The plaintiff was hired to do some contracting work for the defendant, but she hasn’t paid him in full, so the plaintiff is suing. The defendant says she paid the plaintiff for every bit of work except the kitchen cabinet paint job. The defendant claims there were bumps, and he didn’t sand the cabinets first, so she doesn’t owe him the full amount he’s asking for.

Sounds like he was about to present some evidence as the case was closing... Should've done that when the judge asked numerous times to specify and not just say "we did a buncha stuff!" Lol

He was having trouble articulating his point. He kept going along until she found a way to scam him out of labor, etc. all of a sudden, she feels faint. She climbed the ladder to save $. Then when she fell, found someone to blame. The poor paint job wasn't clear, she may have scraped it to provide evidence. She was not credible.

@@elsajones6325 he was answering fluently and coherently so he obviously wasn't having trouble articulating. He was unable to describe the duties he performed which is something way different than having trouble articulating and what ultimately led to him not getting paid for it.

I did plumbing repairs for 30 years. Before I did anything that wasn't written up, I wrote it up, quoted a price and had the work order signed. No signature and I wouldn't do the work.

My boss went to court regularly with customers who didn't pay, he was happy with mine because he had the authorization signed, work description and the price that was agreed to. Had guys do jobs for 30+k with no writing at all. Try getting paid with the customer not knowing a tens of thousands of dollars bill is coming.

no , this guy had no pictures , no other workers to verify work done , no affidavits from anyone to confirm any of his claims . so at the end of the day he was just flapping his gums and hoping he could get thousands of free xtra dollars from this elderly woman . shame on him .

I'm a small contractor & do most phases of residential construction..I always give a detailed estimate..If I get the job me and the costumer sit down I write out the contract in front of them in specific detail..1.The scope of work (Any additional work if needed) 2.The cost 3.Warranty of craftsmanship 4.The estimated time it will take..I have a video camera & together we go as i record where & what the exact work is in detail is..I also record steps when doing the work for instance say a new roof..I record the tear off - re sheating of OSB/plywood (if needed) - felt paper/underlayment - Ice & water shield - new metal (drip edge, gutter appron, flashing, ect.) - shingles - vents - ridge cap - clean up - Then take a video showing the whole roof when completed with the costumer.. By doing this it's ensuring for both of us and there's no problem later on 🎯

Awesome! That's a great idea. Just make sure on your invoices you write 'customer' not 'costumer' unless the customer is providing you with costumes! ;) You sound very responsible and I'm sure you rarely or never end up in court!

"Scope Creep" is the technical term for when people add things on and then expect to pay the original quoted price.

@@FenderBender5150 I'm a legitimate honest business guy I don't hide anything.. There's certain things you cannot account for.. Example: If I'm doing a roof and I write down it needs sheeting..I cannot give an exact amount but I give an estimate because I can't see if it's bad..Say the roof leaked a little and an area of 13' x 7' is "Soft" then I'll write in the bid/contract for 4 sheets (how much per sheet/labor) When I get it tore off then if it needs say 2 more extra sheets then I charge for material (depends If it's plywood or OSB) & labor @ $20/sheet..If it only needs 3 sheets then I'll take off for 1..I've never been to court or had any customers that were "Unsatisfied" with my craftsmanship in almost 25 years..I can literally count on my hand how many times there was a little "Discrepancy" but me and the customer worked it out..💯

I was just saying that "Scope Creep" is the technical term for when people add things on and then expect to pay the original quoted price. I'm a contractor as well and when I was starting out I remember people doing this all the time. They hire you to paint a fence or something for $200 and then when you're there they ask you to do a few other "small" things but they still only want to pay you $200..and that's called "Scope Creep".

Plantiff is an idiot for not being prepared for court, but the defendent, she's a piece of work, and I believe with every fiber of my being, that she owes that man and just got off.

Agreed on both accounts. She 100 percent got over on the plaintiff. JM got it wrong and ended the case way too quickly.

I agree. At 8:50 Judge asks for evidence but he didn't provide any. He needs to write an addendum for "extra stuff" which she signs plus he should take pics before and after.

Something about both of them was off. The Plaintiff wanted to charge her $1000 and then said he didn't care about that. He took the wallpaper off but then admitted he didn't. Those cabinets look raggedy and she wouldn't spend all of that money to ruin them in a newly purchased home. BUT I think she conveniently forgets things to use to her advantage and make people feel sorry for her.

I do not see any extra behavior from her besides placing her hand on her head. I have to live the rest of my life with a concussion caused by an idiot who refused to wait for their right away at a traffic light. I can not begin to tell you how much having a brain injury has changed me and how I'm perceived by others. I've literally felt like I'm falling while standing still, and someone thought I was being extra to gain sympathy. These symptoms hit randomly and suddenly. Many times, when I'm in a situation where I have to focus and process information being given to me or around people just talking, I become over stimulated and have to fight the urge to stay tuned into the conversation. Many times, it looks just like what this woman is doing, placing my hand on my head while people are talking because I can't describe how it feels internally, but you're just trying to keep yourself together in that moment. People with concussions are not going to act or respond the way you expect them to in social settings. I now avoid them as much as I can because I'm tired of people's assumptions and accusations while I'm learning to live and regain some normalcy through my suffering.

When will people learn, the ability to win your case is dependent on your ability to articulate your arguments and show evidence at hand. Play lawsuit, even a small lawsuit, is not based on generic terms an assumptions. If you cannot deliver your augments in clear and concise format, that's your fault not the judge's failure to understand what you're trying to get across.

I think JM didn’t hear out the case well enough. I think the defendant was trying to get over on him. I would’ve liked JM to ask for his contracting license number. I don’t think it’s egregious that he tried to charge 1000 dollar late fee as a tactic to get his money back. It sounds like he did more work than was on the original 8900 contract. I think the defendant used a bogus excuse for why she couldn’t remember, I would’ve liked to seen medical records to prove she got a concussion on the date in question. I think JM got this one wrong.

As a contractor I can tell you this guy didn’t record the work well. Never mind the quality of the workmanship. He lost because he brought no proof of the change order. It’s possible she does owe the money but if the contractor can’t back it up it means nothing.

The defendant was a piece or work, true. But, as the service provider, that's why it's up to him to detail out and document his proposal and work in writing rather than sloppy, loosey goosey, anecdotal stream of consciousness "I did stuff" with no specifics like he did. He's an undisciplined business person dealing with the public and getting paid to do jobs, and hopefully this taught him to be a little smarter and more on point with his documentation.

It's always easy for Judge Milian to call out the shady contractors, who are taking advantage of the elderly. They show up in court with as little evidence as possible, & just their flapping gums to back it up. This lady had it together and wasn't going to be made a fool of.👍👍👍👍👍

The contractor just needed an itemized list of work done but not paid for. He lost because he lost credibility. The lady owes him but not as much as he was seeking.

According to google, there are rare instances where a person can have a permanent concussion, tho the symptoms are manageable. But who knows 🤷🏻‍♀️

He was not honest when first asked about removing the wallpaper. He said everything was done and then had to admit he did not do it. Right there, I no longer believe anything he has to say. 😒

@@lajames4079he vaguely listed things like, “hung some mirrors,” which could mean two mirrors of 102 mirrors. The judge was looking for an itemized invoice. He already proved that he misremembered the work he actually did.

@mikesteele05 mis-remembered ?? He is the one who was honest and also showed an invoice with the charge for that removed. He was in no way trying to get over on that lady so stop it. There was no itemized list because she extorted him to get the side jobs done. It really appeared that he did what she asked so he could get paid.

He is a shady contractor taking advantage of this lady. No before and after pictures. Doesn't document each job to justify the price. He didn't remove the wall paper so wall paper removal was deducted in the list. The rest of the work should have been itemized like the previous work. He couldn't prove the work was done. Judgement was correct. Like Judge Judy would say "where do you think you were coming today, the beach".

Wow my handyman got all of my 1960s wallpaper off and painted my old cabinets. Everything is perfect and no chipping paint, plus he's not a lisensed contractor. That's sloppy, sad work.

I bought a house for my son and his wife and we were doing a 100% renovation. I hired a small time one man contractor as my son and I did a lot of the work. I wrote up a contract and had many stipulations in it for everything. I paid him in advance to order all the kitchen cabinets, but made sure I owned him more in labor in case he stiffed me. He had did wood floors, tile, and other things. I told him I'll sue if he didn't follow the contract. Well sure enough he never ordered the cabinets and wanted his $3,500. I laughed and told him I'll see you in court. I confiscated his tools he left behind. Never heard from him again. I probably picked up $500 in the deal. Would have given him his tools back but he never returned.

@@rabbitbyzan I paid him $3,000 for the cabinets. He was to order. I owed him $3,500 in labor that I had yet to pay him for. He kept saying he ordered the cabinets and they weren't in. I wasn't going to pay him till they arrived. I went to the place and they said he never ordered them. He pocketed the $3,000 which I deducted from the $3,500 I owed him. I ended up ordering the cabinets myself. Then I fired him for breach of contract. I had him two weeks earlier sign that the cabinets were ordered. So I ended up picking up the $500 in labor and I kept his tools. The guy was a jerk and found out later one of his prior client he stole from. On a positive note the guy did excellent work. Anyway moral of the story have a contract that is air tight and follow it and you won't get ripped off. He caused me a little delay and pain but I was out no money

Judge Milian asked the contractor several times what specifically did he do for the extra pay, he kept on dancing around the question. He should have had all his extra work itemized. He wasn't prepared for his own case.

I love how the guy originally says I did a lot.of stuff for her. I am a professional...Glad the Judge was annoyed too by him. He must have had it written down the additional things that he did. So why didn't he just show it to the judge instead of trying to say everything off the top of his head. Also, wish he said why he didn't fix the smoke detectors....

JM asked how she got the concussion. She explained the smoke detector not being replaced. Got a huge shock replacing the battery. I don't think she is blaming him. She would have sued him if that was the case.

The kitchen cabinets were not done properly. They have to be thoroughly cleaned to remove grease. Fill in any nicks. Sanded. Apply primer. I prefer a bonding primer. Two 2 coats of good quality enamel paint. The paint should not be scratching or peeling with regular daily use. And the judge asked him like 100 times what was the extra work and he never gave an good answer, unless he charges $4,000 to hang a mirror!

6:48 If she has a “permanent concussion “ as she claims it’d actually be post-concussion syndrome. It’s rare, and symptoms are usually mild, and treatable. I’d want to see the Cat Scan results to check for permanent damages.

The plaintiff seemed just as mentally lost as the defendant. Every time the judge asked him a question about the facts, he had to guess what his answer would be.

We hired two different contractors to redo our two bathrooms in our home. We actually had purchased all of the materials ahead of time. First guy was a complete flake. Showed up sporadically and did subpar work. He just ghosted us and never showed up mid job. Second guy was so professional he put the first guy to shame. Our home ended up selling before it went on the market via a rumour we were going to be selling. Multiple offers, all cash. I am so grateful the first guy flaked.

Isn't it so hard to find people that are reliable and do good repair work these days. Where I live it's damn near impossible to ever get a quote for repair jobs. 🙄

@@cynthiacler9284 my husband had his own electrical contractor business. He was so reliable and his work was excellent. We had to turn away business when other companies were begging for work. Most contractors never called people back. It’s so easy to be successful. Just want to do your job.
