So there is still a slight economic gain from working these islands.

Some people wonder, why the Korean government is not responding to the Japanese government's ICJ complaint. If I explain the reason, I can organize it as follows. The Japanese government continues to insist on resolving the Dokdo issue through international law in the ICJ. Since the ICJ has multinational judges, and the ICJ's existence itself is an institution established to resolve disputes between countries by third parties, the Japanese government's argument for resolving disputes in the ICJ is valid. Although this ruling is not compulsory, it can face international criticism if ignored. However, the Japanese government has mistakenly pointed out the parties to the complaint. It is not Korea that excluded Dokdo from Japan's territory, but the United States, the United Kingdom, and the Republic of China, the victors of the Pacific War, which declared the exclusion of Dokdo from Japan's territory, No. 677-1, which finally confirmed it, and the San Francisco Peace Treaty, which recognizes the effectiveness of all actions under the direction of the occupation authorities during the occupation. At that time, it was completely in agreement with the Japanese government's strengthening treaty and independence, so even if it can be claimed that 'the territory was stolen because of the coercion of the strengthening treaty', the subject of the robbery was the Allies, and Korea can never be made. The reason for the repeated misinterpretation of SCAPIN 677 and Article 192 'd' of the San Francisco Peace Treaty is that they are asking the wrong questions about these materials. As the order and treaty do not stipulate "Whose land does Dokdo belong to?" the right answer cannot be given, and the Japanese side induces an analogy interpretation that is absolutely taboo in the treaty interpretation of "So it's Japanese territory." The right question is "Whose territory is Dokdo not?" The right answer to this question is clearly "Dokdo is not Japanese territory." The U.N. can recommend that the ICJ resolve disputes that may jeopardize the maintenance of international peace and security, but if the Korean side deploys troops to Dokdo, it could be criticized for avoiding the conflict zone issue. Therefore, it is not good for Korea to imply a military conflict with Japan over Dokdo with an overly emotional response based on cold facts, as the sovereignty of Dokdo will not suddenly be transferred to Japan unless it goes to war with Japan, at least immediately. Even if Korea maintains its effective control of Dokdo and there are even more serious territorial disputes than the Dokdo issue, it is unlikely to be a matter of Korean territory effectively controlled by other countries. Japan, which recognizes compulsory jurisdiction, calls for Korea and China to recognize its compulsory jurisdiction, but even if Seoul does, it cannot apply the compulsory jurisdiction over the Dokdo issue, as it has avoided applying it to matters prior to the date in which Tokyo recognizes it. After all, Japan's unilateral complaint over the Dokdo issue is absolutely impossible. This is why they continue to provoke Korea to agree to the complaint. The Japanese government is also aware of this. Japan, however, has not responded to China's ICJ complaint in opposition to the issue of Senkaku with China. Japan's refusal to apply the same policy as Dokdo means Tokyo's complaint itself is merely a means of provocation. As long as Korea has effective control of Dokdo, it is not desirable to cause serious disputes by overly sensitive and emotional responses. Making Dokdo recognize as a conflict zone among global villagers is Japanese government's strategy in itself. Some argue that 'Korea will naturally win the ICJ because it is natural, and will the controversy over Dokdo disappear?' However, with that logic, Japan wants Korea to comply with the ICJ complaint. Once you agree to the ICJ complaint, you are acknowledging that Dokdo is a disputed area and may become Japanese territory depending on the outcome of the trial. Even if Japan claims Ulleungdo as its territory beyond Dokdo, just as Korea has no reason to go to the ICJ to determine whether it is Japanese territory, just as Ulleungdo is clearly Korean territory, Dokdo is the same. Above all, there is no guarantee that Japan will accept the results and give up its claims over Dokdo as there has already been a precedent of ignoring the ICJ's rulings and orders, even if Korea wins. In fact, Japan has already shown a direct rejection of the ICJ's ruling by withdrawing from the IWC, an international organization, and deciding to catch whales in response to the ICJ's ruling and order prohibiting Japanese whaling. '세종실록지리지에도 독도가 한국 땅이다'...... 등등 훨씬 많은 근거들 입니다. 그러면 이제 일본측의 근거도 살펴봐야 할 때이지요?? 1. 대한민국 영토는 대한민국 국민이라면 자유롭게 방문할 수 있어야하는데, 독도는 한국인이 접근 불가능한 섬입니다. →한국이 독도를 천연 기념물로 지정해 놓았는데 어떻게 방문합니까?? 2. 울릉군청에는 독도의 공시지가 없습니다. →현재, 공시지가를 발표하고 있습니다. 또한, 울릉도 심흥택의 보고서에 의하면 이미 100여년 전부터 확실하게 울릉도에 속한 섬이라도 했습니다. 3. 시마네현이 독도를 일본 영토에 편입하기 이전에 일본 어민이 독도를 경영하고 있었습니다. →사실에 맞지 않는 이야기입니다. 위에 설명드린 자료로 설명 가능합니다. 또한, 시마네현이 출처가 불분명해 국제적인 효력이 없는 건 아시고 계시죠? 4. 사람이 살지 않는 땅인 독도를 먼저 영토에 편입시켜 세상에 알린 것은 일본이므로 선점권에 의해 국제법상으로 독도는 일본의 영토입니다. →러일 전쟁 때, 일본이 침탈하여 일본 어민들이 독도에 들어올 수 있도록 한 것은 사실이나, 일본 영토로 편입시킨다는 조항은 없었습니다. 정확히는 몇 개의 조건을 빠뜨렸습니다.) 5. 센프란시스크 조약에 의하여 독도는 일본땅입니다. → 미국은 여러차례 끝에 결국 독도를 한국과 일본 모두에게 독도를 편입시키지 않았기에 오히려 독도가 일본 땅이 아님을 인정하는 한국측의 증거가 될 수 있습니다. 제677호 제3항을 제대로 읽어보시지요. 6. 태정관 지령에는 독도라고 정확히 적혀있지 않습니다. 한국측이 문서를 왜곡하여 읽은 것입니다. →누가 왜곡을 한 것입니까? 초안을 수정한 결과 최종본에서 독도의 표기가 달라진 것을 보아 이가 독도를 명시한다는 것을 인정하는 결과를 낳았습니다. (외1도) 7. 왜 한국이 ICJ에 나오지 않을까요? → 일본이 너무 멍청해서 한국이 국제법을 위반했다고 주장하는 것이다. 한국은 이에 가입할 때 다른나라와 달리 양측이 모두 ICJ에 찬성할 때에만 재판이 열린다. 즉, 한국으로서 구지 이런 위험을 감수할 필요없기 때문에 재판을 열지 않는 것이다. 제발 한국의 입장부터 똑바로 읽어보았으면 좋겠다. 사실 독도가 한국 땅인 이유는 이보다도 훨씬 많을 것입니다. 저는 독도가 일본 땅이라는 주장은 명백히 틀렸다는 것을 알려주고 싶었습니다. 아시다시피 일본은 한국의 영토를 많이 빼앗았고, 한국의 문화유산도 많이 없앴습니다. 대표적으로, 대마도는 원래 조선(한국)의 땅이었습니다. 저도 대마도에 대해서는 잘 모르지만, 대충 127가지의 근거가 있다고 합니다. 또한 석유 매장량이 6000조원 (사우디아라비아의 10배로 추정) 가까이 되는 7광구마저도 대륙봉을 기준으로 하였던 영토 기준이 일본에게 유리한 국제법으로 바뀌어 7광구의 90%를 일본이 차지하게 되는 어처구니 없는 상황도 벌어지고 있습니다. 뭐, 일본이 평상시에 행동하는 것 처럼, 국제법이 바뀌고 난 뒤부터 한국과 개발을 하지 않고 일본이 그 땅을 다 소유하려는 욕심 때문에, 조항을 어기면서까지 이기적인 행보를 보이고 있습니다. In the past, Japan wrote that Dokdo had nothing to do with Japan according to the Taejeonggwan directive it made. This is evidence that Japan recognized Dokdo as Korean land, and it is true that Dokdo is close to Korea, and Japan had no relationship with Japan before 1905. You know why no one called dokdo as "bamboo island"? because there's no bamboo on Dokdo. It's funny that you even say that it could be a fictional island because that name actually existed lol.

1) Since the Three Kingdoms Sagi (512), there have been consistent references to Dokdo in Korean (Joseon) ancient literature and old maps, but Japan's Goheon and old maps did not mention Dokdo and said it was not Japanese territory. 2) The Japanese shogunate received a reply from Tottoriburn that Dokdo was not Japanese territory, and in 1696, Ahn Yong-bok of Joseon visited Oki Island in Japan and received a reply that Dokdo was Joseon territory. 3) On October 25, 1900, Emperor Gojong of the Korean Empire enacted the Korean Empire Edict No. 41, which designated Dokdo as an annexed island to Ulleungdo Island, and practically exercised the territory sovereignty of the Republic of Korea after the defeat of the Japanese Empire and liberation. Dokdo is Korean territory and not a disputed area. Takeshima is just a dream of the Japanese government

Anyway, the obvious thing is that Dokdo is under the administration of South Korea. There are some governmental facilities in thay island. And there is a platoon of South Korean police in that island. On the other hand, Japan doesn't have the administrative control over that island. Dokdo has been Korean territory since the Three Kingdoms period. The Three Kingdoms period was from -58 to 658, during which Silla occupied Usan-guk (now Dokdo), and Japan insisted that Dokdo was its land since 1905 after the Russo-Japanese War.

I am Japanese. First of all, I would like to say that there is often cursing between Japanese and Koreans happening on the internet, which is very sad, and I myself would like to get along with the Korean people. I don't know much about what you are talking about from 900-1400, so I won't mention it, but at least after 1618 Japan went to Takeshima (Dokdo) and fished there! Well, this is not direct evidence from the Japanese side. To cut to the chase, some others have commented that the Allied General Headquarters guidelines clearly state the abandonment of Dokdo, which in itself is correct. However, it must be noted that it is only a guideline and not a treaty. In fact, the Allied Powers did not include Dokdo in the islands that Japan had to renounce in the subsequent San Francisco Peace Treaty. In response, the Korean side submitted a written opinion, which was not accepted. (From the Ministry of Foreign Affairs pages). Because of these facts, Japanese people believe that Takeshima belongs to Japan.

Despite the fact that the MacArthur Line had already been drawn in the Treaty of San Francisco, South Korea arbitrarily included Takeshima in a line called the Syngman Rhee Line and began to claim that it belonged to its own country. Dokdo is a korean island. The word Takeshima means island with bamboos. But they are none. Originally Ulleungdo was called takeshima . Ppl in korea used to call dokdo 죽도 which means big island. But 죽도 can be also translated to be bamboo island(it doesn’t mean that) which means japan named the island after the original korean name which also means that korea found it first

It is total bullshit because they have no proof of the emperors they claim existed before the 6th century AD. The Chinese wrote Records of the Three Kingdoms, guess what, the names of the Japanese chiefs or kings in the Records of the three kingdoms do not match up with the names of fake Japanese emperors claimed to have existed in that era by the 8th century Nihon Shoki and Kojiki which were the first books written in Japan. A book that compiled information on Joseon's territory in the 1300s was made at the order of King Sejong, who was the king at the time, and there is a record of Dokdo and Joseon's territory. Joseon knew the history from the Silla period and recognized it as Joseon's territory along with Ulleungdo Island. And later, to counter Japanese influence, the emperor ordered it in 1905 and officially recorded it as a territorial notation under modern international law along with the official name Dokdo. Japan is more rational than Korea. Sovereignty is a modern concept it is irrelevant to history. but Korea still can assert and demands sovereignty at the ICJ, not an illegal occupation by force. Also, So-called historical records are not accurate and have many contradictions. none of them showed the name of 独島 nor the correct location of those islands. The most critical thing to Korean's assertion is the SF treaty. Korean must understand that International society has common sense as the thief detests a court.

This “Syngman Rhee line” was the beginning of the Takeshima-Dokdo territorial dispute, and also the beginning of the Japan-Korea dispute that continues to this day. Syngman Rhee's anti-Japanese ideology has been passed down to the present day Koreans, and Takeshima (Dokdo) is a symbolic existence of anti-Japan. If he hadn't acted foolishly, the anti-Japan symbol wouldn't exist, and current Japan-Korea relations would be more friendly, with nothing for the US to worry about.

The clear reason why Dokdo is Korean territory is that Korea had the southern part of the Korean Empire's territory at the time, and the Korean Empire at that time officially announced that Dokdo was Korean territory by issuing Article 41 of the Imperial Decree of the Korean Empire in 1900, so Dokdo was Korean territory. . (Japan's official announcement of Dokdo's incorporation is Shimane Prefecture Notice No. 40, which is four years later than Korea's)

I understand some comments making it a bit of jokes because it may be not important to you. But it's a serious problem. Dokdo has been Korean territory since ancient ages. And Japan took it by force during Imperialism times. And now Japan should not claim Dokdo since it means Japan claims Imperialism. Germany didn't claim any territories it took during WW2, Nazi period. The reason Japan can dare claim Dokdo is because the US needed Japan as allies in Cold War. So the US kinda had closed its eyes on Japan. Please listen to the truth World :)

That's a lot of weird comparisons. Liancourt was claimed by Japan before their imperialist expansion, and WW2 was in the late imperialist era and the German invasions in the 40s are an entirely different matter.

@@FOLIPE You misunderstood some points. Firstly I didn't claim Nazi imperialists, Nazi and Japanese Empire have done war crimes. So the point is they both did horrible things in the past. And they both invaded many countries and both are vanquished nations. But unlike Germany apologized, Japan didn't apologize. And Japan now claims a territory from one of the colonized countries. I explained about US and Japan relationship during cold war above.

Thank you for a very objective and well made video about the issue, I have a little objection though, and this is the San Francisco Peace treaty, according to the documents available, it seems that the dispute about Liancourt Rocks was indeed on the agenda, and there was several discussions back and forth, but there was a draft of 5 different agreements, including the island and not. The final agreement did NOT include the islands, remember this was the agreement of Japan giving back what they took during the War. If the islands was not included in the official agreement that was signed (Not by any fault of the Japanese, but the western World) this means the island are still Japanese, because the whole of Korea was Japanese. Many aspects of this whole process was unfair to the koreans, because they were not there when this happened, not to any fault of the Japanese, but still not fair. I do NOT believe that (officially, on paper) that the Liancourt Rocks are Korean, but as a Japanese descendant I strongly believe that Japan as a gesture of friendship, should officially give the islands back to Korea. I do however also believe that the whole reason for Japan's anger around this, was that Korea deliberately invaded the island after the War, just to build on it (Officially illegally) if this would not have happened, I believe that the islands would have been given back to Korea a long time ago.

A peace treaty is a treaty concluded between belligerent countries declaring the end of war and the restoration of peace. The conditions for peace include the cession of territory, compensation, and the release of prisoners of war. It is natural that the South Korean government could not attend San Francisco, since South Korea was not a belligerent in World War II. South Korea is a country that was founded on August 15, 1948, and is classified as a "third country." Japan continues to insist that it did not abandon Takeshima under the San Francisco Peace Treaty. If there is an objection to the Japanese government's claim, only the 48 countries that are signatories to the treaty can file an objection, and the Republic of Korea does not have that right. The territory of the Republic of Korea was granted by Japan and the 48 Allied Powers. The Republic of Korea's armed occupation of Japan's Takeshima is an act that goes against the international order.

Hello, I am Korean. Thank you so much for making the video. In Korea, Dokdo is called a solitary island, and in Japan is called Takeshimaialand. Take means bamboo and Shimah means an island. And in Korea, bamboo is called Jukdo. (Bamboo Island = Jukdo) Why do the Japanese call a stone island without any bamboo as Takeshima (Jukdo = Bamboo Island)? In Korea, there are many islands with bamboo, so there are more than 10 islands named Jukdo.(=Bamboo island) There are also Jukdo Island next to Ulleungdo and Dokdo. Maybe the Japanese got confused when they named it. There are many old maps that Dokdo belongs to the Korean Peninsula, and they are also found in Japan. And Dokdo have their name from Korean history. The Japanese are slowly and continuously turning Dokdo into conflict zones to take it away as its value goes up. Dokdo belongs to Korea, but Koreans do not want to allow the slightest chance of losing an international trial and being taken to Japan. If we lose, we risk losing our territory. Even if we win, there will be no benefit except recognition. If a court is held that the U.S. is owned by Russia, why would the U.S. accept it if half of the world agrees and half opposes it? I remember 20 years ago, when Koreans interviewed Japanese people, "Do you know where Takeshima is or what it is?" 98% said, "I don't know, but is it an island?" However, when it was known that Dokdo has natural resources, suddenly more people claim that Takeshima belongs to Japan. When Korea was playing Dokdo Challenge for 30 years, Japan didn't even know what takeshima was. AND there are probably still many Japanese who are not interested. On the other hand, 100% of Koreans know where Dokdo is.

In the drafting process of the San Francisco Peace Treaty (signed on September 8, 1951 and entered into force on April 28, 1952), which dealt with Japan's territorial treatment after World War II, Korea requested the United States, which was drafting the treaty, to include Takeshima in the area to be abandoned by Japan. However, the U.S. clearly rejected Korea's request, stating that "Takeshima has never been treated as part of Chosun and is Japanese territory. This is clearly shown in diplomatic documents released by the U.S. government. As a result, the San Francisco Peace Treaty stipulated "Chosun including Jeju, Geomundo and Ulleungdo" as an area to be abandoned by Japan, and Takeshima was intentionally excluded from it. Thus, in the San Francisco Peace Treaty, which established the international order after World War II, Takeshima was confirmed as Japan's territory.

The word Takeshima comes from the korean word 죽도 meaning "bamboo island". It proves that Dokdo was long since korean territory. The another proof is that during Silla regime which is the older version of Korea, there are still records existing proving that Silla general "yi sa boo" have conquered 우산국(old ver. Of dokdo). To explain, the reason our country is not going to ICJ is because there is no reason to. If I go to the middle of Tokyo and yell "JAPAN IS KOREA'S!!" and request that we go to ICJ to get it over with, would Japan accept it? Absolutely not. @@転生者AmixLobbying, aka bribery, is an incredibly powerful tool. A tool that is illegal in Korea. Thus, the Korean capability to bribe officials and companies is less developed than that of Japan. With this knowledge, it would be foolish to send this matter to a third party, especially when there is nothing to gain and everything to lose. "Solving the issue" won't make the Japanese government deny history any more than proof for comfort women and unit 731 have stopped them from denying those/worshipping the perpetrators as gods in their shrines. Plus, Korea loses nothing even if the issue isn't resolved in the ICJ. Japan won't do anything more than verbally whine about wanting more territory in this time and age. Their Empire has been taken away from them. They can't really go back to their child-raping and human-experimenting days regardless of how much they want to, especially through military force. Why should Korea take an arrogant risk and allow the risk of a potentially swayable third party tweaking the truth in Japan's favor?

There is ample evidence in historical Korean documents that Korea has effectively controlled Dokdo for a long time. Even in official historical documents of Japan, there are acknowledgments of Dokdo as Korean territory, with fishing activities prohibited in the area. Maps drawn by prominent Japanese figures of the time also depict Dokdo as Korean land. Furthermore, the Allied Powers' SCAPIN-677 document, which is more recent than the San Francisco Treaty, officially recognizes Dokdo as Korean territory.

I am Japanese and I think this problem is caused by the fact that GHQ did not clearly decide which country owns this small island called Takeshima, it is not a problem that can be solved by discussing in the comments section of KZbin. It is not a good thing for both countries to have Japan-Korea relations deteriorate over such a small island.

So why don't we just stop this stupid bickering, and since the people of neither country are ever going to give up, why don't we just have an international tribunal to decide which country's islands are theirs?Why didn't they have an international trial in the first place before now?

The majority of Japanese people do not want to be involved with South Korea. Japan will not want to be involved even if the Korean War resumes or South Korea's economy collapses. If the South Korean government lifts its armed occupation of Japanese territory, Takeshima, Japan will no longer want anything to do with South Korea.

No disputes about it. SCAPIN 667 explicitly REMOVED Japanese ownership of the rocks, and San Francisco treaty DID NOT give the rocks back to Japan. Since Japanese ownership over the rocks was removed and never returned, it is only logical to conclude that Japan does not have jurisdiction over the rocks. Since no other countries made reasonable efforts to claim the rocks afterward besides Korea, it is Korea that owns the rocks without question. To those of you who question why Korea simply does not take Japan to international court: if Germany, similar to Japan, continuously whined about how Alsace and Lorraine belonged to Germany and how France is illegally occupying them now, why would France bother to take Germany to international court to determine the ownership of Alsace and Lorraine? A complete waste of time and effort, with a real risk of ‘shady’ deals corrupting judgement. Just like how France would not bother, so too is Korea.

You seem a representative of ignorant Koreans. Scapin 667 is just a directive related to "Governmental & Administrative Seperation", not a determinant directive to JPN's sovereignty. To begin with, international law requires agreement and/or treaty made by and between countries when ownership of territory moves. Piece of paper Allied Powers sent to JPN via telegram or something like that is deemed unmatch for that. That's why SKor asked US to revise the content of the final draft of the treaty on July 19, 1951 after receipt of that and there are plural confirmed evidences telling SF treaty is only a determinant document to JPN's sovereignty. So there is contradiction in your assertion, which shows you just put what you want to say WITHOUT SEEING PRIMARY EVIDENCES. It's easily understandable which country is a miserable liar on this territorial claims bcuz there are a lot of conclusive evidences written in English issued by third party. SKor just failed to legally take Liancourt Rocks due to no-evidence it has been under its sovereignty till 1910. Needless yo say, a liar is SKor. Of course, there are documents criticizing SKor doing an illegal act on JPN's island. Even medias entitled, "South Korea, Problem Nation" after SKor committed a crime in 1954. Therefore, this rock is too close to Ulleungdo Beach, and its size is too small to be mentioned as an area under the jurisdiction of Uldo Island. Another notable island is Gongam in the main surface of Ulleungdo Island, which is not mentioned in Decree No. 41, but is important. This is because Gwaneumdo Island is not mentioned as importantly as other neighboring rock islands on the map of Lee Gyu-won. Looking at a map of Ulleungdo Island surveyed by the Japanese battleship Amazi in 1880, it can be seen that Gwaneumdo Island is not an island, but an extension of the main island.In Korean, the word for rock is "stone." You know, as a Japanese student I was given plenty of reasons to think South Korea's claim over the islands are illegitimate. The Syngman Rhee line being drawn after the san fransisco treaty, South Korean border guards foecefully displacing japanese fisherman, that sort of stuff. And I will be honest, I still think South Korea should accept coming to the International court to settle this. However when I look at the issue from a third person view like this video, I see that there are a lot of facts that support Korea's claim as well. I didn't know about those things. I wonder if the same thing is happening on the other side, and koreans are being given all the reasons to think that the Japanese claim is total nonsense, while not knowing any of the reasons that the Japanese think it rightfully belongs to them. Whoever the rightfull owner of the island actually is, I just want to say, we should still be respectful to each other, because the other side is being just as manipulated as you are.

First of all, from the conclusion, Dokdo is Korean territory. If a nation has the capability to prosecute it's own laws somewhere, it means it has control over the land. @@yantom701 It was a huge mistake for the US to use a nuclear bomb against Japan. It is a country that will be destroyed anyway, but because of the impact of the nuclear bomb, Japan has created a global image as a peace-loving Japanese who hides his true nature by cosplaying as a victim. Have a day of giving thanks to your ancestors who were hit by nuclear bombs.

You know, no matter how much Japan and South Korea hate each other because of an inability to recognize and reconcile over past historical events, controversial symbols and border disputes, one can't deny that Japan and South Korea actually need each other; South Korea needs Japan not only for economic or cultural purposes, but if North Korea invades the South, then Japan could assist the South in repelling the North's attack, and offer a safe haven for Koreans fleeing the war. Japan, for it's part, relies on South Korea as a buffer state between itself, North Korea and China (I don't know what to say of Russia in the north though), which have nuclear weapons and the former has deliebratly threatened to use them; and Japan has firsthand experience with the devastation of nuclear weapons at the end of WW2, when it was just as aggressive and isolated as North Korea is today. What I'm trying to say is that no matter how much Japan and South Korea hate each other over the past, they still need and rely on each other, and they should just reconcile and stop hating each other, since now they're like the UK and France prior to the world wars; with animosity, but good allies when they encounter common enemies, and eventually they will have to put aside their differences, reconcile, and become really close in face of common threats. Besides, if they don't reconcile, they're just making each other's lives harder unnecesarily, even though they could be best buddies.

They rely on each other but these sorts of disputes makes their cooperation weaker which strengthens the positions of China and N.Korea

There is no way NK will win SK. If China backs up NK, then the US will be involved, and you know how shits are going to escalate from that point onwards. I believe SK desperately wants NK to attack because SK has already outran NK in terms of military power.
