You have a point that intent is what matters here, when determining if it's porn you need to know if the intent of the creator of it is trying to sexually excite someone. And intent is almost always hard to know for sure, and some ASMRtists do intend to sexually excite. But not all ASMR is done for that intent, in fact quite a lot is not. How you, or I, or anyone else personally interprets it doesn't matter, it's figuring out the intent of the creator of it that matters.
