The judge ruled against the plaintiff bc the contingency “when the lease was sorted out” of her being paid her ownership of the business was met. The defendant was owed the money. The only thing under dispute was *when*. The plaintiff has no right to hold on to what is owed the defendant.

I think what hurt the plaintiff is the way she presented her case, she was talking to Judge Mathis like he was a person on the street , saying “period”, “we’ll talk about later” etc.. the defendant won because she was clear on the items still not sorted out during their “buyout” although she did get some in the value of clothes she took there was still more items remaining with the plaintiff .. her response when judge asked her how much she said I don’t know .. smh , when you’re in court come prepared

Now I could be wrong, but I believe I understand why the defendant won. The defendant let the plaintiff know she wanted out and that she was willing to sell the plaintiff her 1/2 of the business. All the plaintiff had to do was access the current value of the company and send an official offer to the defendant. When the Defendant “stole” the items, she was still part owner of the company so she basically moved her own items and so JM “divided up” what’s was left since it wasn’t half, which the plaintiff confirmed. The apartment is a non-issue because the lease ended and the Plaintiff obviously wasn’t charged anything for it or she would’ve added that to her suit. Whatever license thing the Plaintiff was relying on saying the Defendant wasn’t a legal owner of the company anymore was probably done illegally (like ignorant of the law kind) and that’s why Judge Mathis didn’t go into it.

I agree with the judge for this ruling. The plaintiff confirmed that ownership is 50/50 and confirmed that the items she has left in the business was more than $5000 so the defendant left with less than half of their ownership. She offered to buy her out, if her name was removed from the lease. The kease expired and she never told her an amount. Her claim was dropped and because the defendant left with less than 50% of the dissolved business she owes her
@diamondz4lfye313
@diamondz4lfye313 2 жыл бұрын
I don’t know why some in the comment section disagree with judgement. The defendant had invested in the business (50%) so rightfully so, the plaintiff has to buy her out. Doesn’t matter if she quit, she still deserve her buyout/return and if not she’s still part owner.
@kristinzotoyi6925
@kristinzotoyi6925 2 жыл бұрын
She may be part owner but her buyout was set and determined while she was in court and he made it very clear so even the defendent knew. First of all, the ruling amount was incorrect based on what he asked the defendant. When the plaintiff said the items she had were worth way more than 5k, but she didn’t know how much, he turned and asked the defendant how much she WANTED for them and she said $3k… during the ruling, he said the defendant said the plaintiff’s possessions were worth 3k, thus splitting that in half (on top of the buyout money). She should’ve walked away with $4500 based on what he said during the case.

I'm confused on this judgement. The girl was owed $1500 in buy out but she took 5K worth of stuff. She said what the plaintiff had was worth more than what she took. When Mathis asked her how much she wanted for the stuff she said 3k. Now the defendant has 8k from the buy out?
@A.MoniqueN
@A.MoniqueN 2 жыл бұрын
That’s what I was thinking! If the plaintiff owned inventory worth more than the 5k worth of inventory the defendant left with, why did she say what the plaintiff had was only 3k and why did she get half of that when she didn’t return half of the 5k of stuff she left with? If the plaintiff said it was more, like 7k for example, would the defendant get 3500 of that?? So confused.

@@Chitosiri wow I see you really tried to break it down. I still don't agree. 1. You cant try to make up figures and expenses like paying employees. I agree she owed 50% and $1500 was clearly not 50%. The defendant took $5k then asked for $3k from what she left. The Judge I guess determined he would split the $3k and also make the Plaintiff pay $1500 buy out because she said she would before the defendant took $5k. Lol So that's 5k +1500+1500

What an odd case. Nothing about them was entertaining so the slang and not being organized doesn’t get you anywhere. If you feel you are owed something and have enough evidence to win a case, use it. Imagine they went to their local court acting like that?! Just because this court is on tv, doesn’t mean you get to act like a buffoon. Unfortunately, the defendant was no better but that’s business. Don’t get mad when you don’t know your rights.

I don't agree with the decision in this case. Azana abandoned the business via text message, stole from it, and then sued the business partner for money. #Trifling. The agreement was that Cyan would provide Azana half the money for the business, only on one condition. The condition was that Azana would remove Cyan off the lease. Contract was breached when Azana didn't execute the terms. Even though the lease dissolved later, the agreement was never executed by Azana. Judge should have awarded Cyan for the stolen items. Azana should have left the courtroom disappointed.
