Should I already donate properties to my kids while I am still alive? What are my options? What taxes should I pay and how much will it be?

“We are planning to execute a deed of donation of our house and lot to our 3 children. Can we indicate there the exact division of the property, like the land is 200 sqm, we want to give to our youngest 100sqm and the other 2 children 50sqm each. Does the deed of donation requires also an estate tax?”

Hi po atty. Pwede bang mapatituluhan ko na yong portion ng lupa na ibibigay ng magulang ko? Aprob napo ang subdivision plan sa aming 9 na siblings. May natanong po ako sa ibang vlog na pwede ko daw patituluhan na, hiramin ko lng po daw yung original title at sinabing ipa partially cancel yung titulo. Ano pong ibig sabihin na ipartially cancel yung original title? Atty, good am, my parents own 8 subdivided land included of the right of way. Can they donate the land to us. We are 5 children of them. Should they give the 5 lots which is 200 sq mts each and the rest to them. They are already 89 and 88 yrs olds. Hope you can give me advice regarding this. Than you very much...

Ano po gagawin kung ang parents ay dead na. At hindi nakagawa ng will. 10 ang anak. At nakasangla sa anak un property sa anak din.

Hi, May itatanong lang sana ako, kung okay lang po. Pero eto yung topic: 1. Selling/buying property of minor as represented by a guardian. 2. Registration of property under minor's name 2008 A,B,C,D-minor bought lot F from heirs of E-deceased thru extrajudicial settlement with absolute sale (without map) A,B,C,D built their house on the vacant lot which they assumed as lot F 2022 A,B,C,D and F-owner of lot G found out that lot F was the one occupied by F and Lot G was the one occupied by A,B,C,D. They should exchange their property since they do not want to destroy the properties already built on the respective lots. They were advised to execute two deeds of sale. 1- ABCD to F 2-F to ABCD *D is a minor Taxes were paid in the BIR and LGU Now, the RD told ABCD that they may either wait for D to be of legal age or undergo court clearance. D cannot sell a property since he is 12 years old The ECAR from BIR is valid only for 5 years The guardian of D who represented him has cancer so time is of the essence F is now over 70 years old so time is also of the essence.
