I remember in 2009 - 10, somebody was able to take down a whole bunch of channels due to the fact it's all automated. KZbin needs to be held legally accountable for this as well.

The problem with fighting a copyright strike is giving away your personal info (such as your full name and address) while the scammers don't have to give any personal information.

Most scam victims get taken due to their own greed and/or stupidity, in this case they got taken due to KZbin’s greed and stupidity. At any rate, greed and stupidity always leads to loss. And KZbin should pay this restitution.

Agreed. It's been an anti-competition law from day one. Having exclusive rights to an idea is a stupid concept. All that tells me is that the holder is afraid someone can execute their idea better than they can and reap the benefits. Copying means one for me and one for you, it's not stealing. All they're entitled to getting is being known as the creator of the idea and nothing more.

​@@brandonburns5365 bullshit. the copying goes both ways, you will always gain more copying the ideas of a big company than you lose when they copy your ideas. if you don't have the means to produce enough instances of your idea to meet demand, then frankly I think you deserve having a better, faster, cheaper company outcompete you. if you can't adapt your idea to thrive in a smaller production environment, then you deserve to lose to the bigger competition. that's that. plenty of companies are still turning a profit despite widespread copying of their products by Chinese manufacturers, they don't need protection to succeed.

Everyday is a moral struggle to not run a scam. I've seen so many people fall for them in my professional life. Every time I just think ' even with 50k, I could go live somewhere on the beach or a jungle city' Then I think, ' for 250k I could buy citizenship, run a business and have a good life in a different part of the world'. These people to get a million and keep going, I never understand. Its got to be all about the thrill at that point.

Almost 6 years for a non violent crime doesn't seem that short, maybe they'll be let out sooner, but even so. US has highest incarceration rate in the world so I'm not sure massive sentences for non violent, non sexual offences are wise.

Here is how I see it, there is some very dangerous dudes out there that could scam millions of dollars yet the only thing stopping them is a moral and ethical compass. And a Belief in the Lord Thy God. This is one of the barriers against scammers being so much worse.

harsh would be return 100% of the $ plus hefty fines on top of that PLUS 70 months in the slammer. What they got was a pretty sweet deal. Makes me think any scammer will be better off in the end no matter what.

5 years is shorter than the time it often takes that starting a business pays off big. So yes, if they laundered a lot of that money, the 5 years are worth it.

KZbin needs to change their policy. If you get 5 or 10 or whatever number of claims reversed against you. Then you’re no longer allowed to make copyright claims

I'm always tempted to actually run a scam, but then I remember how much work it is and I just go back to scrolling instead. The prospect of jail has zero impact on me because most criminals are idiots and get caught by being stupid or getting greedy.

If it was a service like KZbin, they should have to pay back the people that were scammed. That way KZbin wouldn't be able to just side with these people so easily but they would think twice about it because they might be liable if they're wrong

"too soft on criminals" you mean too soft on actual crime. There are a lot of petty crimes, like possession of weed, that will get you extremely harsh sentences. While cp and things like this gets a little more than a slap on the wrist. The Government is simply securing when their own corruption comes to light, they'll not get the punishment they deserve.

I don't think KZbin can or should solve the issue of false claims. Copyright law is complicated and KZbin is in no place to determine which claims are false. If they defaulted to siding with the creator, they would be sued instead. The whole law needs to be revised.

Everyone gets a revenge bon*r and starts throwing out big ideas like "more prison time!" and "cut off their hands!", but from what I've read, harsher punishment is a garbage deterrent and doesn't accomplish much. A more effective strategy would be to track down and fix the vulnerabilities that the scammers are exploiting. But since our current system is abhorrently ineffective at compelling companies to do their part in virtually any way due to regulatory capture, that seems like it won't happen.

Ross Ulbricht was basically caught red handed plotting murder for hire all the way through to the end where they faked kill confirmation. It’s arguable that life in prison is over the top but they did seize what would be maybe 3 billion in Bitcoin in 2021 while he facilitated laws being broken in dozens of countries with thousands of people. His crimes eclipse these almost entirely. Five years is small for this but it’s like comparing a Lexus to a Gulfstream

I'm pretty sure that these dudes and the twitter hacker got similar sentences because the law has no correlation between the amount of gains and the length of the sentence. Which is by design, putting hard amounts of money in laws always brings about a bunch of problems down the line.

What puzzles me more than the laughable sentence is that people still believe the judicial system delivers... justice. It doesn't-and it's not meant to. It delivers a verdict. Yes, rough guidelines exist to create sentencing uniformity. But ultimately, the procedural complexity (e.g. evidence admissibility, count grouping, etc. etc.) harbours so much room for deviation.

About scam in runewhatever game is called it hurts. Cause I've been scammed exactly like this in lineage2 when I was like 15-16. But I managed to kind of scam this guy as well by taking his insurance.

Length of prison sentences doesn't seem to influence individual's decisions. Whether it's one year or thirty, you're only going to go through with a crime if you don't believe getting caught is possible.

Just because its not really clear from the video, youtube is sort of legally required to side with the person making the claim. DMCA requires youtube to act immediately on claims. Content iD claims are obviously not the same as DMCA claims, but similar.
