I was diagnosed with respiratory failure 8 months ago. TWO pulmonary embolism. Long ICU stay. I'm still on oxygen. Can't pass a 6 minute walk test without my sats dropping to 93 within the first 2 minutes. I'm now getting physical therapy due to losing the use of my legs. My therapist documents that my sats drop during gentle exercise and minimal exertion with frequent breaks needed both sitting and standing. I also have osteoarthritis in back and knees with disc deformities. Knees are both bone to bone. Also neuropathy in my legs and feet per the nerve conduction studies. I drag my oxygen while walking with a cane. I'm 58 years old. BMI greater than 50 and very long steady work history. One job in 37 years. LPN in nursing home medicine nurse on my feet not a desk job. I applied 7 months ago but no word yet. Spoke with one lady on the phone who remarked about my long work history. She said she knew I was getting therapy but didn't think she would need anything from them. Does that sound good or bad ? She also told me she had lots medical info on me. I'm so not used to no income and admit I'm worried. What do you think ? * addendum* I really don't care about all of this. I mean I do care but I don't want disability. I want to get better even if it takes 5 more years. I want to go back to my little nursing home residents. I was with them during Covid. I loved my job. Not being able to say a goodbye to them has been worse than anything else. My doctor put me on an anti depressant but I'm not depressed. I'm just very sad because I loved my job. Tiaza, the long delays are the result of SSA's employee situation. Here is a blog post that explains this clearly: socsecnews.blogspot.com/2021/07/what-horror-show-most-damning-oig.html. Decisions on initial and recon used to take 3 to 5 months, now they are taking 8 to 12 months. This has nothing to do with you - this is SSA's processing issue. Regarding the merits of your case, I think you have a winner. However.... Generally speaking you win early by meeting a listing. Listing 3 (socsecnews.blogspot.com/2021/07/what-horror-show-most-damning-oig.html) or Listing 4 (www.ssa.gov/disability/professionals/bluebook/4.00-Cardiovascular-Adult.htm) might apply but which subsection? At a hearing I would argue that you are disabled because your "functional capacity" for work has been so reduced by the combined effect of your medical issues that you would not be a reliable employee. At the initial and recon level, however, state agency adjudicators rarely approve based on a functional capacity issue because there is judgment involved. Once you get before a judge, I think you are likely to win. At initial or recon it will be tougher because you have multiple medical issues and at initial and recon the adjudicators are looking for one main thing.

I won my case in 2 months time. I had no attorney. I never stepped foot into any office or court. I used the telephone and I had completely obtained all; my Medical records prior to the process, and sent them all in from my address. This was when I was 32. I am, now 62, officially I was declared disabled for working outside of my home since the age of 26. and yes indeed I had plenty enough work credits. They cut me a nice check. years ago, I had applied just for medical benefits post car accident, I was denied and appealed...I won and the judge ordered the medical benefits, was sent to a spinal specialist who determined I had permanent nerve damage to left leg, they never obeyed the judge and did not pay that doctor (who they sent me to) or any others (I followed up and asked them about being reimbursed)

Diagnosed with Crohn's disease at age 19 I am now 47 years old. I've had most of my large intestine removed, and have had several surgeries on anal fistulas. I also take medication for depression. With this disease I spend most of my time inside my house, if I do venture out I'm scared to death I may have an accident or that I cannot find a bathroom so I do not venture out very often and not far.

I am a 50 year old male, had a heart attack Sept 3, 2015. 2 blockages were found. 95% LAD blockage that was able to be stented and a 100% RCA blockage that was not able to be stented. I have been diagnosed with Chronic Total Occlussion with Ischemia. I have had 4 cardiac caths to try and open this artery, but none were successful. I applied for SSDI in Nov. 2016 and was contacted by an Adjudicator asking me to have someone fill out some papers regarding my activities. I asked about when were they going to send me to see their dr and I was told that they were not going to as my Cardiologist has sent enough evidence for them to make a decision, but needed these papers filled out 1st. I am assuming that I will be denied, but I feel I meet the criteria for the listing regarding blocked arteries as they require 70% and I have 100%. How long do I have to ask for an appeal and when can I hire an attorney? Thanks.....I find your videos very informative!

My fiance has severe Schizo-Affective disorder, a mixture of anxiety and schizophrenia. Two hospitalizations for two suicide attempts, she rocks back and forth, she needs medicine everyday, she is getting soon a weekly therapist to come to our home, she cannot go outside without her stuffed animal as a comfort item, she has crying fits for things as small as spilling milk, several psychiatrists have asked if she has been tested for autism. We are currently trying for the second time to get her on disability and we are at the questionnaire right now. I hope she will be approved this time.

Scott, it sounds like your fiance is going through a rough time. Mental health claims are increasingly difficult but multiple hospitalizations and suicide attempts suggest a very serious problem. Her case will most likely end up at a hearing so don't give up.

Social Security Disability videos Many thanks for the advice, we tried again onxe more and I was sent a questionnaire but the very next day she recieved a denial letter, sadly. But instead of feeling down about it I called a law firm called Cambell And Associates. The polite lady who took our call said that since she was so young being 19 she would constantly get rejected because of her age. Hee therapist and nurse practitioner have said she's unable to obtain employment. However there is one agency that needs to deem her unable to work and that is Vocational Rehab. If she is deemed untrainable in any field then we can take that documentation and that of her therapist and make another claim. If denied once more then her and I will call that same law firm and we can be seen because we have better proof of her inability to work and our case will be heard. :) I will keep you posted of any updates and again, many thanks. :)

Please let me know Mitral valve prolapse...where my heart will beat around 240 a minute. I have always been able to stop it after maybe ten minutes. Only made me pass out once. But, now I have emphysema, diagnosed in 2014. But, it's gotten worse, and I can't stop my mvp, if I can't breathe. This happened, then on top of it had a panic attack started hyperventilating...luckily The ems were there right when that started and were able to calm me down. They really freaked out over my heart rate, and got the paddles out just in case. My only concern was breathing. Two weeks later, I ended up back in er fatigued severely, can't breathe, can't sleep, ended up having covid and emphysema...and Thank God this doctor gave me an inhaler. I can actually get prepared to take a shower without panicking.

Mr Ginsberg I was supposes to EASILY meet the 12.05B listing at a hearing but the ALJ have never considered the listing thus denied me! Among so many other errors, that error alone of not analyzing nor considering the 12.05B listing is grounds for a complete reversal and approval by the appeals council! (it has happened before and it could happen again!) Furthermore, this was the remand order by the AC AND the federal court, they instructed the ALJ to consider that 12.05B listing, and this judge flat out said no she wont consider it and she stands by her old decision without providing any explanations! Complete violation of the orders by the higher courts! You should of seen the other errors by this judge, you would be VERY shocked! One of them is that she stated that the Neuro test is less persuasive because I PARTICIPATED IN THE EXAM!

I served 24 years in the Air Force. I was blown up twice, shot once, ribs broken 6 times, collapsed lungs, Thermal burns in both eyes, shrapnel wounds, other broken bones, Guano virus, hundreds of stitches, migraines, Traumatic Brain Injury, etc, etc. I retired 14 years ago and the VA rated me at 80%. About 3 years ago they raised the rating to 90% I broke a finger a few weeks back and while I was in with the VA Doctor he asked me why I wasn't getting SSDI and I told him I thought I had to be 100% for that. He said no, I should be pretty much automatic. I have heard about the nightmare with the SSA so I called and talked with a well known SS lawyer and he said I should just apply on my own. Any advice?

My guess is that you would be approved at the initial application stage without the need for a lawyer. You can seek counsel if you are denied.

@@CrazyLibrarianCatLady If there's enough medical records before you reach the hearing, *probably* but not necessarily. If you meet a listing criteria, it has to be proven through medical records. At the start of my application, there wasn't hardly any medical evidence for my issues, but throughout the 2.5 years of appeals and waiting, that medical history built up. I was hospitalized 6 times and talked to a lot of mental health professionals and had two psych evaluations by Social Security. So by the time I reached the hearing process, there was enough evidence my attorney said I did; as such her proceeding strategy argument was that I met a listing and that was how my attorney's proceeding strategy went. *However, even though my case was pretty damn severe, the judge determined that I didn't quite meet a listing,* but it was obvious I was impaired enough. The judge seemed to have made his decision before I walked in the room for the hearing. It was pretty clear he was doing everything in his power to make sure I was put on disability. . I think what hurt the listing case was the fact that the big company that picked up my case, at least the lady I talked to, did not understand I had not gone though a full set of appeals and wanted me to have an entirely new onset date and everything, which cut out 3 months worth of additional evidence. Luckily I'm sure the judge acknowledged the evidence, but could not legally put it together.

I have an incurable autoimmune disease called Secondary Adrenal Insufficiency. It is a rare disease with a lowered life expectancy. It stemmed from a benign tumor on my pituitary gland that completely threw off every hormone in my body. I developed hypothyroidism and diabetes from it. My testosterone was almost O when I got diagnosed and it shut down my adrenal glands. I am on several steroids everyday. The steroid for the adrenal glands is the most important, because without it I will die. My disease is not in the listings and I just got denied by an ALJ after waiting over 3 years for a hearing.

When I was a baby I was diagnosed with Plexiform Neurofibroma (Genetic Disorder) and I had Torticollis and doctors told my mother I could qualify for SSI benefits which she went through the process of doing and I qualified. Plexiform Neurofibroma causes tumors on skin or nerves etc... Unfortunately, I have 3 tumors inside my neck C1,C2,C3 ever since I was born and still have them till this very day. These tumors cause severe pain that affect my life and concentration is something I lack because of the pain that I get that interferes with my life. Ever since I was found disabled I was approved but the time came where I turned 18 (Adult) and I was denied so I had to file a hearing to explain why I'm still disabled and I did which they denied me again and again. So I would like to know what are some suggestions I could do to get approved again?

I am a 59 year old living in Texas . I was first diagnosed with rheumatoid arthritis back in the 90's . At the time I was prescribed methotrexate which I took for a couple of years but discontinued due to increased frequency of stomach discomfort such as nausea. I have not seen a doctor for many years. I have worked for much of the time despite the pain except for the past year and a couple of other years when the pain was too intolerable. Currently I have severe pain in all my joints , my hands and feet are badly deformed and even tying my shoes is a painful chore. How should I proceed?

Yared, I would start by establishing a relationship with a treating doctor. It is very difficult to win SSD without current medical records no matter what the condition.

I am 61. Bipolar seeing psychiatrist for about 12 years for meds. Had cardiac issues for 20 years including heart attack 4 yrs ago several months after getting stents. Diabetes for about 20 years and developed Charcot foot 2 years ago and had to get 3 long screws put in my foot to reconstruct it. Thyroid malfunction for 30 yrs. Obesity. Lost 4 jobs as hospital lab tech due to the undiagnosed bipolar. Many years of taking countless medications for everything. Psychiatrist had me under very constant appointments for a time for fear I might harm myself. Carpal tunnel in both hands and neurologist said it was severe at the time. Would a lawyer take my case and would I be approved quickly? I worked 2 yrs in a hospital then 4 years then 2 yrs as a picture framer then yrs of no work. Tried twice in 2012 and 2013 to go back to work in labs but could not adapt to the changes and lost both jobs because supervisors said I could not take the stress etc. My total work time for past 25 yrs is about 8 yrs.

I think you need to find out if you are insured for SSDI. If not, do you qualify for SSI based on household income/resources. A local SSD lawyer can offer guidance. You should not assume that you will be approved quickly - nothing happens quickly in the SSD world.

Thank you so much for all of the helpful information in your videos. It is much appreciated. Background to my questions: I have a listing level impairment that I have been struggling with for years. It was finally documented on 10/26/15 via lab report that I am heterozygous for the Factor V Leiden mutation, which is a hypercoagulation disorder listed in the SSA's Listing of Impairments (in 7.00 Hematological Disorders-Adult). This was after having deep venous thrombosis in my right leg in Oct. 2013 and then in Aug. 2015 in my left leg. I didn't have insurance in 2013, but I did in 2015, so I do have a "grossly abnormal" ultrasound from 8/25/15 showing "extensive deep venous thrombosis." At the time, I could not even walk or stand or sit, but I was under the false impression that if I were awarded benefits then it would run out by the time I am older (and I would of course need it even more at that time). A lawyer I spoke with at the time did not clear up that misconception for me, so I have been borrowing money and moving around too much to live with family, etc, since then. I have not needed to file taxes for 2015 and 2016 because my income has been under the $10,350 reporting threshold, and I have not received any work payment since Nov. 2016, so officially have not been able to work since Nov. 2016 although before that I was only doing odd jobs here and there only with others' help and really struggling through and not able to continue anything I tried to start. Now though, I have just come to terms with the fact that I cannot concentrate at all even in doing one or two household tasks per day and I have severe fatigue and severe anxiety (as well as the sharp and burning pains in my legs and groin). For years now I have been trying to convince myself that I can make it somehow, but I am sure I need help at this point. I was shocked to find all of my symptoms mentioned under my condition in the Listing of Impairments: "serious limitation in your ability to sustain concentration or pace adequate to complete work-related tasks (and household tasks and social interaction) because of symptoms, such as pain, severe fatigue, anxiety, or difficulty concentrating caused by your hematological disorder (including complications of the disorder) or its treatment, even if you are able to do some routine activities of daily living." Questions related to this video topic: Does that mean since I have a listing level impairment, I should most likely get a favorable result within 3 months even though I am now only 31 years old? (I am asking to allay some of my severe anxiety.) If so, do I have to worry so much about exact date I stopped working, how long I haven't been working, etc, on application? I don't really know how to answer those questions because I stopped being able to work even before my first blood clot in 2013 so had been doing odd jobs here and there with lots of help, but I don't have medical documentation until 2015. What would I put as date I stopped working? Since I didn't have to file taxes in 2015 and 2016 due to low income would that be considered not working?

Actually, I believe I did not need to file in 2014 either, but in 2013 I filed even though my adjusted gross income was negative but I paid a little bit in self-employment/social security tax. So, again, I am confused about what date to put I stopped working because I actually stopped being able to work in 2013 and then only worked some months with help from my sister doing a lot of the work for me and others. (By the way, when I went into the SSA office a couple weeks ago, they looked me up and said I am fully "insured.")

I had a my disability hearing on July 21, 2017. The Judge asked the VE if I could perform my previous 2 jobs as a Respiratory Therapist and Certified Professional Coder. The VE response was "No". No other questions were asked. I have Sjogren's Syndrome, Fibromyalgia and Bulging Discs at cervical, lumbar and thoracic levels. My representative says that I will be approved for disability but I have not received an official letter. Do you think my chances good for a favorable determination and how long with I have to wait for a decision? I'm patiently awaiting a response.

I was recently diagnosed with Hereditary Spastic Paraplegia. I have had trouble walking and my balance has become bad. I have only fallen once, but that is thanks to walls or furniture to catch me on other occasions. I have not applied for SSDI yet. I have worked as a bookkeeper for over the last 30 years, with 2 short periods of unemployment. The HSP is considered a Rare Disease, but the symptoms mimic those of MS. I am fatigued from the disease and the medication I take also makes me more tired. I almost fell asleep at my desk 2x this week. I feel the spasticity progressing and moving to other areas of my body. Must I stop working all together before applying for SSDI?

My attorney said he “scraping the bottom of the barrel” as far as the jobs he said I was able to work. What holds more weight, the blue book listing or the VE?

It is rare to win at a hearing using the listings. The listings are designed to be very difficult to meet and most listing approvals are made at the initial application. Most hearing decisions are issued based on a functional capacity argument or a grid rule argument. So when I am presenting a case that may be listing level, I mention the applicable listing but I also make the other arguments.

If you meet the listing, you win regardless of what the VE says. Med/voc is irrelevant if you truly meet a listing. The listing is step 3 of the SSA five step sequential process. Can you do other work which involves the VE is step 5.

If this is true. why is it that i was denied twice. I have LUPUS 14.02 on the listing which is called the blue book, and diagnose since 2006, fatigue , malice joint pain specially on hands, elbows, knees, hips and ankles. I'm on meds like methroxtrate which did not work ,hydrochloroquen that dammage my retna mycofinalte that gives me dhierra now I'm on Benlsta in for of IV. MRI shows I have sever synovitis on my hands and now I have sciatic nerve that is not going away, been on theraphy that never work along with a note that therapy would not be beneficial to my lupus , no brake in seeing the RA doctor, since I was diagnose. what else I could do to win this case.

The problem is that at the initial and recon stages, state agency adjudicators are looking at your file. They often do not have the time to plow through extensive medical records, or the records are not clear that you do meet a listing. By contrast, at a hearing you have a more highly trained judge reviewing the records plus you would have a lawyer advocating for you by identifying specific pages in your record that show you meet a listing.

@@ssdattorney I just went to my hearing today 2/6/2020 which is a surprise me when the letter came that i have ALJ person to person I got in the room and it was a video call and the ALJ is from Baltimore also the VE was not in the video until the ALJ called her and I was in Tacoma WA. anyway I answer all the question the ALJ ask and I think I did very well in answering, after all the ALJ ask three deferent hypothitical question to the VE and the VE said no JOB on all the 3 question that the ALJ ask. after that ALJ said that no more question and it was the end. Oh, also the ALJ was trying to change my on sit date of april 2018 from original sept 2016 But I proved that the on sit was 1 Sept 2016 That i have in my file.

Unfortunately a VA finding of disability arising from PTSD is not binding on SSA. The VA records and finding will help, and if you are 100% VA disabled, your SSD case will be expedited. But SSA will make its own determination. My experience, however, has been that most of my 100% VA PTSD clients do get approved for SSD.

I'm 45 and was diagnosed with stage 4 bone cancer in knee/shin about 3 years ago. It's time for my review and I'm scared. I had first surgery to replace knee and shin and 3 recurrences in 3 years other than that I've done pretty well. I do have pain and have to sit down and rest and Ice between activities. Dolores, given your medical issues I would think that SSA would be unlikely to push too hard to terminate benefits. That being said, I would make sure that you provide them with all medical records and that you ask one or more treating doctors for letters stating that you do not have the stamina to return to competitive employment and that your pain would interfere with attention and concentration.

very helpful my mri impression reads as follows mild transverse central canal narrowing is present due to facet hypertrophy at the L4-L5 level. (2). mild bilateral foraminal encroachment is present at L3-L4 L4-L5 and L5-s1,due to combination of disc bulging and facet hypertrophy. (3). there is no disc herniation at any lumbar level. i applied for disability im at stage 1 how will i fair since facet hypertrophy and central canal narrowing witch is stenosis is on there list of impairments.

In 1988, I was a teenage passenger in a drunk driving accident, TBI & Spinal Compression Fracture, which I collected SSI for. I don't think I had enough work credits to qualify for SSDI yet. But anyway, I collected SSI benefits for 2-3 years. Now 30 years later, I was hospitialized unconscious due to Septic Shock, Menegitis, Acute kidney failure, acute respiratory failure, hypertensive heart disease w/ heart failure, among other things. I applied online for disability benefits and my application is in front of the disability determination board now. Will they look back to my earlier accident in addition to my current hospitalization in determining my case? Do you think I have a case? My upright balance is unsteady, as a result of both occurances and I am on a daily regimine of meds for high blood pressure, high cholestrol, seizures, blood thinners

Debbi, generally speaking they will look at your medical record starting about a year or so prior to your alleged onset for this application. But I would take the position that your long ago medical history is relevant and if you can get those records I would submit them. The question in your current case: do you have a doctor who will go on record to say that you do not have the capacity for full time work because of your medical issues and is that condition expected to last at least 12 consecutive months?

Peripheral neuropathy involves damage to the nerves that send signals to the brain and spinal cord. It is often associated with long time or untreated diabetes but it can also be caused by other conditions. It often involves numbness, tingling and lack of sensation in the hands and feet. The listing looks for a level of severity that limits walking, standing, use of the arms and other physical functioning. The listing also indirectly references pain when it speaks to problems concentrating, remembering and maintaining pace.

Having a listing level disorder did not help me. Listings should = diagnosis. It does not. To qualify, there has to be a very specific diagnosis that 100% matches. If you have conditoin a and your diagnosis says nothing about probable effect b, you don't qualify.

Hello I'm 45yrs old and about 10yrs ago I lost all my hearing in my left ear. Had severe vertigo and had to learn to walk again ECT. I still have the severe vertigo and fatigue and blurred vision days I spend in bed. These attacks can last weeks.. I don't have much medical evidence of this due to I stopped going to any Dr because I was told in the beginning by 2 different Dr that there isn't anything to do about it and I'd just gave to live with it. So that's what I've done. In the past 2yrs it's gotten bad again and a yr ago I had to quit my job of 10yrs due to missing to much work because of my condition. I don't have health ins. Can't afford it. But I can't work cause driving for me is dangerous and my attacks are on a regular basis. I want to get disability but have been turned down. Could you tell me what I can do now?

If you had an evaluation by a vestibular specialist, even once a year, that might be enough to prove that you would not be reliable at work. My experience has been that you need an expert medical source statement for this type of impairment. I think these cases are winnable.

I have at the bottom of my heart a electrical problem the Doctor said when i have these spells where my blood pressure rises over 200 my blood is not going up and over my heart valves it is like its quivering instead of pumping and I take heart and high blood pressure meds like three all together, the Dr. said if i did not take my meds it will happen again, I passed out in the hospital and my heart was way out of rythem and they had to shock me, they gave me a pace maker and difibulater just incase this problem happens again its called Vantricker Attackacardia is what i have is this on the list?? Kelly, it sounds like your condition could fit within listing 4.05 - www.ssa.gov/disability/professionals/bluebook/4.00-Cardiovascular-Adult.htm#4_05. You would need a cardiologist to write a letter summarizing your history and test results and offering conclusions about the severity of your condition and how it impacts your capacity for work. Your lawyer can print out the "F" section of your electronic file so you can see what records are there.

I got a quick question. I'm about to see the judge and I just recently got approved the handicap plates. I saw a doctor and they filled out the form and said that I was physically disabled. So since I'm already approved by the state as physically disabled does that increases my chances .. even though there's not a 3 year period of doctors visits. And there's a 8 months gap of getting treatment in the us .... But I've been going to Mexico for treatment "no insurance" ... So is the handicap permit. Big win for my case

I think that having handicap plates can help, especially if your doc included details on the form. But SSA is not bound by the state determination. You should get your records from Mexico and have them translated if needed. They are relevant.

I am waiting to have my hip replaced sometime at the end of this year. SSA makes meeting a listing very difficult. However at your hearing you can argue that you meet a listing, that you meet a grid rule, that your functional capacity would not prevent work or all 3.

I haven't had a evaluation since 2013. But I've gone to the same Dr which is a Dr that specializes in dizzines due to ear problems also she checks my hearing. ECT. She was my first Dr I went to in 2009 when it happened. She put me through therapy for the dizziness and balance issues. She had told me it was the worst case she had seen. The questions I would ask - is the murmur treatable with meds? Does this condition prevent you from working 8 hours a day, 5 days a week at a simple job? Do you have a doctor who will explain why this condition makes it impossible for you to work?

Social Security Disability videos It is not treatable or preventable with these meds.. one of them vasotec and lenoxin.. and a baby aspirin a day... Since five days old on I was always on restrictions for my heart history of 31 years with one year history of emergency room visits... Have restrictions at work no lifting more than 25 pnds and no standing or sitting with out a break if needed.. with 137 days missed last year, thank God for FMLA but Pepsi is threating me cuz I'm ILL too often... I have always found the grid rules to be a theory that judges like to use because it takes some of the interpretation of the evidence out of the mix. That being said, I would use all 3 if they are applicable but start with the grids.

Hi Attorney, my opthamologist wrote a physician 's statement that I meet/equal a listing as being "legally blind" & a request for OTR requested and I was still scheduled for a hearing..why? & they are requesting another opthamologist to give his opinion at the hearing as if my opthamologist is not correct in his diagnosis. However, a few matters to note: 1) a statement by an optometrist (O.D.) -a perhaps better, a physician statement-esp. a specialty physician (e.g. "ophthalmologist"-M.D. or D.O.) -that you are "legally blind" -even w/ corrective measurements -specifically, w/ several observations & objective examinations & measurements to support this- is great evidence!

Many physicians don’t know exactly what SSA is looking for or how to speak SSA language and without reading your physician’s statement it’s hard to comment on its validity. A consultative exam doctor should know what SSA is looking for thus the need for the CE. SSA likes to limit paying for CEs whenever possible. In some case physical statements are worthless because they don’t contain a medically supported rationale.

There is no short term disability from Social Security. Your impairment would have to keep you out of work (from any job, not just your current one) for at least 12 consecutive months.

Jeanette, if you don't have earnings, you won't qualify for SSDI on non-medical grounds. SSA does not give any earnings credit for work done around the house or for raising kids. You could be eligible for SSI but only if your household income doesn't offset your SSI eligibility.

I am 35, worked since 16. I have had 3 bulging lumbar discs since at last 7 years and still worked-and just pushed on. In Dec. Was rear ended at 55+ and now one of the lumbar is now herniated and I have 3 cervical "prortusions" with C-6 having a radioculpathy with failed EMG on left arm. With these 6 bad discs now, anxiety, depression, diabetes, incontinence and other things...does my spinal condition meet the "blue book" listing? Thank you. I received my first denial, although my neurologist says I cannot go back to work and will likely need surgery. The migraines from cervical protrusions are almost daily and medicines make life even more difficult.

You may meet the listing but unless your doctor refers specifically to the language of the listing the SSA adjudicator may not realize you have a listing level claim.

+JPostmater2016 - generally earnings in the $300 per month range do not amount to #substantialgainfulactivity so those earnings should not prevent you from getting approved. You may have to explain what you did when working and why you would not have been able to work more to earn more.
