As much as they nickel and dime everyone, I can Not believe they over paid her brother. They are using that as an excuse to cut her benefits. Even if they had overpaid her brother millions, it still should not be her responsibility to pay back.

I don't think anyone taking over his account would question his ss check. It might not have crossed her mind to say and they overpaying him. They should tax his estate.

@@mrwonderful2142 highly doubtful since the funeral home notifies Social Security of the death. I know. I just went through it last year for my sister. As his payer representative, she might not have known what amount he should have been getting, plus they take forever to let you know. If it’s their screw up, they shouldn’t collect the money.

Because Social Security made themselves a convenient rule: "If we make a mistake, it's the Social Security recipient's mistake NO MATTER WHAT." So keep all correspondence and file an appeal. This is ridiculous!

It's been almost 20 years and the man is dead. There has to be a limit to when you can collect. If you were negligent enough to not identify it 10 years ago then you have to take the lost.

Government overpaid me for military disability and garnished my disability 100% until the money was paid back. The saying is when you owe them money it is immediate, but when they owe you, good luck.

Social Security made an error, and they need to pay for it. Not this woman, what she earned by working, she worked for it. No way should she have to pay for what mistake they made and the brother is dead now and he can't pay it back either so the bill ends up in the grave with him, NOT HER THIS IS NOT FAIR AND THIS COULD BE MY MOTHER! For 6 years social security took money from my employment checks for overpayment. someone stole my identity and was able to apply for ssi. I proved it wasnt me that did it. They kept charging me for a year after i proved i was right. For 5 years my tax returns have been taken to pay this crap. This government sucks.

How is that possible? To apply for SSI you have to go through a lot of crap. When I was sick I was forced to apply for SSI. More than once because the state office of disability does the medical. They always refused me. I had to show up for a medical. Then you have to go before an administrative judge when they refuse you. With SSI they never give you that easily they always deny you then you have to fight to get it.

He could be disabled. My husband had to take care of his son’s bills/finances. I had to take care of my 90+ y/o dad’s bills when he went into assisted living.

SS took part of my tax return recently because of an overpayment in the 70s when I was a kid getting survivor benefits. That's ridiculous.

They did the same to my sister. She was getting SSI because of her father's death back in the 70's. Then she got married (at a young age), called the SSA to let them know. But apparently someone dropped the ball there and kept sending those checks to her grandmother who was her legal guardian. Fast forward to 2018, they began garnishing her money until those 1970's checks were paid off. They actually asked her if she knew who she talked to when she called. Yeah, someone is going to remember the details of a phone call from 1976?

SS tried to bill me for an overpayment to my father as well from when I was a kid. My dad was not my primary parent and was not supposed to get the money. In fact, he was tried and found guilty of fraud when my mother turned him in when she figured out what he was doing. He was ordered to pay it back by the court after his conviction. When he died, they put it all on us (me and my siblings) to pay back his fraud. My sister paid it without knowing it as she was getting disability and was in a home (so they just took it out). I fought it and just had it waived. Two of my other siblings still are having to go through the process to fight having to pay it back.

@@themeg1540Wow. With every comment that has their own story of how Social Security treated them, it just gets worse! That is so unfair! Anyone with a brain could understand how terribly unjust your story is (and all the other’s I’ve read here). Something needs to be done to stop this insanity! But I assume it’s against the law to sue them?! For anyone who has had this happen to them: I hope you are letting your senators know.

They did the same thing to me when my father passed and they sent me a letter 1 year later after his death stating i owed for his over payment. And i told them my father wasnt even in my life. I had to go to court in order to stop what was going on. That was well over 10 years ago. These type of practices are scrupulous. Shes right SSA does not calculate correctly

For everyone who didn't catch it: She became his payee when their mother passed away. The lettret they sent her in Nov. says "Congress passed a law that Soc. Sec. can recover overpayments FROM THE RECIPIENT'S PAYEE." That's how they're justifying taking HER money now. I agree with HER that it was THEIR MISTAKE, NOT HERS, SHE DOESN'T WORK FOR THEM . . . And her Soc. Sec. benefit is NOT, or should NOT, be theirs for the taking based on them ALLEGEDLY having mistakenly overpaid her brother, whether she was his payee or not.

This is really scary - the brother has been dead for over 15 years, I think (2006?) and she's getting these notices now? My husband and his brother currently are financial POAs for my Mother-in-Law, who is mentally incompetent. Does this mean when we retire, and along the way she passes, if they screw up that they're going to take out of our Social Security? We are counting on that, along with 401(k) and pension to pay our bills. This is a bit unnerving to think that we could be liable for her bills long after her estate is settled. Social Security needs to get their act together, or just give us our money now and be abolished.

Go bug your Congress Critter to get a law passed that adjusts what SSA can recoup, when, and from whom. Assuming the law covering this woman is still in play, it seems she's getting tagged for _the entire amount overpaid,_ not the amount overpaid for the time she was his caretaker. Simply limiting it to the time she was responsible, then setting a statute of limitations on time (5 years seems fair) to advise the responsible party, would fix a lot of problems. If we all stand up and demand change, they'll have to do SOMETHING to get rid of us for a while.

We need to hold the incompetent social security workers accountable, not the people. Fire the incompetent workers, their supervisors and managers in charge of double and triple checking and verifying everything is in order.

I've been off permanent disability for at least 5 years now, I was able to return to work. I keep getting letters telling me my benefits are being increased, and also letters saying they can't pay me because I owe $26,000. I wish they would make up their minds, if I am owed or if I owe.

You might want to get a free consult with a lawyer and show them the conflicting letters… maybe it’s enough of a case that they might take it pro bono…if they like fighting SS I mean… or maybe you can get free legal help in your county…some legal services might be available for older adults and/or the disabled… If you have a county social worker that’s previously been assigned to your case or something maybe they could help you. Have you actually still been getting money for your disability after you went back to work or not? Good luck.

I fought with them for 3 years. In person and on the phone. You never talk to the same person twice. They don't have employ or badge numbers. Was told that there is 7000 Janet's that work for them. They tell you what you are going to get its their figures not yours. SS was a good idea when it was started. People really didn't have a say. Then came politicians.

Yeah, I got the same letter. They said they overpaid my minor son benefits he received due to the death of his father. I don’t believe for a second it’s a mistake. I swear they are running a scam.

Why is this law retroactive? The guy died in 2006. This recovery from payee just was passed in November 2023? This will be overturned. A social security cut of $233 a month for years for THEIR mistake? Retroactive 18 years? This stinks. No statute of limitations for a debt?

Government at it's best. Mistakes do happen. But a person who never knew of the over payment, or benefited from it, should not be punished for it. And, as much as the govt wants people to trust them, they make an awful lot of mistakes. And they waste money on so many things the government should never be involved in. Those working for the government should be held to a higher standard, and should make certain they are qualified(& not by DEI standards) for their job position.

The letters always state they made a mistake then they proceed to make you pay it back. Ive had this happen amd no matter how hard you fight,they win. You always have to pay ot back even though they letter states that IF you can prove it wasn't your fault. Its ridiculous!

This happens to disabled people regularly. They send you a letter saying you were given too much money and until it’s paid back, your check will be cut. They used to just stop paying altogether.

So, she became his financial assistant a year or so before he died. HOW LONG DID SS MAKE OVERPAYMENTS TO HIM? Years? At most, she should be "responsible" only for any overpayments occuring during her official time as his administrative assistant, and not for whatever was the time that SS negligently overpayed him on his own time. In any event, who were the SS employees who authorized the overpayments?

If this is even true. Much of the time, government records just get messed up over time and information gets dropped. I've had IRS tell me that I didn't file five years ago. I asked them to look up a check number. They said that's the check number from the refund after you filed your return. Oh, they said, so you did file and we just lost the records. Right says I. Still took weeks on the phone and still paid $300 for their screw-up.

The govt have been threatening to cut social security for decades. They want our money and they will take it one way or another. I've seen reports describing the "baby boomers" as the generation that trusts the government. The government is purposely taking advantage of us. So stop trusting them and stop voting for them.

They went after me and my siblings for money my father owed them. In his case, he committed fraud and was convicted with a court order to pay it back. He claimed he was disabled and tried to get money for child assistance. However, he was working and had no custody of us. My mom eventually figured it out when she received something and turned him in. When he died, they put it on us to pay back the money he stole despite his conviction. I successfully fought it. Two of my siblings are still fighting to have it removed. My one sibling paid it as it was taken out of her disability payments before we figured out what was occurring.

They have taken mine away for a year. $11k. I retired in 2022, got SS for a little over a year, then they said I was overpaid and I haven’t gotten a check for close to a year now. I think this is their new plant to remain solvent. 🤬

I can relate. I got a letter last year stating that I owed monies from over payment of death benefits 54 years ago went to my adopted mother who put me back in foster care when my adopted father died. I never received a dime from her! Outrageous that I was held accountable for her crime. It was deducted from my retirement benefit and made me default on credit card debt. I’ve been struggling to survive ever since.

What I don't like about this is that Soc. Sec., like the IRS, has carte blanche to just help themselves to your money - without any court order, without your side being heard, as though there's no possibility that they might be mistaken

I had the same thing happen to me 2 years ago when I had a ticket to work contract with SSA from June 2018-June 2019 which included the 9-month Trial Work Period and a 60-day Extended Period of Eligibility. I had to get the Choice Group involved to help me appeal this. Luckily, Ms. Lisa Duncanson and I turned the tables on Social Security and found out that Social Security owed me. I received a US Department of Treasury refund check 2 years ago from SSA for $1,917.50.

I'm dealing with the same thing with my stepdaughter. They cut her check off but now she's an adult we have an appointment to get it back on. But they will definitely take out some for overpayment.

This is madness. She managed HIS money, it was not awarded to HER. It is not HER debt?? 😮 Using their logic, they would also need to collect debts from any bank that held the money for the claimant. I cant see them doing that! I hope she wins her appeal, and receives a refund.

@@briangc1972 It is an easy mistake, to think that. The money was awarded to her brother. She was managing his money, not her own money. She was not awarded money she was working at the time. The debt is not hers. They made an error and see her as an easy mark to collect from. If I helped a family member manage their income and bills while they were incapacitated in hospital for a long period. I'd pay their bills, included any debts (credit cards loans mortgage etc).I didn't incur that debt, did not benefit from those purchases that incurred the debt, nor do I assume the debt by paying someones bills with their money. I am not a guarantor.

When my Mother passed away in 2011, the funeral Home sent a notice to Centerlink here in Australia the day after she passed away. I found this out when I ran the office on the Monday morning as she was due to be paid on the Friday and I wanted to make sure it did not happen. They informed me that the funeral home had sent through the paperwork already. They also told me there was a one of payment called a Bereavement payment that had been sent to me Dad’s account that he shared with Mom, this was to help him with funeral costs. So my question is if it was an over payment was there a death certificate sent to them once her brother’s body reached the funeral home, and if so who and WHEN did they process the paper work once received, because it sounds like someone did not do their job or were too lazy to do their job which means it was THEIR mistake in the first place and they should take it out of the workers personal salary for not doing their job in a timely manner.

She was his representative payee, she received his money and spent it on his care. However, it is unreasonable to try to collect from a payee 15 years after the fact unless she also inherited assets from her brother's estate after he passed.

Frankly 10 years is too long... but better than nothing. “(9) In any case in which more than the correct amount of payment has been made, there shall be no adjustment of payments to, or recovery by the United States from, any person of an over payment that occurred 10 or more years prior to the date on which the Commissioner finds that more than the correct amount of payment has been made to such person.”.

SSA has a "formula" to calculate payments. Math is a pretty precise thing. So how does SSA keep getting it wrong and then take it out on someone who had nothing to do with there own mistake.

My son is dealing with this crap. Good luck finding and talking to any knowledgeable SS representatives. Almost every time he called, he got someone who clearly had no clue how to explain anything or what steps to take. While receiving his temporary benefits, my son followed all the rules. SS staff dropped the ball. Maybe their high paid salaries/wages should be impacted by their mistake. Many of those employees couldn't add 2+2 = 4.

I once received a letter saying my federal income tax was late and I was assessed a fine. I sent in my postal receipt showing it was postmarked on time and we went back and forth with them sending me collection letters and assessing interest. Finally I escalated my case to a person in charge and they said there is no way in the computer system to remove the penalty and I had just better pay....or else.

Happened to me with child support supposedly over paid over a period of time. What is so frustrating is they never show you how they calculate what you are supposed to be paid so how do you know if it’s correct or not? Suddenly you owe them from THEIR mistake that they made and it’s now your responsibility to pay it back when you have no clue if they are doing it correctly. They make a mistake and you end up paying for it. This system is totally wrong they need to pay the penalty not the recipient. How are the recipients to know when the amount is over or under when no formula is ever shown on how it’s calculated.

This reminds me of a recent British video, a guy eating his McDonald's in his car when the employee came out saying the manager would like him to pay for the extra food they accidentally gave him. He already ate it, and the employee tried emotionally blackmailing it about honesty. But you can't serve food given back by the public. Anyway... your mistake, not mine.

This doesn't make any sense. If she's rep payee, she would get a letter or could go online anytime and see the amount that he was supposed to get every month. If she did all his banking, (which is what you do as rep payee) then she would see a much higher deposit in his bank account than expected every month. It is not her fault social security messed up, but she wasn't doing the job she signed up and didn't read the paperwork. When you agree to be rep payee, you also agree to handle any over payments (aka social security screw ups). It is ridiculous that they're allowed to have this whole over payment thing in the first place. They should do their job correctly but when they screw up, it screws us up as taxpayers.
