then at the end of the day, he can mail tickets to the address on file. The department can decide if they prefer to install higher resolution cameras on their traffic cruisers or to pay a second officer or perhaps a non commissioned employee who's not driving to operate the camera and record information. Frankly I don't see why police departments need sworn law enforcement officers whatsoever to handle tickets in this fashion.

Qualified immunity shouldn't be applicable here, the officer violated a clearly established right protected by the 4th amendment that any reasonable person would know, that is sufficient for qualified immunity to be lost.

@@nic.h I totally agree with you but..... if there was no qualified immunity don't you think their mindset would be different in all aspects of the law. In other words they would think more about exactly how to properly enforce their duties or face law suits. Thank you for your reply. I think open discussion is important even if two people don't agree on everything.

@@sixfootpooka3598 yes agree if there was no qualified immunity there would be quite different behavior seen alot of the time. Having said that I don't completely disagree with qualified immunity, I don't think it's unreasonable for officers to have some protection from honest mistakes, my issue is that the courts side with officers far to often in cases where qualified immunity should be lost, exactly the same as the majority of internal affairs reviews find no wrong doing. Fix those two problems and qualified immunity wouldn't be such an issue.

That is a way over broad statute the way it is written. Here in FL they have a similar one but it says IF THEY HAVE COMMITTED, ABOUT TO COMMIT, OR IN THE ACT OF COMMITTING, a crime or violation. In other words can't just stop and ask for ID.

I do not like law enforcement leaning on my car and putting their hands inside my vehicle. They could "drop" illegal drugs inside a car without you noticing it. Additionally, if they slip and fall their workers compensation will go after you for the bill.

James - I think you're spot on with the idea of piggies committing unlawful/immoral stunts like this to condition people to accept this b.s. I was driving to work (about 1 month ago) through rock hill, SC and out of nowhere, a few cops had a checkpoint going on. Guess what the checkpoint was for? "License check" - I quickly asked what violation/crime I was being investigated for, and he added "You were doing 57 in a 45....which I was. I then asked "What are all these other cars stopped for? His response: "We're doing a license check" I told him he's in the wrong and to stop being a scumbag. He gave me a scary warning and I drove away. I drive speed limit now with a phone at my ready, because when (not *if* people) this happens again, I'm not showing a damn thing.

@@jeremysteinacker4889 Your ID is considered your "PAPERS" So what you are saying is Officers in Texas can pull someone over with no traffic Infraction as every traffic stop has been ruled by The United States Supreme Court to be a temporary suspension of a person Forth Adminment Rights so long as it is a legal stop for a traffic infraction or crime. To demand to conduct a search of someone's papers. Unless Texas has Succeeded from the Nation what you are describing that you claim Cops in Texas can do would be undisputed 2 separate counts of Violation of the 4th Adminment of the Constitution of the United States of America the Right to be free from Unreasonable search and Siezure of a person, paper, property, and effects. Violation of these Rights under US Title 18 Code 242 Depravions of Rights would be 2 counts of Felony Crimes the Officer Committed which if convicted in a Court of Law would leave the Criminal Officer Subject to being punished by Fines, Prison and even the Death Penalty. This video even if the cop could get past the Crime he committed by refusing to let them leave until he saw there I'd because playing word games saying he was only asking for there ID the Fact he admitted they committed no traffic Violation makes the traffic stop unlawful and a violation of the 4th Adminment of the Constitution and as such a Felony Crime committed by the Cop and the refusal to allow them to leave until after they had surrender thier ID would then be a 2nd count of Depraviotion of Rights under Color Of Law so by that count this cop Committed 2 counts of a Felony Crime in 1 single stop with no crime committed by his Victims both punishable in a Court of law of up to 2 $10,000 and 2 Penaltys of up to 10 years in prison. So in a Court of Law he could face fines up to $20,000 dollars and up to 20 years in prison and since this cop and you appeartly think this haneous disregard for the Constitution of the United States and the sacrifice that every man and women who has ever served fought bleed and died to protect this country and the Freedoms it holds dear. If you went back and reviewed footage if there is any of every traffic stop he and you as well have made since you think this is legal as only a Cop could possibly think the law doesn't apply to them. Then my guess is you could easily find hundreds if not thousands or tens of thousands of counts of deprivation of Rights both of you have committed which when viewed in totality could easily be viewed as treason and be subject to millions of years in prison and the death penalty.

@@robertgosney5657 This response was chock full of hyperbole, but did you even read the law? I didn't write it, but I will damn sure abide by it. When you apply for a license you voluntarily agree to suspend your rights while engaging in the privilege of traveling by motor vehicle on the roadway. I also think it is hilarious that you somehow managed to bring the troops into this when I am currently one of them. There are unconstitutional laws like the NFA of 1934, but you still have to abide by them. I am not saying this law is, but even if it was.

The weird thing is cops usually want ID so they can check you through the system to see if they can get you for SOMETHING....this guy just looked at the license. Like you said, it must have said " not who you're looking for" on the license.

Know contract is legal unless both parties are aware of the damage one is doing to the other. well, that's under common law but under the colour of statutes, they reversed things and made it buyer BE ware. I have a copy of my long-form Birth record and where my mother signed her name it reads in very small print "informant". There is no need to put that there. Unless something is wrong but mom was too nieve and her parents were slave farmers and they did the same thing. Now it is too late to reverse because millions are indoctrinated to the treasonist act.

He asked if they still lived there. If not, I believe he can give them a ticket for not updating their home address. He asked for the ID to fish for reasons to steal or arrest.

100% legal. check out TTC 521.025 b. the officer is well within his authority to pull over anyone and demand id without any traffic violation occurring. It is a terrible law, but it is the law.

I’m a contractor and I had an appointment today at a home and I was waiting around the corner for the time of the appointment. So some snow flake called the cops on me. When they showed up and said someone called for a suspicious vehicle and asked for an id. I told them to basically fuck off im not committing a crime. I couldn’t believe they actually fucked off with without getting my id. I was so mad at myself for not recording it. I tell myself all the time to record if I ever had this situation, but I was kind of surprised by it when he knocked on my window and it didn’t come to my mind. By the time I thought to turn on my camera the interaction was over. This must happen to people all the time.

No matter what the sheriff finds during this stop. The only thing to prove this van was going the wrong way is either self incrimination (clearly they aren't) or video (warrant needed). Its clear that won't happen so time for him to move on. And that's if I even believe he got the call he says

The law you referenced doesn't say that police can pull anyone over purely because they want to check for ID. That law enables a police officer to pull someone over when their only suspected crime is driving without a license. However, fourth amendment cases have repeatedly shown that it is not lawful to pull someone over without reasonable suspicion that they are committing a crime.

Making them articulate everything is a great idea. Having it recorded is great for evidence and just might cause them to stop and think about what they're about to do. Doubtful but it could happen. @2:00 the passenger was correct. The cop had his questions answered. Unless there are facts showing this vehicle committed the alleged offense, this stop should be completed. And everyone continues on their way.

check out TTC 521.025 b. the officer is well within his authority to pull over anyone and demand id without any traffic violation occurring. It is a terrible law, but it is the law.

That is a man that really hasn't been told the word "NO" too many times in the past and has become BADGE DRUNK. He really knew he could never be in trouble for doing anything. Please follow-up with a civil rights lawyer and sue the department and specifically that sheriff. He needs to feel some pain for doing wrong. That sheriff apparently has the mindset that it is him against everyone else.

Actually, in TX, RAS is not a thing as far as ID goes. It's really quite simple: 1) Consensual Encounter = In no case are you required to ID 2) Lawful Detainment = In no case are you required to ID, but giving a false name is a crime 3) Lawful Arrest = Now you are required to ID, and refusing to do so is a crime

I agree with James, giving ID never changes the facts of the situation. But when driving on a Texas road, drivers need to be aware that Police officers can asked for a driver's license without a violation having been committed. Most Texas police officers don't even know the law. It is how DPS used to hold DL checks on country roads, when they were really looking for something or someone else. Read section "b" below of the Texas traffic code. (a) A person required to hold a license under Section 521.021 shall: (1) have in the person's possession while operating a motor vehicle the class of driver's license appropriate for the type of vehicle operated;  and (2) display the license on the demand of a magistrate, court officer, or peace officer. (b) A peace officer may stop and detain a person operating a motor vehicle to determine if the person has a driver's license as required by this section. (c) A person who violates this section commits an offense.  An offense under this subsection is a misdemeanor punishable by a fine not to exceed $200,

The sheriff had no factual evidence of a crime connected to this particular vehicle. He did not observe this vehicle committing any offense. No RAS for the stop or demand for ID.
